Abstract

People’s refusals and disobediences upon fatwa (released by MUI or ulama with their own opinions), followed by influence decreases of religious figures (ulama) towards Muslim community, were being such of phenomenal realities in Indonesia nowadays. This mass behavior might redefine their perceptions and thoughts about “the legitimate ulama”, according both; syara’ (religious legitimation), and social system. The research was located in Pekalongan Regency, thought-out known as “Kota Santri”, and plenty more, many Pesantren and Kyai have lived there. The result revealed that ulama and Muslim Community mostly had the same perception and view in understanding the meaning of Hadist “al-ulama’ waratsat al anbiya” (ulama are heir of prophets). Ulama’ as informants added ulama’ were religious successor leader after the end of Muhammad’s saw prophetic era. But, in another sides, there were some differences, especially in interpreting social label: Kyai, KH, or Ustadz. Muslim Community mostly thought that a person who had such social label was ulama. Meanwhile ulama noted Kyai, KH or Ustadz was just social label, no more. So, it seemed to be weird and screwy if we looked up the sosial fact of fidelity of Muslim Community in Pekalongan Residence. It also could be said that Muslim community in Pekalongan Residence were standing still their obidiece toward kyai, KH, Ustadz or another ones, not toward ulama yet.

Abstract

After the breaking off of Banjarsari market of Pekalongan City, the small vendors of the market came up and did not give up with the condition. They made an institution called PARTI or PASTI –standing for pasar tiban – to hold a temporary market to make them survive economically. The problems to be answered in this research are what the social capital values that are acknowledged and institutionalized among the vendors; how they struggle to survive; and what factors that support and hamper their struggle. To answer those problems, this research used qualitative approach by observation and in-depth interview to collect data. Key informants were selected purposively using snowball sampling. Data triangulation was used to validate the collected data. The result of this research shows that social capital values i.e. trust, values-norms, participation, and structure based on Islamic values and built up through social interaction between the vendors and their stakeholders can put the society’s economic wheel in motion and also build social structure more effective, efficient, and communicative. The ability strategy done by them to survive and exist is that they are able to maintain their ability in increasing their turnover, number of costumers, capital, and family’s welfare, and their ability to make good relationship among them, and between them and local community and administration. In fact, the existence of temporary market has not only support factors but also hamper factors.

Abstract

This research focuses on three fatwa of MUI that are regarded controversial, i.e. legal opinion on smoking, apolitical attitude, and under aged marriage. These three problems are viewed from maqâshid asy-syari’ah view. In legal opinion on smoking, maslahah that will be manifested is to avoid the negative effect of smoking. In this case, they used sad al-dzari’ah method. In legal opinion on apolitical attitude, they viewed that voters should vote their leader based on certain criteria. In this case they also used sad al-dzari’ah method. In legal opinion on under aged marriage, they tended to avoid under aged marriage practices to avoid madlarat, and, according to them, it is difficult to reach the objective of marriage. Under aged marriage, however, according to them, is still legal. To manifest this maslahah, they used maslahah al-mursalah, qiyas dan sadd adz-dzarî’ah altogether.
