Abstract

Abstract

Cross-cultural communication in Ubud represents a critical friction point where high-context local traditions clash with low-context tourist expectations. This study investigates how cultural symbols are negotiated and transformed into tourism myths within this ecosystem. Employing an interpretive qualitative approach, data was collected through in-depth interviews with six key informants representing local and tourist perspectives, alongside participant observation in ritual and commercial spaces. The analysis was operationalized using Roland Barthes’ semiotic framework to trace the shift from denotation to myth. Findings reveal a systematic recoding of signifiers where local denotations, such as dance as a sacred offering or yoga as a modern lifestyle, are overwritten by tourist connotations of exotic magic and ancient spirituality. These individual perceptions coalesce into a second-order signification system, producing the global "Myth of Paradise." This myth functions to naturalize the commodification of culture, where authenticity becomes a negotiated service rather than an inherent quality. The study concludes that the "Paradise" narrative actively masks sustainability challenges, suggesting that future tourism management must prioritize cultural literacy over myth-making to ensure community resilience.

Abstract

Abstract

Commercial contract practices in Indonesia still reveal an imbalance of bargaining power, particularly through the use of standard-form contracts that often disadvantage one party. This condition raises questions regarding the role of the principle of proportionality in achieving contractual justice. This study aims to analyze the application of the proportionality principle as a corrective instrument to the freedom of contract in order to realize a fair balance of rights and obligations between parties. This research employs a normative legal method using statutory, conceptual, case, and comparative approaches, based on primary legal materials such as the Indonesian Civil Code and court decisions, as well as relevant national and international literature on contractual fairness. The findings indicate that the proportionality principle plays a vital role in maintaining substantial balance between contracting parties and aligns with Aristotle’s theories of distributive and corrective justice. However, its implementation remains weak due to the lack of control over standard contract clauses. The study recommends adopting the proportionality principle as a benchmark for contract formulation and judicial review to ensure fair, ethical, and sustainable business practices.

Abstract

Acquisitions of limited-liability companies (Perseroan Terbatas, PT) in Indonesia continue to rise, yet not all of them generate maximum benefit for shareholders, creditors, employees, and the public. This study examines the application of legal entity theory at every stage of an acquisition—from the pre-acquisition phase, through the transaction itself, to the post-acquisition period—and analyses how the principle of “the greatest happiness for the greatest number” can be aligned with Indonesian positive law. KPPU Decision No. 06/KPPU-M/2024 affirms that every limited liability company (PT) is an independent legal subject, so the statutory notification of an acquisition must be filed by the PT that actually exceeds the concentration threshold. Using a qualitative method and a case-study approach, this article examines how the theory of legal entity is applied in the acquisition of PT Sumber Baru Hydropower by PT Tamaris Hidro. The findings are: (i) KPPU rejected the “single economic entity” doctrine and upheld the principle of legal-entity independence; (ii) procedural factors (wrong notifying party) obstructed economic utility, while the absence of a social-impact assessment hindered social utility. The article recommends integrating a “Joint Utility Plan” as a prerequisite for the conditional no-objection letter.

Abstract

This qualitative case study examined: What mechanisms enable parent-school partnerships to transcend episodic initiatives and become embedded institutional practices in inclusive PAUD contexts? Data were systematically collected through semi-structured interviews with nine key informants, participant observations of 35 instances, and document analysis over five months. The study's most distinctive contribution documents the institutionalization of parent-school partnerships through eight systematically designed collaborative programs formalized in a comprehensive Parent Guidebook: KINASIH (parent peer learning community), Guest Teacher (parent expertise leveraging), Passion Club (parent skill-sharing), Meja Peradaban (cultural literacy), Market Day (entrepreneurship education), Anjangsana (home visits), monthly Parent Meetings (structured dialogue), and Home Visits (individualized family engagement). Analysis revealed five interconnected dimensions of collaborative leadership operating synergistically: shared vision understood across all stakeholder levels; structured communication mechanisms through multiple channels; democratic participatory decision-making; continuous professional development embedded in daily practice; and adaptive flexibility maintaining philosophical consistency. Findings demonstrate effective partnership institutionalization requires: formalizing programs in accessible documentation; establishing systematic multi-channel communication; embedding professional development in daily reflective forums; involving stakeholders democratically in vision formulation; and building programmatic flexibility while maintaining philosophical consistency.

Abstract

Evaluation of Supervision as the Role of the Principal and Its Impact on Improving the Quality of Teaching and Learning Activities in Elementary Schools: A Literature Review Study Background: The quality of teaching and learning activities in elementary schools is a fundamental pillar of education, the success of which is heavily influenced by the principal's role as an academic supervisor. However, supervision is often perceived merely as an administrative formality. Objective: This study aims to evaluate the implementation of supervision by principals and analyze its impact on improving the quality of teaching and learning activities at the elementary level through a systematic literature review. Methods: The method used is a Systematic Literature Review (SLR). The article selection process followed the PRISMA protocol across Google Scholar, SINTA, and Garuda databases within the 2020–2025 timeframe. Fifteen selected articles were analyzed using data extraction and thematic synthesis techniques. Results: Findings indicate that clinical supervision and classroom visitations are the most effective methods for enhancing teacher professionalism. Supervisory evaluation has a significant impact on innovative teaching methods, orderly instructional administration, and increased student engagement in class. Conclusion: Supervision that is carried out consistently, collaboratively, and followed by concrete follow-up is proven to sustainably transform the quality of teaching and learning activities in elementary schools.

Abstract

This study examines the role of the Ombudsman of the Republic of Indonesia Representative of West Sumatra in resolving reports of public service maladministration and identifies the obstacles and improvement efforts undertaken. Using a sociological legal research approach, the study is based on primary data obtained through semi-structured interviews and field observations, as well as secondary data from laws, regulations, and relevant documents. The findings indicate that the Ombudsman plays a significant role in handling maladministration cases; however, its performance has not yet been optimal due to limitations in human resources, operational budget, infrastructure, report complexity, and resistance from reported institutions. To address these challenges, the Ombudsman has implemented several strategies, including task optimization, digitalization of report management, public reporting education, inter-agency coordination, and budget advocacy. These efforts contribute positively to improving the effectiveness of complaint handling and strengthening public service accountability and citizen rights protection at the regional level.

Abstract

This study examines the direct and indirect effects of arm muscle explosive power, hand-eye coordination, and flexibility on smash ability among badminton players at PB Cahaya Pinang. Using a quantitative approach with path analysis, 14 male athletes were selected as participants. Data was collected through sport-specific tests: the two-hand medicine ball throw for explosive power, a tennis ball throw-and-catch test for hand-eye coordination, shoulder and wrist flexibility tests, and a smash performance test. The results revealed that flexibility had the strongest direct effect on smash ability (p = 0.906), followed by arm muscle explosive power (p = 0.270) and hand-eye coordination (p = 0.264). Flexibility also mediated the effects of arm muscle explosive power (64.4%) and hand-eye coordination (40.8%). Together, these variables accounted for 96.4% of the variance in smash ability, highlighting the integrated role of physical components in badminton performance.

Abstract

Health services constitute a constitutional right of every citizen, including self-funded BPJS Kesehatan participants who receive inpatient care in hospitals. In practice, however, various obstacles remain that may create gaps between legal norms and their implementation, as observed at RSUD dr. Rasidin Padang. This study aims to analyze the implementation of inpatient services for self-funded BPJS Kesehatan participants, identify the obstacles encountered, and examine the hospital’s responsibilities and efforts in providing legal protection for patients. The research employs a sociological juridical approach using an empirical legal research method. Data were collected through interviews with hospital management, healthcare personnel, and patients, as well as through a literature review of relevant laws and regulations. The findings indicate that inpatient services are generally implemented in accordance with applicable legal provisions; nevertheless, constraints such as limited inpatient capacity, service waiting times, and the complexity of BPJS administrative procedures persist. Therefore, hospitals bear the responsibility to deliver safe, high-quality, and non-discriminatory services and to continuously improve service mechanisms to ensure the protection of the rights of self-funded BPJS Kesehatan patients.
