Abstract

Nickel is a metal that has the characteristics of a silvery-white color with the characteristics of strength, heat resistance, light weight and corrosion resistance with the chemical formula Ni. It has good electrical and thermal conductivity making it suitable for coating copper, iron and aluminum to prevent corrosion. Nickel was first discovered and developed by Cronstedt in 1751, in a mineral called Nicolite (Kupfernickel), which was found in the Sudbury region, Ontario, Canada, a nickel-producing area of 30% of the world's demand for nickel metal. One of the countries with the largest nickel reserves is Indonesia. According to several experts, it is estimated that Indonesia has nickel reserves of more than 1 billion tons of nickel. The largest distribution of nickel reserves is in the eastern part of Indonesia. The distribution of nickel in Indonesia and the distribution of nickel mining in Indonesia today, among others, are found on the islands of Sulawesi (Southeast and South Sulawesi), Maluku and Papua. Unfortunately, currently a lot of Indonesian nickel is exported in the form of raw material, so the selling price is very cheap. Thus, government support is very much needed to improve nickel processing, such as support for ease of licensing, clear and transparent rules and regulations. This support can be seen in the issuance of a decree by the Ministry of Energy and Mineral Resources Number: 549.Pers/04 SJI/2019 dated 2 September 2019 concerning "Nickel Ore Cannot be Exported Again as of January 2020".

Abstract

The decision of the WTO Dispute Settlement Organs regarding the ban on the export of crude nickel by Indonesia has significant implications for international trade law. This ban was opposed by the European Union because it could hamper the development of their electric-powered automotive industry which requires nickel ore as a raw material for electric vehicle batteries. Provisions in the General Agreement on Tariffs and Trade (GATT) allow export restrictions in certain situations, such as for the protection of health, safety, sanitation, or the preservation of natural resources. However, import and export bans and other non-tariff measures are not permitted. The WTO provides exceptions to quantitative restrictions that meet certain criteria. In this dispute, Indonesia was declared to have violated GATT provisions by the WTO panel. The impact of this decision is important for Indonesia, because nickel is a non-renewable natural resource and is very much needed in the country's development. Indonesia's defeat in this dispute could have a significant impact on the supply of nickel ore and its domestic use. Developed countries with high consumption already use most of the world's natural resources, while developing countries use only about 10%. WTO decisions can also affect international trade policies and relations between countries. Indonesia's defeat could reduce state revenues, discourage investment, and affect relations with the European Union. In addition, this policy may also affect the electric power automotive industry and the development of electric vehicles in the European Union. Therefore, this decision has broad and important implications in the context of international trade and bilateral relations.

Abstract

The development of elections in Indonesia has two systems, namely, closed proportional system and open proportional system. Both electoral systems have their own advantages and disadvantages. The implementation of both electoral systems has significant legal and political implications in the context of state law in Indonesia. This background explanation illustrates the existence of legal problems related to the electoral system in Indonesia and the legal implications of the application of each electoral system. The research used in this research is a combination of conceptual approach with comparative approach. The comparative analysis of open and closed proportional electoral systems in the perspective of state laws in Indonesia is conducted. It can be concluded that the implementation of an open or closed system cannot be viewed as a single solution to all legal problems in the country. Decisions on the most suitable electoral system for Indonesia must consider aspects of democracy, political participation, justice, and political stability. The selection of the right electoral system will have significant implications in building a democratic and effective political system.

Abstract

Departure terminal capacity to passenger volume at Patimura Ambon International Airport, Maluku Province in 2021 has experienced an increase in the number of passengers, won the Airport Service Quality (ASQ) award, in the airport category with a capacity of less than 2 million per year, from this statement the researcher wants to conduct a wide capacity analysis waiting room terminal, seating facilities, and passenger volume, whether the research results need development or not. The data in this study used secondary data, namely data on the number of passengers in the last three years, and primary data, namely data on the number of existing passenger departure terminal seats. Data analysis used descriptive statistical methods based on the formula in SKEP/347/XII/99, Director General of Civil Aviation. The results of the study stated that the area of the departure waiting room was 220 m² based on SKEP 77/VI/2005 Director General of Civil Aviation. The capacity of the departure waiting room at Gate-1 to gate-5, gates 1 and 2 can accommodate passengers, gate-3 = 271 passengers, gate-4 = 267 passengers and gate-5 = 247 passengers. The need for seats based on SKEP 77/VI/2005 Director General of Civil Aviation is 828 seats. The results of the analysis of the capacity of the Departure Waiting Room Terminal for Passenger Volume at Patimura Ambon International Airport, Maluku Province, were declared to be appropriate based on SKEP 77/VI/205 of the Director General of Civil Aviation.
