Abstract

Respect for individual rights is an important moral and legal foundation in maintaining justice and humanity in the criminal law system. Although the individual has passed away, complexities arise as their rights still need to be respected. A deceased individual's legacy, including reputation and social influence, remains relevant and influences society. This research aims to understand how the criminal law system, particularly in the Criminal Code (KUHP), handles cases involving deceased individuals, including the protection of their reputation and open legal liability. This research utilizes a normative legal research method that involves analyzing existing legal norms. The results show that the Indonesian criminal law in detail regulates respect for deceased individuals in the Criminal Code. Despite having physically left the world, the law still recognizes and protects their rights regarding honor, reputation, and inheritance. Crimes against corpses are regulated in Chapter V of the Second Book of the Criminal Code on Crimes Against Public Order. Articles in the Criminal Code, such as Articles 175, 178, 179, 180, 181, 320, and 321, provide protection to the reputation, burial, graves, corpses, as well as preventing insults or defamation of deceased individuals, punishable by imprisonment or fines. Although the individual has biologically left the world, the law still recognizes and protects their rights regarding honor, reputation, and inheritance. Chapter V of the Second Book of the Criminal Code regulates crimes against public order involving corpses. Articles such as Article 175 to Article 321 provide protection to reputation, burial, graves, and corpses, and prevent insult or defamation of deceased individuals, punishable by imprisonment or a fine.

Abstract

Kejahatan siber di Indonesia telah berkembang pesat seiring kemajuan teknologi, hal ini menimbulkan ancaman serius bagi individu, organisasi, dan keamanan negara. Berdasarkan data dari Badan Siber dan Sandi Negara (BSSN), hingga Oktober 2023 tercatat sebanyak 361 juta anomali lalu lintas siber, dengan 42% di antaranya merupakan aktivitas malware. Beberapa insiden besar yang terjadi, termasuk serangan ransomware yang berhasil meretas Pusat Data Nasional (PDN) serta peretasan 150 juta data penduduk Indonesia oleh hacker dengan nama samaran Bjorka, tragedi ini menunjukkan betapa gentingnya perlindungan data di Indonesia. Akar permasalahan yang mendasar terletak pada fragmentasi regulasi perlindungan siber serta tidak diratifikasinya Konvensi Budapest tentang Kejahatan Siber oleh Indonesia. Regulasi yang ada, seperti Undang-Undang tentang Informasi Dan Transaksi Elektronik (ITE) dan Undang-Undang tentang Pelindungan Data Pribadi (PDP), dinilai belum mampu memberikan perlindungan hukum yang efektif dan kepastian hukum bagi korban kejahatan siber. Fragmentasi regulasi menyebabkan tumpang tindih kewenangan dan ketidakefektifan penegakan hukum dalam menangani ancaman siber yang semakin kompleks. Penelitian ini bertujuan untuk mengeksplorasi penerapan metode Omnibus Law sebagai solusi untuk mempercepat perlindungan siber yang berkepastian hukum di Indonesia, dengan mengharmonisasi berbagai peraturan perundang-undangan yang terfragmentasi. Penelitian ini menggunakan pendekatan yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan komparatif. Hasil penelitian menunjukkan bahwa metode Omnibus Law dapat menjadi solusi efektif untuk menyatukan peraturan terkait perlindungan siber dalam satu undang-undang komprehensif, mengurangi tumpang tindih regulasi, dan meningkatkan kepastian hukum. Setelah menyelaraskan regulasi nasional, ratifikasi Konvensi Budapest menjadi langkah strategis bagi Indonesia dalam memperkuat kolaborasi internasional untuk menangani kejahatan siber lintas negara.

Abstract

Novum is one of the requirements for submitting a Judicial Review in accordance with Article 263 paragraph (2) letter a of the Criminal Procedure Code. However, in the practice of criminal law enforcement, there are various interpretations by legal officers, such as police, prosecutors, lawyers and judges. These differences in interpretation trigger legal uncertainty and result in irregularities in the criminal justice system. The research method used is a normative juridical research method. Furthermore, this research aims to provide an overview of the Ratio Legis from Novum in Judicial Review as an Extraordinary Legal Measure, with the aim of providing understanding, input and contribution of thought about what is meant by Novum. In general, the novum must have a very strong role or influence, or be decisive in being able to issue a decision of acquittal, free from all legal demands, the public prosecutor's demands cannot be accepted, or lighter criminal provisions are applied. In fact, the meaning of novum is broader than just 'new evidence' because it can be 'new valid evidence', 'new evidence', as well as 3 (three) reasons for requesting a PK as regulated in Article 263 paragraph (2) of the Criminal Procedure Code can also be called a novum.

Abstract

Regulation of Rape in marriage has reaped pros and cons in its implementation because it is considered contrary to religious values ​​that live in society. This paper aims to examine the regulation of rape in marriage in Indonesia and its suitability to the perspective of Abu Zahra's maslahah. The type of research is a literature review (library research) with a qualitative approach. The results of the study show 3 regulations that regulate rape in marriage in Indonesia, namely the PKDRT Law, the TPKS Law, and the Law on the Criminal Code. The 3 laws are relevant to Abu Zahra's maslahah based on 3 indicators, namely: a.) in terms of quality, the presence of this regulation is a form of darar prevention of a marriage that has the concept of mu'asyarah bi al-ma'ruf, b.) in terms of quantity, the benefits generated from this regulation will be felt by most people, especially victims of domestic violence and law enforcers, c.) from a certain period of time, the benefits of this regulation will provide long-term effects, for example as enforcement of human rights and increasing public security.

Abstract

Penelitian ini menggunakan jenis penelitian yuridis normatif, denganmenggunakan metode pendekatan peraturan perundang-undangan(statute approach) dan pendekatan kasus (case approach). Hasilpenelitian ini didapatkan bahwa pertama, Rasio legis Putusan Nomor143/Pid.Sus/2021/PN. Lmg didasarkan Pasal 81 ayat (2) UU No. 35Tahun 2014 yang mengatur pidana penjara minimal 5 tahun danmaksimal 15 tahun serta denda maksimal 5 miliar rupiah.Pertimbangan hakim yang memberatkan adalah kerugian mental dantrauma yang dialami korban serta keluarganya, sementara yangmeringankan adalah terdakwa menikahi anak korban secara sah.Kedua, Berdasarkan analisis Putusan Nomor 143/Pid.Sus/2021/PN.Lmg, putusan tersebut mengakomodir penegakan hukum denganpenerapan Pasal 81 ayat (2) UU No. 35 Tahun 2014, yang tepat karenaunsur-unsurnya terpenuhi, serta mempertimbangkan teorirestorative justice dengan meringankan hukuman karena terdakwamenikahi anak korban. Pertimbangan hakim juga sesuai dengankonsep penegakan hukum yang menggabungkan teori absolut danteori relatif, serta memenuhi tujuan hukum yaitu kepastian, keadilan,dan kemanfaatan.

Abstract

Abstract This study aims to analyze the role of village heads in resolving minor criminal cases through a restorative justice approach in Trosono Village. This empirical juridical research focuses on how village heads, as local leaders, mediate conflicts, prioritize deliberation, and maintain social harmony. Data were collected through in-depth interviews, observations, and document reviews, with qualitative-descriptive analysis methods. The findings reveal that the village head plays a central role in facilitating dialogue between disputing parties to reach fair agreements without resorting to formal legal processes. This restorative approach proves effective in resolving minor criminal cases, such as disputes among residents, petty theft, and other incidents that do not require court intervention. Supporting factors for this approach include community trust in the village head, a culture of deliberation, and the support of village officials. However, the main challenges include the village head's limited legal authority and potential external pressures. In conclusion, the restorative justice approach implemented by the village head in Trosono Village has the potential to serve as an effective model for resolving minor criminal disputes at the local level, provided it is supported by clear regulations and synergy with formal law enforcement authorities. Abstract

This study examines the application of restorative justice in the criminal justice system, particularly within the West Java Regional Police, in light of Police Regulation No. 8 of 2021, and the factors that support and hinder its success. The paradigm shift from retributive justice to restorative justice aims to create a more humane legal system oriented toward restoring social relations. This study uses a qualitative method through an empirical legal approach. The study's results indicate that the application of restorative justice by the West Java Regional Police is reasonably practical in resolving conflicts peacefully, restoring victims' losses, and maintaining social harmony. It still faces challenges, including inconsistent enforcement by law enforcement officers, a lack of public understanding, and technical obstacles to restitution.

Abstract

The protracted armed conflict in Gaza, Palestine, has profoundly affected the survival, security, and resilience of Muslim families. The ongoing war not only threatens their physical safety but also disrupts the social fabric, weakens economic stability, and erodes moral foundations within the family unit. In this context, family protection in conflict zones requires a comprehensive legal framework, one of which can be approached through the Maqāṣid al-Syarī‘ah perspective as articulated by Imam al-Syāṭibī. This study seeks to analyze the concept of Muslim family protection through the lens of maqāṣid principles, assess the dynamics of legal politics in Gaza, and evaluate the role of criminal law in safeguarding families in conflict. Employing a qualitative juridical-normative and sociological method, the research relies on literature studies of regulations, government policies, scholarly works, and international reports. The findings demonstrate that family protection efforts in Gaza partially reflect maqasid values such as hifz al-nafs, hifz al-‘aql, and hifz al-nasl, though they are hindered by limited legislation, weak infrastructure, and political instability. Imam al-Syāṭibī’s thought offers a strong normative foundation for integrating benefit into legal policy, thereby reinforcing family resilience amid crisis.

Abstract

Asset confiscation arising from criminal acts, particularly corruption, is a vital instrument for preventing offenders from enjoying illicit gains and for restoring state financial losses. However, Indonesia’s asset recovery rate remains low due to regulatory challenges, weak interagency coordination, and limited Non-Conviction-Based Asset Forfeiture (NCB) mechanisms. Therefore, new legal formulations are required to address these obstacles. This study employs legal research methods, including statutory, conceptual, and case approaches. The findings indicate that the in rem approach, which targets assets without requiring criminal conviction, is more efficient and adaptive in combating corruption, aligning with UNCAC 2003 recommendations. Effective synergy between the Financial Transaction Reports and Analysis Center (PPATK) and investigators is crucial for asset tracing, freezing, and confiscation, despite ongoing issues with data access and regulatory harmonization. Legal reform, strengthened international cooperation, and the protection of human rights are essential to optimize asset confiscation for justice and state financial recovery.

Abstract

Livestock theft particularly cattle is a serious issue in East Lombok, given the high economic and social value these animals hold for local communities. This study examines the practice of community punishment carried out by the Ambal-Ambal group in Pringgasela Subdistrict to resolve livestock theft cases. Employing an empirical legal research design with a socio-legal and case study approach, the study draws on both primary and secondary data, analyzed through qualitative descriptive methods. Findings reveal that conflict resolution prioritizes socio-economic restoration over repressive punishment. The identity of the offender is kept confidential, while sanctions typically involve productive community tasks or internal fines. In some cases, offenders even receive social assistance as an expression of communal solidarity. These findings affirm that community punishment serves as a culturally appropriate and effective alternative dispute resolution mechanism, deeply rooted in local values of brotherhood and social harmony.
