Abstract

The increase in land buying and selling activities occurs as a result of an increase in the community's need for land. This buying and selling activity is a form of the process oftransferring ownership rights to land. However, in practice there is still a lot of buying and selling done under the hands. This sale and purchase is not carried out before the PPAT, but is carried out on the basis of mutual trust between the buyer and seller. The sale and purchase of landrights under this hand will be very detrimental to the buyer, because legal certainty for the buyer has not been fulfilled. Normative legal research methods from secondary data sources. The transfer of rights through underhand buying and selling begins with deliberation. After an agreement ismade, the price is determined and the handover is carried out, which is attended by the Village Head, RT Chair, Customary Leaders, witnesses. As evidence that the sale and purchase of land had taken place, then a sale and purchase statement was made signed by the Village Head,seller and buyer, and two witnesses, stamped by the village, there was proof of payment in the form of a receipt and stamped. The legal consequences of buying and selling under the hands are still valid because the legal conditions for buying and selling according to the UUPA have beenfulfilled, namely cash, clear, real. Meningkatnya kegiatan jual beli tanah terjadi akibat dari adanya peningkatan kebutuhan masyarakat akan tanah. Kegiatan jual beli ini adalah sebagai salah satu bentuk proses peralihan hak milik atas tanah. Akan tetapi dalam prakteknya masih banyak jual beli dilakukan di bawah tangan. Jual beli ini tidak dilakukan dihadapan PPAT, akan tetapi dilakukan atas dasar saling percaya antara pihak pembeli dan penjual. Jual beli hak atas tanah dibawah tangan ini akan sangat merugikan bagi pihak pembeli, karena kepastian hukum untuk pembeli belum dapat terpenuhi. Metode penelitian hukum normatif dari sumber data sekunder. Peralihan hak melalui jual beli di bawah tangan dimulai dengan musyawarah. Setelah adanya kesepakatan kemudian menentukan harga dan dilakukan serah terima, yang dihadiri oleh Kepala Desa, Ketua RT, Ketua Adat, saksi-saksi. Sebagai alat bukti telah terjadi jual beli tanah, kemudian dibuat pernyataan jual beli ditanda tangani Kepala Desa, penjual dan pembeli, dan dua orang saksi, di stempel oleh desa, ada bukti pembayaran berupa selembar kuitansi dan bermaterai. Akibat hukum jual beli di bawah tangan adalah tetap sah karena sudah terpenuhi syarat sah jual beli menurut UUPA, yaitu bersifat tunai,terang, riil

Abstract

Village Assets are one of the assets belonging to the Village Government that are utilized and managed for a business activity which will later become one of the sources of Village income. One of the village assets that can be managed by the village is in the form of village treasury land. In the management of this Village Cash Land, it must be in accordance with the provisions of the applicable laws and regulations. However, there are often cases of abuse in the management of Village Treasury Land by the Village Head, therefore there is a need for law enforcement in the problem of misuse of Village Treasury Land management. The purpose of this study was to find out about the management of Village Cash Land by the Village Head in Pusporenggo Village, Musuk District, Boyolali Regency and to find out the obstacles faced in managing Village Cash Land in Pusporenggo Village, Musuk District, Boyolali Regency. The research method used in this study is a research with an empirical juridical approach, where the data are taken directly and real from the results of interviews and literature studies. The results of research on the management of village treasury land in Pusporenggo Village have been carried out in accordance with the Regulation of the Minister of Home Affairs Number 1 of 2016, which is managed through leases and cooperation in the use of buildings for handover, namely in the form of renting shop houses, renting land for agriculture, building construction. Meetings that are rented out for receptions, construction of dams in cooperation with PDAM, and construction of soccer fields. In managing the village treasury land in Pusporenggo Village, it is through an auction system. The obstacle in managing village treasury land in Pusporenggo Village is that there are still many tenants who violate the contents of the lease agreement that was agreed upon at the beginning, namely the rent payment is in arrears by the tenant. It is hoped that the Village Government will give strict sanctions to village treasury land tenants who are in arrears in their rent payments. Aset Desa adalah merupakan salah satu kekayaan milikPemerintah Desa yang dimanfaatkan dan dikelola untuk suatu kegiatan usaha yang nantinya akan menjadi salah satu sumber pendapatan Desa. Salah satu aset desa yang dapat dikelola oleh desa adalah berupa tanah kas desa. Dalam pengelolaan atas Tanah Kas Desa ini haruslah sesuai dengan ketentuan dalam peraturan perundang-undangan yang berlaku. Akan tetapi seringkali terjadi beberapa kasus terhadap penyalahgunaan dalam pengelolaan Tanah Kas Desa oleh Kepala Desa, maka dari itu perlu adanya penegakan hukum dalam permasalahan penyalahgunaan pengelolaan Tanah Kas Desa. Tujuan penelitian ini adalah untuk mengetahui tentang pengelolaan Tanah Kas Desa oleh Kepala Desa di Desa Pusporenggo Kecamatan Musuk Kabupaten Boyolalidan mengetahui hambatan yang dihadapi dalam pengelolaan Tanah Kas Desa di Desa Pusporenggo Kecamatan Musuk Kabupaten Boyolali.Metode penelitian yang digunakan dalam penelitian ini adalah penelitian dengan pendekatan yuridis empiris, dimana data diambil secara langsung dan nyata dari hasil wawancara dan studi pustaka. Hasil penelitian tentang pengelolaan tanah kas desa di Desa Pusporenggo telah berjalan sesuai dengan Peraturan Menteri Dalam Negeri Nomor 1 Tahun 2016, yaitu dikelola dengan melalui sewa dan kerjasama pemanfaatan bangun guna serah, yaitu berupa sewa bangunan ruko-ruko, sewa tanah untuk pertanian, pembangunan gedung pertemuan yang disewakan untuk acara resepsi, pembuatan embung kerjasama dengan PDAM, dan pembangunan lapangan sepak bola. Dalam pengelolaan tanah kas desa di Desa Pusporenggo ini dengan melalui sistem lelang. Adapun hambatan dalam pengelolaan tanah kas desa di Desa Pusporenggo adalah masih banyak penyewa yang melakukan pelanggaran terhadap isi perjanjian sewa yang telah disepakati di awal, yaitu menunggaknya pembayaran uang sewanya oleh pihak penyewa. Diharapkan Pemerintah Desa memberikan sanksi yang tegas kepada penyewa tanah kas desa yang menunggak pembayaran sewanya.

Abstract

This comparative study as a method is used to compare two legal systems in Indonesia by the theme the application of sanctions toward the of murder from the Criminal Code and Islamic law’s perspective. This study aims to; (1) investigate the application of sanctions against the perpetrators of murder from the Criminal Code and Islamic Law’s perspective. (2) Discover the obstacles and solutions toward the application of Islamic law against the murder’s crime in Indonesia. This normative legal study used comparative approach. The data was obtained by secondary source. The data collected through literature study and interviews. This study showed that in the Criminal Code, the crime of murder divided into two types; intentional murder and unintentional murder. The punishment refers to Article 10 of the Criminal Code namely; death penalty, imprisonment, imprisonment and additional punishment While, Islamic law categorized three types of murder; intentional murder, unintentional murder and semi-intentional murder which are stated in the Qur’an and Hadith. The punishments are namely; qisas, diyat, kifarat and ta'zir. There are several obstacles toward the application of Islamic law against the crime of murder in Indonesia. First, Indonesia is not an Islamic country. Second, Indonesian criminal law is based national legal system. Third, the qisas punishment is contrary to human rights activist. Therefore, the solution that can be taken is Indonesia adapts the Islamic law in some measure. Studi komparatif sebagai metode penelitian dengan membandingkan dua sistem hukum atau lebih yang berlaku di Indonesia, penelitian ini mengambil tema perbandingan penerapan sanksi terhadap pelaku tindak pidana pembunuhan dalam perspektif KUHP dan hukum Islam. Penelitian ini bertujuan untuk; (1) mengetahui penerapan sanksi terhadap pelaku tindak pidana pembunuhan dilihat dari perspektif KUHP dan hukum Islam. (2) mengetahui kendala dan solusi dalam penerapan sanksi pidana Islam terhadap pelaku tindak pidana pembunuhan di Indonesia. Penelitian ini merupakan penelitian hukum normatif yang menggunakan metode pendekatan perbandingan. Sumber data yang digunakan dalam penelitian ini adalah data sekunder. Metode pengumpulan data yang digunakan adalah studi kepustakaan dan wawancara. Hasil penelitian ini menunjukkan bahwa tindak pidana pembunuhan dalam KUHP dibedakan menjadi dua macam yaitu; pembunuhan sengaja dan pembunuhan tidak sengaja. Sanksinya merujuk pada pasal 10 KUHP yaitu; berupa pidana mati, pidana penjara, pidana kurungan dan pidana tambahan. Sedangkan hukum Islam membagi tindak pidana pembunuhan menjadi tiga macam, yaitu; pembunuhan sengaja, pembunuhan tidak sengaja dan pembunuhan semi sengaja, yang diatur dalam Al-Qur’an dan Hadist. Sanksinya berupa; hukuman qisas, hukuman diyat, hukuman kifarat dan hukuman ta’zir. Penerapan sanksi pidana Islam terhadap pelaku tindak pidana pembunuhan di Indonesia terdapat beberapa kendala, yaitu: pertama; Indonesia bukan negara Islam sehingga tidak menerapkan hukum Islam. Kedua; sistem hukum pidana Indonesia bukan Al-Qur’an dan Hadist tetapi berdasarkan Undang-Undang. Ketiga; hukuman qisas betentangan dengan aktivis HAM. Oleh karena itu terdapat solusi yang bisa diambil yaitu Indonesia dapat menerapkan kaidah-kaidah yang sudah diatur oleh hukum Islam.

Abstract

DETERMINATION OF VILLAGE FUND AS A FORCE MAJEUR IN HANDLING CORONA VIRUS DISEASE 2019 IN GEMAWANG VILLAGE 2020-2022 Gemawang Village is one of the villages in Jambu District, Semarang Regency which implements Law Number 6 of 2014 concerning Villages, but in determining the different 2019 Corona Virus Disease handling budgets in 2020-2022 which is mandatory in the budget, it requires a sufficient process. long considering that the determination of the budget has been determined in the previous year. Some of the problems that arise as a result of the Corona Virus Disease 2019 pandemic require several problem formulations in completing the budget changes that have been set, so that everything can be carried out in accordance with the government's expectations but does not leave the basis for determining the deliberation set by the village and approved by the Village Consultative Body. The purpose of this study was to find out about village procedures in force majeure in determining the budget for handling Corona Virus Disease 2019 in Gemawang Village in 2020 to 2022 based on Law Number 6 of 2014 concerning Villages. In Gemawang Village, Jambu District, Semarang Regency, this research uses an empirical juridical approach which examines the process of determining the budget process for determining the 2019 Corona Virus Disease Handling Budget in Gemawang Village, Jambu District, Semarang Regency. Some of the benefits for the author in compiling this thesis, one of which is to fulfill the requirements for a Bachelor of Law, knowing the process in determining the Corona Virus Disease 2019 budget in Gemawang Village, as a legal research study on Force Majeure in Determining the 2019 Corona Virus Disease Management Budget in Gemawang Village. The results of the research on the determination of the Village Fund as a Force Majeur in Handling Corona Virus Disease 2019 in Gemawang Village in 2020 - 2022, are in accordance with Law No. 6 of 2014 concerning Villages, Ministerial Regulations and Presidential Regulations, this proves that the Gemawang Village Government has implemented regulations set by the government to protect citizens from the spread of covid-19 with a budget sourced from the Village Fund for handling Corona Virus Disease 2019 in Gemawang Village, in a state of force (force majeure) as a non-natural disaster determined by the central government which has an impact on the determination a budget managed by the village sourced from the State Revenue and Expenditure Budget. PENETAPAN DANA DESA SEBAGAI FORCE MAJEUR DALAM PENANGANAN CORONA VIRUS DISEASE 2019 DI DESA GEMAWANG TAHUN 2020-2022 Desa Gemawang adalah salah satu Desa di Kecamatan Jambu Kabupaten Semarang yang melaksanakan Undang-Undang Nomor 6 Tahun 2014 tentang Desa, namun dalam penetapan anggaran penangganan Corona Virus Disease 2019 yang berbeda-beda pada tahun 2020-2022 yang wajib di anggaran, membutuhkan proses yang cukup panjang mengingat bahwa penetapan anggaran sudah di tetapkan ditahun sebelumnya. Beberapa permasalahan yang timbul dari akibat pendemi Corona Virus Disease 2019 dibutuhkan beberapa rumusan masalah dalam menyelesaikan perubahan anggaran yang sudah ditetapkan, agar semua dapat terlaksana sesuai dengan harapan pemerintah namun tidak meninggalkan dasar penetapan musyawarah yang ditetapkan desa dan disetujui oleh Badan Permusyawaratan Desa. Tujuan penelitian ini untuk mengetahui tentang tata cara desa dalam force majeure dalam menetapkan anggaran penanganan Corona Virus Disease 2019 di Desa Gemawang di tahun 2020 sampai dengan Tahun 2022 berdasarkan Undang-undang Nomor 6 Tahun 2014 Tentang Desa. Di Desa Gemawang Kecamatan Jambu Kabupaten Semarang penelitian ini adalah menggunakan pendekatan yuridis empiris di mana mengkaji proses proses penetapan anggaran penetapan Anggaran Penanganan Corona Virus Disease 2019 di Desa Gemawang Kecamatan Jambu Kabupaten Semarang. Beberapa manfaat penulis dalam menyusun skripsi ini, salah satunya untuk memenuhi syarat Sarjana Hukum, mengetahui proses dalam penetapan anggaran penangganan Corona Virus Disease 2019 di Desa Gemawang, sebagai kajian penelitian hukum tentang Force Majeure dalam Penetapan Anggaran Penangganan Corona Virus Disease 2019 di Desa Gemawang. Hasil Penelitian Penetapan Dana Desa Sebagai Force Majeur Dalam Penanganan Corona Virus Disease 2019 Di Desa Gemawang Tahun 2020 - 2022, sudah sesuai dengan Undang-Undang No 6 Tahun 2014 Tentang Desa, Peraturan Menteri dan Peraturan Presiden , Hal ini membuktikan bahwa Pemeritah Desa Gemawang telah melaksanakan peraturan yang ditetapkan oleh pemerintah untuk melindungi warga masyarakat dari penyebaran covid-19 dengan anggaran yang bersumber dari Dana Desa untuk penanganan Corona Virus Disease 2019 Desa Gemawang, dalam keadaan memaksa ( force majeure ) sebagai bencana non alam yang ditetapkan oleh pemerintah pusat yang berdampak pada penetapan anggaran yang dikelola oleh desa yang bersumber dari Anggaran Pendapatan Dan Belanja Negara.

Abstract

The administration of the state is identical with power based on authority. For example, in the local government environment, namely the authority in the field of transportation for parking matters, which in the Boyolali Regency Government is contained in Local regulations number 19 of 2016 concerning Parking Management, which is carried out by the Department of Transportation. The implementation of good parking is intended to support development and economic growth and ensure safety, smoothness, order, security and comfort. However, in reality there are still parking activities that are not appropriate and interfere with safety, smoothness, order, security, and comfort, both for motorists using road users and pedestrians using sidewalks. The purpose of this study was to determine the implementation of the Regional Regulation on Parking Management and the obstacles faced. This research is a descriptive research with an empirical juridical approach. By collecting primary data by conducting interviews with officials at the Department of Transportation in charge of parking matters, namely the Head of the Operational Supervision and Violation Enforcement Section. Based on the results of the study, it is understood that the implementation of Local regulations number 19 of 2016, which was carried out by the Department of Transportation was followed up by Local regulations of Boyolali Regency number 12 of 2021 concerning Public Service Retribution, Local regulations of Boyolali Regency number 13 of 2021 concerning Business Services Retribution, and Decree of the Head of the Department of Transportation number 189.6/028/4.11/2021 concerning Standard Operating Procedures at the Department of Transportation. For obstacles, there are budget allocations for the completeness of parking officers, the number of employees who are still lacking, as well as facilities for moving vehicles in the form of locks and vehicle cranes and there are still parking activities that are not in accordance with the provisions. Thus, additional budget allocations, additional staff and facilities, as well as strengthening the duties, functions, and roles of the Department of Transportation still need to be improved by the Boyolali Regency Government. Penyelenggaraan negara identik dengan kekuasaan didasarkan wewenang. Contohnya dalam lingkungan pemerintah daerah, yaitu pada kewenangan bidang perhubungan urusan perparkiran yang mana di Pemkab Boyolali tertuang dalam Perda nomor 19 tahun 2016 tentang Penyelenggaraan Perparkiran, yang dilaksanakan oleh Dinas Perhubungan. Penyelenggaraan parkir yang baik dimaksudkan agar menunjang pembangunan dan pertumbuhan ekonomi serta menjamin keselamatan, kelancaran, ketertiban, keamanan, dan kenyamanan. Namun pada kenyataannya masih terdapat kegiatan parkir yang tidak sesuai dan mengganggu keselamatan, kelancaran, ketertiban, keamanan, dan kenyamanan, baik bagi pengendara kendaraan bermotor pengguna jalan maupun pejalan kaki pengguna trotoar. Tujuan penelitian ini untuk mengetahui pelaksanaan Perda Penyelenggaraan Perparkiran dan hambatan yang dihadapi. Penelitian yang dilakukan adalah penelitian deskriptif dengan metode pendekatan yuridis empiris. Dengan pengambilan data primer dengan melakukan wawancara dengan pejabat pada Dinas Perhubungan yang membidangi urusan perparkiran yaitu Kepala Seksi Pengawasan Operasional dan Penindakan Pelanggaran. Berdasarkan hasil penelitian dipahami bahwa pelaksanaan Perda nomor 19 tahun 2016, yang dilaksanakan oleh Dinas Perhubungan ditindaklanjuti dengan Perda Kabupaten Boyolali nomor 12 tahun 2021 tentang Retribusi Jasa Umum, Perda Kabupaten Boyolali nomor 13 tahun 2021 tentang Retribusi Jasa Usaha, dan Surat Keputusan Kepala Dinas Perhubungan nomor 189.6/028/4.11/2021 tentang Standar Operasional Prosedur pada Dinas Perhubungan. Untuk hambatan terdapat pada alokasi anggaran untuk kelengkapan petugas parkir, jumlah pegawai yang masih kurang, maupun sarana untuk pemindahan kendaraan yang berupa gembok dan derek kendaraan serta masih ada kegiatan parkir yang tidak sesuai ketentuan. Dengan demikian, penambahan alokasi anggaran, penambahan pegawai, dan sarana, serta penguatan tugas, fungsi, dan peran Dinas Perhubungan masih perlu ditingkatkan oleh Pemerintah Kabupaten Boyolali.

Abstract

Empirical juridical, criminal acts of not obeying an official order)Indonesian National Amed Force (TNI) as a means of state defense requires high discipline from its soldiers. Various efforts and regulations have been made in order to maintain this discipline, however, as an organization, TNI cannot be separated from various problems that can interfere with the implementation of its duties caused by various factors. One of these problems is the crime of withdrawing from the unit as committed by Anjas Widiastama (the defendant), rank/SN: Sargent/21170039431196, Squad Commander 1/II/C Military Police Batalyon of Indonesian Army Military Police Centre. There are two formulations of the problem specified in the writing of this thesis. First, how to apply sanctions for criminal acts of not obeying an official order. Second, how are the obstacles of the military court in resolving criminal acts of not obeying an official order. This paper was made by conducting research using empirical juridical methods with a statutory approach, cases that occurred and conceptual. The form of research in writing this thesis is descriptive which means this research focuses on explaining the object of research in order to answer what events or phenomena occur so that it is expected to be a problem solver if the same event occurs again in the future. The depiction designed to obtain the necessary information is carried out by going down the field to conduct observations and interviews in order to collect primary and secondary data. The crime of not obeying an official order regarding absence without permission in this study is regulated in article 86 of the KUHPM paragraph 1. The condition of military absence in the fact that this incident occurred with reasons or motivations that did not endanger the institution or the state and constituted a minor offense. The imposition of sanctions for criminal acts that occurred by the panel of judges by applying Article 86 of the 1st KUHPM was considered fair in base on the evidence. The obstacles that exist for the military court II-08 Jakarta regarding disobiente of an official order made by Sergeant Anjas Widiastama have been handle base on the law. Tentara Nasional Indonesia (TNI) sebagai alat pertahanan negara memerlukan kedisipilinan yang tinggi dari para Prajuritnya. Berbagai upaya dan aturan telah dibuat dalam rangka menjaga kedisiplinan itu, namun demikian sebagai sebuah organisasi bukan berarti TNI bebas dari masalah-masalah yang dapat mengganggu pelaksanaan tugas yang disebabkan oleh berbagai faktor. Salah satu permasalahannya adalah tindak pidana kejahatan menarik diri dari kesatuan seperti yang dilakukan oleh Anjas Widiastama (terdakwa), pangkat/NRP: Serda/21170039431196, danru 1/II/C Yonpomad Puspomad. Ada dua rumusan masalah yang ditentukan dalam penulisan skripsi ini. Pertama bagaimana penerapan sanksi perbuatan tindak pidana tidak mentaati suatu perintah dinas. Kedua bagaimana kendala peradilan militer dalam menyelesaikan tindak pidana tidak mentaati suatu perintah dinas. Tulisan ini dibuat dengan melakukan penelitan yang menggunakan metode yuridis empiris dengan undang-undang sebagai pendekatannya (Statute Approach), kasus yang terjadi (Case Approach) dan konseptual (Conceptual Approach). Bentuk penelitian dalam penulisan skripsi ini adalah deskriptif yang bermakna penelitian ini fokus pada menjelaskan objek penelitian guna menjawab peeristiwa atau fenomena apa yang terjadi sehingga diharapkan dapat menjadi pemecah masalah bila peristiwa yang sama terjadi lagi dimasa depan. Penggambaran yang dirancang untuk memperoleh keterangan-keterangan yang diperlukan dilakukan dengan turun kelapangan untuk melakukan observasi dan wawancara guna mengumpulkan data-data primer dan sekunder. Tindak Pidana tidak mentaati suatu perintah dinas mengenai ketidakhadiran tanpa izin dalam penelitian ini diatur dalam pasal 86 KUHPM ayat 1 (satu). Kondisi ketidakhadiran militer dalam fakta peristiwa ini terjadi dengan alasan atau motivasi yang tidak membahayakan institusi atau negara dan merupakan pelanggaran yang ringan. Pemberian sanksi atas perbuatan tindak pidana yang terjadi oleh majelis Hakim dengan menerapkan Pasal 86 ke-1 KUHPM dinilai sudah adil sesuai dengan bukti-bukti yang ada dipersidangan. Melalui pemberian keputusan ini maka dapat dikatakan bahwa kendala yang ada bagi peradilan militer II-08 Jakarta dalam menyelesaikan perkara tindak pidana tidak mentaati suatu perintah dinas yang dilakukan oleh Serda Anjas Widiastama telah dapat diatasi sesuai dengan aturan yang berlaku.

Abstract

Tulisan ini bermaksud untuk mengkaji dan menganalisis pengaturan yuridis tentang perlindungan anak dari kelompok minoitas di Indonesia dalam upaya perlindungan dan pencegahan terhadap kekerasan dan diskriminasi. Penelitian dengan menggunakan pendekatan yuridis normative ini menemukan bahwa telah ada instrument hukum, baik internasional maupun nasional yang mengatur tentang perlindungan hukum terhadap anak dari kelompok minoritas di Indonesia. Namun masih ada sedikit kelemahan dalam pengaturan regulasi khususnya dalam undang-undang No. 35 Tahun 2014 tantang perlindungan Anak yang belum konsisten menggunakan terminologi “anak kelompok minoritas” dalam beberapa pasalnya, yang tentunya akan berdampak pada penerapan hukum oleh aparat penegak hukum khususnya Jaksa Penuntut umum dalam mengkostruksi dakwaannya. Oleh Karena itu, bagi penulis, perlu dikaji kembali beberapa pasal yang berkaitan dengan perlindungan terhadap anak kelompok minoritas sehingga dapat mencegah kekekrasan dan diskriminasi. Kata Kunci: Hukum, Anak, Minoritas, Kekerasan, Diskriminasi Abstract This paper intends to examine and analyze the juridical arrangements regarding the protection of children from minority groups in Indonesia in an effort to protect and prevent violence and discrimination. This research using a normative juridical approach finds that there are legal instruments, both international and national, that regulate the legal protection of children from minority groups in Indonesia. However, there are still some weaknesses in regulatory arrangements, especially in Law no. 35 of 2014 concerning the protection of children who have not consistently used the term "minority group children" in several articles, which of course will have an impact on the application of the law by law enforcement officials, especially the public prosecutor in constructing their indictments. Therefore, for the author, it is necessary to review several articles relating to the protection of children from minority groups so as to prevent violence and discrimination. Abstract

Simple lawsuits in Indonesia are used formally in the Supreme Court Regulation of the Republic of Indonesia Number 4 of 2019 concerning Amendments to Supreme Court Regulation Number 2 of 2015 concerning Procedures for Settlement of Simple Claims (PERMA Number 4 of 2019), which is a provision of Article 1 point 1. A simple lawsuit is defined as a settlement procedure in civil cases with certain conditions and limitations that aim to simplify the process of examining cases before a court of law so that the settlement is faster and is specifically applied to contract disputes (default/default) and claims for losses due to unlawful acts. . The general principle in settling a case in court is as explained in Article 2 paragraph (4) of Law Number 48 of 2009 concerning Judicial Power which requires that trials be carried out simply, quickly and at low cost. This study aims to find out about the implementation of simple lawsuits in the District Court from the perspective of legal certainty. The research method used is descriptive analysis with a normative juridical approach. The sources of data used in this research are primary, secondary, and tertiary legal materials. All data obtained and collected is then used and understood the truth that has been obtained from research results to look for relationships between one another

Abstract

The issue of maritime boundaries is a fundamental matter that should be resolved and agreed upon by a country. The purpose of this research was to find out how the regulation of the law of the sea convention (UNCLOS 1982) relates to the settlement of maritime disputes between countries and how the authority of the international court of law of the sea (International Tribunal for The Law Of The Sea-ITLOS) in resolving maritime disputes. By using the method normative juridical research, qualitative methods and the concept of national interest, geopolitics and geostrategy are used to analyze this study. In this study, the South China Sea is the border for several countries, including Indonesia, Vietnam, Malaysia, Brunei, the Philippines and China. Because of this, border disputes in the South China Sea have quite high dynamics. This writing uses normative juridical research methods, with primary and secondary data to assist writers in finding research results and discussion. It is the obligation of Indonesia as a sovereign country to be able to play an active role in maintaining world peace in the form of participating in resolving disputes on the border of the Natuna Sea.

Abstract

The issuance of Presidential Regulation Number 12 of 2021 concering a a Government Procurement of Goods/Services and its amendments have strengthened the existence of the Commitment Making Officer (PPK) as one of the state financial management officias who has a very large role and task. Given the importance of the role of PPK in the framework of the imolementation, of course it is necessary to omprove and at the same time reorganize its central role in order to improve the quality of services that are more excellentin in line with the increasingly complex demands of modern era developments. The purpose of this study was to find out about the legal arrangements regarding the role of officials making commitments in the implementation of goods and services procurement services at the Ministry of Transportation and knowing the role of commitment officials in implementing goods and services procurement services at the ministry of transportation and knowing the obstacles faced by commitment officials in impelemnting propcurement services. Goods and services at the ministry of transportation. The research method used in this study is research with an empirical juridical approach, where data is taken directly and literally from interviews and literature studies The results of research on legal arrangements regarding the procurement of goods and services in the Ministry of Transportation refer to the civil Code concerning cintracts, Law Number 2 of 2017 concerning contracts, Law number 2 of 2017 concerning Construction Services, Article 1number 10 and number 11 Law Number 1 of 2004 concerning State treasury. Presidential Regulation 54 of 2010, Presidential Regulatin 54 of 2010, Presidential Decree NO. 16 of 2018. The role of Commitment making officials in the procurement of goods ans services establishes plans for the implentation of goods/services procurement, signs contracts, executes contracts with goods and services providers and the obstacles faced by commitment officers in being accountable for goods procurement and services consisting of external obstacles, which are influenced by natural factors, while the internal obestacles to work must be in accordance with the aircraft departure schedule, implanting technical personel are not always in the field, implementing contractors are inexperienced in working on airport runway overlays so that performance is not optimal. This resulted in the committee making officials and consultants/implemenethers having to carry out maximum supervision.
