Abstract

The banking industry is often perceived as the heart and driving force of a country's economy. Given its strategic position, the role of banking as an intermediary institution in collecting and distributing funds to the public for financing economic sector activities is crucial. Based on field practices, debtors often refuse to make payments or settle the credit, which impacts one of the banking health factors, namely the non-performing loan percentage. Legal staffing is essentially a method for resolving credit with a collectibility of 5 and credits that have been written off (Write-Off). The legal staffing method emphasizes resolution principles through non-litigation mechanisms (out-of-court dispute resolution), focusing on the effectiveness and efficiency of case resolution.

Abstract

Law enforcement aims to promote societal order and legal certainty by clearly defining the roles, responsibilities, and authorities of the institutions tasked with upholding the law, in accordance with their respective jurisdictions. This process extends beyond the mere fulfillment of duties; it involves the comprehensive enforcement of legal norms. The law serves as a mechanism for safeguarding human interests, and to protect these interests effectively, it must be applied equitably. Upholding basic human rights is imperative, and no entity, including the state, has the right to infringe upon an individual's fundamental rights. The adoption of the Miranda Rule/Miranda Principles into Indonesian positive law—through the enactment of Law Number 39 of 1999 on Human Rights and Law Number 12 of 2005 on the Ratification of the International Covenant on Civil and Political Rights—has strengthened the rights of suspects and defendants, particularly their right to legal assistance and defense. The Miranda Rule/Miranda Principles are vital to the criminal justice system, particularly in protecting the rights of suspects during interrogation. As a legal state, Indonesia upholds these principles, which are integrated into various judicial laws. These principles emphasize the necessity for law enforcement officers to prioritize the rights of suspects and defendants. Providing legal assistance to suspects or defendants is a fundamental aspect of the criminal justice system, and it is expected that all law enforcement officers conduct their duties in a coordinated manner, adhering to the principles of this system. The presence of legal counsel, as mandated by Article 56 of the Indonesian Criminal Procedure Code (KUHAP), is essential; neglecting this requirement can result in the nullification of the proceedings' outcomes, including investigations, prosecutions, or trials.

Abstract

Violence against women is a complex social issue with diverse causes. Economic, social, and cultural factors contribute to the occurrence of such violence. Analyzing social and cultural capital is a way to understand the root causes of violence against women. This research aims to analyze the influence of social and cultural capital on efforts to prevent and address violence against women in Bandung Regency. The method used is descriptive qualitative. The research findings indicate that the social capital influencing efforts to prevent and handle violence comes from the social networks of women victims of violence, including family, religious groups, and the Bale Istri community. However, cultural capital has a low influence on efforts to prevent and handle violence against women. The cultural capital of women victims of violence is still influenced by patriarchal culture, which forms embodied cultural capital based on long-internalized patriarchal norms and values. The internalized practice of patriarchal culture can be altered through gender and violence socialization by Bale Istri, enabling women to develop new embodied cultural capital that supports the prevention and handling of violence against women. Cultural change is an ongoing process that requires a long time; a combination of strong social capital and efforts towards cultural change can overcome various barriers in preventing and addressing violence against women (KtP).

Abstract

This research analyzes the political perceptions of faction members in the Garut Regency Regional House of Representatives (DPRD) regarding the formation of Southern Garut Regency. Findings indicate broad support for the expansion, motivated by the need to enhance public services, accelerate development, and improve community welfare in the southern region. Despite this, some factions express skepticism, emphasizing the necessity for in-depth studies and administrative readiness. Utilizing political perception theory, the study explores how DPRD members form their views based on information and interpret their political and social contexts. The research also highlights theoretical limitations, such as insufficient consideration of broader power dynamics and structural influences, including central government policies and local economic interests. These findings underscore the need for further theoretical development to comprehensively capture the complexities of the regional expansion process.

Abstract

In carrying out their duties, notaries often face situations where interested parties try to manipulate the situation in order to gain illegal benefits, which can have legal implications for the validity of the deed made. This research aims to examine legal protection for notaries in dealing with the crime of misbruik van omstandigheden (abuse of circumstances) in making a mortgage deed. This research uses a normative juridical method with a statutory approach to analyze existing legal protection and the effectiveness of its implementation. The findings reveal that Mortgage Rights under Indonesian civil law serve to ensure debt repayment and offer security to creditors. In case of debtor default, creditors can enforce these rights through a public auction in line with UUHT regulations. Authentic deed validity relies on both formal (technical and procedural) and material (agreement substance) aspects. Misuse of circumstances, where one party exploits the other's vulnerability for unfair gain, can lead to agreement annulment. Legal safeguards for notaries are outlined in Law No. 30/2004 and Law No. 2/2014, encompassing evidence generation, users, and notaries' roles as public officials. Oversight by the Notary Honorary Council (MKN) ensures compliance with duties, imposes sanctions for violations, and governs document summoning procedures. The notary's right of recusal upholds document confidentiality and integrity, while administrative sanctions uphold professional conduct. Minister of Law and Human Rights Regulation No. 7/2016 emphasizes transparent and rule-compliant notary summoning procedures, enabling notaries to fulfill their duties securely and calmly while balancing legal scrutiny with notary rights protection.
