Abstract

Narcotics crimes damage the future of the nation's generations in various aspects of life. Research result; By rejecting the request for review from the applicant for review/convict: FREDI BUDIMAN alias BUDI bin H. NANANG HIDAYAT; means that it does not fulfill the provisions of Article 263 paragraphs (2) and (1) of the Criminal Procedure Code, then based on the provisions of Article 266 paragraph (2) letter a of the Criminal Procedure Code, the request for review from the Judicial Review Applicant/Convict is due to the Judge's error or obvious error in the Judex Facti and Judex Juris decisions. , nor can it be justified because in the Judex Facti and Judex Juris decisions. The judicial review by the Supreme Court is in accordance with the provisions of Article 270 Jo. Article 271 of the Criminal Procedure Code. This is supported by the President's rejection of clemency submitted by convicts on death row for narcotics crimes in accordance with applicable provisions which also automatically stipulate that the court decision has permanent legal force (inkracht van gewijsde). This has also provided legitimacy for the Prosecutor to carry out executions in accordance with the provisions of Article 270 Jo. Article 271 of the Criminal Procedure Code. Author's Suggestions; That the decision can be used as jurisprudence for cases that are similar and have similarities to this case. There is a need to re-evaluate legal findings regarding state officials that provide legal certainty in the field.

Abstract

This article discusses and analyzes about. Correlation between Madrasah Culture, Leadership Style and Work Ethics of Madrasah Heads and Career Growth of State Madrasah Aliyah Teachers in Jambi Province. Abstract

Article 297 paragraph (2) of Law Number 17 of 2023 concerning Health explains that every patient has the right to access the information contained in medical record documents. The regulation of patient access rights to medical records in Indonesia has given rise to various interpretations. The public has interpreted the meaning of the patient's right of access to information in medical record documents for themselves. This is where the problem arises, hospitals often face patients for some reason requiring medical records. With access rights, patients can freely use the contents of medical records as they wish. Seeing these conditions, the author wants to compare Malaysia's approach to regulating patient access rights to medical records. Objective: to examine the legal position and gaps using a comparative analysis of patient access to medical records in Indonesia and Malaysia. The research method uses normative juridical data with secondary data and is analyzed using descriptive analysis.

Abstract

The purpose of this study is expected to be able to build a hypothesis regarding the influence between variables that can later be used for further research in the scope of human resource management. The article on the concept of human resource management: recruitment, job analysis, job evaluation, remuneration, and organizational development is a scientific literature article in the scope of human resource management. The approach or method used in this literature review research is descriptive qualitative. The data collection technique is to use literature studies or conduct a review of relevant previous articles. The data used in this descriptive qualitative approach comes from previous research that is relevant to this research and is sourced from academic online media such as the Thomson Reuters Journal, Springer, Taylor & Francis, Scopus Emerald, Sage, WoS, Sinta Journal, DOAJ, EBSCO, Google Scholar and digital reference books. In previous studies, 1 relevant previous article was used to review each independent variable. Abstract

Water is a natural resource that humans need as a source of livelihood and shelter. Business actors address this as a way to earn income. However, the methods used do not or do not have permits by the terms and procedures specified in the statutory regulations. One of them is the independent water management business actor in Ciapus Village, which of course, this situation has attracted the interest of researchers to research how to protect consumers and producers/independent water management business actors and what the government's responsibility is regarding this situation and preserving the environment in Ciapus Village, Banjaran District, Regency. Bandung. To get answers to these problems, researchers used an empirical juridical approach, descriptive analysis research specifications, document study data collection techniques to obtain secondary data, and field studies to obtain primary data bymeans of observation and interviews. Based on the results of research in the Ciapus Village area, Banjaran District, it was found that independent water companies managed by individuals [3 entrepreneurs] do not yet have permits, but those managed by Bumdes Raksa Manggala have establishment permits, and business permits, and certificates of drinking water product test results from Bandung District Health Service Laboratory. The Regional Government of Bandung Regency has not yet supervised independent water management, so that independent water management entrepreneurs can take as much water as possible from their springs, without paying attention to environmental sustainability. This results in when the dry season arrives, the water flow decreases and even dries up.

Abstract

This research explores the use of TikTok as a new tool for political communication strategy in the context of the 2024 Presidential Election in Indonesia, focusing on the User Generated Content (UGC) model and the role of "Proxy" as a key component. The concept of UGC emphasizes how social media, particularly TikTok, influences political dynamics by allowing active public contribution to creating and disseminating political content that can shape public opinion. In the new media era, the Two-Step Flow Model and its modifications illustrate a shift from direct message transmission from opinion leaders to followers towards a more complex integration where opinion leaders and influencers interact not only with their followers but also with mass media through UGC. The research methodology employed is qualitative with a phenomenological approach, enabling researchers to delve into how TikTok is used to disseminate political information and shape public opinion. Data collected and analyzed aim to understand new constructions in political communication through UGC in the digital context. The study indicates that TikTok plays a crucial role in political communication strategy in Indonesia, where its success or failure can significantly impact public perceptions of political candidates. Findings provide a foundational basis for strategic recommendations to enhance the effectiveness of political campaigns in an era of rapid technological advancement. Overall, this research not only reveals the evolution of political communication strategies in the digital age but also offers valuable insights for the development of future political campaigns in Indonesia. The intensive use of social media platforms like TikTok as tools to influence public opinion and voter choices is increasingly becoming a critical strategy that needs careful management by political actors and their campaign teams.

Abstract

The ritual ceremony of Naik Dango is a Dayak ethnic tradition in West Kalimantan which is still being carried out, as an expression of gratitude for having received an abundant rice harvest. Through the implementation of this ritual, researchers seek to explore the various living traditions held by the Dayak ethnic group in West Kalimantan so that they can contribute to an understanding of the traditional Dayak rituals, can explore the educative values ??contained in their implementation while at the same time preserving the ancestral traditions of the Dayak ethnic group. Using descriptive qualitative method with literary anthropology approach, data were collected by observation, recording and interviews. Data validation was carried out by means of triangulation of data sources and triangulation of methods. The implementation of the ritual ceremony of Naik Dango represents religious and creative practices as well as the customs of the Dayak ethnic group in ancient times. The educational values ??contained in the implementation of the Naik Dango ceremony are religious values, tolerance, gratitude and love for nature, social care.

Abstract

Hospital Accreditation is an acknowledgment of the Minister of Health through the Hospital Accreditation Committee (an independent assessment agency), that the Hospital has met the quality service standards constinously. Research was conducted on the topic of service quality and patient safety at the Sartika Asih Hospital Bandung (RSBSA) in 2019 and 2020. The purpose was to obtain secondary data on the implementation of quality and patient safety indicators, service complaints data and solutions offered, also data on patient satisfaction. In January to March 2021, about 450 respondents were taken to see their perceptions on hospital services based on the primary data. Hospital failure to meet minimum service standards according to predetermined indicators can lead to the failure of therapeutic contract. This is supported by the Hospital Law Number 44 Year 2009 Article 32 letter (q) which states: every patient has the right to sue and/or sue the hospital, if the hospital is suspected of providing services that are not in accordance with standards, both civil and criminal. Thus, a violation of the rules might result in a lawsuit. With the preventive and repressive legal protection, it is hoped that the patients’ rights to quality and safety can be fulfilled by the hospital.

Abstract

The purpose of this study is to help regulate child custody after divorce between couples where one is an Indonesian Citizen (WNI) and the other is a Foreign Citizen (WNA). This study involves juridical to conduct normative legal research. Legislation, court decisions, and related literature are used as data sources. Reviewing, describing, and interpreting the collected data is how qualitative data analysis is carried out. The results of the study indicate that the problems that arise in mixed marriages include the place of divorce lawsuits, child custody disputes, and child citizenship. Indonesian judges use Indonesian national law to resolve child custody issues from mixed divorces. Judges rely on the most important needs of the child.

Abstract

Effective financial management is a key factor for the success and sustainability of Micro, Small, and Medium Enterprises (MSMEs) in Brunei Darussalam. This article explores the implementation of a legal framework for financial management among MSMEs and examines the challenges encountered in the regulatory implementation process. Using a descriptive-qualitative approach, the study analyzes the financial regulations applied in Brunei and their impact on the financial and legal literacy of MSME actors. The findings indicate that although the financial regulations in Brunei have been comprehensively designed, there remains a significant gap between the formulated policies and their implementation. The low levels of financial and legal literacy among MSME actors, coupled with a lack of support from regulators, exacerbate non-compliance with existing regulations. This article recommends simplifying regulations, enhancing financial and legal literacy programs, and strengthening the role of regulators as facilitators to ensure that MSMEs can more easily understand and comply with their legal obligations. Through regulatory harmonization and improved literacy, MSMEs in Brunei are expected to become more competitive and capable of accessing broader financing opportunities to support business growth.
