Abstract

Money as a medium of exchange, has at least two forms, namely fiat money and dinar dirham. This paper discusses the use of fiat money and the use of gold and silver as a currency with its advantages and disadvantages. Furthermore, this article also compares the use of fiat money and dinar dirhams as currency. This paper answers the question of whether gold and silver are the only metals accepted as the currency in the economic system, while other currencies are not. The results of this study indicate that, although the hadith is more likely to state that gold and silver as money, it is not limited to gold and silver. By law, 'Illah of thamaniyyah' which is not restricted to gold and silver but money in general, is supported by Ibn Taymiyah's opinion. In addition to that, the principle of ibahah where in muamalah everything is allowed, as long as it is not prohibited by the texts (Al-Quran and Sunnah). Maqashid Al-Shariah allows other forms other than gold and silver to be used as currency, if the conditions are demanding so. Metals other than gold and silver are accepted, as long as it can facilitate sharia activities such as paying zakat and rejecting usury.

Abstract

Since the enactment of Law No. 8 of 1981, LN. No. 76 of 1981, namely regarding the Criminal Procedure Code which came into force on December 31, 1981, the provisions contained in the HIR (Het Herzine Inlandsch Reglement) Staatsblad 1941 44 and all its implementing regulations are no longer valid. The values of Pancasila and the 1945 Constitution which are noble and uphold the existence of human rights also recognize the position and role of defenders which are implemented or further embodied in the Criminal Procedure Code, namely Law No. 8 The position and role of the defender are closely related to the rights of the suspect or defendant because the defender or legal advisor is present in the process of settling criminal cases precisely to assist and defend the rights of the suspect or defendant as regulated in the Criminal Procedure Code (KUHAP) A suspect who is suspected of committing a criminal act is not necessarily a guilty person, nor is a defendant charged with a criminal act not necessarily guilty because in our legal state recognizes the principle of "the presumption of innocence", so the suspect or defendant must be considered innocent. guilty before there is a judge's decision that already has permanent legal force. The presence of a defender in the settlement of a criminal case in addition to accompanying a suspect or defendant and defending him is also due to moral and juridical responsibility as one part of law enforcement officers who work together same as other law enforcers trying to find the material truth. In this criminal justice process, the provisions of Article 54 of the Criminal Procedure Code emphasize the rights of the suspect be accompanied by the defense or legal counsel at every level of examination, in other words, that the suspect or defendant has the right to have contact with the defender from the time of the preliminary examination until the time of the preliminary examination. examination in court.

Abstract

This study will develop a strategy model for a small qualifying company in the field of Construction Services using the David model. In principle, there are three steps in David's model, namely the input stage, matching stage, and decision stage. The Analytical Hierarchy Process (AHP) is used to determine the weight of the internal and external factors of the strategy and the Quantitative Strategic Planning Matrix (QSPM) to determine the chosen alternative strategy. From the results of the External Factor Evaluation (EFE), Internal Factor Evaluation (IFE) and Competitive Profile Matrix (CPM) matrix at the input stage, the Strength-Weakness-Opportunity-Threat (SWOT) matrix, Strategic Position and Action Evaluation (SPACE), Grand Strategy (GS) at the matching stage which produces several alternative strategy proposals. Then the decision stage using the Quantitative Strategic Planning Matrix (QSPM) is selected the alternative strategy with the highest score. From the selected alternative strategy recommendations, a strategy model is then made with a new Business Model Canvas (BMC). The results of the research are expected to create an appropriate strategy to be used as a reference for small qualified Construction Service Companies to win the competition and be able to move up to the qualifications above (medium). Thus, the composition of small companies in Indonesia is increasingly ideal hence a good business competition climate will be created for small qualified construction services, besides that, a new strategy is also obtained for PT. ABC-U.
