Abstract

Dewan Perwakilan Rakyat (DPR) memiliki kewenangan untuk melakukan fungsi pengawasan, termasuk pengawasan terhadap uji kelayakan dan kepatutan (fit and proper test) dalam rekrutmen pejabat publik. Fungsi pengawasan tersebut merupakan bagian dari mekanisme checks and balances yang bertujuan menjamin akuntabilitas penyelenggaraan negara oleh pemerintah. Namun, dalam realitanya, mekanisme fit and proper test yang dilakukan oleh DPR dalam rekrutmen pejabat publik berjalan secara tertutup dan dipenuhi proses politik yang kental ketimbang mengutamakan proses teknokratis. Akibatnya, banyak pejabat publik hasil rekrutmen, yang tidak berintegritas dan tersandung kasus hukum. Penelitian ini mencoba untuk menelaah lebih dalam bagaimana seharusnya fungsi ideal DPR dalam fit and proper test dengan realitas yang terjadi, dan menawarkan bagaimana fungsi pengawasan DPR dalam mekanisme fit and proper test harusnya dijalankan.

Abstract

This study is presented to analyze the oversight function of the House of Representatives (DPR) in recruiting public officials through the fit and proper test from the perspective of Fiqh Siyāsah (Islamic constitutional jurisprudence). The issues examined include the mechanism and problems of DPR’s fit and proper test, and its analysis based on the principles of amānah (trustworthiness), ahliyyah (capability), shūrā (consultation), and maṣlaḥah (public interest). This normative juridical research employs statutory, conceptual, and comparative approaches, drawing on primary sources such as the Qur’an, Hadith, the 1945 Constitution, and classical Islamic constitutional works like al-Aḥkām al-Sulṭāniyyah. The findings indicate that, mechanistically, the fit and proper test represents a modern manifestation of shūrā and ḥisbah in overseeing official appointments. However, in practice, distortions such as political bargaining, subjective assessment, and lack of transparency contravene the principles of ‘adālah (justice) and amānah. Islam emphasizes a balance of moral integrity (al-amānah) and expertise (al-kifāyah), as well as an objective evaluation founded on clear argument (ḥujjah). The study concludes that an ethical reorientation is necessary, integrating the values of ṣiddīq (truthfulness), amānah, tablīgh (communicative competence), and faṭānah (wisdom) into the eligibility test parameters to achieve genuine public maṣlaḥah.

Abstract

The People's Representative Council (DPR) of the Republic of Indonesia possesses a supervisory function, one manifestation of which is the conduct of fit and proper tests (uji kelayakan dan kepatutan) for prospective public officials. Normatively, this mechanism aims to ensure the competence, integrity, and professionalism of officials entrusted with state responsibilities. However, in practice, various legal and institutional problems frequently arise, including the absence of objective assessment standards, alleged politicization of the selection process, and inconsistency among different commissions. This study normatively examines how regulations govern the implementation of fit and proper tests by the DPR, identifies structural weaknesses in the mechanism, and formulates the necessary institutional reforms. Employing a statutory and conceptual approach, this study finds that existing regulations remain partial and fail to provide adequate standardization, rendering the process vulnerable to deviation from the genuine objectives of parliamentary oversight. This study recommends the enactment of comprehensive DPR Regulations on fit and proper test standards along with measurable accountability mechanisms.

Abstract

The oversight function of the House of Representatives of the Republic of Indonesia, granted by the constitution, makes it a barrier against abuse of power by the executive branch, which in a presidential system enjoys significant power. To oversee this significant role of the government, strengthening the oversight function is crucial. The research method used in this study is juridical-normative, emphasizing a statutory approach, a conceptual approach, and a philosophical approach. The findings of this study are: first, that the oversight function of the House of Representatives of the Republic of Indonesia in a presidential system is limited to three rights: the right of interpellation, the right of inquiry, and the right to express an opinion. In a presidential system, the President's influence in the Indonesian state is dominant, resulting in political factions in parliament. Second, the strengthening of the House of Representatives' oversight function has decreased significantly compared to previous periods, namely 1999-2019, resulting in the House's oversight function not being effectively implemented.

Abstract

The appointment of Constitutional Court judges is a crucial process in safeguarding the independence and credibility of the constitutional judiciary. The controversy surrounding the appointment of Adies Kadir as a judge of the Constitutional Court has sparked debate regarding the role of the House of Representatives (DPR), particularly in the implementation of the fit and proper test mechanism. The research question in this study is how the DPR exercises its authority in formal terms and whether the substance of the assessment of prospective judges has fulfilled the principles of independence and accountability. The method used is normative legal research employing a legislative approach and conceptual analysis. The research findings indicate that, formally, the DPR has carried out the procedures in accordance with the regulations; however, substantively, there remain weaknesses in terms of transparency, objectivity, and the depth of evaluation regarding the integrity and competence of the candidates. In conclusion, the DPR’s authority in the fit and proper test must not be fulfilled merely procedurally, but must also prioritise the quality of substantive assessment to ensure the selection of Constitutional Court judges who are independent, professional, and of high integrity.

Abstract

This article analyzes the phenomenon of constitutional retrogression in the election of judges of the Constitutional Court (MK) proposed by the House of Representatives of the Republic of Indonesia, especially in the case of the appointment of Adies Kadir. The main issues examined are how the threat of constitutional decline occurs and how the ideal model for the election of constitutional judges in Indonesia. This research uses normative juridical method with conceptual approach and legislation, and supported by comparative studies. The results showed that the selection process of constitutional judges who are not transparent, minimal public participation, and loaded with political interests have the potential to weaken the independence and impartiality of the Constitutional Court as the guardian of constitution. The practice reflects the symptoms of constitutional retrogression, namely the weakening of democratic principles and constitutionalism through formal mechanisms that appear to be legally valid (under the mask of law). To overcome these problems, this article offers a more ideal model of constitutional judge selection reform through an open, participatory, and accountable mechanism, by adopting best practices from South Korea. The proposed Model includes the formation of an independent selection committee, the establishment of concrete criteria for statehood, the implementation of a transparent public test, and the restriction of the authority of the proposing institution to select only candidates from open selection. This reform is expected to strengthen the independence of the Constitutional Court and maintain the continuity of democracy and the rule of law in Indonesia.

Abstract

This research will uncover the structural weaknesses of the Mahkamah Kehormatan Dewan (MKD) that hinder its internal oversight function within the DPR, while proposing the U.S. Senate Select Committee on Ethics as a model for strengthening the MKD. Employing a normative legal approach with a comparative law method, this study analyzes the regulations of the DPR Honor Court against the U.S. Senate Select Committee on Ethics. The U.S. Senate Select Committee on Ethics model provides a concrete blueprint for structural reform of Indonesia's MKD to address systemic weaknesses, including its 100% factional composition and lack of transparency. The proposed hybrid reform adopts the bipartisan principles of the Senate Ethics Committee by establishing a new MKD comprising nine members: five from DPR factions proportionally, and four independent professionals from constitutional law academics, former constitutional judges, or political ethics experts, selected through open DPR screening with Judicial Commission approval as an independence filter. An Office of Parliamentary Ethics (OPE) would be formed as a public complaint screening body akin to the Office of Congressional Ethics (OCE), staffed by seven non-partisan professionals with initial 60-day investigative authority before referral to the MKD. This transformation elevates the MKD from a politicized factional formality to a credible internal oversight pillar, where public censure sanctions and expulsion recommendations can be effectively executed without political vetoes, thereby strengthening presidential checks and balances in Indonesia's semi-parliamentary system post-MD3 Law

Abstract

The House of Representatives (DPR) has a supervisory function that serves as the basis for its authority to conduct fit and proper tests as a mechanism to assess the capabilities of prospective public officials, including officials from the General Elections Commission (KPU) and the General Elections Supervisory Body (Bawaslu). However, regulations related to fit and proper tests are not regulated in detail, thus creating legal uncertainty. This condition has the potential to affect the independence of independent institutions that should be free and independent from external intervention. This research will raise the issue of the urgency of evaluating the regulations on fit and proper tests for officials from independent institutions by the DPR. The type of research used is normative juridical research with a statutory regulatory approach and a conceptual approach that utilizes secondary data in the form of primary, secondary, and tertiary legal materials. The results of this study indicate that the implementation of fit and proper tests carried out by the DPR requires evaluation in the form of codification to create clear standards, thereby creating legal certainty and harmonization in its application.

Abstract

This study presents an analysis of the concept and role of the Mukomuko Regency Land Office as a mediator in resolving land ownership disputes, with the formulation of the problem: What are the procedures for the Mukomuko Land Office as a mediator in resolving land ownership disputes? and What are the obstacles encountered by the Mukomuko Land Office as a mediator between the parties in resolving land ownership disputes? This research is an empirical research, using a conceptual approach and a statutory approach, data collection is carried out by observation or interviews, data analysis in this study uses qualitative analysis methods. This study obtained the results that the Mukomuko district land office in dispute resolution has a role to mediate in resolving existing dispute cases, is neutral, does not take sides on any side, seeks solutions and solutions together, so that no party feels disadvantaged in the settlement event. this dispute. The settlement of land disputes is based on the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 21 of 2020 concerning Handling and Settlement of Land Cases. There are two factors that hinder the mediation process, namely obstacles that come from the disputing parties and obstacles from the mediator himself.
