Abstract

This study aims to determine the authority of notaries and Land Deed Making Officials (PPAT) in making a concession agreement deed due to a lost mortgage certificate, analyzing the stages and processes in registering a concession agreement deed due to a lost mortgage certificate at the Asahan Regency Land Office and assessing the position law and the use of a concession agreement deed due to a lost mortgage certificate at the Asahan Regency Land Office. This study uses a qualitative descriptive method with a case approach and a statutory approach. The results of the study indicate that the Royal Consent Deed was made with a notarial deed. Although the APHT, which is the "base" of making mortgage certificates, is a PPAT deed, the consent deed remains the authority of a notary, not a PPAT. The registration process and completeness of the documents related to the Roya application using the Roya Consensus deed are the same as the general Roya service, as regulated in the Regulation of the Minister of Agrarian Spatial Planning/Head of BPN Number 3 of 1997 and Regulation of the Minister of Agrarian Spatial Planning/Head of BPN Number 1 of 2010. Deed roya permit made by a notary, its position is only as a substitute for a mortgage certificate lost in the roya process, not for execution, so that its position cannot be equated with a mortgage certificate which has executorial power because it is not regulated by law..

Abstract

This article seeks to discuss Islamic ideas and civilisation during the time of the Prophet Muhammad S.A.W., as well as the function and strategic importance of the Mosque, Baitul Mal, and Fathul Makkah. The problem focuses on the development of Islamic thinking and civilisation during the time of the Prophet Muhammad SAW, as well as the role and strategic position of the Mosque, Baitul Mal, and Fathul Makkah. In order to approach this problem, theoretical references from a variety of subject-relevant specialists located in books and journals are used. Literature is used to collect and interpret qualitative data. This study indicates that Islamic thinking and civilization in the classical period attempted to spread Islamic treatises as a new way of life over the Arabian Peninsula by describing the dynamics of Muslim society. In the Pre-Islamic Arab culture, also known as the Jahiliyah Era (ignorance), there was a lack of religious, social, and political understanding, as well as awareness of Allah SWT. As for the growth of Islamic civilisation in the time of the Prophet Muhammad, such as through mosques, Baitul mal, and at the time of the fathu Makkah event, examples include mosques, Baitul mal, and the fathu Makkah event. In its early days, this mosque served as an Islamic educational institution, therefore it arranged studies in the form of talks, lectures, and learning models, each of which had its own form or format according to the level of Muslim community development at the time. Prophet Muhammad SAW also initiated the construction of Baitul Mal, which served as a muassasah (institution), managed governmental expenditures and income, and served as a repository for Muslim assets. As for the Fathu Makkah incident serves as a reminder to Muslims and everyone else that human values must always take precedence, regardless of the circumstances.

Abstract

The purpose of this research is to examine and analyze the legal rules regarding Syahbandar in Indonesian laws and regulations; the role played by Syahbandar Belawan and its obstacles in carrying out sea transportation safety. The method used is normative juridical research by analyzing laws and regulations and conceptual analysis by analyzing descriptive data. The results of the study show that the Syahbandar regulations are regulated in Law 17 of 2008 concerning shipping, Minister of Transportation Regulation No. 34 of 2012, Minister of Transportation Regulation No. 36 of 2012, and RI Government Regulation No. 9 of 2019. The future role of Syahbandar must be as the front guard in identifying cases of ship accidents at sea and must be able to change himself in a more professional direction and must routinely carry out ship inspections so that accidents during shipping can be minimized. The obstacles faced by Syahbandar in carrying out sea transportation safety supervision can be seen from a regulatory perspective, from an agency perspective, and from a facilities and infrastructure perspective. Suggestions that can be drawn from this thesis are that Belawan Syahbandar officers should provide educational supplies and train their employees to increase knowledge and skills that support supervisory activities, so that they can run properly so that the supervisory function of shipping safety can be improved.

Abstract

Currently, Indonesia's institutional structure is overweight with 34 ministries, 28 non-ministerial government institutions, and around 69 non-structural institutions with overlapping authority, indicating the complexity of government fragmentation in Indonesia. Globalization will intervene more in the field of government institutional restructuring when Indonesia's institutional situation is too hierarchical, fragmented, and over-procedural. This paper aims to discuss the importance of ASN management and how the government steps to actualize public values in ASN reform. This research uses a qualitative approach, which describes the efforts to reform ASN management in the face of globalization. The data collection technique used in this research is a literature study by collecting materials from books, journals, by describing the data through several experts' opinions. This paper proposes a recommendation that institutional downsizing is a logical consequence of the fragmented condition of Indonesian government institutions, the president should dare to reorganize the power structure in order to save the cost of governance. The quality of ASN in the face of globalization should be strengthened by recruiting younger employees who understand the dynamics of technological development, and educating ASN personnel by conducting special trainings in responding to globalization as a challenge that must be faced.

The problem is focused on the married life of elderly couples, what are the because motives and in order to motive the elderly to divorce at a relatively long age of marriage. To approach this problem, a theoretical reference from Alfred Shuzt is used. The motive for the elderly deciding to divorce is dominated by sexual problems. Another reason is infidelity and polygamy by husbands, husbands leave the house and wives are busy taking care of their children and grandchildren. The in order to motive is to want to get out of marital problems, live quietly in old age and free oneself from obligations as a wife. However, it was found that this motive did not stand alone, but was an accumulation of various things.
