Abstract

This research analyses the legal politics of children's participation in public policy in Batang District, focusing on the gap between normative recognition and practical implementation. Although Indonesia has ratified the Convention on the Rights of the Child (KHA) and adopted it in the Child Protection Law, children's participation rights are still reduced, as seen in the vagueness of Article 10 of Law No. 23/2002 which limits participation based on ‘decency and propriety’. This qualitative study combines legal document analysis, participatory observation at the Children's Forum and Musrenbang (2018-2024), as well as stakeholder interviews, to find that children's participation in Batang District-despite being recognised as a Child Friendly District-is symbolic. Key challenges include a lack of stakeholder understanding, manipulation of children's voices, and the absence of a follow-up mechanism for aspirations, which is reflected in the omission of participation indicators in the Regional Action Plan. The research concludes that there is a need to strengthen ratification of the KHA, constitutional amendments to recognise children's right to be heard, and local policy reforms that guarantee space for meaningful participation. The findings emphasise the urgency of a holistic approach in the politics of child protection law.

Abstract

This research examines customary violations in the walimah al-'urs tradition that contradict Islamic law, focusing on practices in Indonesian society. The background of the research shows that many local wedding traditions contain elements that are not in accordance with the principles of sharia, such as extravagance, discrimination, and entertainment that violate Islamic norms. The research method uses a qualitative approach through library research by analysing classical turats books such as Al-Muhazzab, Fathul Wahab, and sahih traditions from Sahih Bukhari-Muslim. Comparative analyses were conducted on the views of the four schools of fiqh as well as contemporary literature related to Islamic law and marriage traditions. The results identified three main forms of violations: entertainment practices involving gender mixing and forbidden music, discrimination in the treatment of invited guests, and extravagance that contradicts the Islamic principle of modesty. These findings are supported by qath'i propositions from the Quran and Sunnah. The discussion emphasises that Islam recognises valid customs (urf sahih) as long as they do not contradict clear texts. The study offers concrete solutions in the form of: replacing un-Islamic entertainment with halal alternatives, implementing hospitality protocols that comply with the Islamic principle of equality, and community education programmes involving religious and traditional leaders. The research conclusions present a framework for harmonising cultural traditions with sharia compliance in wedding celebrations, emphasising the supremacy of Islamic legal principles while valuing positive cultural elements. This research makes an important contribution in guiding Muslim communities to conduct sharia-compliant walimahs without losing good cultural values

Abstract

Domestic violence (DV) in Sumatera Barat is a serious issue that requires special attention from a legal perspective. Law No. 23 of 2004 concerning the Elimination of Domestic Violence is expected to be an effective instrument in providing protection for victims, especially women and children. This study aims to assess the effectiveness of the implementation of this law in providing legal protection for DV victims. Although the regulation has been implemented, the increasing number of domestic violence cases that are not optimally addressed indicates that there are problems in its execution. The method used in this research is a juridical analysis that focuses on examining the legal norms contained in Law No. 23 of 2004. Data were collected through the study of legal documents, including relevant implementing regulations. The findings show that challenges in the implementation of this law, such as a lack of understanding among law enforcement and low community awareness of victims' rights, still dominate. For instance, in several regions, reported DV cases are often not adequately followed up, particularly due to limitations in supporting infrastructure, such as inadequate integrated service centers to assist in the recovery of victims.

Abstract

Penelitian ini membahas perlindungan hukum bagi korban tindak pidana perdagangan orang di Indonesia, yang semakin meningkat dan menimbulkan banyak penderitaan bagi korban. Tujuan utama penelitian adalah untuk menjelaskan pengaturan dan bentuk perlindungan hukum yang diberikan kepada korban sesuai dengan Undang- Undang Nomor 21 Tahun 2007 tentang “Pemberantasan Tindak Pidana Perdagangan Orang”. Metode yang digunakan adalah yuridis normatif, dengan analisis terhadap perundang-undangan dan konsep hukum yang relevan. Hasil penelitian menunjukkan bahwa undang-undang ini memberikan jaminan dan kepastian hukum yang lebih baik bagi korban, termasuk hak atas restitusi, kompensasi, rehabilitasi, serta perlindungan identitas. Namun, kendala dalam penerapan perlindungan hukum masih ada, baik dari segi yuridis maupun non-yuridis. Penulis merekomendasikan peningkatan sosialisasi mengenai undang-undang ini agar masyarakat lebih memahami hak-hak mereka dan tidak menjadi korban tindak pidana perdagangan orang.

Abstract

This research examines the existence of Islamic Law and Customary Law in Indonesia's national legal system which reflects legal pluralism in a country with high cultural and religious diversity. The purpose of the research is to explore the role and integration of Islamic Law and Customary Law within the national legal framework, particularly in the context of the application of sharia principles and the recognition of customary law communities. This research utilizes a qualitative descriptive method with analysis of documents, legal literature, and relevant legislation, as well as a historical approach to understand theories of legal acceptance such as Receptie and Receptie in Complexu. The results of the analysis show that Islamic Law has gained significant legitimacy, especially through the Compilation of Islamic Law (KHI) which regulates family law and inheritance. Meanwhile, Customary Law is also recognized in Article 18B of the 1945 Constitution as an important part of the national legal system, although its implementation faces modernization challenges. This research finds that the interaction between these two legal systems produces not only challenges but also opportunities to build a national law that is adaptive and responsive to the needs of society. Thenovelty of this research lies in the comprehensive analysis of the dynamics of harmonization of Islamic Law and Customary Law amidst the social and political complexities in Indonesia. This research emphasizes the importance of an inclusive and contextual approach in building a just and sustainable legal system, which accommodates local religious and cultural values.

Abstract

Peran istri dalam keluarga mengalami perubahan signifikan seiring meningkatnya partisipasi perempuan dalam dunia kerja, dipengaruhi oleh faktor ekonomi, sosial, dan budaya. Dalam konteks hukum Islam, transformasi ini menuntut kajian ulang terhadap tafsiran tradisional yang memposisikan suami sebagai pencari nafkah utama dan istri sebagai pengurus rumah tangga. Penelitian ini menggunakan pendekatan normatif dengan analisis deskriptif-kualitatif terhadap literatur hukum Islam, untuk menafsirkan ulang ajaran yang relevan dengan kebutuhan sekarang ini. Hasil penelitian menunjukkan bahwa kontribusi istri dalam mencari nafkah dapat diterima dalam Islam, dengan syarat tidak mengabaikan kewajiban utama dalam keluarga. Prinsip maslahat menjadi landasan untuk menyeimbangkan nilai-nilai tradisional dengan tuntutan modern, sehingga istri yang bekerja dapat mendukung kestabilan ekonomi keluarga tanpa mengorbankan keharmonisan rumah tangga. Penelitian ini menegaskan pentingnya dukungan suami dan lingkungan sosial, serta fleksibilitas aturan kerja untuk memungkinkan perempuan menjalani peran ganda secara optimal. Penafsiran kontekstual terhadap hukum Islam menjadi kunci dalam menjawab tantangan zaman, sekaligus menjaga prinsip-prinsip dasar agama.

Abstract

In Indonesia, Islamic law plays a significant role in various aspects of societal life, despite being within the framework of the national legal system based on positive law. Given the diversity of existing norms, the implementation of Islamic law within the context of national law often presents challenges in terms of integration and harmonization. Therefore, it is important to understand strategies that can be applied to accommodate the values of Islamic law within the plural national legal framework. This article aims to analyze and identify strategies that can be applied to integrate the principles of Islamic law into Indonesia's national legal system. The approach used in this study is qualitative, utilizing literature analysis and doctrinal study of legal texts, both Islamic law and positive law in Indonesia. Additionally, an analysis is conducted on the application of Islamic law in various legal fields in Indonesia, such as family law, religious courts, and criminal law. The findings indicate that the integration of Islamic law into Indonesia's national legal system requires a more contextual and adaptive approach, considering local values and societal diversity. Several strategies that can be implemented include harmonizing Islamic legal norms with positive law, enhancing the understanding of legal pluralism, and adjusting the implementation of Islamic law to align with the principles of social justice in Indonesian society.

Abstract

Islamic legal thought undergoes dynamic development from the classical to the contemporary era, influenced by social, political, and cultural changes. This study aims to analyse and compare the Islamic legal thought of classical figures, such as Imam Abu Hanifah, Imam Malik, Imam al-Shafi'i, and Imam Ahmad bin Hanbal, with the thoughts of contemporary figures, such as Muhammad Abduh, Rashid Rida, Fazlur Rahman, and Abdullahi Ahmed An-Na'im, in facing modern legal challenges. This research uses a qualitative method with a historical-comparative approach to identify the transformation of Islamic legal thought and its relevance in contemporary legal practice. The results show that classical thought is more oriented towards sharia texts with a systematic methodology of legal istinbath based on ijma', qiyas, and istihsan, while contemporary thought emphasises the reinterpretation of Islamic law through ijtihad, maqasid sharia, and contextualisation of legal norms to remain relevant in modern social dynamics. This study contributes to providing a more comprehensive perspective on the evolution of Islamic law and its implications for the formation of Islamic legal policies in the modern era.

Abstract

This study aims to find out how the construction of Islamic economic law thought from Abul A'la Maududi to the current development of contemporary Islamic economics. Abul A'la Maududi is a prominent Islamic economist. Abul A'la Maududi is better known in the socio-politics between Islam in the world. This type of research is a type of qualitative research with a method of collecting data through literature studies. Where the researcher will collect several book or journal materials related to the construction of Abul A'la Maududi's thought. And the researcher will analyze descriptively the construction of Abul A'la Maududi's Islamic economic legal thought. The result of this research is that Abul A'la Maududi's thinking on economic law seeks to offer a holistic system and in accordance with Islamic teachings. The principles he put forward underlined the importance of balancing individual and social interests, the fair distribution of wealth, and the role of the state in ensuring economic justice. In the contemporary era, the construction of Abul A'la Maududi's thought still has relevance, especially in efforts to overcome economic inequality and fight for economic justice based on Islamic values.
