Abstract

This study aims to construct the concept of the economic value of service fees for Land Deed Officials (PPAT) based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 33 of 2021, as well as to examine its consistency from the perspectives of legal certainty and justice. This research employs a normative juridical method, utilizing statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively through legal reasoning techniques. The findings indicate that the regulation of the economic value of PPAT service fees is normatively intended to establish a balance between public interests and the professional interests of PPAT. However, the provision still contains normative ambiguities that may lead to multiple interpretations, thereby failing to fully ensure legal certainty. Furthermore, the regulatory framework has not optimally reflected the principles of justice and efficiency within the law and economics perspective. Therefore, refinement of the regulatory norms is necessary through clearer, more systematic, and consistent formulations in order to enhance legal certainty and ensure fairness for all relevant parties.

Abstract

This research will discuss the principle of equal freedom and the principle of difference in the health context. The principle of equal freedom will emphasize the importance of universal access to health services as a basic right of every individual, while the principle of difference will discuss the need for policies that better support vulnerable groups to reduce inequality in the health sector. By applying Rawls's theory to the legal system and health policy, it is hoped that social justice can be improved for the entire community in the field of health services. Also, health systems can be designed to minimize inequities and ensure that health resources are distributed ethically and fairly.

Abstract

Judi online adalah jenis perjudian yang dilakukan secara daring. Masalah yang muncul adalah selain menimbulkan tindak pidana turunan akibat perjudian, judi online juga merugikan perekonomian negara karena sebagian besar dana dari judi online mengalir ke luar negeri. Masalah ini semakin sistemik karena kesulitan dalam memberantas situs atau aktivitas yang mengandung judi online. Hukum positif Indonesia memandang judi online sebagai tindak pidana seperti perjudian pada umumnya. Upaya penegakan hukum dapat dilakukan melalui upaya represif atau preventif melalui pemblokiran, pemantauan, pelacakan, dan pemblokiran semua aktivitas yang mengandung judi online. Selain itu, upaya lain yang direkomendasikan adalah melakukan kerja sama internasional dalam mencari penegakan hukum yang efektif untuk kejahatan judi online. Dengan demikian, penelitian ini bertujuan untuk menyajikan pola sosial masyarakat terhadap pengaruh judi online, dan menyajikan pandangan hukum dan penegakannya dari perspektif hukum pidana dan bentuk-bentuk penegakan hukum yang efektif untuk kejahatan judi online melalui upaya preventif.

Abstract

This study discusses legal considerations regarding criminal sanctions and work training for children as perpetrators of sexual intercourse crimes, focusing on Medan District Court Decision Number 70/pid.sus Anak/2024/PN Medan as the source case. This is done to ensure that children in conflict with the law continue to receive supportive care for future guidance and rehabilitation. Conversely, children can also be criminalized. Therefore, the issues discussed include the legal basis governing the criminal responsibility of children towards children and the considerations taken by judges when they make decisions after being found guilty by a judge in accordance with Article 81 Paragraph (2) Article 76d of the Child Criminal Justice System Law (SPPA Law). This study uses a normative juridical method with a case study approach, examining materials from secondary and tertiary law, literature reviews, and descriptive analysis. This study also focuses on providing recovery to victims to achieve a more balanced justice in the Juvenile Criminal Justice System in Indonesia. The results of the study show that the judge's considerations include legal aspects such as (UU SPPA). However, the considerations in the verdict are inaccurate because they do not pay enough attention to the future of the victims..

Abstract

This study aims to analyze law enforcement on strengthening state intelligence in an effort to counteract information system hacking as a form of cybercrime that has an impact on national stability and security. The research method used is normative juridical with a legislative and conceptual approach, through a study of relevant regulations such as the Law on Information and Electronic Transactions as well as provisions on state intelligence and cyber defense. The results of the study show that strengthening the state intelligence function, both through increasing the capacity of early detection, coordination between institutions, and optimizing the legal apparatus, is a crucial factor in preventing and overcoming information system hacking. However, there are still challenges in the form of limited resources, regulatory harmonization, and cross-sector collaboration. Therefore, continuous synergy is needed between law enforcement officials, intelligence agencies, local governments, and the community to strengthen the cybersecurity system as part of protecting state sovereignty in the digital era.

Abstract

This study analyzes the normative construction of the death penalty for corruption in Indonesia and identifies the gap between legal norms and law enforcement practice. The research focuses on how criminal law literature constructs the legitimacy of capital punishment, why the sanction has never been applied in practice, and how the death penalty is positioned within the criminal law system. Using a non-Systematic Literature Review method, this study adopts qualitative doctrinal and socio-legal approaches to relevant indexed journal articles. The collected data are examined through thematic synthesis to map patterns of normative argumentation, judicial reasoning, and orientations of criminal law policy reflected in the literature. The findings demonstrate that scholarly works consistently acknowledge the normative legitimacy of the death penalty for corruption based on juridical, philosophical, and theoretical considerations. Nevertheless, the literature simultaneously reveals the complete absence of its application in judicial decisions. This gap is explained by judicial discretion, weaknesses in norm formulation, and the pragmatic orientation of criminal law policies that prioritize flexibility over severity. The study further finds that the death penalty operates primarily as a symbolic norm rather than as an effective operational sanction. Consequently, the persistent divergence between normative recognition and practical non-application reflects a broader normative dysfunction within Indonesia’s corruption criminal law regime. This research contributes conceptually to debates on criminal law effectiveness globally.

Abstract

The phenomenon of online gambling in Indonesia involving influencers as promoters through social media raises complex criminal law issues. This normative research with a statutory approach analyzes legal regulations and criminal liability of influencers in online gambling promotion. The results indicate that this practice is regulated through Article 27 paragraph (2) in conjunction with Article 45 paragraph (3) of the ITE Law No. 1/2024 with a maximum criminal threat of 10 years and/or a fine of IDR 10 billion, Article 426 of Law No. 1 of 2023 concerning the Criminal Code with a maximum imprisonment of 9 years or a category VI fine, as well as the Consumer Protection Law. Criminal liability requires accountability capacity, intent, and absence of justification reasons, accompanied by consequences in the form of criminal sanctions, asset seizure, and social media account blocking.

Abstract

This study aims to analyze the implementation of Agrarian Reform by The National Land Agency (BPN) of Deli Serdang Regency in the 2020–2025 period and identify the main obstacles faced and efforts to solve them. This research uses a type of qualitative research with the nature of empirical juridical research, namely examining the legal provisions that govern Agrarian Reform and relating it to implementation practices in the field. The research data was obtained through in-depth interviews with officials and apparatus of the Deli Serdang Regency BPN, documentation studies, and tracing of relevant laws and regulations. The results of the study show that the implementation of Agrarian Reform in Deli Serdang Regency has been carried out systematically and guided by the national regulatory framework, especially the Basic Agrarian Law and Presidential Regulation Number 62 of 2023 concerning the Acceleration of the Implementation of Agrarian Reform. The implementation of Agrarian Reform is realized through asset legalization, land redistribution, and access arrangement that is integrated with the Complete Systematic Land Registration (PTSL) program and coordinated through the Agrarian Reform Task Force. The main obstacles faced include low community participation in several locations as well as the complexity of physical and juridical data that has the potential to cause land disputes. Efforts to resolve it are carried out through strengthening cross-sector coordination, increasing socialization to the community, and applying the principle of prudence by ensuring that the objects and subjects of Agrarian Reform are in a clean and clear condition. This research is expected to make an academic and practical contribution to the development of more effective and equitable Agrarian Reform policies.

Abstract

This study aims to analyze the implementation of restorative justice in domestic violence (DV) cases from a positive legal perspective. The approach used is normative juridical, examining legislation, doctrine, and cases. Restorative justice, as an alternative to resolving criminal cases, emphasizes restoring relationships between perpetrators, victims, and the community without neglecting substantive justice. In cases of domestic violence, its implementation faces a dilemma between social recovery and protecting the rights of victims, particularly women and children. The analysis shows that the implementation of restorative justice in DV cases can only be carried out with caution, while still observing the principle of non-discrimination and the victim's right to a sense of security. The effectiveness of restorative justice in DV cases depends heavily on oversight of its implementation.

Abstract

This study aims to analyze the effectiveness of Structural Legal Aid (BHS) in resolving disputes over former PTPN II concession land in the Medan–Deli Serdang area in 2024–2025. These disputes involve communities affected by evictions, with plantation companies as the parties seeking land execution. SLL focuses on more equitable policy changes and community empowerment through legal assistance and policy advocacy. This study uses a legal-empirical approach with a case study design. Data were collected through in-depth interviews, field observations, and document analysis. The results show that SLL is effective in delaying evictions and increasing the legal capacity of the community, with 70% of residents feeling the benefits of the legal assistance provided. Factors supporting the effectiveness of BHS include active community participation and the involvement of supporting institutions, while obstacles include a lack of coordination between relevant agencies and limited resources. This study provides policy recommendations to improve fairer agrarian governance, which can reduce conflict and increase the protection of community rights in disputes over ex-HGU land.
