Abstract

Hubungan antara manusia dan tanah sangatlah erat. Bukan hanya hubungan individual namun berkaitan dengan umum. Tanah mempunyai peranan yang luar biasa dan juga mempunyai nilai ekonomi. Selanjutnya proses peralihan hak atas tanah dapat dilakukan melalui suatu perjanjian yaitu perjanjian jual beli tanah. Kenyataannya, terkait tanah ulayat, banyak pihak yang melakukan perjanjian tersebut di bawah tangan mereka sendiri. Berdasarkan permasalahan di atas, maka rumusan masalah dalam penelitian ini adalah: 1) Bagaimanakah kepastian hukum bagi para pihak dalam jual beli tanah ulayat yang dikuasainya? 2). Apa akibat hukum yang timbul dari pembuatan perjanjian jual beli tanah milik pribadi? Metode pendekatan masalah yang digunakan adalah yuridis normatif, sumber data dalam penelitian ini berasal dari penelitian kepustakaan, dan analisis serta pengolahan data yang akan digunakan dalam penelitian ini adalah analisis kualitatif. Hasil Penelitian: 1) Pengalihan Tanah Ulayat melalui perjanjian jual beli dengan akta di bawah tangan hanya mengikat para pihak. 2) Akibat hukum yang timbul dari pembuatan perjanjian jual beli tanah ulayat di bawah tangan adalah peralihan hak atas tanah dari penjual kepada pembeli, namun apabila di kemudian hari terjadi perselisihan maka kekuatan pembuktian perjanjian perseorangan ini tidak sempurna.

Abstract

Desentralisasi menjadi kebijakan yang berkembang di negara demokrasi. Indonesia merupakan salah satu negara demokrasi yang telah mengeluarkan kebijakan otonomi daerah yang kemudian berpengaruh juga pada proses pemerintahan di lingkup paling kecil yaitu pemerintahan desa. Desa Ngadas merupakan desa yang terletak di Kecamatan Poncokusumo Kabupaten Malang Jawa Tengah. Dalam penelitian ini berfokus pada pelaksanaan otonomi daerah, partisipasi masyarakat dan perumusan peraturan desa untuk mencapai good governance. Penelitian ini menggunakan metode kualitatif dengan proses pengambilan data dengan observasi, wawancara dan dokumentasi. Hasil penelitian menunjukan masyarakat Desa Ngadas lebih menekankan adat istiadat dan masih percaya dengan dukun adat, peran dukun adat sangat terlihat jelas dalam politik dalam pengukuhan jabatan kepala desa sekaligus kepala adat. Partisipasi masyarakat Ngadas masuk dalam kategori partisipasi aktif, masyarakat mendapatkan undangan atau informasi mengenai musyawarah melalui RT yang datang langsung ke rumah warga. Desa Ngadas mampu mencapai good governance dengan cara yang berbeda dibandingkan dengan desa lain, keunikan dalam desa ngadas menjadikan perpolitikan yang lebih sehat dengan menekankan pada hukum adat istiadat.

Abstract

Consumer legal protection in Indonesia refers to legal efforts to protect consumers from various economic actions that harm them. This research uses normative legal research methods. The purpose of this study is to determine the law enforcement of legal protection of consumers for the purchase of rice products with fake brands. The results of this study indicate that riceoplosan is an effort to produce fake rice brands that endanger consumer health and is a criminal offense as stated in articles 254 to 259 of the Criminal Code. As an existence of legal protection by the state against this, business actors who counterfeit rice product brands can be subject to sanctions as in Article 62 of Law Number 8 of 1999 concerning Consumer Protection, namely a maximum penalty of 5 (five) years or a maximum fine of Rp.2,000,000,000.00 (two billion rupiah).

Abstract

Pembunuhan berencana adalah tindakan yang terencana dan disengaja yang dilakukan dengan maksud mengambil nyawa orang lain sehingga tindakan ini merupakan suatu perbuatan yang melanggar hukum. Belum lama ini, terdapat kasus pembunuhan yang terjadi di Purwokerto. Karya tulis ini memiliki tujuan untuk melaksanakan sila pertama Pancasila dalam suatu kasus dengan korelasi Undang-Undang 340 KUHP. Kasus pembunuhan ini melanggar Undang-Undang Nomor 1 Tahun 2023 KUHP. Undang-Undang Nomor 1 Tahun 2023 mengenai Kitab Undang-Undang Hukum Pidana dirancang dengan pertimbangan untuk menyesuaikan dengan kebijakan hukum, kondisi aktual, dan pertumbuhan kehidupan nasionalis untuk menjunjung hak asasi manusia. Di samping itu, pembunuhan adalah sebuah tindakan yang tidak cocok dengan prinsip pertama sila Pancasila yang mengatakan "Ketuhanan Yang Maha Esa". Metode yang digunakan termasuk kedalam metode normatif serta metode yang bersifat kualitatif. Selain itu, penelitian ini menggunakan perundang-undangan sebagai pendekatan bahan baku primer serta buku sebagai pendekatan bahan hukum sekunder. Dalam Pasal 340 KUHP, diatur tentang pembunuhan berencana yang dimana pelaku secara sadar dan sengaja untuk mengambil nyawa orang lain, yaitu meliputi hukuman mati, hukuman penjara seumur hidup atau, pada tingkat maksimal dua puluh tahun. Dalam hal ini, pelaku juga melakukan tindakan inses yang ditetapkan dalam Pasal 294 ayat (1) Kitab Undang-Undang Pidana (KUHP).

Abstract

The responsibility borne by PPAT is not only to the parties in terms of making land deeds but is also responsible for managing the deed effectively so that it is completed quickly, monitoring land sale and purchase transactions, and carrying out PPAT obligations by PMNA/Kep BPN RI No. 3 of 1997 concerning provisions for the implementation of Government Regulation Number 24 of 1997 concerning land registration as amended by the regulation of the head of the land agency Number 8 of 2012. An empirical juridical approach method was used, where data collection was carried out by field research which can support existing theories after analysis conclusions are drawn. Based on the research results, it was found that there were still PPATs carrying out their duties not based on the provisions of the statutory regulations written above.

Abstract

The Tablighi congregation often carries out its da'wah activities by leaving his wife, who is called khuruj. Ideally, in Islamic law, a partnership must be built to form a family, what happens in a family but the husband only preaches outside (khuruj), giving the impression that he does not take care of the household. A husband and wife partnership is built on the relationship between husband and wife in building a household to achieve common goals. This study aims to examine the relationship between husband and wife in the Tablighi congregation family, especially in the Medan Amplas Tablighi congregation family. This study is also to analyze the partnership that is built within the family from the perspective of Islamic Family law. Using qualitative methods, data was explored using interviews. This study found that basically a good and harmonious family is a commandment in Islamic teachings. Then from the thoughts above the question arises, what is the actual relationship between husband and wife among the tabligh congregation. Do they really have an ideal partnership as suggested by Islam? What about their partnership from a gender perspective? Why is it necessary to look at it from a gender perspective because the relationship between husband and wife is always related to gender, is that true? The purpose of this writing is to determine the suitability of Islamic family law and its implementation for husband and wife partnerships among members of the Medan Amplas tabligh congregation. The research methods used are library research and field research. The results of this research are that the husband and wife partnership built by the Medan Amplas tabligh congregation family is very organized following the procedures taught by the Prophet and according to Islamic law.

Abstract

The impediment to make a sale act by the ppat because its conditions are not met, of course, will create uncertainty for the parties who conduct the sale. The agreement is a binding agreement. The parties entered into an agreement for binding the sale of the land which has not been inherited depending on several factors such as the buyer needs time to carry out the payment of the sale price while the seller takes time to process the inheritance certificate of the right to the land, the purchaser has paid the purchase price but the unity of the rights to the ground has not yet been made to inherit, and/or payment of income tax (PPh) and customs duties on land and building (BPHTB) have not been issued by the parties. The contract of sale of land that has not been inherited is based on the agreement of the parties, which is then continued with the application for the drafting of an act before a notary, the approval of the law by a notar, the submission and inspection of documents, the verification of certificates of the right to the land, the preparation and drawing of acts, and the signing of the act. The Civil Procedure Act against land not inherited made before a notary has legal certainty, because the notary as a public official authorized to make an authentic act subject to the regulations of the laws and the code of ethics of the office of the notar has ensured the validity of the civil procedure act against land that has not been made in heritage made against him and by referring it to a civil proceeding act against the land noted in the notarial act can provide legal protection to the parties in the event of legal protection of an authoritative act.

Abstract

Street lighting is one of the regional government services that is used for the benefit of the general public in daily life. Minister of Transportation Regulation No. 27 of 2018 concerning Public Street Lighting Equipment is to optimize road equipment facilities in the form of street lighting devices. In order to realize safety, security, order and smooth traffic as well as convenience for road users in traffic. Providing street lighting facilities is a form of successful development in an area. However, the reality found in the field is that there are still street lights in the city of Medan that are not functioning or are not on. Malfunctioning of street lights can cause accidents, theft, and so on for road users. Therefore, the physical form and function of street lights must be in accordance with the regulations or procedures, and also the form of operation of street lights must be in accordance with the needs of the community in general and avoid waste and wasteful use of resources and budgets as explained in Minister of Transportation Regulation Number 27 of 2018 concerning Street Lighting Equipment that the government does not implement the points in this regulation properly, so the construction of public facilities for street lighting. From the perspective of Fiqh Siyasah, and Minister of Transportation Regulation no. 27 concerning Street Lighting Equipment, there are still many things that are not in accordance with the provisions of Siyasah Fiqh.

Abstract

Criminal activities in the labor industry are illegal acts carried out by laborers, employers, or other persons not affiliated with the firm that face criminal penalties under the Criminal Code, Manpower Law, and/or other legislation, either alone or in combination. In the course of Civil Servant Investigators' criminal inquiries in the labor sector. The Manpower and Transmigration Service (Disnakertrans) employs Civil Servant Investigators who carry out their work in accordance with the Law Number 13 of 2003 concerning Manpower and the Regulation of the Chief of the National Police of the Republic of Indonesia Number 6 of 2010 concerning Investigation Management by Civil Servant Investigators (PPNS). Both laws provide authority for their operations. It seems sense in this instance that PPNS Disnakertrans's inquiry is coordinated with the police as well. One of the issues preventing the inquiry from operating at its best in its execution is the ineffective coordination. The following issues may be created based on the backdrop of the aforementioned difficulties: 1. How are criminal investigations in the area of labor being carried out by Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of West Sumatra Province? 2. What are the challenges facing the Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of the Province of West Sumatra in carrying out criminal investigations in the area of labor? Based on the study's descriptive methodology and empirical juridical approach, the following conclusions may be drawn from it: 1. The implementation of criminal investigations in the field of labor by PPNS Disnakertrans is a series of: examination, processing of crime scenes, Sprindik, SPDP, examination of witnesses and suspects, completion and submission of Case Files to be submitted by PPNS to the public prosecutor through police investigators. 2. The obstacles experienced by PPNS Disnakertrans in carrying out criminal investigations in the field of labor are the lack of supervisors and PPNS both in quantity and quality. In addition, the lack of facilities and infrastructure as well as limited budget are obstacles in the investigation. SOPs that are not fully implemented and lack of coordination between PPNS and the Police as Korwas are obstacles found in the implementation of criminal investigations in the field of labor. For better implementation of investigations, PPNS Disnakertrans West Sumatra must be able to improve coordination with Police Investigators. In addition, Disnakertrans is expected to be able to overcome internal obstacles so that the enforcement of criminal acts in the labor sector can run even better.

Abstract

This study aims to analyze the responsibility of doctors who carry out medical procedures without written consent for patients at the Pratama Aesthetic Beauty Clinic and also to analyze the legal protection for patients who do not provide written consent for medical procedures at the Aesthetic Beauty Pratama Clinic. Administratively, it is the responsibility of a doctor to carry out medical procedures without written consent from the patient administratively. The legal responsibility of doctors, apart from civil law, is also accountable under criminal law. In Indonesia, the problem of liability for a doctor's criminal law is regulated in the Criminal Code, which includes legal responsibility arising on purpose or negligence/negligence. Forms of legal protection for patients for medical record errors resulting from the absence of informed consent in health services are regulated in Law Number 36 of 2009 concerning Health Law Number 29 of 2004 concerning Medical Practice and Law Number 8 of 1999 concerning Consumer Protection where these three rules can provide protection and legal certainty for patients who also serve as consumers about the rights and obligations of patients in obtaining health services which in practice are not by applicable laws.
