Abstract

Fornication is a kind of jarimah (felony) resulting in confusion of the biological father. However, nowadays, there is clarity on the status of the children out of marriage. The Constitutional Court issued a decision of regulation No. 46/PUU-VIII/2010 on February 27th, 2012 about the out wedlock children who have a civil relationship and the blood rapport with their biological father as long as it can be proven biologically. This regulation drives some criticisms from various parties; the pro-side of the Court Regulation will claim it in the term of the doer of the adultery, while the contra-side of the Court Regulation will review it in the term of legalized the adultery. Furthermore, the aims of this study are: First, to know the opinion of jurists' law (fuqaha‟) about the status of the out of wedlock children; Second, to find the legal implications of the out of wedlock children after the application of the Constitutional Court regulation No. 46/PUU-VIII/2010 on February 27th, 2012 based on the Fuqaha' perspective?. Moreover, this study uses the library research. The data are collected through the documentary of the primary and secondary data sources. The collected data are, then, analyzed qualitatively by using the content analysis. The results of this study are: Firstly, This according by the Shafi'i jurists' of four and the ad-Dzahiri the out of wedlock children (bastard) are not related to their biological father, but they are related to their biological mother and her family. Secondly, This according by some groups of Hanafi and Shaykh of Islam Ibn Taymiyah corroborated by ibn Qayyim al-Jauziyyah the wedlock children (bastard) are related to the men as their biological father and their father's family. Thirdly, the Constitutional Court (MK) regulations do not have any legal implications associated on the civil relationships of the out wedlock children (natural children) with their biological father. Moreover, the attitude of the biological father is classified as a jarimah (felony), and it is entitled to a penalty of the ta'zir; it is an obligation to provide the children, which the amount is considered to the fit and proper in accordance income of his; while the other civil rights includes the right of lineage, inheritance, and the rights of guardians. The ta'zir punishments in the provision of livelihood can be executed after the filing of a lawsuit and obtain an order from the Religion Court. The provision of the living is solely to satisfy the justice and legal protection for the interests of children's rights.

Abstract

A way for developing good writing skills is by using thematic progression. It can help students improve their writing abilities. Theme and rheme are used to analyze the thematic progression. This study aimed to find out the types of thematic progression of students' descriptive texts and the most dominant pattern of thematic progression in students’ descriptive texts. The researcher used the descriptive qualitative method in the research design. There were 50 texts written by students at SMP Swasta Sultan Agung Pematangsiantar. The data was analyzed using (Eggins, 2005) theory as the theoretical framework that found three types of thematic progression. The findings revealed that the students' descriptive texts follow three thematic progression patterns: reiteration or constant pattern, zig-zag or linear pattern, and multiple patterns or split rheme pattern. The constant pattern was the most dominant used by students in 271 occurences (91.80%), followed by zig-zag or linear pattern occurred 13 times (4.4%) and multiple patterns or split rheme pattern occurred 11 times (3.8%)l. The findings show students, in writing descriptive text, tend to use simple thematic progression due to their level of knowledge in grammar and thematic progression is relatively low.

Abstract

This study dealt with effort of finding the lexical and grammatical ambiguity in English textbook of Bahasa Inggris for the tenth grade. The objectives of the study were to find out the types of ambiguity and to find out the dominant types of ambiguity in Bahasa Inggris of the tenth grade. The numbers of the data were 21 of reading texts which were taken from English textbook of Bahasa Inggris of the tenth grade. The types of ambiguities were identified based on Fromkin et al theory. The research design used in this research is descriptive qualitative. The data were analyzed by Identifying , classifying, tabulating and interpreting. From 21 reading texts, there were 27 sentences that contained ambiguous meaning. There are two types of ambiguity found in reading texts, they were lexical and grammatical ambiguity. The lexical ambiguity consisted of homonym, polysemy and antonym. While grammatical ambiguity consisted of coordinate structure, negation scope, active or passive meaning, gerund + object or participle modifying a noun, prepositional phrase (PP) as modifier or sentence adjunct, and a head of inner modifier and outer modifier. The dominant type of lexical ambiguity was homonymy with 6 occurrences (20.68%). While the dominant type of grammatical ambiguity was coordinate structure as many as 8 occurrences (27.59%).

Abstract

Purpose of this study was to answer two problems: (i) how is the guardian of the constitution embodied through the function of the Constitutional Court; and (ii) how the Constitutional Court as the guardian of the constitution reduces constitutions that are indicated by the policy corruption. Policy corruption is an invisible and covert element that able to threaten the synergy of the legal system and the public interest. The form of policy corruption is realized in the form of a law. Efforts that can be made to reduce the policy corruption are to implement the tight control over the media, which in this case is relevant to the function of the Constitutional Court. This studywas classified as doctrinal research with primary and secondary legal materials. Comparative approach and case approach were used to answer the legal issues. The results showed that: First, the guardian of the constitution through the function of the Constitutional Court through the optimization of the Constitutional Court Judges as the agent of constitution, strengthening the execution of the Constitutional Court decisions and collaborative steps with other state institutions in enforcing the constitutional guardianship. Second, the Constitutional Court as the guardian of the constitution in reducing laws indicated by the policy corruption is manifested in the form of a Constitutional Court decision that can be retroactive to recover the impact of legal losses that are indicated by the policy corruption, the decision of Constitutional Courtis justified by ultra vires to anticipate the chain of constitutions that indications of policy corruption, the decision of Constitutional Courtis strengthened in terms of its execution and the Court can examine or test the Constitution Drafting (bill/ RUU) (a priori review) as a preventive measure to prevent the enactment of laws that indicate policy corruption.

Abstract

The objective of this scientific paper is to understand the role of financial literacy for Business Sustainability at PT Olam Makassar.  This scientific paper used descriptive qualitative method which described the observation and interview results. To get data, the writer observed and interviewed the employees of PT Olam Makassar which resposible for  financial literacy for Business Sustainability. The result of the research obtained such as : the role of financial literacy for Business Sustainability implemented and related elements to the financial literacy for Business Sustainability at PT Olam Makassar. Based on the research, it can be concluded that by having knowledge about good financial literacy, one can make sustainable business concept, therefore its business sustainability can be maintained.

Abstract

The background of this research is to know the background of the influence of the covid-19 virus and learning online on the education system for Islamic religious subjects whether the covid-19 virus which is now a resident throughout the world affects the learning system in Indonesia, especially subjects Islam and whether online learning media is a very appropriate medium to be applied to the teaching and learning system that exists during the current pandemic. The method used in this research is to use a quantitative method using a survey tool conducted to 100 people who were randomly selected with the survey tool, the data obtained will be able to represent the original data in the field and be able to find out the actual results. The thing that will be found in this research is how to find out the relationship between Covid-19 and the learning system and how this online learning system affects the learning system on Islamic religious subjects. Therefore, what variables affect it can be seen in this study. In this study will produce data that will be able to find out what variables affect Islamic religious subjects, especially the teaching and learning system in Indonesia and what variables affect the current pandemic, therefore variables must be determined carefully and can affect dependent variable. Abstract

The role of external institutions in education quality assurance is very important in the External Quality Assurance System (SPME). This research is about the Implementation of Education Quality Assurance in North Sulawesi especially at Bitung City and Tomohon City. This research was conducted on planning the quality of education, quality of education, and evaluation of the quality of education in the Department of Education and Culture of Bitung City and Tomohon City. The research problems are: 1) How is the quality of education planning in Bitung City and Tomohon City?; and2) How is the implementation of the quality of education in Bitung City and Tomohon City?.This study used a qualitative approach with descriptive methods designed for a multi-site study design. Data were collected through observation, interviews and documentation. The data analysis used includes simultaneous process flow of activities, namely data reduction, data presentation, and conclusions.The results of this study indicate that: 1) Education quality planning in Bitung City and Tomohon city is carried out through joint meetings to focus more on program activities and strengthen appropriate and targeted activity programs. Planning for quality fulfillment in Bitung City is the result of recommendations for improvement from quality mapping activities, namely quality data analysis, namely standards, recommendations for improvement, volume, funding requirements. Quality planning in Tomohon City is carried out by implementing the implementation steps of the preparation of a quality fulfillment plan within the Tomohon City Education and Culture Office carried out by forming a regional education quality assurance team (TPMPD).2) Implementation of Education Quality Fulfillment in Bitung City is focused on process standards, facilities and infrastructure standards and educator standards. This is adjusted to the conditions during the COVID-19 pandemic. Teacher Competency Improvement Program, namely activities carried out in the form of Distance Learning (PJJ) socialization, RPP Simplification Workshop, and Basic Competency Analysis. The implementation of quality fulfillment is carried out online and face-to-face for certain areas that are difficult to connect to the internet by paying attention to health protocols.

Abstract

This study aims to analyze the effect of the General Allocation Fund (DAU) and Special Allocation Fund (DAK) variables on capital expenditures. In addition, this study uses the role of intervening variables to analyze the effect of these variables. The data source for this research uses secondary data sources originating from the Director General of Fiscal Balance of the Regional Government. Respondents in this study were local governments in Central Java with a total of 35 regencies and cities for the period 2016-2019. The results of the analysis show that the DAU variable has a positive and significant effect on capital expenditure while the DAK variable has no significant effect on the modal expenditure variable. In addition, the results of the analysis also show that the variable Economic Growth (PE) is not a variable that mediates the effect of DAU on capital expenditure, while further analysis shows that PE is a variable that mediates the effect of DAK on capital expenditure.

Abstract

The background of this research is by prioritizing how to improve the safety of passengers on a vehicle with increased security so that if an accident occurs, the passenger does not suffer any injury. If necessary, it is not scratched on the body. With this research, it is necessary to increase security in order to provide maximum protection. for passengers and motorists. The method used in this study using the literature review method based on research that has been done previously so that it can be the basis for this research. With the literature review, the research will be able to find new research problems so that this research can be the latest research in order to serve as the basis for future research. In this study, we will find out how to protect passengers on a vehicle with ways that passengers can do so that the security side can be improved. Therefore, the use of security in a vehicle is very important so that it can help drivers and passengers in driving. In this study will produce a proposed system that can be used as a basis as a guide in order to protect passengers and motorists and can improve the safety side of driving.
