Abstract

The right to freedom of religion is a fundamental right. For Indonesian people, religion is not only seen as a ritual but also as a part of the social relations between society members and the state. However, the sacred value of religion in social relations is degraded through normative recognition in the form of official religious politics. The policy does not actually engender order and justice. On the contrary, official religious political policies and restrictions on religious freedom raise widespread discriminatory practices that affect religious minority groups, such as the Indonesian Ahmadiyya Community. The purpose of this study is to examine the tension between the law and the right to freedom of religion or belief in cases of discrimination against the Ahmadiyya Community of Indonesia from the point of view of the legal theory of legal disorder. The research methods used are socio-legal with a statutory approach, a conceptual approach, and a critical legal study approach using legal disorder theory. This research emphasizes that the Ahmadiyya, as a sect in Islam, has the right to freedom of religion within the Forum Internum. In practice, the official religious politics subordinated the rights of religious freedom under the control of religious majoritarianism. However, empirical facts show that the multireligious social context of Indonesian society places the situation in a state of irregularity. Through the disorder of law theory, Sampford opens the horizons of the legal paradigm, showing that seeing and answering various irregularities cannot be done through the lens of order.

Abstract

The problem of the identity of educational institutions is a matter of awareness, attitudes, and actions. Institutions with a clear identity also produce clearer educational processes, ecosystem and relations between educational institutions. The problem is that Islamic educational institutions are often seen as monolithic and stigmatized as second-class educational institutions. For this reason, this article focuses on constructing the identity of SDIT Al-Hidayah and SDIT Al-Wathaniyah in Sumenep, Madura. To answer the focus of this article, a qualitative approach was used by choosing the type of case study based on a multi-site design. Data collection was conducted through interviews, observation, and documentation. The data were then analyzed using an interactive analysis model, which included data collection, condensation, data display, and conclusions. Credibility, transferability, dependability, and confirmability tests were conducted to determine the validity of the data. The results of this study indicate that, in general, the construction of the identity of Integrated Islamic Primary Schools in Sumenep consists of three essential elements, namely Islamicity, integration and locality. Islamicity means that the entire identity of the integrated Islamic schools is based on the Islamic values of Ahlussunnah wal Jamaah. The identity of integration refers to the integration of the curriculum, the roles of teachers and parents, the identity of the soul of educators, and the integration of institutions under one foundation. Meanwhile, local identity is an identifying identity taken from local wisdom, such as a Qur'ani-inspired school, a madrasah-nuanced school, and a philanthropic school.

Abstract

Genealogy as a system is generally used to preserve a tradition, culture, thought, science, or power. However, in the Raudhatul Muttaqin Mosque, Kotaraja East Lombok and Al-Bayani Mosque, Gondang, North Lombok, this system is actually used to determine the imam, which in Islam and the government there are no rules regarding the obligatory prayer imam from certain descendants. The purpose of the research is to identify how the descendants of Sheikh H. L. Abdurrahman and Amiq Sahabuddin communicate with the community in implementing the genealogical system of mosque imam in Kotaraja and Gondang. The research method used is a qualitative type of a case study and data were collected through observation, documentation, and interviews with the generations of Shaykh H. L. Abdurrahman and Amiq Sahabuddin as mosque imam, community leaders, and villagers. The study concluded that the main actors of persuasion to the community are the descendants of the imam who are supported by the power of the message, media, argumentation, psychological appeal, credibility, and legitimacy of the community. The persuasion process of the descendants of the imam displays convincing expressions and contains various values, both religious, customary, social, and educational values, so that the community can accept it well.

Abstract

Gender equality is an important aspect of building harmony in the family. Salafis, with their teachings of Islamic purity, is considered a religious organization that severely restricts women's activities. This reality makes the public think that Salafi women are domesticated, subordinated, and discriminated against in terms of gender. This study examines and explores the concept of gender equality in the Salafi family and how it is contextualized in reality and women's economic movements. This qualitative research uses observational data, periodic WhatsApp application interviews, and documentation studies. This study shows that, first, an understanding of gender equality has been developed in Salafi families in Lampung, although its implementation still requires negotiation by considering the rights and obligations of women in the family, as wives, mothers, and both. Second, while still paying attention to religious norms, Salafi women utilize social media, the internet, and digital technology to build businesses, partner, and connect with many parties. Third, the creativity of Salafi women in building homes as a place for entrepreneurship, no longer a domestic space, has been able to form alliances instead of causing conflict between home and workplace and clouding public perceptions that they are domesticated.
