Abstract

The aim of this research is to describe the prospects and problems of waqf in Indonesia. This research uses descriptive qualitative methods. The research results show that Waqf in Indonesia has quite large potential, in 2022 there will be 440,512 points of waqf land in Indonesia with a total area of 57,263.69 hectares. If these assets are used productively, the potential is very large, around 19.4% of Indonesia's gross domestic product. Apart from that, the potential for cash waqf is estimated to reach 180 trillion rupiah per year. Apart from the great potential, there are problems with waqf in Indonesia, namely: Nadir's low understanding of waqf principles, law, management and Nadir's profession not yet being the main profession are the causes of the low quality of Nadir's waqf in Indonesia. Apart from that, Wakif's limited understanding of the concept, law and objectives of waqf is also part of the problems of waqf in Indonesia. Likewise, low public knowledge about waqf causes waqf assets in the community to not be managed well and productively. Waqf management in Indonesia tends to be traditional, the waqf certification process is complicated, coordination between institutions is weak, the use of waqf assets is not yet productive, government policies and supervision regarding the use of existing assets are not optimal, thus causing conflicts over waqf land.

Abstract

Islamic economics has a unique and different value framework compared to conventional economics. In this article we will discuss the concept of price in the context of Islamic teachings. The research method used in this research is a qualitative method in the nature of library research by collecting data from various sources of information, such as books, articles and so on related to the topic of discussion. Prices in Islamic economics are influenced by the principles of justice. Islam teaches the importance of avoiding practices that harm other parties. Therefore prices must be fair and must not create inequality or exploitation. Prices have a significant role in the economy and everyday life and Islam has a specific view on how prices should be set, regulated and run in accordance with sharia principles. In Islam, prices are seen as an important element in economic transactions. Through a better understanding of the concept of prices in Islam, it is hoped that Muslim communities and business people can carry out their economic transactions in accordance with sharia values, create a fairer and more sustainable economy, and contribute to shared prosperity.

Abstract

The transaction of buying and selling according to the perspective of fiqh constitutes a contractual agreement regarding a specific item, wherein the seller explicitly mentions the item to be sold, including its price and quality, to the buyer, while simultaneously establishing a certain amount of profit. Meanwhile, in the case of certain traditional markets, particularly in the sale of mixed rice, neither the seller nor the buyer specifies the process of mixing the rice, thus resulting in rice with various quality variations. This study aims to delve into the practice of buying and selling mixed rice from the perspective of Islamic Law in Traditional Markets. The research method employed is descriptive qualitative research with the application of analytical techniques based on an inductive approach. Based on the research findings, it can be inferred that the Islamic legal scrutiny of the practice of selling mixed rice in traditional markets involves various types of rice variations based on their quality. The quality of the rice is determined by the extent to which high-quality rice is mixed with low-quality rice. According to the perspective of Islamic Law, the transaction of buying and selling mixed rice is deemed prohibited (haram) as it is considered to involve deceptive elements that can harm one of the parties. This deceitful practice, which could encompass misrepresentation (tadlis) and uncertainty (gharar) regarding the quality in the transaction of buying and selling mixed rice, is deemed detrimental to the general public. Therefore, the marketing of mixed rice falls under the category of rice marketing that is prohibited according to the principles of Sharia.
