Abstract

Abstrak Fenomena penerapan Peraturan Daerah (Perda) Syariat di beberapa wilayah Indonesia telah menjadi topik yang memicu berbagai reaksi publik, terutama karena perda syariat ini dianggap sebagai upaya daerah untuk mempertahankan nilai-nilai Islam di tengah arus modernisasi dan globalisasi. Kebijakan ini muncul seiring diberlakukannya otonomi daerah pada tahun 1999, yang memberi wewenang lebih besar kepada pemerintah daerah untuk mengatur wilayah mereka sesuai dengan aspirasi masyarakat setempat. Salah satu daerah yang menonjol dalam penerapan perda syariat adalah Aceh, yang mendapat hak istimewa untuk menerapkan hukum syariah melalui Undang-Undang Nomor 11 Tahun 2006. Fenomena ini menimbulkan berbagai pandangan dan perdebatan, baik dari pendukung yang menganggap perda syariat sebagai upaya untuk menjaga moralitas publik maupun dari kritik yang menilai aturan ini berpotensi mendiskriminasi kelompok minoritas. Penelitian ini bertujuan untuk menganalisis dampak, tantangan, dan kontroversi yang terkait dengan penerapan perda syariat di Indonesia, khususnya di Aceh. Dengan menggunakan metode analisis kualitatif, penelitian ini mengkaji persepsi masyarakat terhadap perda syariat, efektivitas aturan, serta implikasi hukumnya terhadap hak-hak dasar warga negara. Hasil penelitian menunjukkan bahwa meskipun perda syariat dapat menciptakan ketertiban sosial yang sesuai dengan norma-norma mayoritas, aturan ini juga menghadapi tantangan dalam bentuk inkonsistensi penegakan hukum dan berpotensi bertentangan dengan prinsip-prinsip hak asasi manusia, terutama bagi kelompok masyarakat non-Muslim.

Abstract

Istri bekerja sebagai TKW di luar negeri untuk menghidupi keluarga namun berdampak buruk bagi kehidupan rumah tangga bahkan marak kasus pelecehan dan kekerasan oleh majikan asing sehingga Islam mengatur bagaimana menghukum dan memberikan solusi terhadap pekerjaan tersebut, maka penulis menetapkan 5 rumusan masalah diantaranya: Apa saja definisi dan sistem menjadi TKW?; Apa saja Faktor yang Mengharuskan Istri Menjadi TKW?; Bagaimana pandangan Islam terhadap Istri yang bekerja di luar rumah?; Bagaimana Pandangan Islam terhadap Istri yang Menjadi TKW di Luar Negeri?; Apa saja dampak menjadi TKW? Metode yang digunakan adalah studi pustaka dimana penelitian ini menganalisis berbagai sumber hukum Islam seperti Al-Quran, Hadits, dan pendapat ulama tentang kedudukan hukum, hak, dan kewajiban seorang istri yang bekerja di luar negeri. Temuan/hasil yang diperoleh bahwa hasil penelitian menunjukkan bahwa Islam pada prinsipnya memperbolehkan wanita untuk bekerja di luar rumah dengan syarat-syarat tertentu, seperti harus seizin suami dan menjaga kehormatan dirinya. Akan tetapi, bekerjanya TKW di luar negeri dalam jangka waktu lama tanpa mahram, terdapat perbedaan pendapat di kalangan ulama. Sebagian besar ulama melarang hal tersebut, namun sebagian lainnya membolehkannya dalam keadaan darurat. Kajian ini menyimpulkan bahwa keputusan seorang perempuan untuk menjadi TKW harus mempertimbangkan aspek hukum Islam, sosial, dan ekonomi.

Abstract

يمثل برنامج خيارًا لأسلوب الحياة للأزواج الذين يقررون عدم إنجاب الأطفال. وتعتمد هذه الممارسة عادة على عدة أسباب واعتبارات أساسية، بما في ذلك القضايا الجسدية المتعلقة بالتجارب الاقتصادية والعقلية والشخصية والعوامل الثقافية والاكتظاظ السكاني وغيرها. وينبغي أن تؤخذ هذه الأسباب في الاعتبار في هذه الدراسة. الغرض من هذا البحث هو دراسة ظاهرة التحرر من الأطفال من وجهة نظر المقاصد الشرعية حسب جاسر عودة وآراء المحاضرين في جامعة سنان أمبل سورابايا حول هذه الظاهرة. تستخدم هذه الدراسة منهج البحث النوعي الوصفي من خلال المنهج الظاهري في هذا البحث يتم تطبيق المقاصد الشرعية عند جاسر عودة كأداة تحليلية في الدراسات الشرعية الإسلامية، مع الأخذ في الاعتبار جميع مكونات النظام القانوني الإسلامي، وهي: الطبيعة المعرفية (الفهم الأساسي)، والكمال، والانفتاح، والتسلسل الهرمي المترابط، والتعددية. البعدية، والهدفية (التوجه نحو أهداف الشريعة الإسلامية). وخلصت الدراسة إلى أن قرار عدم الإنجاب، أو عدم الإنجاب، هو قرار مقبول لأسباب معينة مثل المرض أو ظروف الحمل التي تهدد الحياة، كحل للتغلب على الصعوبات. ولا يتم اتخاذ هذا القرار بمحض إرادته الشخصية فحسب، بل لحماية النفس من المواقف غير المرغوب فيها. إن قرار عدم الإنجاب له آثار إيجابية وسلبية. التأثير الإيجابي هو تجنب المواقف التي تهدد الحياة عندما يشكل إنجاب الأطفال خطراً. ومع ذلك، فإن التأثير السلبي، إذا اختار المزيد من الناس باستمرار عدم الإنجاب، سيؤثر على السكان البشريين ويقلل من العمر الإنتاجي اللازم لبناء الحضارة في المستقبل.

Abstract

The marketing strategy of sharia general savings products with a mudharabah contract at BMT-UGT Nusantara Capem Bantur uses the Mudharabah Agreement, namely the BMT plays the role of Mudharib and the members play the role of Shahibul Maal. The profits from the business are distributed according to the initial agreement between the two parties, which is 70%: 30%. This study uses qualitative methods obtained from primary and secondary data, with data collection through observation, documentation and interviews. Then the analysis technique used is to use a descriptive method, namely by providing a description of the subject being researched. The results of this study conclude that the first BMT-UGT Nusantara Capem Bantur has implemented 2 (two) types of marketing strategies, namely internal and external strategies. As for the internal: The internal strategy carried out is to determine employees who are originally domiciled in Bantur village even if they move from another village as long as they have settled in Bantur village, while externally: The external strategy carried out is to collaborate with partners, school institutions, community organizations (Muslimat), and sugarcane farmer groups. The two obstacles experienced when carrying out marketing activities carried out by BMT-UGT Nusantara Capem Bantur are the lack of public trust in financial institutions that have a background so dark that they experience trauma due to fraudulent investments, lack of public awareness of halal transactions, and people are used to using deposit services in conventional banks and the difficulty of finding genuine employees

Abstract

This paper discusses the epistemological framework of ijtihad carried out by the Indonesian Ministry of Religion when establishing the murūr Muzdalifah scheme for elderly and disabled Hajj pilgrims. The focus is on the stipulated time for implementation, namely before midnight. With a normative-epistemological approach that relies on content analysis methods, this paper concludes that the Indonesian Ministry of Religion uses two ijtihad methods simultaneously, namely the istishlāhī and takhayyur methods. Using this method, the Indonesian Ministry of Religion selects and selects fatwas that are more appropriate to the conditions of the Hajj pilgrims and the situation in Muzdalifah and prioritizes the health and mental safety (hifzh al-nafs) of the Hajj pilgrims.

Abstract

Law No. 16 of 2019 stipulates that the minimum marriage age for both males and females is 19 years. If this requirement is not met, a marriage dispensation must be obtained from the Religious Court. This study aims to evaluate the effectiveness of Law No. 16 of 2019 regarding marriage dispensation. Using a qualitative method with a normative-empirical approach, the findings reveal a significant decrease of approximately 79.9% in marriage dispensation applications at the Malang Religious Court from 2020 to 2024. This decline reflects effective law enforcement supported by government outreach programs and stricter judicial discretion in approving dispensation requests. From an Islamic perspective, marriage dispensation is permissible, aligning with the jurisprudential principle that preventing harm (darar) takes precedence over pursuing benefit (maslahah).Law No. 16 of 2019 stipulates that the minimum marriage age for both males and females is 19 years. Abstract

Abstract: Acts of radicalism and religious extremism are often associated with religious teachings that are considered deviant from what they should be because they lead to acts of terrorism. Radicalism is ideological thinking with the aim of achieving change through more systematic or organized methods. Meanwhile, religious extremism is thinking or behavior that is very radical and often leads to acts of violence and intolerance to differences. This research is a literature study that examines efforts to resolve radicalism and religious extremism through the constitution, civil society and law in Indonesia. The results of the discussion explain: in the Radicalism section, the government emphasizes the importance of Pancasila and the Law as the basis of life so as not to deviate and be radical about the order of the Indonesian state. While in the Religious Extremism section which leads to acts of terrorism, the government issued regulations PP No. 77 of 2019 concerning the Prevention of Criminal Acts of Terrorism and Law No. 5 of 2018 concerning Eradication of Criminal Acts of Terrorism, besides that prevention is carried out through religious-based educational institutions and community efforts through social media and community organizations. The value of legal philosophy shown is through a deep understanding of radicalism and religious extremism in Indonesia which is extracted from religious, social and political values. Abstract

Marriage is a sacred institution in Islam that governs the lawful relationship between men and women based on sharia. One of the essential requirements for a valid marriage involving a woman is the presence of a legal guardian (wali). Problems arise when a female convert to Islam (muallafah) has no Muslim guardian. This article aims to analyze the role and legal status of the wali hakim (judge guardian) in the marriage of converts according to Islamic Family Law in Indonesia. The research applies a qualitative approach using library research methods with sources including the Qur'an, hadith, Islamic jurisprudence, national regulations, and academic literature. The findings indicate that the wali hakim has both sharia and legal authority to act as a marriage guardian in specific circumstances, such as the absence or disqualification of a biological guardian. The function of the wali hakim is carried out by an official from the Office of Religious Affairs (KUA) based on provisions from the Compilation of Islamic Law (KHI) and Regulation of the Minister of Religious Affairs No. 20 of 2019. Therefore, the presence of the wali hakim is a valid legal solution that ensures the legitimacy of a convert’s marriage and protects their religious rights within the framework of Islamic and national law.

Abstract

Maraknya praktik pinjaman online ilegal di Indonesia telah menimbulkan krisis sosial dan ekonomi yang signifikan, mulai dari bunga eksploitatif hingga penyalahgunaan data dan intimidasi dalam penagihan. Urgensi perlindungan konsumen dan penciptaan sistem pembiayaan yang etis mendorong pentingnya mengeksplorasi pinjaman online berbasis syariah (pinjol syariah) sebagai solusi alternatif. Artikel ini bertujuan untuk menganalisis secara konseptual dan normatif potensi pinjol syariah dalam merespons fenomena pinjol ilegal di Indonesia. Penelitian ini menggunakan pendekatan kualitatif-deskriptif melalui studi pustaka dengan sumber data meliputi regulasi OJK, fatwa DSN-MUI, situs resmi platform fintech syariah, serta jurnal-jurnal terakreditasi. Teknik analisis yang digunakan adalah content analysis dan pendekatan hermeneutik hukum Islam. Hasil penelitian menunjukkan bahwa pinjol syariah beroperasi dengan landasan akad yang sah, transparansi margin, dan prinsip keadilan, berbeda secara fundamental dengan pinjol ilegal yang melanggar norma hukum dan etika. Meskipun memiliki potensi besar sebagai solusi keuangan yang etis, implementasi pinjol syariah masih menghadapi tantangan literasi masyarakat, keterbatasan akses digital, dan trust issues. Regulasi seperti POJK No. 77/2016 dan Fatwa DSN-MUI No. 117/2018 telah memberikan dasar hukum, namun masih dibutuhkan regulasi teknis yang lebih adaptif. Kesimpulannya, pinjol syariah berperan strategis dalam membentuk ekosistem fintech yang inklusif dan berkeadilan, asalkan disertai sinergi antara regulator, platform, dan edukasi publik yang masif. Penelitian selanjutnya disarankan mengevaluasi dampak sosial-ekonomi langsung dari implementasi pinjol syariah pada kelompok masyarakat rentan.

Abstract

Handling criminal acts involving children in motorcycle gangs is a crucial step regulated by national criminal law and Islamic law with an emphasis on child protection and moral development and the future of these children. The purpose of this study is to evaluate existing legal regulations, identify challenges in their implementation, and analyze efforts made to prevent criminal acts by children in motorcycle gangs in Bangun Sari Village, Tanjung Morawa District. The method used in this study is juridical-empirical with a case study approach, which includes interviews with the police and field data analysis. The research findings show that the preventive approach is carried out through active involvement of families, schools, and communities; the repressive approach is applied as a last resort with the principle of ultimum remedium; while the rehabilitative approach focuses on development and restorative justice. The challenges faced include technical limitations such as facilities and human resources, legal obstacles in aligning regulations, and the social impact of the environment and media. This study concludes that collaboration between preventive, repressive, and rehabilitative approaches is essential to create a supportive atmosphere in preventing deviant behavior in children. The police are implementing preventive measures consisting of preventive efforts, namely actions taken before a crime occurs, as well as enforcement measures, namely actions taken after a crime occurs.
