Abstract

Street photography is a form of artistic expression that captures social life spontaneously in public spaces. Behind its aesthetic and documentary value, this practice raises complex legal issues, particularly when it intersects with the boundary between the photographer’s freedom of expression and the individual privacy rights of the photographed subject. In the current legal framework, there are no specific regulations that clearly define the boundaries and legal responsibilities in the practice of street photography. Both photographers and the subjects they capture are placed in vulnerable positions: photographers risk criminalization on the grounds of privacy violations or defamation, while subjects who feel harmed lack a clear legal pathway to seek protection of their rights. This study examines the practice of street photography in Indonesia through a normative approach by analyzing the Criminal Code (KUHP), the Electronic Information and Transactions Law (UU ITE), and Law No. 27 of 2022 on Personal Data Protection (PDP Law), as well as connecting them to the principles of human rights as enshrined in the 1945 Constitution, the Universal Declaration of Human Rights (UDHR), and the International Covenant on Civil and Political Rights (ICCPR). The findings emphasize the need for the establishment of more specific regulations to create a balance between the rights of photographers and the rights of photographic subjects, thereby achieving legal certainty, justice, and the protection of human rights in the digital era.

Abstract

Self-efficacy is an important psychological aspect that influences students’ ability to cope with academic demands, social challenges, and future planning. At the senior high school level, students are faced with various challenges that require strong self-confidence in order to make independent and responsible decisions. This study aims to describe students’ self-efficacy levels, analyze the strategies employed by Guidance and Counseling (GC) teachers to enhance students’ self-efficacy, and identify the supporting and inhibiting factors in the implementation of these strategies at SMAN 3 Lubuk Basung. This research adopts a qualitative approach with a descriptive qualitative design. Data were collected through in-depth interviews, observations, and document analysis involving GC teachers, homeroom teachers, and students. Data validity was ensured through source and technique triangulation as well as member checking. The results indicate that GC teachers implement various services, such as individual counseling, group counseling, and information services focusing on strengthening students’ potential and self-confidence. The strategies applied include providing motivation, positive reinforcement, utilizing students’ successful experiences, and encouraging self-reflection. Supporting factors include school support and GC teachers’ competence, while inhibiting factors include limited service time, a large number of students, and low awareness among some students in utilizing counseling services.

Abstract

Legal protection for consumers in the banking sector has become an important issue along with the rapid development of digital technology that is changing the landscape of financial services. This article aims to analyze the challenges faced by consumers in banking transactions in the digital era and explore solutions that can be applied to improve consumer protection. Technological developments, such as mobile banking services, digital payments, and the use of artificial intelligence (AI) in customer data analysis, bring benefits, but also give rise to new risks such as threats to personal data security, cyber fraud, and inequality in access to services. This article examines existing regulations, such as the Consumer Protection Law and Bank Indonesia policies, as well as banking practices that can help protect consumers, including information transparency, strengthening cybersecurity systems, and implementing the principle of prudence. Through a legal analysis approach and case studies, this article provides recommendations for improving regulations and increasing the role of supervisory institutions in order to maintain a balance between digital innovation and consumer rights protection in the banking sector.

Abstract

This article examines local wisdom within the framework of cultural fiqh through the perspective of Islam Nusantara and its relevance for the global Muslim community. Islam Nusantara is understood as a manifestation of Islamic teachings that harmonize with local traditions and cultures without abandoning the universal principles of Islamic law. This approach emphasizes that fiqh is not rigid, but rather elastic in responding to social, customary, and cultural diversity. Local wisdom—such as traditions of mutual cooperation (gotong royong), deliberation (musyawarah), and respect for social harmony—is interpreted as embodying Islamic values that enrich religious practice. In a global context, the Islam Nusantara model offers a paradigm of religious moderation, tolerance, and intercultural peace. Thus, cultural fiqh serves as a bridge between normative texts and empirical realities, making it not only relevant to Indonesian society but also a potential source of inspiration for the world in building an inclusive and civilized civilization.

Abstract

This article analyzes management theories within the sectors of entrepreneurship, cooperatives, and MSMEs through an Islamic economic perspective on both national and international scales. In Islam, entrepreneurship is defined as an innovative and risk-taking activity that must be grounded in the principles of Tawhid (oneness of God), justice, and Sharia ethics. The study highlights Islamic cooperatives as a representation of a people-based economy that prioritizes the spirit of ta’awun (mutual assistance) and profit-sharing systems, with significant developments observed in Indonesia, Malaysia, and Turkey. Meanwhile, MSMEs are positioned as a vital pillar for the growth of the halal economy and job creation. Overall, the integration of Islamic values across these three sectors shifts the business orientation from mere profit-seeking toward the attainment of maslahah (public interest) and long-term sustainability.

Abstract

Client readiness is a key factor influencing success in the counseling guidance process. This article presents a literature review related to indicators of client readiness that are important in determining the effectiveness of counseling. Various studies have shown that client readiness can be influenced by internal factors, such as personal motivation, self-awareness, and emotional readiness, as well as external factors, such as social support and life situations faced. This article identifies key indicators of client readiness, including openness to change, ability to recognize problems, and commitment to be actively involved in the counseling process. In addition, the implications of these indicators for counseling practice are also discussed, including the importance for counselors to develop appropriate strategies in assessing and facilitating client readiness. By understanding indicators of client readiness, counseling practitioners can design more effective interventions that focus on increasing client motivation and involvement. This article is expected to provide useful insights for counselors and researchers to better understand the dynamics of client readiness and its application in more optimal counseling practice.

Abstract

The development of information technology in the digital era has encouraged law enforcement officials, particularly cyber police, to adopt increasingly sophisticated digital surveillance tools to detect, analyze, and prevent complex and rapidly changing cybercrimes. One instrument often associated with law enforcement intelligence functions is the use of malicious software (spyware) capable of covertly accessing information and collecting sensitive data from target devices. Although spyware is operationally effective in intelligence activities, its use raises fundamental issues related to legality, limits of authority, and protection of citizens' privacy rights. In the Indonesian context, the police's authority to conduct digital surveillance is based on Law No. 2 of 2002 concerning the Indonesian National Police and Law No. 17 of 2011 concerning State Intelligence, but neither regulation specifically regulates the mechanisms for spyware use. On the other hand, the Electronic Information and Transactions Law (UU ITE) and the Personal Data Protection Law impose strict restrictions on illegal access, interception, and processing of personal data without a valid legal basis. Therefore, this study examines the urgency of comprehensive legal regulations for the use of spyware by cyber police to ensure a balance between effective law enforcement and human rights protection. The study's findings indicate that specific regulations are needed to prevent abuse of authority, ensure accountability, and ensure that digital surveillance is conducted based on the principles of legality, proportionality, and transparency within a democratic, rule-of-law framework.

Abstract

Abstract

Childhood trauma is a negative early-life experience that can significantly disrupt an individual’s psychological development and influence later stages of life. This study aims to analyze the impact of childhood trauma on the mental health recovery process of university students. The focus of this research includes the types of trauma experienced, the psychological mechanisms affected, and the challenges that arise during the recovery process within the academic environment. This study employs a qualitative approach using in-depth interviews with students who have a history of childhood traumatic experiences. The findings indicate that childhood trauma can impair emotional regulation, increase levels of anxiety and academic stress, and reduce self-confidence in forming social relationships on campus. Nevertheless, social support, counseling services, and a responsive campus environment play a crucial role in strengthening students’ mental health recovery. These results highlight the importance of early trauma intervention and adequate psychological support services to promote long-term mental well-being among university students.
