Abstract

The mechanism of checks and balances in a democratic system is intended to avoid the use of hegenomic, tyrannical, and centralization of power, as well as provide performance monitoring activities between state institutions. However, the mechanism of checks and balances by the Constitutional Court related to the doctrine of Judicial Activism is faced with the issue of the independence of the Constitutional Court. This study aims to identify and analyze the mechanism of Checksand Balances by the Constitutional Court by applying Judicial Activism in democratic practices in Indonesia. The research is a doctrinal research and applies the statues approach and deductive analysis methods. The results of the study showed that to ensure the fair exercise of each individual as the fundamental basis of democratic values, the law and politics as an inseparable unit so that the court can use its political power to create a new norm provided for a noble purpose based on the doctrine of judicial activism by developing constitutional texts to create a social change so that the fundamental values in the Constitution can be applied progressively according to progressive legal theory. Judicial Activism is related to the judicial power that serves to check and balance. However, the freedom of judges in Indonesia is limited by the Grundnorm of Pancasila, the 1945 Constitution, legislation, public order and morality, government/political system, economic system, culture.

Abstract

Corruption crimes in government procurement of goods and services, such as bribery, price mark-ups, and manipulation of bidding processes, can disrupt good governance, cause financial losses to the state, and diminish public trust in the government. Therefore, legal audits by the State Prosecutor play a crucial role in preventing financial losses to the state and identifying administrative errors that potentially harm state finances based on the results of such legal audits. The research findings indicate that the legal audit by the State Prosecutor in avoiding financial losses to the state through the Prosecution is governed by the Cooperation Agreement between the Ministry of Home Affairs, the State Prosecutor, and the Indonesian National Police. This audit involves receiving reports or complaints from the public, verifying with supporting evidence, providing written notices of handling outcomes, and protecting the identity of the reporters. The steps of the legal audit include ensuring objectives, planning, data confidentiality, document collection and analysis, report preparation, result exposition, and result delivery to the applicants. These stages also involve auditing findings analysis, compliance evaluations, decision feasibility assessments, and considerations for further legal actions, all aimed at maintaining integrity and accountability in governance. The State Prosecutor uses legal audits to ensure legal compliance and identify errors that could harm state finances. They determine indications of criminal acts or legal violations and assess sufficient evidence to support allegations of violations. During the audit process, the State Prosecutor looks for irregularities or legal non-compliance related to public fund management, financial misconduct, and other administrative violations involving state finances.

Abstract

Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif (Selanjutnya ditulis Perja No.15 Tahun 2020) memberikan kewenangan kepada Jaksa untuk menghentikan penuntutan terhadap perkara tindak pidana berdasarkan restorative justice dengan tujuan pemulihan kembali pada keadaan semula bukan berorientasi pada pembalasan. Penerapan penghentian penuntutan berdasarkan restorative justice yang dilakukan Jaksa Penuntut Umum di Kejaksaan Negeri Jakarta Selatan dalam perkara tindak pidana pencurian dengan pemberatan yang diatur Pasal 363 ayat (1) ke 5 KUHP diancaman dengan pidana penjara paling lama 7 tahun tidak sesuai dengan syarat batas ancaman pidana maksimal penghentian penuntutan berdasarkan restorative justice dalam Pasal 5 ayat (1) huruf B Perja No.15 Tahun 2020 yang menyatakan bahwa ancaman penjara tidak lebih dari 5 tahun.

Abstract

Dalam Kompilasi Hukum Islam, pengertian nusyuz secara eksklusif mengatur tentang nusyuz yang dilakukan oleh istri. Kompilasi Hukum Islam yang menganut hukum nusyuz tetap berpijak pada fikih patriarki yang berlandaskan pada ajaran agama yang mendasar. Dari segi metodologi, KHI tetap menyerupai gagasan para peneliti sebelumnya. Perspektif dan konteks umat Islam Indonesia belum tertanam secara baik dalam rumusan perundang-undangan KHI. Kandungan materiilnya, sebagai hukum positif di Indonesia, adalah keabsahan fiqh yang memberikan kedudukan tersendiri bagi perempuan. Kajian penelitian dilakukan melalui pendekatan konseptual (conceptual appoarch). Disamping itu penelitian ini juga menggunakan pendekatan perundang-undangan (statute approach). Al-Qur'an memperlakukan nusyuz dari dua sudut pandang, sehingga menjadikannya sebagai penghujatan dalam kaitannya dengan nusyuz. Dengan kata lain, nusyuz itu ada dua macam: satu dari istri (QS. an-Nisa [4]: ​​34) dan satu lagi dari suami (QS. an-Nisa [4]: ​​128). Cara apapun (mauizhatul hasanah, hajrun, dhorbun, islah, ihsan, taqwa) dapat digunakan untuk menyelesaikan masalah tersebut.

Abstract

This study aims to determine the relationship between the implementation of good governance based on employment contracts, bureaucratic reform and e-government to improve the efficiency of government administration in Indonesia. This research also uses qualitative research methods with data collection methods in the form of describing analysis methods, describing and discussing, and on the basis of relevant literature review, studying and collecting data taken from articles published in various scientific journals and book compilations. Secondary data referenced from the relevant literature review is used as a tool. Indonesia has implemented work contract-based bureaucratic reform in an effort to improve government administration. Bureaucratic reform based on work contracts, where the government organizers, such as regional heads, are always required to achieve the pre-determined work goals. The results of this study show that in implementing bureaucratic reform to achieve good governance, the Government uses the concept of working contract. By using the concept of employment contract that uses technology (e-government), the employment contract can be more transparent with the output in the form of work evaluation. This is shown from several points of view, as use of electronic government related to establishment of good governance practices, implementation of good governance related to bureaucracy institutional transformation, there is a relationship between performance and electronic government, performance with bureaucracy transformation, and implementation of good governance with performance.

Abstract

This research is motivated by the fact that there are still many LAHP and/or Ombudsman Recommendations that are not implemented, while the implementation is a necessity for the realization of good, clean and efficient public service delivery and to prevent and eliminate abuse of authority as specified in the laws and regulations. This research was conducted using secondary data, which is sourced from the 2021 Annual Report of the Ombudsman RI, Laws and Regulations on the Ombudsman and on Public Services. From the research conducted, it is known that the factors causing the LAHP and / or Ombudsman Recommendations not to be implemented are due to: First, the legal material factor which still contains legal loopholes, intertwined with the Second factor, namely Law Enforcement, where not all Officials who have the authority to enforce the law oversee the implementation of LAHP and / or Recommendations, as well as impose administrative sanctions on the Reported Party who does not implement LAHP and / or Recommendations, and Third, the factor of those affected by the rule of law, where there is still an assumption of some Reported Party, that LAHP and / or Recommendations are only suggestions, not as something that must be implemented.

Abstract

TikTok Shop is a social commerce feature that allows users and creators to advertise and sell products through TikTok. Currently, TikTok is still not licensed as social commerce. As a platform that connects sellers and buyers, TikTok Shop has the responsibility to ensure the security and validity of transactions that occur in it. However, there are still some unresolved legal issues. This study aims to identify and analyze legal uncertainty related to the Minister of Trade Regulation Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Trading through Electronic Systems where social commerce must have a license first before it can operate in Indonesia, in this situation TikTok Shop cooperates with one of the largest e-commerce platforms (marketplace) in Indonesia, namely Tokopedia, which occurs in the return of TikTok Shop as a social commerce platform in Indonesia. The method used in this research is normative juridical. This research approach is a statutory approach (statue approach). Based on the results and discussion, it is found that there is legal uncertainty where TikTok Shop is not in accordance with the regulations mentioned above, especially regarding the rules stating that social commerce is not allowed to put a payment transaction feature (checkout) in it. It is hoped that the results of this study can contribute to increasing understanding and legal awareness for TikTok Shop users and provide recommendations for related parties to increase security and trust in transactions on this platform.

Abstract

Dewasa ini dengan mudahnya akses pembelian buku bagi masyarakat selaku konsumen pada marketplace, banyak dimanfaatkan pihak tidak bertangungjawab untuk mencari keuntungan secara finansial dengan menjual buku-buku bajakan. Kegiatan pembajakan merupakan penggandaan ciptaan dan atau produk hak terkait secara tidak sah dan pendistribusian barang hasil penggandaan dimaksud secara luas untuk memperoleh keuntungan ekonomi. Masyarakat sebagai konsumen wajib menerapkan prinsip kehati-hatian, mengingat maraknya praktik jual beli buku bajakan pada sebuah marketplace. Diharapkan pula marketplace sebagai perantara antara penjual dan pembeli melaksanakan upaya preventif dan represif guna mengatasi praktek jual beli buku bajakan. Upaya nyata dari masyarakat selaku konsumen dan merketplace sebagai perantara penjual dan pembeli tersebut, merupakan perwujudan dan penghargaan atas karya intelektualitas terkait hak moral dan hak ekonomi bagi pencipta atau pemegang hak cipta.

Abstract

The principle of good faith is a fundamental legal principle in the registration and protection of registered trademarks, so it can be a reason for rejecting a lawsuit to cancel a registered trademark in the Commercial Court, if the Plaintiff cannot prove that the registration of the disputed trademark was carried out by the Defendant in bad faith. This article will examine how good faith is regulated in trademark registration based on the 2016 Trademark Law?, and what requirements must be met when filing a lawsuit for canceling a registered mark in the Commercial Court?, as well as how to apply the principle of good faith as a reason for rejecting a lawsuit for canceling a registered mark by the Court. Commerce? This article is the result of normative legal research, using a statutory, case and concept approach, using secondary data, with qualitative data analysis. The research results show that the regulation of good faith is regulated in Article 21 paragraph (3) and Article 77 paragraph (2) of the 2016 Trademark Law, and the requirements that must be fulfilled in filing a lawsuit for cancellation of a registered trademark at the Commercial Court meet the formal and material requirements in Article 76 to Article 79 and Articles 85 to Article 90 Jo. Article 21 of the 2016 Trademark Law, as well as the application of the principle of good faith as a reason for rejecting a claim for cancellation of a registered mark by the Commercial Court, is casuistic and proportional and objective according to the legal facts revealed in the trial.

Abstract

The code of ethics in the notary profession is not just a set of rules or codes of conduct, but also reflects the essence of integrity and responsibility that a notary must have. In providing services to clients, a notary not only acts as a legal professional, but also as a guardian of trust and legal certainty for the community. Therefore, it is important for notaries to understand and abide by their code of ethics conscientiously. The research method used is normative legal research. With a statutory approach, i.e. examining current laws and regulations, other relevant literature, and case studies related to the research topic. The results showed that the Code of Ethics is important for notaries in providing services to clients, maintaining integrity and professionalism. However, there are still cases of violations that harm the reputation of the profession. To prevent this, it is necessary to increase supervision, education, and training for notaries. Transparency and accountability in handling violations are also important. Public awareness of the importance of choosing notaries who comply with the code of ethics should also be increased through information campaigns. These steps are expected to ensure that notary services remain of high quality and trust.
