Abstract

Abstract: The right of use is the right to use or collect the proceeds from something that is controlled directly by the owner of the goods, and can be transferred to another party with the permission of the owner rather than the goods to be used. In the Perspective of Islamic Law the transfer of the right of use must be with the permission of the owner of the goods that will be the object of the transfer, Imam Abu Hanifah and Ulama Malikiyah and Ulama' others argue that utilizing an item must be with the permission of the owner of the goods, if the owner of the goods does not give permission then the goods that are the object of the transfer of the right of use cannot be transferred to others. This research is a literature study (Library Research), defining literature studies is the result of literature research and the results of thinking conducted by researchers on a study. By collecting a book or reference that can be used as a relevant reference, so as to be able to get a good and correct conclusion. While judging from the type of data information this research includes qualitative research, which is research that cannot be tested with statistics. From the results of research transfer rights to other parties related to renting back rental goods, lending back loans, and renting borrowed goods according to ulma' madzhab Maliki and Madzhab Hambali punish "may" as long as it does not come out of the usefulness of the rented goods, according to imam Shafi'i and Imam Hanafi do not allow renting back before asking permission to the original owner. In the discussion of lending back loans according to Ulama' Madzhab Maliki and Hambali punished "may" as long as it does not come out of expediency, and if it has asked permission will not be allowed then it should not lend back loan goods while according to Ulama' madzhab Shafi'i and Hanafi are not allowed to lend back loan goods unless getting permission from the owner is strengthened in the grace contained in Fathul Qorib. As for the opinions of ulama' Maliki, Hambali, Shafi'i, and Hanafi agreed not to allow renting loans because the rental agreement (Ijarah) is a binding agreement, while the loan agreement is a non-binding voluntary agreement. Abstract

Abstract: Prayer is the most important worship in Islam. Discussing prayer, it will not be separated from the conditions for the validity of prayer, namely the entry of prayer times. The beginning of the prayer time is determined based on the position of the sun concerning the earth, thus calculating the beginning of the prayer time is calculating when the sun occupies certain positions while circling the earth, namely when the dawn of Sadiq, the sun slips when the shadow of an object is the same as the shadow of the object itself, the sun sunset and the loss of the red twilight. In determining the beginning of this prayer time, there is a dichotomy/difference in interpretation. Among the different forms of interpretation when determining the start of the Zuhur prayer time, when the shadow of an object is as long as the object itself and the shadow of an object is twice the length of the object. Especially in the book Ihya Ulumuddin, Imam Al-Ghazali, has his own opinion about the beginning of prayer time, when in an area you cannot see the sun setting in the west because it is blocked by a mountain such as, then look towards the east, see black bursts in the sky, then it is the same as a sign of the entry of maghrib time, and the beginning of the time for the Isha prayer, marked by the loss of the red twilight, if in an area covered and blocked by mountains to see the disappearance of the red twilight in the west, then look at the small stars that appear in the east, then that is an early sign of entering the time for the Isha prayer. Abstract

Abstract: Humans in carrying out various activities are very dependent on time. When traced in ancient times, humans marked the time with different references, causing confusion with each other. Therefore, humans are looking for parameters to equalize time. This parameter is the movement of the Sun, Moon and other phenomena. The explanation of the time system is explained in the Book of Enoch. But the explanation is based on that time. So, the question arises of the time system into the present. This research is library research with a qualitative approach. The primary source of this study is the Book of Enoch. The result of this research is it is known that the smallest unit in the book of Enoch is part equivalent to 80 minutes. The day begins with sunrise which occurs for 12 months of the year. One month consists of 30 days with an intercalation of 4 days a year in order to equalize the time of season and solar time so that a year consist of 364 days ending with sabbath. Every month, the sun rises and sets from different places and correlates with constellations. Keywords: Day, The Book of Enoch, Time system.

Abstract

Abstract: Technological developments have changed many things in all lines of human life. including buying and selling transactions. Through internet services, the trend of online buying and selling or what is commonly called e-commerce emerged. E-commerce services offer convenience and speed in buying and selling transactions without having to meet physically. However, the advantages offered still create gaps. It is often found that there is disappointment from buyers who use e-commerce services because the goods received do not match the specifications of the goods offered. Islamic law has provided a solution to this problem through khiyar rights. The buyer can submit a cancellation of the transaction if there is a discrepancy in the goods received. In this article, the author will examine the implementation of khiyar in canceling transaction regulations on the Shopee application. This research is in the nature of literature research which makes the regulation of canceling transactions on the Shopee application the object of research. The data that has been collected will be analyzed using the theory of khiyar in fiqh. Kata kunci: khiyar, pembatalan, pengembalian, Shopee.

Abstract

Abstract: Da'wah is an activity that is carried out consciously in order to convey Islamic religious messages to others so that they accept the teachings of Islam and carry it out well in individual and social life to achieve human happiness both in the world and in the hereafter, using the media and certain ways. Culture tends to be followed by the supporting community from generation to generation from generation to generation, although it often happens that members of the community come and go due to the emergence of various factors, such as death and birth. Considering the function of culture is as a reference in behaving and behaving in society, every ethnic group will definitely develop values ??which are then used as a reference for interacting with others in order to create a society that maintains harmony and good friendship. From the data analysis, it was concluded that many da'wah values ??and Islamic elements were found in this local tradition. In this case, it includes several values ??that contain elements of da'wah, namely: mutual cooperation, religious values, educational values ??in culture, brotherhood values, and harmony in society. Abstract: The purpose of this study is to see the reality of plurality in Medina, thanks to the constitution of the Medina Charter that can be regulated and managed properly by the Prophet Muhammad. Therefore, how can the values ??contained in the Medina Charter be implemented and integrated into national education. The focus of this research is on how the values ??of multicultural education are viewed from the Medina Charter in national education and the values ??of multicultural education are implemented in national education from the perspective of the Medina Charter. The researcher chose the library research method. Where researchers collect information from available materials in the form of books, archives, journals and other documents that support research. There are two sources of information in library research, namely primary and secondary sources of information. When analyzed, its validity is tested using inductive, deductive, comparative, and interpretive techniques. Abstract

Abstrak: Modernitas sebagai fakta historis perkembangan peradaban umat manusia tidak bisa dipungkiri adanya. Bahkan moernitas menjadi identitas yang tidak bisa dipisahkan dari peradaban umat manusia saat ini. Hegemoni Modernitas Eropa bahkan telah berhasil menjadi representasi peradaban universal. Saat arus modernitas merasuk hampir seluruh belahan bumi, benturan antara tradisi dan modernitas menjadi tidak terelakkan. Reaksi atas modernitas dan bagimana memposisikan tradisi di hadapan modernitas memunculkan tiga kelompok utama yaitu kelompok transformaatif, kelompok reformis dan kelompok idealis-totalistik. Al-Jabiri mencoba mengurai persoalan hubungan tradisi dan modernitas dengan merumuskan suatu konsep pembacaan modernitas yang produktif yakni modernitas yang tidak diadopsi dan ditransfer dari peradaban luar yang tidak memiliki akar dalam tradisi. Sebaliknya modernitas yang sesungguhnya tidak-bisa tidak harus dibangun dan berangkat dari dalam tradisi. Dalam hal ini al-Jabiri melalui proyek kritik nalar arabnya membongkar tradisi-tradisi dalam peradaban Arab-Islam untuk menemukan benih-benih tradisi yang berpotensi dikembangkan untuk membangun peradaban Arab-Islam sehingga modernitas menemukan wujud kesejatiannya dalam tradisi. Dari kajiannya atas sejarah Arab-Islam, setidaknya ada tiga otoritas rujukan epistemologis dan ideologis” atau tiga sistem pemikiran (episteme) yang masing-masing berbeda yaitu episteme bahasa yang berasal dari kebudayaan Arab (nalar bayani), episteme gnosis yang berasal dari tradisi Persia dan Hermetis (nalar ‘irfani) dan episteme rasionalis (burhani) yang berasal dari Yunani (nalar Burhani). Tesis Al-Jabiri mengenai basis modernisasi Arab Islam yang pantas dan patut dijadikan dasar bagi modernisasi Arab-Islam adalah merekonstruksi bangunan relasi antara epistem bayani dan epistem burhani adapun epistem ‘irfani diabaikan oleh al-jabiri karena yang ketiga ini cenderung berlawanan dengan dua epistem sebelumnya. Dengan cara ini al-Jabiri mengharapkan kemodernan yang sebenarnya dengan menjadi subyek pelaku (fail) dan bukan semata sebagai konsumen (munfa’il). Dengan tesisnya ini al-jabiri dapat digolongkan sebagai golongan reformis dalam menyikapi modernitas daihadapan tradisi. Keyword: Al-Jabiri. Relasi tradisi, Modernitas.

Abstract

This paper aims to describe the contextual leadership of the Principals of Madrasah Ibtidaiyah (MI), and Islamic Elementary School which includes (1) Their understanding of the internal and external environment (2) Their understanding of the various strengths that exist in stakeholders, and the ability to capitalize on them for the success of their schools; (3) Their understanding of society's expectations, as well as their response to these expectations; and (4) Efforts by school principals to encourage high performance and innovation in teachers and school staff. This paper is based on the results of a qualitative descriptive study conducted at three schools: State Madrasah Ibtidaiyah, Private Madrasah Ibtidaiyah and Islamic Elementary School in Salatiga. Data were collected using multiple sources, including participant observation, interviews with a variety of people including the principal, other school leaders, teachers, school council/board members, parents and students, and documents study. Data analysis is done through: (1) data collection, (2) data reduction, (3) data display (data display), and (4) conclusion and verification. The result of study shows that (1) school principals have a good understanding of the internal and external conditions of the school they lead, (2) school principals can find the strengths that exist in stakeholders and are able to capitalize on them for school progress, (3) school principals absorb aspirations and com-munity expectations and trying to provide a satisfactory response, and (4) school principals encourage the perfor-mance of teachers by prioritizing a sense of responsibility and challenges to meet community expectations.

Abstract

Abstract: Moderation of Islam from the perspective of Habib Umar bin Hafidz is to understand the shari'ah thoroughly so that it can put a law in its place. Moderation of Islam must be included in all aspects, including in the realm of Education, especially Islamic Religious Education (PAI), both textually and contextually. Based on research, the presenters of the Al-Makmur Bojonegoro Islamic Boarding School have adopted a moderate-based PAI that is delivered contextually, this is proven by the activities that will be described in this paper. Moderasi Islam prespektif Habib Umar bin Hafidz adalah memahami syari’at secara menyeluruh sehingga dapat menempatkan suatu hukum pada tempatnya. Moderasi Islam harus masuk pada segala aspek termasuk dalam ranah Pendidikan khususnya Pendidikan Agama Islam (PAI) baik secara tekstual maupun kontekstual. Berdasarkan penelitian yang dilakukan, pondok pesantren Al-Makmur Bojonegoro telah mengadopsi PAI yang berbasis moderat yang disampaikan secara kontekstual, hal ini terbukti dengan adanya kegiatan-kegiatan yang akan dipaparkan dalam tulisan ini.. Abstract

This study aims to determine the effectiveness of the direct method for Maharah Kalam in the Muhadatsah program at the Mamba'us Sholihin Suci Islamic boarding school, Manyar Gresik. This research is a Classroom Action Research which consists of 2 cycles with subjects being Arabic language education students in the second semester of the Mamba'us Sholihin Gresik Islamic boarding school. Data collection is done through tests, observations, and documentation. The results showed that the use of the direct method in the muhadatsah program was able to make learning effective. Student learning outcomes in cycle II experienced a significant increase based on the average student score, where at the beginning of the cycle there were 5 students with good grades, or around 26% increasing to 13 students or around 68%, and from none of the students with very good grades, it increased to 6 students or around 32% who had very good grades.
