Abstract

This research discusses the state institutional format in the Constitution of 1945 after the amendment. Since the Constitution 1945 had four changes from 1999 to 2022, so need to know what implications for all state institutions. The Constitution is the supreme law of the land in the Indonesian legal system, which was used as the basis for all social practice, nation, and state. This research used a normative approach in which the formation of the state is in accordance with its designation or not. The study of the content used normativejuridical or doctrinal methods. This study found that the third and fourth amendments to the 1945 Constitution established three new institutions, namely the DPD, the Constitutional Court (MK) and the Judicial Commission, while the Supreme Consultative Council was abolished. With amendments to the 1945 Constitution, the MPR is no longer the highest institution. Likewise, changes in the constitutional system. These changes cover the government system (the President and Vice President as one leading institution),the representative system (MPR consisting of the DPR and DPD), and the justice system (MA and MK). The reformed format for organizing state institutions in the 1945 Constitution applies a system of enhancing power and the principle of checks and balances between state institutions, as in democratic countries.

Abstract

Because the world is mortal, Islam is a complete religion that is the solution to all problems. Islam regulates the way of human life based on needs and does not splurge, making enjoyment the goal of life. The Prophet warns his people not to be extravagant, greedy, or oblivious to the world. However, the emergence of a lifestyle trend makes enjoyment. Enjoyment of life and endless satisfaction is a disease. Hedonistic behaviorcauses perpetrators to be excessively consumptive without realizing that if their income sources are limited, the impact of hedonistic actors will be wasteful, irresponsible, and in debt to the worst corruption. This paper addressed the Prophet's hadith as a solution to hedonism. Sahih (valid) hadiths are found by using the takhrj hadith method (validation) and examining its content using the taḥlīli (analytic) method by revealing the ontology, epistemology, and axiology sides. From the way of seeking sustenance and always seeking the lawful in order to benefit human life and avoid hedonistic behavior.

Abstract

This research was focused on the correlation of socio-political conditions of pre-Islamic Arab society and the formation of tamaddun Islamiyah. This research study is driven by the historical disintegration that developed in academic circles, where history is understood in various ways without a clear accentuation of the developing storyline. Thus, this study tries to reveal how there is a close correlation between pre-Islamic Arab historiography and the tamaddun Islamiyah project initiated by the Prophet Muhammad. This research was a descriptive-qualitative research using socio-historical and Islamic history (Tārīkh Tasyrī') to analyze the nature, character, and influence of civilization then interpret and generalize the historical facts that surround it. The sources of data were obtained from various historical literatures relevant to the research topic. The results of this study indicate that the correlation between tamaddun Islam and pre-Islamic Arab civilization is a project to abolish Ashabiyyah which is rooted in Arab society.

Abstract

The purposes of this research were to (1) describe the practice of the Jember Fashion Carnival (JFC), which is held in Jember, Indonesia, and (2) explain how the practice of the Jember Fashion Carnival (JFC) is regarded from the perspective of Islamic law. This research is included in the qualitative-descriptive and literature research category. In conclusion, (1) the Jember Fashion Carnival (JFC) is a cultural event as well as a carnival that is held every year with a specific theme; this spectacular activity attracts foreign tourists and helps to boost the economy, among other things; and (2) the entire event contained in the Jember Fashion Carnival (JFC) is a good culture that does not conflict with Islamic law. As a result, it is feasible and may be implemented as a normal culture within the local community. No action taken at the Jember Fashion Carnival (JFC) activity violates Islam, nor does it ban something permissible, nor does it cancelsomething compulsory, invalidate the meaning of benefit, nor does it foster the growth of evil.

Abstract

Darwin's theory of evolution continues to be a source of contention for academics concerned with the main issues of Islam and science in the twentieth century. As such, this research seeks to elicit perspectives from Islamic scholarly figures such as Seyyed Hossein Nasr, Zaghloul Al-Najjar, and Nidhal Guessoum. The three figures have varying perspectives on Darwin's theory of evolution. This divergent interpretation of Darwin's theory of evolution demonstrates that the debate on Islam and science did not totally result in the merger of the two, as all Muslim scholars agreed. This research employs Michel Foucault's archaeology and genealogy theories to examine the growth of Darwin's theory of evolution in the Islamic world, as symbolized by the three thinking figures. The findings indicated that Nasr expressly rejected Darwin's theory of evolution, which had been subjected to scientific and philosophical scrutiny. Al-Najjar says that the attitude of rejection and general acceptance of evolution theory is incorrect. By contrast, Guessoum views Darwin's theory of evolution as a factual truth that must be understood through the lens of Islam in order to generate theistic conceptions of evolution.

Abstract

This study aimed to describe the condition of the digital economy in Indonesia before the COVID-19 pandemic, analyze the challenges, strategies, and Islamic ways to strengthen economic digitalization in Indonesia, and describe the upgrading steps to realize economic digitalization in Indonesia. Using qualitative data and qualitative-descriptive analysis methods, the researchers analyzed the digital economy, community index, and social and economic processes. System observations and online transaction recapitulation, online journals, books, papers, and other publications were used to obtain the data of this study. As a result of this study, the challenges ofeconomic digitalization in Indonesia are the ability of Indonesians to adapt to new technologies and the diverse locality values in Indonesia, which are still general. The strategy that can be implemented is developing end-user policies, such as end-to-end business cycle policies, and strengthening digital economy development governance that retains the value of Indonesian locality while involving various parties through collaborative steps. Besides, developing Islamic financial technologies is also required. This aims to improve sharia-compliant online market liquidity and social finance (zakāt, infāq, and waqf). In conclusion, the digital economy in Indonesia must encompass enhancing company processes through technology innovation, encouraging growth through government regulations, and involving new actors.

Abstract

Internet and social media are sources of information and religious knowledge references, especially for millennials and middle-class urban communities. The transformation of Islamic da’wah mode from offline to online is still dominated by men preachers. Actually, women's da’wah movement can be found in new media platforms but they get less attention. This study aims to explore the role of women preachers in Islamic da’wah in the digital era. Second, to explore the digital da’wah strategy of the Islamic Gender Justice studies (Ngaji KGI) community. The research method used to analyze the problem above was a qualitative-research with an anthropological-da’wah approach. This paper shows that the role of female da’i is equal and their position is crucially the same as that of male da’i. In addition, Ngaji GKI strategy by adhering to relative advantage, compatibility, complexity, triability and observability makes its existence different from other communities.

Abstract

This article discusses the condition of pesantren in Pantura (the northern coast area of Java) during the pandemic of Covid-19. This phenomenon of the Covid-19 outbreak is worrying because pesantren is a collaborative community that carries out activities without fulfilling social distancing. How the pesantren community negotiates themselves amid the Covid-19 pandemic, and how it reflects and adapts each activity. This study aims to reveal the pattern and response of the religious community of pesantren related to activities during the Covid-19 pandemic. This research was field research that used a model to obtain data by observing pesantren and analyzedwith three theories, namely Glok and Stark on religiosity and Max Weber for social action and Talcott Parsons' theory of adaptation. During the Covid-19, pesantren can negotiate conditions amid a pandemic by reflecting on maintaining and preserving the tradition of prayer and a form of adaptation to spirituality and morality while still adhering to health regulations.

Abstract

This study focuses on the justice contained in al-'awl as a part of the inheritance system in Islam. For some people, justice in the Islamic inheritance is a form of injustice, and others consider it proportional justice. Therefore, tracing how the value of justice in the initial concept is a challenge in itself. Moreover, the concept of Al-Awl is considered as a reduction of existing parts. In addition, this article also focuses on the problem of the distribution of Al-Awl's manifestations with the provisions of God's law. This research used a qualitative method with a philosophical-theological approach to answering this question. This study shows that al-Awl in the Islamic inheritance system is closely related to the value of justice. This is because al-Awl shows equality by reducing legal provisions to avoid conflicts between family members, not injustice or proportional justice. Al-Awl is a solution to reduce the definite portion of all heirs proportionally, which is a way out that provides the general benefit compared to reducing the definite portion of some heirs. In addition, al-Awl's concept is a manifestation of the acceptance of God's law in the destiny of death and the reality of the remaining family structure.

Abstract

This study was to investigate the influence of mosques in developing moderate communities in West Kalimantan. Mosques are Da'wah institutions that are aligned with the community's values. Aside from serving as a place of prayer, the mosque is also a source of empowerment for women. Threrefore, the focus of this article is on the role of mosques in the development of Islam and the adoption of models of religious moderation in mosques. This study used a sociological approach. This study reveals that, despite the fact that a certain group was responsible for the mosque's construction, the mosque's management does not take sectarianism into consideration. A significant indication that mosques play a vital role in the development of moderate Islam is their refusal to join sides with particular parties. The mosque serves as a social institution in addition to serving as a place of prayer. The successful implementation of modern mosque administration principles is a model that may be adopted by a number of other mosques to enhance their facilities as a location to foster the development of a moderate community. When modern management ideas are used to mosque management operations, the realization of the mosque's existence is possible to achieve.
