Abstract

This study aims to men analysis the causes of corruptors have yet to be charged by the applicable legal provisions, as well as to examine the current law enforcement problems of corruption. The type of research in this study is the normative juridical method, whose other name is doctrinal legal research, also known as library research or document study because this research is carried out or aimed only at written regulations or other legal materials. The approaches used by researchers in compiling this research are, among others: the Statute Approach and the case approach. Every ruler tends to maintain his power, and it is also possible that with his power, he can prepare himself to prevent or avoid legal proceedings that can potentially execute him for his arbitrariness.

Abstract

Home is a primary need for most families, both living in rural and urban areas, which is a primary need. The fulfillment of these primary needs cannot be fulfilled by everyone by buying in cash. Therefore, a financial institution is needed to provide financial assistance in the form of lending, particularly in the form of Home Ownership Loans (KPR). The purpose of this research is to find out the sale and purchase agreements for houses at PT. Rudensia Jaya Raya and the legal consequences of the unilateral cancellation of the house sale and purchase agreement by consumers at PT. Rudensia Jaya Raya. By using a statutory approach and a fact approach. House sale and purchase agreement at PT. Stages of Rudensia Jaya Raya include booking fees or receipts, selection of building designs, and making payments in cash or with housing loans, if the KPR stages are payment of booking fees, advances for credit agreements and PPJB. Abstract

Waste banks are an alternative way of handling waste that can be converted into something of economic value. The process of managing Waste Bank deposits with a computerized system is expected to improve the performance of Waste Bank managers. Sutojayan District has been using a website-based waste bank management application since 2021 and has recorded 660 transactions with a total of 1529 users. However, until now these transactions have only been carried out by 2 villages, namely Pandanarum and Jingglong, out of 11 villages in Sutojayan District. The sample used was 100 respondents from application users who came from managers and customers, this study aims to determine the effectiveness of the web-based Waste Bank Savings Application using the EPIC Model, with four indicators namely empathy, persuasion, impact, and communication. From the results of the study it can be concluded that empathy, persuasion, impact, and individual benefits have a positive and significant effect on user satisfaction of 0.292; 0.390; 0.326; 0.885. This shows that the higher the empathy, persuasion, impact, and individual benefits, the higher the user satisfaction. Meanwhile, communication has a negative and insignificant effect on user satisfaction of -0.042, due to the manager's own internal management problems.%MCEPASTEBIN%

Abstract

The inconsistency of legal regulations regarding the registration of marriages between couples of different religions in Indonesia is the subject of this research. The author uses a normative juridical research method with a statutory approach in this study. The primary legal materials used in this study are laws and regulations related to the problem under study, while secondary legal materials are in the form of journals, literature, books, papers, theses, dissertations whose contents are related to this research, dictionaries, encyclopedias, and other sources. another source. These legal documents are systematically compiled and analyzed qualitatively. According to the research results, the elucidation of Article 35 letter a. The Population Administration Law or abbreviated ADMINDUK Law as amended by Law Number 24 of 2013 concerning Amendments to Law Number 23 of 2006 concerning Population Administration, and Supreme Court Circular dated 30 January 2019, Number: 231/Pan/Hk 05/1/2019, there was disagreement in the rules for registering marriages between couples of different religions. Therefore, in order for these two regulations to be synchronized, the elucidation of Article 35 letter a of the ADMINDUK ACT needs to be changed, and there needs to be clear and firm rules for interfaith couple marriages so that there are no more parties to go to court for a decision.%MCEPASTEBIN%

Abstract

Indonesia is a country that has to deal with the problem of refugees from abroad entering and living in Indonesian territory. Indonesia is a stopover from waves of refugees to destination countries (asylum countries), namely Australia, America, Canada and others. Indonesia seems to really understand that human rights and humanitarian issues which are currently challenging international interactions need to get serious focus so that Indonesia seeks to provide protection for refugees from abroad who come to Indonesia. In this case, the State's obligation to protect, protect and uphold human rights is not only aimed at Indonesian citizens, but also includes citizens from other countries in Indonesia's territory, whether they are legally or illegally. In terms of international law, the State of Indonesia has no obligation to protect cross-border refugees due to the refusal of the State of Indonesia to sign the Vienna Convention on the status of refugees (the 1951 UN refugee convention). Therefore, in order to respect the Human Rights of Refugees, the Government of Indonesia is committed to enacting Presidential Regulation Number 125 of 2016 concerning Handling Refugees from Abroad, so that the Government has a reference standard for dealing with overseas refugees. Article 2 of the Presidential Regulation of the Republic of Indonesia Number 125 of 2016 states quite clearly that the handling of refugees is carried out based on cooperation between the central government and the United Nations through the High Commissioner for Refugees in Indonesia and/or organizationsinternational affairs in the field of migration or in the humanitarian field which has an agreement with the central government. The regulation broadly mandates 3 (three) government agencies and 1 (one) international organization to manage refugees, namely the Central Government which coordinates with the Regional Government in terms of accommodation, the Police in terms of security, Immigration in terms ofmonitoring and IOM as a facilitator of the basic needs of refugees.

Abstract

The Covid 19 pandemic that has spread throughout the world has had an impact on the course of the judicial process. Empirical juridical research using qualitative descriptive data analysis methods and deductive conclusions aims to describe the effectiveness of the implementation of electronic based trials for children in conflict with the law. The electronic based trial law policy is based on Supreme Court Regulation Number 1 of 2019 concerning Electronic Administration of Cases and Trials in Courts and Supreme Court Regulation Number 4 of 2020 concerning Administration and Trial of Criminal Cases in Electronic Courts. At the implementation level, the Boyolali Regency Class IB District Court for electronic juvenile criminal cases was effective in 2020, holding 11 (eleven) electronic trials of juvenile criminal cases. However, there were still non technical obstacles during the trial. Therefore, the implementation of electronic criminal justice for children needs to be supported by adequate electronic systems and devices as stated in the Decree of the Director General of the General Courts of the Supreme Court of the Republic of Indonesia Number 1693/DJU/SK/HM02.3/12/2020 concerning Standardization of Trial Facilities and Infrastructure Online (on the network) in general courts, including juvenile justice. Abstract

It is fascinating to study the legal politics of the protection of Indonesian Migrant Workers (PMI), particularly Female Migrant Workers. It should be able to provide legal protection via Law No. 18 of 2017 concerning the Preservation of Indonesian Migan Employees and other regulations. However, this is not the case; according to a number of comparable studies, the regulation is insufficient to provide legal protection for female migrant laborers abroad. Because it does not contain a single provision that regulates the protection of the law. According to Legal Feminist Theory (LFT), this regulation is still general and has not sided with women based on its content. In the future, there must be a legal regulation that truly prioritizes historically and spiritually more vulnerable female migrant laborers whose fundamental worker and human rights have frequently been violated. The purpose of this paper is to provide the government with constructive criticism and recommendations on how to regulate the law against female migrant laborers in the future.%MCEPASTEBIN%

Abstract

The objective of this study is to analyze the impact of COVID-19 pandemic dynamics in the Entikong land border area between Indonesia and Malaysia, and how they may change as the virus becomes endemic. The Entikong region is highly susceptible to the spread of COVID-19 due to its significant cross-border traffic and trade. The exploratory descriptive method was employed, with primary data (interviews) and secondary data from desk review results related to the COVID-19 situation and its impact on communities in the border areas of the country. This study examines the impact of socio-economic situations on the spread of the virus. The findings suggest that the economic activity of the people in the Entikong region has been disrupted since the implementation of the border access closure due to the COVID-19 pandemic. This economic activity is regulated by the Border Trade Agreement (BTA), which has been in place since the 1970s, allowing economic activities in both regions of Indonesia and Malaysia. The pandemic has forced the border region to close all access to and from goods and people. However, our results also indicate that the region may be better equipped to manage the virus as it becomes endemic. The implications of our findings for policymakers and public health officials are discussed, emphasizing the need for ongoing monitoring and response efforts in the Entikong land border area. This study contributes to the existing literature on the impact of COVID-19 in border regions and provides insights that can guide policymakers in their efforts to mitigate the pandemic's impact on communities living in border regions.

Abstract

The Hudoq mask is a dance attribute used in the Hudoq ritual ceremony in Ujoh Bilang Village, Long Bagun District, Mahakam Ulu Regency. This research uses descriptive analysis method, using data collection techniques; observation techniques, interview techniques, and documentation. This study aims to describe and analyze cultural values, and their potential as a source of learning and morals based on local wisdom contained in the Hudoq mask dish. Topeng Hudoq is a regional art that must be maintained and preserved in society, especially in the younger generation, because regional art is an asset and cultural identity of the Dayak Bahau Busang Tribe. The wisdom values contained in the Hudoq mask art are religious values, cultural values, moral values, aesthetic values, togetherness values, politeness values, and social values. The Hudoq mask has the potential to become a source of learning about fine arts and morals because it has unique shapes and motifs that can be used as a source of learning about fine arts, namely drawing. Training children to draw with objects that are close to the environment in which they live is related to culture, can instill a sense of love for culture in children as well as education of cultural values, and aims to teach lessons that customs need to be maintained and maintained. preserved for future generations.
