Abstract

The Defendant in the Corruption Case on Land belonging to the Kupang City Government, Thomas More, committed a criminal act of corruption with witness Jonas Salean in accordance with the contents of the Kupang Class IA District Court decision in 2020 and in this case the Defendant and the Witness in question issued the land title certificate and signed the assets. belongs to the State in order to enrich oneself, so that in the District Court decision letter Number: 40/Pid/Sus-TPK/2020/PN-KPG. The defendant Thomas More was sentenced to a criminal sentence while the witness Jonas Salean was given an acquittal. The main problems in this research are: (1) What are the factors that cause the occurrence of criminal acts of corruption? (2) What is the basis for the judge's consideration in handing down an acquittal decision in this case? This research is empirical legal research, namely reviewing and analyzing data obtained from the research location. The results of this research show that (1) the factors causing corruption in land belonging to the Kupang City Government are (a) Internal Factors, namely the feeling of wanting to enrich oneself. (b) External Factors, namely the existence of opportunities/opportunities which are seen from the position of the defendant at the time of committing the crime corruption and also the closeness of the defendant to witnesses who participated in committing criminal acts of corruption. (2) The basis of consideration used by the judge in handing down an acquittal decision is seen from: (a) the elements of the primary indictment article and (b) the elements of subsidiary coercion.

Abstract

The purpose of this study, conducted by the author, is to generally understand and analyze the relationship between the village chief and the village deliberative body (Badan Permusyawaratan Desa) in the implementation of development in Mundinggasa and Natanangge Villages. It aims to identify and examine the obstacles that hinder the relationship between the village chief and the village deliberative body in the implementation of village development in Mundinggasa and Natanangge Villages, using an empirical juridical method and analyzing qualitative descriptive data. The research focus includes the relationship between the village chief and the village deliberative body, development planning, implementation, supervision, and the impact of the relationship on the administration of the village. Data were directly obtained from the research location involving 12 respondents. The results of the study conducted by the author show that the relationship between the village chief and the village deliberative body in development planning is generally good. However, the main issue lies in the lack of communication and coordination between the village chief and the village deliberative body, resulting in the implementation of village development not proceeding smoothly and being vulnerable to exceeding the specified time frame in the development plan. A positive relationship can bring about beneficial changes in village governance, but a lack of harmony in the relationship, due to insufficient transparency from the government institutions, can lead to negative impacts.

Abstract

The employment agreement, whether in written or oral form, holds significant benefits for the parties involved. This should be recognized because a well-made and adhered-to-employment agreement can create a peaceful work environment, guaranteeing rights and obligations for both workers and employers. Consequently, the company's productivity increases, and it can further open up new job opportunities. From the above description, the main issues are as follows: (1) What is the binding force and legal consequences of an employment agreement in terms of its form in the employment relationship in Kupang city? (2) Why do the parties use a particular form of agreement in the employment relationship in Kupang city? The purpose of this study is to determine the binding force and legal consequences of an employment agreement in terms of its form in the employment relationship in Kupang City. To find out the reasons why the parties use a particular form of agreement in the employment relationship in Kupang City. The research results prove that the binding force of an employment agreement in initiating an employment relationship in Kupang city is no different between oral and written agreements, as long as the agreement made complies with the legal requirements of a valid agreement as emphasized in Article 1230 of the Civil Code. The legal consequences of using both forms of employment agreements are equally binding on the parties according to the agreement's content. The issue arises when there is a conflict of interest between the parties; oral agreements will have a negative legal consequence in terms of proof, whereas written agreements can ensure legal certainty from the time the agreement is made until its termination. On the other hand, the reason the parties choose a written agreement to initiate an employment relationship in Kupang City is that a written agreement provides more certainty for the parties, whereas oral agreements are chosen more for practical reasons, saving time and costs. In general, this paper concludes that the binding force, legal consequences, and any form of employment agreement are the same as long as the parties are honest, especially during conflicts. The parties' choice of a particular form of agreement also has logical, practical, and legal certainty reasons.

Abstract

This study examines the Restorative Justice system in BNNP NTT, particularly focusing on the rehabilitation of drug addicts. Issues such as stigma, labeling, limited social support, mental health challenges, and post-rehabilitation job access constraints are identified. By integrating the Transtheoretical Model Theory and Reintegrative Shaming Theory, the research delineates six stages of behavior change at the Rehabilitation Center of BNNP NTT. Recommendations include enhancing education, social support, and collaboration. The research methodology employed is normative research, meaning it involves an examination of relevant laws and other legal sources. Primary legal materials, secondary legal materials, and tertiary legal materials are utilized. Social reintegration can be improved through effective awareness campaigns via social media and community activities. In conclusion, BNNP NTT needs to intensify efforts to support the Restorative Justice System, emphasizing education, social support, and collaboration to enhance the rehabilitation of drug addicts.

Abstract

This paper aims to discuss to what extent the management of village-owned enterprises (BUMDes) in Menia Village, west Sabu District, Sabu Raijua Regency in realizing community welfare and to examine the inhibiting factors for managing village-owned enterprises (BUMDes) in Menia Village, west Sabu District, Sabu Raijua Regency. The research is Empiris juridical research, namely: to approach the problem under study with a real legal nature or by the reality experienced by the community. The research emphasizes the implementation and obstacles faced in carrying out the roles and functions of Village Owned Enterprises (BUMDes) in Menia Village, West Sabu District, Sabu Raijua. The results of this research show that the management of village-owned enterprises (BUMDes) in Menia Village is not running well and is not in accordance with the established rules. This is because the initial funds or capital for micro small businesses (kiosan) are smaller than the capital for social and other development in Menia villages. So the management of kiosk businesses experiences bottlenecks due to goods that have been purchased and resold by BUMDes members setting prices higher than market prices. The impact of this stalled kiosk business is making it difficult for people to meet their needs amidst activity restrictions (Covid-19) andd also losses in funds that have been provided by the the villagee for initial capital in running BUMDes. Inhibiting factors that occur in the management of BUMDes are divided into two parts, namely: human resources. Minimal budget, leadership, and governance, while the external factor was an unexpected disaster (COVID-19). This shows that in managing BUMDes there must be careful management and preparation so that the expected results can be achieved for the welfare of the Menia village community

Abstract

The main problems in this writing are as follows: (1) What are the reasons for the transfer of consumer change in donations? (2) What is the procedure for withdrawing donations for the remaining fractions of consumer change coins at PT Sumber Alfaria Trijaya Tbk? (3) What are the obstacles and solutions to returning the remaining fractions of coins in transactions at PT Sumber Alfaria Trijaya Tbk? This type of research is empirical research conducted in This research was conducted at the place of business actors PT Sumber Alfaria Trijaya Tbk/Alfamart LLBK and Fatululi Villages, Kupang City, East Nusa Tenggara Province and the data source used was primary data. Primary data is data obtained directly from the research location through direct interviews with respondents. Based on the results of this study, it can be seen that (1) The following are some of the reasons for diverting consumer change, availability of small change, ease of transactions, store policy and reducing the loss of small change. (2) After the shift change or completion of working hours, the bank will collect all sales transactions, sales and donations every 2 or 3 days. Furthermore, it will be processed by the parent Alfamart Company in each province, then channeled to the Alfamart head office of the welfare care program, and given to the people in need through the Alfamart care program. (3) (obstacles) in the transfer of consumer change, there are still often some employees (unscrupulous) who do not carry out their duties properly, such as misusing consumer donations for their personal interests and not recording the donation money in the monitor. (Solution) Regarding the existence of dishonest cashier employees, the company should take actions such as, often conducting work checks at each Alfamart outlet, and if it has occurred, it should immediately give a firm warning and sanction to the employee, always routinely checking and disciplining employees

Abstract

The main problems of this research are: (1) How is the implementation of supervision of the Regional Government of North Central Timor Regency on the management of Village-Owned Enterprises? (2) Are there any obstacles in the use of supervisory authority of the Regional Government of North Central Timor Regency on the management of Village-Owned Enterprises? This research is an empirical juridical research. Data collection techniques are carried out by: interviews, literature studies, and documentation. The analysis technique used is qualitative descriptive. Results and discussion: (1) The supervisory authority of BUMDes has not been maximized, there is still abuse of authority. (a) Preventive Supervision Authority: In Lemon Village BUMDes the staffing authority has been running well according to their respective authorities, in Leo Sikun BUMDes Saenam Village supervision has not been maximized due to abuse of authority and no follow-up. In the PMD Service, supervision is routine and runs according to its authority, duties and functions. (b) Repressive Supervision Authority: in the PMD Office the follow-up action carried out is by conducting coaching, monitoring and evaluation. In BUMDes Lemon, follow up on existing obstacles by discussing with PEMDES. At BUMDes, Leo Sikun followed up by discussing with PEMDES, the community during MusDes and will be submitted to the PMD Office. However, until now there has been no change. (2) There are constraints in the supervisory authority: (a) Human Resources: in Lemon Village and Saenam Village the level of education is not very good and the need for attention from the PEMDES. (b) Facilities and Infrastructure: in Lemon Village there is no BUMDes office and also lack of supporting facilities in the form of computers. Meanwhile, in Saenam Village, facilities and infrastructure are sufficient, but there is no coordination between administrators and supervisors

Abstract

This study aims to analyze the implementation of Regent's authority delegating to Subdistrict Head in the context of regional autonomy and the impediment factors of the implementation of the Subdistrict Head authority at Kambera and Kota Waingapu Subdistrict of East Sumba Regency. This was an empirical judicial research with qualitative and conceptual approach. The data processing technique used were editing, clarification, tabulating, and verification, and analyzed by qualitative descriptive accord with the law theories, principles and norms. The results revealed that the Head of Kambera and Kota Waingapu Subdistrict have implemented the authority delegated by the Regent of East Sumba eventhough not optimal yet, which were (1) licensing services of commercial sector of issuing Micro and Small Enterprises (MSEs/UMK) Business License, by publishing code of conduct terms in running the MSEs business while the issuing and signing up the license by OSS RBA (Online Single Submission Risk-Based Approach) at the Capital Investment and Integrated One-Stop Services Agency (CIIO-SSA) of East Sumba Regency Government, (2) non licensing services of village and society/community empowerment sector by budget allocation for family welfare empowerment (PKK) activities and the homelesses; listing the village inhabitants deserved for and distribution the social aids; developing the young millenial generations through engagement in farming, breeding, running a business, and trading; (3) evaluation of the program by capacity developing of the Chiefs and all human resources apparatus set of the villages in drafting the Village General Revenue and Expenditure Budget (APBDes); accompanying in the planning, establishing, and implementing the APBDes, APBDes draft and village budget evaluation, and APBDes concerned village regulations evaluation quarterly and every year. The impediment factors of the implementation of the Subdistrict Head authority were (1) the minimity of MSEs Business Licensing socialization, (2) the utilities and infrastructures lacking which were the availability of services hall, office appliances such as computer, printer, operational motor vehicle, and budget, (3) the lack of coordination between the subdistrict with the villages government, neighborhood asociation (RT/RW) of the MSEs Business licensing services, listing the MSEs businessmen, acceptor listing and distribution of the social empowerment aids, and had not ever coordinated with the regency government and the CIIO-SSA, and (4) the poor quality of the subdistrict government human resources. Researcher suggests that the concerned stake holders which are the chief and the all human resources apparatus set of the subdistricts and regency governments, and CIIO-SSA should more enhancing the synergy in solution finding efforts of the impediment factors of the implementation of the Regent’s authority delegating to the Subdistrict Head such as by routine and continuously coordination in order to maintain and enhancing the services performance and regional welfare development

Abstract

Sebagai Negara yang kaya akan sumber daya alam, Indonesia memiliki potensi sumber daya alam yang meliputi bumi, air ruang dan kekayaan yang terkadung didalamnya, seperti bahan tambang. Di Indonesia usaha pertambangan tersebar hampir diseluruh wilayah yang bergerak dalam bidang eksplorasi, eksploitasi, pengelolaan/ pemurnian dan pengangkatan mineral tambang. Nusa Tenggara Timur merupakan salah satunya tambang batu warna yang terletak di Pesisir Pantai Kolbano, Kecamatan Kolbano, Kabupaten Timor Tengah Selatan. Aktivitas tambang batu warna merupakan mata pencaharian masyarakat setempat yang turut membantu memenuhi kebutuhan masyarakat lebih dari itu juga menyebabkan adanya pengrusakkan lingkungan. Secara yuridis kegiatan pertambangan diatur dalam Undang –Undang No. 3 Tahun 2020 Tentang Perubahan Atas Undang –Undang No. 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara. Pada Pasal 35 Undang –Undang Minerba menjelaskan bahwasannya setiap kegiatan pertambangan dilaksanakan berdasarkan perizinan berusaha. Pada kenyataannya, masih ada masyarakat yang menambang tanpa izin. Oleh karena itu, penelitian ini dilakukan dengan tujuan untuk mengetahui dan menjelaskan pelaksanaan penegakan hukum terhadap masyarakat yang melakukan penambangan batu warna secara illegal di Pesisir Pantai Kolbano. Penelitian ini dilaksanakan dengan menggunakan metode penelitian hukum Empiris (Empirical Legal Research) dengan hasil penelitian menjelaskan bahwa penegakan hukum pidana terhadap kegiatan penambangan batu warna di Pesisir Pantai Kolbano di Kabupaten Timor Tengah Selatan masih lemah dikarenakan masih adanya masyarakat yang menambang tanpa izin. Dari hasil penelitian, peneliti menyimpulkan bahwa lemahnya penegakan hukum terhadap kegiatan penambangan batu warna di Pesisir Pantai Kolbano di Kabupaten Timor Tengah Selatan dikarenakan kurangnya koordinasi antara masyarakat dan aparat penegak hukum.

Abstract

Perdagangan orang merupakan perbuatan perekrutan, pengangkutan, penampungan, pengiriman, pemindahan penipuan, pemalsuan, penyalahgunaan kekuasaan atau memberi manfaat kepada posisi rentan sehingga memperoleh persetujuan dari orang yang memegang kendali atas orang lain tersebut untuk dieksploitasi atau menyebabkan orang tereksploitasi di dalam maupun luar negeri. Perdagangan orang di saat ini lebih mengarah kepada perempuan dan anak yang mengakibatkan korban merasakan penderitaan psikis maupun fisik. Para pelaku perdagangan orang dalam praktiknya masih belum mendapatkan hukuman yang setimpal dengan perbuatannya. Penelitian ini bertujuan untuk mengetahui apa saja yang menjadi dasar pertimbangan hakim dalam menjatuhkan pidana terhadap putusan pengadilan dengan nomor perkara 160/PID.SUS/2018/PN.Kpg. Penelitian ini menggunakan metode normatif yang bersumber dari : (a) Bahan Hukum Primer yaitu Kitab Undang-undang Hukum Pidana, Kitab Hukum Acara Pidana, Undang-undang Nomor 21 Tahun 2007 Tentang Tindak Pidana Perdagangan Orang dan yang paling utama yaitu Putusan Pengadilan Nomor 160/Pid.Sus/2018/PN.Kpg, (b) Bahan Hukum Sekunder yaitu buku-buku hukum, jurnal-jurnal hukum, dan karya tulis hukum atau pandangan ahli hukum, (c) Bahan Hukum Tersier, diperoleh dari kamus hukum dan internet. Hasil penelitian menunjukkan bahwa terdakwa dihukum dengan hukuman yang rendah jika dilihat dari kesaksian yang diberikan oleh para saksi dan pelaku yang dituntut atas kasus yang sama dengan terdakwa PT sehingga menurut penulis hal ini tidak membuat efek jera dan tujuan dari pemidanaan itu tidak tercapai. Simpulan dari skripsi ini adalah dasar pertimbangan hakim dalam menjatuhkan pidana terhadap putusan pengadilan nomor 160/Pid.Sus/2018/PN.Kpg secara yuridis, hakim menilai bahwa putusan tersebut telah tepat tetapi jika diteliti maka hal tersebut sangat rendah menurut penulis. Secara filosofis, hukuman yang dijatuhkan sudah teapt dan adil tetapi penulis hal tersebut belum terlaksa sehingga tidak terciptanya nilai kebenaran dan keadilan. Secara sosilogis, dalam menjatuhkan hukuman perlu untuk jera para pelaku sehingga masyarakat setempat tidak melakukan hal yang serupa.
