Abstract

The World Trade Organization (WTO) agreements have a broad and complex impact on its member countries, especially regarding trade policy and global economic justice. Legal challenges in implementing these agreements, including harmonization between national and international law, as well as domestic political and economic dynamics, add to the complexity of their implementation. In addition, the WTO agreements also offer significant opportunities for member countries, such as wider market access and increased foreign investment. This study aims to analyze the long-term impact of the WTO agreements on trade policy, economic justice, and sustainable development in its member countries. This study uses a qualitative approach, with data obtained from various relevant sources such as research results and previous studies, which are then processed and analyzed in depth. The results show that the WTO agreements significantly shape the direction of member countries' future trade policies, with a greater impact felt by developing countries. Global economic injustice has emerged as one of the consequences of the implementation of these agreements, where developed countries are better able to utilize WTO provisions. On the other hand, the environmental and social impacts of implementing the WTO agreements are concerns that require better integration into trade policy. Projections of future challenges suggest that the WTO must continue to adapt to global changes to remain relevant and effective. Overall, this study highlights the need for a balance between trade liberalization and the protection of social and environmental values ​​within the WTO framework.

Abstract

Bilingual teaching in Indonesia has great potential in improving students' English skills. However, its implementation faces limited resources, teacher readiness, and support from the school environment and family. By overcoming these challenges, bilingual teaching can have a significant positive impact. This study aims to evaluate the impact of bilingual teaching on the development of students' English skills in Indonesia. This study uses a qualitative approach, collecting data from various relevant sources including research results and previous studies, and analyzing the data systematically. Bilingual teaching significantly improves students' speaking, listening, reading, and writing skills. In addition, this method also increases students' self-confidence and motivation, which ultimately supports their academic success. Government policy support, parental and community participation, and innovation in teaching materials and methods are key factors in the success of bilingual teaching. With commitment from all related parties and continuous efforts, bilingual teaching can be implemented effectively. This is expected to prepare Indonesian students to face global demands in the future.

Abstract

The movement of Foreign Terrorist Fighters (FTFs) in Syria has emerged as a global phenomenon, drawing serious attention from numerous countries due to its significant scale. Indonesia is among the nations contributing to the movement of FTFs in this context. A critical aspect currently under scrutiny is the discourse around their repatriation to Indonesia. Therefore, a key component that must be considered is the potential threat these individuals pose upon returning to Indonesia. To address this, the study employs a qualitative approach, gathering data through literature reviews and interviews with stakeholders directly involved with Indonesian FTFs. The research provides an analysis of the various potential threats posed by these FTFs upon their return to Indonesia, based on a review of literature and factual data regarding the actions previously undertaken by FTFs in Indonesia.

Abstract

This study analyzes the financial management of female Indonesian migrant workers in Singapore. This type of research uses a quantitative descriptive approach where data is obtained by conducting interviews, questionnaires, and observations with purposive sampling of as many as 40 respondents who work in Singapore. The financial management of female PMIs is different because every female PMI is not the same in managing finances from the income or monthly salary she receives. How to manage female PMIs' finances is to record all basic needs and try to make needs not exceed income or have been as previously targeted. The rest of these basic needs are saved in the bank by opening several savings books, and if the savings are saved in the bank with the first objective of investing, then if the savings money is sufficient, female PMIs will allocate the money to invest. Property investment, including land investment, is considered one of the leading investments by Singaporean female PMIs because land prices continue to rise and are accompanied by price increases, high resale value, more affordable investment price, multifunction, easy maintenance, and direct ownership. By becoming female PMIs, their economic life has changed, and the income earned is much more than before with proper financial management.

Abstract

According to Article 1328 of the Civil Code, fraud is a defect of will, while Article 378 of the Criminal Code contains a series of words such as lies, deception, false circumstances, and false dignity. The consequences of fraud are a reason for cancelling the agreement. The problems raised in research on the imposition of criminal fraud in debt and receivable agreement cases. The method used in this research is normative juridical with descriptive-analytical specifications. The research results obtained first: The parameter that differentiates default from criminal acts of fraud is that default is seen from the good faith of the parties, whereas in criminal acts of fraud, it is motivated by evil intentions (mens rea) to possess objects (goods) belonging to other people as well as intentionally not fulfil his achievements. second: The debtor can only be criminally processed if an agreement meets the elements of fraud. If the debtor does not commit a series of lies to obtain a loan from the debtor, the debtor cannot be prosecuted under the threat of Article 378 of the Criminal Code regarding fraud. The debtor will be free from the threat of criminal penalties due to his inability to carry out the agreement's contents. In the case based on Decision Number 331/Pid.B/2021/Pn Jkt. Brt, the defendant committed an act through deception or a series of lies, encouraging other people to write off the receivables by giving 2 blank checks to pay the remaining loan which appeared to be -as if the Defendant's debt had been paid off. This is a legal event that can be tried through criminal justice.

Abstract

The international shipping industry is the backbone of global trade, with around 90% of international trade carried out by sea. As an integral part of the global transportation system, this industry plays an important role in facilitating the exchange of goods and services between countries. In this context, the quality and competence of seafarers is a crucial factor in ensuring the safety and efficiency of ship operations. This research explores the influence of Certificate of Competency (COC) and Certificate of Proficiency (COP) diplomas on seafarers' salaries in Indonesia, a developing country with unique maritime industry characteristics. Using a quantitative approach, this research analyzed data from 49 seafarers, and found that COC had a significant positive influence on wages, while COP did not show a statistically significant influence. These findings emphasize the importance of COC certification in increasing seafarers' earning potential, and suggest that the focus of seafarers' career development be directed at achieving higher COC levels for career advancement in the maritime industry.

Abstract

The alignment between national legislation and international conservation agreements is critical for effectively managing wildlife trade, especially in biodiversity-rich countries like Indonesia. This article examines the consistency between Indonesian national laws on wildlife trade and the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Through a review of existing literature and legal analysis, the study identifies significant gaps and challenges in Indonesia's implementation of CITES. Key issues include legal ambiguities, enforcement inconsistencies, and difficulties in verifying the legality of wildlife specimens. The article also explores emerging threats, such as the rise of online wildlife trade, and their implications for both national and international regulatory frameworks. The findings underscore the necessity for Indonesia to enhance its legal and enforcement mechanisms to improve adherence to CITES and contribute more effectively to global conservation efforts.

Abstract

The transformation of e-government implementation allows local governments to innovate using information technology to improve their performance. One of the e-government innovations in the taxation sector that supports the increase in Local Own-Source Revenue (Pendapatan Asli Daerah) is the electronic collection of Non-Metallic Minerals and Rocks Tax (Pajak MBLB) implemented by the Lumajang Regency Government. The use of the E-Tax Card for MBLB has proven to increase tax revenue by 46% compared to the previous year's receipts and minimize the negative impacts of mining. This study aims to explain the factors influencing the implementation of the E-Tax Card for MBLB in collecting the Non-Metallic Minerals and Rocks Tax in Lumajang Regency. The theory used is a combination of Syahruddin's and George C. Edward III's theories, which include aspects of Policy Makers/Initiators, Field Officers, and Target Groups. This study employs a qualitative descriptive method with data collection techniques through interviews, documentation, and observations at portal units and mining sites. The research results indicate that the implementation of the E-Tax Card for MBLB in collecting the MBLB Tax in Lumajang Regency is less than optimal in the factors of bureaucratic structure, resources, and disposition.

Abstract

This research analyzes the values of natural harmony in the cosmology of the Marind people of South Papua. The research object was carried out on LMA Marind and priests in the Merauke Archdiocese using a qualitative approach. The findings explain that deforestation due to the conversion of natural forests into large plantations in Merauke, South Papua has threatened the socio-cultural survival of the Marind tribe. The loss of forests as a basis for their ecological and spiritual adaptation is contrary to the principles of ecological justice and environmental sustainability in Laudato Si. Pope Francis emphasized that the earth is the common home of humanity which must be protected for the benefit of all generations. Inclusive development policy reform is needed in Merauke by meeting the needs of indigenous communities and restoring natural habitats as the main orientation, not just the interests of investors. Also, political empowerment of local communities to have control over their customary lands. Harmonization of nature conservation, the human rights of indigenous peoples, and the sustainability of cultural heritage are key amidst investment expansion. Full involvement of the indigenous Marind tribe with high understanding and responsibility is a requirement for ecological-socio-cultural sustainability in Merauke. Marind traditional ecological findings, 1) connectedness with the universe, 2) ecology is part of ancestral traditions and wisdom, 3) ecology is the balance of the ecosystem, 4) ecology is dependence on rivers and seas, 5) ecology is a connection with the supernatural.

Abstract

Saguling Reservoir, located in West Bandung Regency, West Java Province, is one of the assets for energy sources for hydroelectric power generators (PLTA). The sustainability of the reservoir is one of the important aspects that needs to be considered to maintain its role and benefits. Sedimentation is a crucial issue in determining the sustainability of a reservoir. Increased waste production in the Bandung Raya area is one of the contributing materials to sedimentation if left uncontrolled. PT. PLN Indonesia Power UBP Saguling initiated an integrated waste management program, addressing waste from upstream areas to those that flow into the Saguling reservoir, as part of their efforts in supporting reservoir conservation. This study aims to determine the impact of implementing an integrated waste management, a community empowerment program, on reducing sedimentation. The secondary data analysis was utilized in the current research. The decrease in reservoir sedimentation was analyzed using data on the amount of waste absorption managed by community groups fostered by PT. PLN Indonesia Power UBP Saguling. The integrated waste management program reviewed from 2020 to 2024 was able to reduce sedimentation by 5,843 m3 with a percentage of sedimentation reduction of 0.36%.
