Abstract

This study aims to analyze the effect of compensation and motivation on employee performance with work discipline as a mediating variable at PT Sustraco Adikreasi. The research employed a quantitative approach using a census method involving 40 respondents. Data were collected through questionnaires and analyzed using SPSS version 20 with multiple linear regression and Sobel test. The results showed that: (1) compensation does not have a significant effect on employee performance, (2) motivation has a positive and significant effect on employee performance, (3) compensation has a positive and significant effect on work discipline, (4) motivation has a positive and significant effect on work discipline, (5) work discipline has a positive and significant effect on employee performance, (6) work discipline significantly mediates the effect of compensation on employee performance, but (7) work discipline does not significantly mediate the effect of motivation on employee performance. These findings highlight the crucial role of work discipline as a mediator in the relationship between compensation and performance, but not in the relationship between motivation and performance.

Abstract

Indonesia, endowed with abundant natural resources, bears a constitutional obligation to ensure a healthy environment for all citizens as mandated by Article 28H of the 1945 Constitution. However, the ongoing environmental crisis—characterized by ecosystem degradation and the impacts of global warming—demands stronger legal instruments for the prevention and control of environmental pollution and destruction. Environmental law plays a crucial role in this regard, particularly through the Environmental Impact Assessment (AMDAL), which has historically served as a preventive planning tool and a primary prerequisite for business licensing. Significant changes have emerged following the enactment of Law No. 11 of 2020 on Job Creation, which shifts the licensing framework from a permit-based to a risk-based approach. This shift has downgraded the status of AMDAL from a primary requirement to a supplementary one, raising concerns about the weakening of its preventive function. Moreover, the perceived relaxation of environmental criminal sanctions under the new law has sparked questions about the state’s commitment to constitutional mandates for environmental protection. These concerns are further compounded by the conditional unconstitutionality status of the Job Creation Law, creating uncertainty regarding the effectiveness of environmental law enforcement. This study employs a normative-juridical approach to analyze the regulatory changes introduced by the Job Creation Law and its implementing regulation, Government Regulation No. 22 of 2021, in comparison with the previous framework under Law No. 32 of 2009 on Environmental Protection and Management. The focus lies on examining the urgency and effectiveness of AMDAL as an instrument for controlling environmental degradation and pollution, as well as its implications for potential environmental criminal acts under the new legal regime. The findings of this study are expected to provide a deeper understanding of the impact of legislative changes on environmental protection in Indonesia and to identify legal gaps that may exacerbate the environmental crisis. The study aims to inform policymakers in striking a balance between economic development and sustainable environmental protection.

Abstract

When restitution (compensation) cannot be fulfilled by the perpetrator for various reasons, an alternative that is usually used is a substitute punishment. By examining Court Determination Number 1/Res.Pid/2023/PN Bkt, which does not formulate a substitute punishment, the Public Prosecutor (JPU) will encounter difficulties in executing the determination. To further study this issue, the problems addressed in this thesis are : 1) How is the implementation of restitution by the Public Prosecutor for child victims of criminal acts based on Court Determination Number 1/Res.Pid/2023/PN Bk?, 2) hat are the judge’s considerations in determining restitution for child victims of criminal acts based on Court Determination Number 1/Res.Pid/2023/PN Bkt?, 3) hat are the obstacles encountered in the implementation of restitution, whether based on court verdicts or judicial determinations, in cases where restitution is not paid to child victims of criminal acts?. This study employs empirical (sociological) legal research. The research approach used includes the statutory approach and case approach through Court Determination Number 1/Res.Pid/2023/PN Bkt, with the research being descriptive in nature. The findings and analysis are as follows: 1) The prosecutor cannot directly seize the perpetrator’s assets if the convict/respondent is unable to pay the restitution as determined by the judge, resulting in the judge's determination being unenforceable by the Public Prosecutor. 2)The legal considerations in Court Determination Number 1/Res.Pid/2023/PN Bkt do not mention legal protection for children at all, even though the case involves a child as a victim of a criminal act. According to existing laws and regulations, such cases must be resolved through approaches that go beyond formal legal mechanisms. 3) The obstacles found in the implementation of restitution based on the judge's determination are influenced by several factors Legal factors (regulations), Law enforcement factors (law enforcement officers), Community factors (individuals)

Abstract

The development of criminal law has encouraged the implementation of penal mediation as an alternative for resolving criminal cases. This study aims to analyze: (1) the resolution of criminal acts through penal mediation based on the Attorney General Regulation Number 15 of 2020 at the prosecution level in Sijunjung District Attorney’s Office; (2) the considerations for appointing a Facilitator Prosecutor within the Restorative Justice framework; and (3) the obstacles in implementing penal mediation. This research employs an empirical legal (sociological) approach with a descriptive method. The findings indicate that the Public Prosecutor acts as a third party facilitating deliberations between the victim and the offender until an agreement is reached; the appointment of a Facilitator Prosecutor considers integrity, competence, communication skills, experience, and caseload; and the main obstacles include negative public perceptions of case termination, limited public understanding of restorative justice, and a short duration for peace-making processes. The study highlights the crucial role of Prosecutors in supporting criminal case resolution through penal mediation.

Abstract

This study aims to describe the implementation of the Project-Based Learning (PjBL) model in the process of creating creative dance in class X.TITL 2 at SMK Negeri 2 Wonosobo. The research uses a descriptive qualitative method, with data collected through observation, interviews, and documentation. The results show that the learning process begins with a pre-instructional planning stage in the form of a teaching module designed according to school facilities and aligned with the Merdeka Curriculum. The application of the PjBL model successfully enhances students' active participation, creativity, and problem-solving skills through collaborative group work. Although the resulting dance works still require further development in terms of creativity, the learning process is effective. Project-based learning provides meaningful learning experiences and encourages students to be more independent and collaborative. Therefore, full support from the school and continuous development of the method by teachers are necessary to optimize learning outcomes.

Abstract

This study aims to analyze the implementation of policies to address the school dropout rate (APS) in Sukabumi City. Although the APS at the elementary/Islamic elementary school (SD/MI) level is almost negligible, problems persist at the junior high/Islamic junior high school (SMP/MTs) level, particularly in areas with high socio-economic vulnerability. The research employs a descriptive qualitative approach, utilizing primary data from interviews with the Head of the Education and Culture Office of Sukabumi City and secondary data from official documents and local media. The findings reveal that the causes of APS include economic constraints, low learning motivation, early marriage, administrative barriers, and cultural influences. Strategies implemented include the School Dropout Tracking Program (PAPS), family mentoring, equivalency education, and mapping of APS-prone areas involving various stakeholders. Challenges encountered include data accuracy and integration, cultural resistance, and the impact of class quota policies on private schools. Assistance programs such as BOS, PIP, and Smart Cards play a role in preventing APS but have not yet been fully optimized. This study recommends strengthening area-based data systems, improving the effectiveness of educational assistance, fostering program innovation, and empowering communities to ensure equitable access to education.

Abstract

The digital transformation of cooperatives has become a crucial strategy to enhance competitiveness and ensure sustainable member-based enterprises. This study aims to analyze the Social Return on Investment (SROI) of the program Future Finance: Transforming FEB Unair Cooperative into Digital Transactions with BRI through the utilization of the Localoka platform. The research employed the SROI framework, which includes stakeholder identification, impact mapping, outcome monetization, and SROI ratio calculation. Data were collected through event observation, documentation, and program financial reports. The findings reveal that the program generated outcomes worth IDR 1,050,025,000 with an input of IDR 52,381,000, resulting in an SROI ratio of 20.05. This indicates that every IDR 1 invested in the program yields a socio-economic return of IDR 20.05. The results highlight that the collaboration between the cooperative and BRI through Localoka not only fosters digital transaction adoption but also contributes positively to digital literacy, institutional reputation, and the economic welfare of cooperative members. This study provides practical implications for developing cooperative–financial institution partnerships to strengthen the digital ecosystem of MSMEs in Indonesia.

Abstract

The legal issues related to insults by state officials against judicial institutions highlight two important aspects. First, the application of sanctions for this action raises questions about legal certainty, because it can damage the integrity of the judicial institution and reduce public trust. Second, there are challenges in proving elements of insult that are often subjective, especially when state officials use the right to freedom of speech as a defense. The complex process of proof requires strong evidence, and a balance between protecting the honor of the judiciary. This study discusses the application of criminal evidence related to insults by state officials against judicial institutions in the context of legal certainty. Based on Article 240 of the Criminal Code which regulates insults against state institutions, including the judiciary, this study highlights the uncertainty in the application of sanctions due to the ambiguous definition of insult and the complaint procedure that depends on the party who feels aggrieved. Gustav Radbruch's legal approach to legal certainty is raised to explain the importance of consistency and clarity of law in these cases. Inconsistent law enforcement can lead to injustice, especially when state officials are protected from criticism under the pretext of insult, which ultimately undermines public trust in the judicial system.

Abstract

Constitutional Court Decision Number 60/PUU-XXII/2024 provides a new interpretation of the provisions on the threshold for nominating regional heads in Article 40 paragraph (3) of Law Number 10 of 2016, which previously limited non-parliamentary political parties from nominating regional head candidates even though they obtained valid votes. This study aims to analyze the normative correction from a legal perspective. This study uses a juridical-normative and qualitative-contextual approach with a library research method through an analysis of the Constitutional Court's decision, the principles of legal principles, and constitutional law literature. The results of the study show that the Constitutional Court's decision eliminates forms of electoral discrimination by restoring the rights of political parties that obtain 25% of valid votes to continue to nominate regional head candidate pairs, even without DPRD seats. In a legal perspective, this constitutional interpretation is in line with the principles of justice (al-adl), political equality (al-musawah), and public welfare (al-maslahah al-'ammah). This decision is considered as a form of ijtihad siyasiy by state institutions to free political access from the domination of local oligarchy. Thus, the constitution and Islamic principles can synergize in encouraging substantive democracy at the local level.

Abstract

Penelitian ini mengkaji menurunnya kinerja logistik Indonesia, tercermin dari penurunan skor LPI 2023, terutama dalam pelayanan kepelabuhanan, keandalan, dan sistem digitalisasi yang menghadapi kendala teknis. Kondisi ini mempengaruhi kepuasan dan kepercayaan pengguna jasa pelabuhan, termasuk di PT Krakatau Bandar Samudera (KBS) yang meskipun telah mengadopsi teknologi Smartport System dan INSW, masih mengalami masalah infrastruktur, optimalisasi dermaga, dan kualitas sistem web yang belum stabil. Penelitian ini bertujuan menganalisis peran kualitas sistem web INSW dalam memoderasi hubungan antara pelayanan kepelabuhanan dan kepuasan pengguna jasa, yang berimbas pada kepercayaan pengguna jasa di PT. Krakatau Bandar Samudera. Survei dilakukan dengan kuesioner kepada 130 responden pengguna jasa di PT. KBS, dengan menggunakan teknik analisis Structural Equation Modeling (SEM) melalui SEM-PLS 4.0. Hasil penelitian menunjukkan bahwa pelayanan kepelabuhanan berpengaruh positif terhadap kepuasan dan kepercayaan pengguna jasa. Kualitas sistem web INSW berperan penting dalam memoderasi hubungan tersebut, dengan fokus pada peningkatan efisiensi operasional dan transparansi layanan. Peningkatan kualitas sistem web berkontribusi pada kepuasan pengguna yang memperkuat kepercayaan mereka terhadap perusahaan. Selain itu, kepuasan pengguna memediasi pengaruh pelayanan kepelabuhanan terhadap kepercayaan pengguna, yang memperkuat hubungan kepercayaan jangka panjang.
