Abstract

The purpose of this study was to find out the legal basis for the protection of caregivers and the forms of legal protection of caregivers in taking disciplinary action against cadets of the Police Academy and the forms of disciplinary action by caregivers against cadets of the Police Academy who commit disciplinary violations. The police in creating prospective leaders must be specially educated at a Police Education Institution, namely the Police Academy. The Police Academy or often abbreviated as Akpol is an educational institution to produce Polri officers. The Police Academy is an element implementing the education for the formation of Polri Officers who are under Kalemdikpol. In educating police leaders, professional caregivers are needed in educating them. The research method used is normative juridical, namely legal research conducted by examining literature or secondary data as the basis for research by conducting a search of regulations and literature related to the problem under study. The results of this study indicate that the legal basis for the protection of caregivers in carrying out disciplinary actions against Police Academy Cadets is the 1945 Constitution, Law No. 23 of 2003 concerning the National Education System, Law No. 14 of 2005 concerning Teachers and Lecturers, Government Regulation No. 74 of 2008 Concerning Teachers, PGRI MoU with POLRI No B/53/XII/2012 and 1003/UM/PB/XX/2012 Concerning the Protection of the Teacher Profession, Supreme Court Decision No 1554 K/Pid/2013 Concerning Reasons for Penalizing Teachers Who Commit Disciplinary Actions , Regulation of the Head of the Police Education and Training Institute No. 1 of 2021 Concerning the Life of Students at the Police Academy, Regulation of the Head of the Police Education and Training Institute No. 3 of 2021 concerning Assessment of Educational Outcomes of Police Academy Cadets, Regulation of the Head of the Police Education and Training Institute No. 2 of 2021 Concerning the Academy Council at the Police Academy, reasons for abolishing crimes that are outside the law (KUHP). The form of legal protection for caregivers in carrying out disciplinary actions against Police Academy Cadets is that there are reasons for eliminating crimes that are outside the law (KUHP), namely the rights of parents and teachers to discipline their children or students (tuchtrecht). Thus caregivers who take disciplinary action against Police Academy cadets cannot be punished. Forms of disciplinary action by caregivers against Police Academy Cadets who commit disciplinary violations, namely direct reprimand, giving special educational assignments, other physical actions that are coaching in nature. In taking action against the offenders, the role of Urgakplin (Disciplinary Enforcement Affairs) is needed because URGAPLIN is an element of discipline for cadets as well as security and cleanliness of flats, including violations of Perkalemdikpol, as an element of prosecution for violations committed by cadets, carrying out analysis and evaluation of cadets who commit violations .

Abstract

The purpose of this research is to find out what are the factors in the writing of birth certificates in the service and civil registration that fall into the category of maladministration, and to find out the implementation of changes to birth certificates that have been determined by the District Court. Good public service is a right and also the hope of every citizen and resident. Especially to apply the concept of good governance in Indonesia, one of the strategic choices is through the provision of public services in order to form good governance. A birth certificate is a legal proof of birth and is recognized by the state for a child who has just been born, therefore the registration must comply with the notes given earlier by the midwife because of the impact experienced if an error occurs in recording a birth certificate it can reduce the rights of a child. The method used in this research is the Juridical Sociological legal research method, which is an approach by looking at a legal reality in society. The data presented in this study are legal material data in the form of primary and secondary legal materials. The conclusion of this study is caused by typos or human errors that affect the child in the future, these factors are the most dominant and often occur by employees. Implementation of changes to birth certificates can be carried out, but only those that are editorial in nature, errors in recording such as name, date and year only, changes to birth certificates can be made directly if it has not reached a year, if the certificate is already many years old and changes are to be made, a decision from district court and meet the conditions that must be set Tujuan dari penelitian ini adalah untuk mengetahui apa saja yang menjadi faktor dalam penulisan akta lahir di dinas dan pecatatan sipil yang termasuk kedalam kategori maladministrasi, serta untuk mengetahu implementasi perubahan akta lahir yang telah di tetapkan oleh Pengadilan Negeri.Pelayanan publik yang baik adalah hak dan juga harapan setiap warga negara dan penduduk. Terutama untuk menerapkan konsep good governance di Indonesia maka salah satu pilihan strategis adalah melalui penyelenggaraan pelayanan publik guna membentuk tata kelola pemerintahan yang baikAkta kelahiran merupakan tanda bukti kelahiran secara sah dan diakui oleh negara kepada seorang anak yang baru saja dilahirkan maka sebab itu dalam pencatatan harus sesuai dengan catatan yang diberikan awal oleh bidan karena dampak yang dialamai jika terjadi kesalahan pencatatan akta kelahiran dapat menggurangi hak kepada seorang anak faktor kesalahan dalam pencatatan akta kelahiran sering kita jumpai biasanya faktor kesalahan dalam pengetikan yang sering terjadi. Metode yang digunakan penelitian ini adalah metode penelitian hukum yuridis sosiologis adalah pendekatan dengan melihat sesuatu kenyataan hukum di dalam masyarakat. Data yang disajikan dalam penelitian ini adalah data bahan hukum yang berupa bahan hukum primer dan bahan sekuder. Kesimpulan dari penelitian ini disebabkan oleh salah ketik atau human error yang berdampak kepada sang anak dikemudian hari, faktor-faktor tersebut paling dominan dan sering terjadi yang dilakukan oleh pegawai. Implementasi perubahan akta kelahiran dapat dilakukan namun hanya yang bersifat redaksional saja kesalahan dalam pencatatan seperti nama, tanggal dan tahun saja, perubahan akata kelahiran dapat dilakukan secara langsung bila belum mencapai setahun jika akta tersebut sudah bertahun-tahun dan akan dilakukan perubahan maka harus adanya keputusan dari pengadilan negeri dan memenuhi syarat yang harus di tetapkan. Abstract

This study aims to analyze the settlement of bad loans with a non-litigation process and to analyze the effectiveness of the settlement of non-litigation bad loans. Litigation. The legal research method used is juridical empirical, which examines the application of law to the working of law by conducting studies through approaches namely the statutory approach or statute approach, case approach or cash approach, historical approach or historical approach, comparative approach or comparative approach, and conceptual approach or conceptual approach. The results of this study reveal that in practice resolving bad loans through non-litigation methods at Bumdesma Sayung Mulyo by rescheduling, loan restructuring, reducing liabilities, compensation, legal/litigation aspects (specifically for misuse of funds). Penelitian ini bertujuan untuk menganalisis penyelesaian kredit macet dengan non litigasi dan untuk menganalisis efektivitas penyelesaian kredit macet non litigasi. Urgensi penelitian ini adalah Sebagai acuhan referensi yang mendukung bagi peneliti maupun pihak lain yang tertarik dalam bidang penelitian yang sama terutama tentang penyelesaian kredit macet non litigasi Adapun metode penelitian hukum yang digunakan adalah yuridis empiris, yang meneliti penerapan hukum bekerjanya hukum dengan melakukan kajian melalui pendekatan yaitu pendekatan undang-undang atau statute approach, pendekatan kasus atau cash approach, pendekatan historis atau historical approach, pendekatan perbandingan atau comparative approach, dan pendekatan konseptual atau conseptual offroach. Hasil penelitian ini mengungkapkan bahwa Dalam praktek penyelesaian kredit macet melalui non litigasi di Bumdesma Sayung Mulyo dengan cara Penjadwalan Ulang, Restrukturisasi Pinjaman, Pengurangan Kewajiban, Kompensasi, Aspek hukum/litigasi (khusus untuk penyalahgunaan dana).

Abstract

The aim of this research is (1) to analyze the regulatory mechanism for filling vacancies for Regional Heads whose terms of office expire before 2024. (2) To analyze the obstacles and solutions for filling vacancies for regional heads in leading regional government administration according to applicable laws and regulations. This research method is a normative juridical method with analytical descriptive specifications. The data used is secondary data in the form of primary, secondary, and tertiary legal materials, while the technique for collecting legal materials uses library studies and documentation studies which are then analyzed qualitatively. The research results show that the legal basis for filling vacancies for Regional Heads whose term of office expires before 2024 is Article 201 paragraphs (9), (10), and (11) of Law Number 10 of 2016. However, this law only regulates to the extent the qualifications of the officials appointed, while the procedures or mechanisms for appointing officials to fill the vacancies of Regional Heads more comprehensively are not accommodated. The obstacle to filling vacancies for regional heads is the absence of definite legal regulations regarding the limits of the authority of regional heads. The solution is that the government should issue implementing regulations from Article 201 of Law Number 10 of 2016 which contain procedures for filling vacancies in regional head positions. The problem is that there are objections to the appointment of Regional Head Officials, the solution is to implement a system for determining Regional Head Officials through voting by Provincial DPRD members to elect Regional Head Officials (Pj) after passing selection by the Ministry of Home Affairs and Regional Government. vacancies of Regional Heads more comprehensively are not accommodated. Metode penelitian ini adalah metode yuridis normatif dengan spesifikasi deskriptif analitis. Hasil penelitian menunjukkan bahwa dasar hukum pengisian kekosongan Kepala Daerah yang habis masa jabatannya sebelum tahun 2024 adalah Pasal 201 ayat (9), (10) dan (11) Undang-Undang Nomor 10 Tahun 2016. Akan tetapi, undang-undang ini hanya mengatur sebatas kualifikasi penjabat yang diangkat, sedangkan prosedur atau mekanisme pengangkatan pejabat untuk mengisi kekosongan Kepala Daerah secara lebih komprehensif tidak diakomodir. Kendala atas pengisian kekosongan kepala daerah adalah tidak adanya aturan hukum pasti tentang batasan kewenangan pejabat Kepala Daerah. Solusinya yaitu pemerintah sudah seharusnya menerbitkan aturan pelaksana dari Pasal 201 Undang-Undang Nomor 10 Tahun 2016 yang berisi tata cara mengisi kekosongan jabatan kepala daerah. Kendala adanya adanya penolakan-penolakan atas Penunjukan Pejabat Kepala Daerah maka solusinya yaitu menerapkan sistem penetapan Pejabat Kepala Daerah melalui pemungutan Suara anggota DPRD Provinsi untuk memilih pejabat (Pj) Kepala Daerah setelah lolos diseleksi oleh Kemendagri dan Pemerintah Daerah.

Abstract

The purpose of this research is to analyze and understand the legal protection of workers whose employment relationship is terminated and the legal liability of employers who carry out layoffs according to Law Number 06 of 2023 concerning Job Creation. The urgency of this research requires regulations regarding layoffs due to serious or urgent violations contained in the Job Creation Law and its supporting laws and regulations. Employers carry out layoffs on the grounds of serious or urgent violations without going through a criminal law process that has permanent legal force. This decision was further strengthened by the existence of SEMA Number 03 of 2015 concerning the Implementation of the Formulation of the Results of the Plenary Meeting of the Supreme Court Chamber where layoffs can be carried out without having to wait for a legally binding court decision. This research uses a juridical-normative method, through a statutory legal approach. The results of research by workers who have been laid off and representatives of workers who have suffered losses due to serious or urgent violations have examined legal regulations regarding the Job Creation Law and PP 35 of 2021, Article 52 which regulates urgent violations, so that workers cannot be a termination by the Company without waiting for legally binding court, and the Employer carries out the rules following the previous rules regarding serious violations. Tujuan penelitian ini menganalisis dan memahami perlindungan hukum tenaga kerja yang diputus hubungan kerjanya dan pertanggungjawaban hukum pengusaha yang melakukan PHK menurut UU Nomor 06 Tahun 2023 tentang Cipta Kerja. Urgensi penelitian ini perlu pengaturan mengenai PHK karena pelanggaran berat atau bersifat mendesak yang terdapat pada UU Cipta Kerja dan peraturan perundangan pendukungya. Pengusaha melakukan PHK dengan alasan pelanggaran berat atau bersifat mendesak tanpa melalui proses hukum pidana yang berkekuatan hukum tetap. Keputusan tersebut dikuatkan lagi dengan adanya SEMA Nomor 03 tahun 2015 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar MA dimana PHK dapat dilakukan tanpa harus menunggu putusan pidana berkekuatan hukum tetap. Penelitian ini menggunakan Metode yuridis-normatif, melalui pendekatan hukum perundang-undangan. Hasil penelitian pihak pekerja yang di PHK maupun perwakilan pekerja yang dirugikan karena pasal pelanggaran berat atau bersifat mendesak melakukan pengujian peraturan perundangan mengenai UU Cipta kerja dan PP 35 tahun 2021, pasal 52 yang mengatur mengenai pelanggaran bersifat mendesak, agar pekerja tidak dapat di PHK secara sewenang-wenang oleh Perusahaan tanpa menunggu keputusan pengadilan pidana yang bersifat mengikat, serta Pengusaha menjalankan aturan sesuai dengan aturan terdahulu mengenai pelanggaran berat.

Abstract

This research aims to understand and analyze the repositioning of prison policies in minimizing overcrowding at the Class II A Semarang Penitentiary Institution. Repositioning Prison Policies in Minimizing Inmate Overcrowding is an effort undertaken by the Penitentiary Institution, as part of the criminal justice system, to rehabilitate and reintegrate inmates so that they are accepted and become beneficial members of society, while considering the principles of justice, utility, and legal certainty. The results of this research indicate that with the change in the law from Law No. 12 of 1995 to Law No. 22 of 2022, inmates experience justice in obtaining their rights. This is especially true for convicts of corruption and narcotics crimes with prison sentences exceeding 5 years, in line with Article 27 paragraph (2) of the 1945 Constitution, which states that every Indonesian citizen has the right to work and a decent life for humanity, including inmates in penitentiary institutions. With the fulfillment of integration program rights for all inmates, the overcrowding in penitentiary institutions can find some relief, as not all criminal offenders, especially those involved in minor offenses, are immediately sent to prison. With regulations on restorative justice, perpetrators of criminal acts and victims, as well as other relevant parties, can collectively seek a fair resolution by emphasizing restoration to the original state rather than retaliation. This allows the penitentiary institution, as the final stage of the justice system, to provide optimal rehabilitation to criminal offenders who require special treatment and enable them to reintegrate into society with skills beneficial to the nation. Penelitian ini bertujuan memahami dan menganalisa reposisi kebijakan lembaga pemasyarakatan dalam meminimalisir kelebihan kapasitas pada LPP Kelas II A Semarang. Reposisi Kebijakan Lembaga Pemasyarakatan Dalam Meminimalisir Kelebihan Kapasitas Narapidana adalah upaya yang dilakukan oleh Lembaga Pemasyarakatan, sebagai bagian dari sistem peradilan pidana, untuk membina dan mengembalikan narapidana agar diterima dan bermanfaat kembali bagi Masyarakat dengan memperhatikan asas keadilan, kemanfaatan dan kepastian hukum. Hasil penelitian ini adalah bahwa dengan adanya perubahan undang-undang dari Undang-Undang No. 12 Tahun 1995 ke Undang-Undang No. 22 Tahun 2022, Narapidana mengalami keadilan dalam memperoleh hak-haknya. Terutama bagi terpidana Tindak Pidana Korupsi dan Tindak Pidana Narkotika dengan putusan pidana penjara diatas 5 Tahun penjara, karena selaras dengan Undang-Undang Dasar 1945 Pasal 27 ayat (2) yang menyatakan bahwa setiap warga negara Indonesia berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan, termasuk pada Narapidana yang berada dalam Lembaga Pemasyarakatan. Dengan terpenuhinya hak-hak program integrasi bagi seluruh Narapidana, maka kelebihan kapasitas pada Lembaga pemasyarakatan dapat menemukan sedikit titik terang, karena tidak melulu pelaku tindak pidana, apalagi tindak pidana ringan, langsung dikirimkan ke Lembaga pemasyarakatan. Dengan adanya peraturan tentang keadilan restoratif, maka pelaku tindak pidana dan korban tindak pidana serta pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan semula, dan bukan pembalasan, sehingga Lembaga pemasyarakatan sebagai tempat akhir dari sistem peradilan dapat melakukan pembinaan dengan maksimal kepada pelaku tindak pidana yang memang membutuhkan penanganan khusus dan dapat Kembali kepada Masyarakat dengan keahlian dan keterampilan yang berguna bagi nusa dan bangsa.

Abstract

This research aims to understand the authority of the Corruption Eradication Commission (KPK) in investigating and prosecuting corruption and understand the constraints and solutions of the KPK's authority in investigating and prosecuting corruption crimes in the context of law enforcement. KPK is an independent institution in Indonesia which was formed to fight corruption with the main task of investigating, prosecuting and eradicating criminal acts of corruption. This is regulated in Law Number 30 of 2002 concerning the Corruption Eradication Commission as amended by Law Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002. With the changes in provisions in the KPK Law, there have been several changes in the authority of the KPK. The type of research used in this research is normative juridical with statutory approach method, collecting and analyzing legal data, laws and regulations, as well as court decisions related to the KPK's authority. The results of the research show that the KPK has broad authority in investigating and prosecuting corruption. The KPK can carry out wiretapping, search and arrest of corruption suspects, and has the authority to submit charges to court. The KPK also has an independent and professional team of investigators and prosecutors. However, there are several limitations in the KPK's authority. Since 2019, the KPK's authority in wiretapping and searching has been limited by the Indonesian Constitutional Court. Apart from that, there is also debate about the independence status of the Corruption Eradication Committee and political interference that can affect the enforcement of corruption laws. In the context of effective law enforcement, it is important for the KPK to continue to strengthen its authority and ensure its independence from political forces. The active role of the community and government support are also needed to support KPK's efforts to eradicate corruption. Penelitian ini bertujuan untuk memahami kewenangan Komisi Pemberantasan Korupsi (KPK) dalam penyidikan dan penuntutan tindak pidana korupsi serta memahami kendala dan solusi kewenangan KPK dalam penyidikan dan penuntutan tindak pidana korupsi dalam rangka penegakan hukum. KPK adalah lembaga independen di Indonesia yang dibentuk untuk memerangi korupsi dengan tugas utama menyelidiki, menuntut, dan memberantas tindak pidana korupsi. Hal ini diatur dalam Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dengan Undang-Undang Nomor 19 Tahun 2019 tentang Perubahan Kedua Atas Undang-Undang Nomor 30 Tahun 2002. Dengan adanya perubahan ketentuan dalam Undang-Undang KPK, mengakibatkan adanya beberapa perubahahan kewenangan KPK. Jenis penelitian yang digunakan dalam penelitiaan ini adalah yuridis normatif dengan metode pendekatan perundang-undangan, mengumpulkan dan menganalisis data hukum, peraturan perundang-undangan, serta putusan pengadilan terkait kewenangan KPK. Hasil penelitian menunjukkan bahwa KPK memiliki kewenangan yang luas dalam penyidikan dan penuntutan tindak pidana korupsi. KPK dapat melakukan penyadapan, penggeledahan, dan penangkapan terhadap tersangka korupsi, serta memiliki wewenang untuk mengajukan dakwaan ke pengadilan. KPK juga memiliki tim penyidik dan tim penuntut yang independen dan profesional. Namun, ada beberapa keterbatasan dalam kewenangan KPK. Sejak tahun 2019, kewenangan KPK dalam penyadapan dan penggeledahan telah dibatasi oleh Mahkamah Konstitusi Indonesia. Selain itu, ada juga perdebatan mengenai status independensi KPK dan intervensi politik yang dapat mempengaruhi penegakan hukum korupsi. Dalam rangka penegakan hukum yang efektif, penting bagi KPK untuk memperkuat kewenangannya dan memastikan independensinya dari kekuatan politik. Peran aktif masyarakat dan dukungan pemerintah juga diperlukan untuk mendukung upaya pemberantasan korupsi yang dilakukan oleh KPK.

Abstract

The purpose of this study is to analyze and describe the problems that often arise in online collateral auctions and obstacles experienced by auction organizers and bidders and to find out whether online auctions are more effective and efficient than conventional auctions. The urgency of this research is a reference for researchers in particular and the public in general who are interested in the problem of online auction of collateral; besides that, the internet is an electronic communication service that connects computer networks and computer facilities organized throughout the world via telephone or satellite by connecting their devices to the internet network. Currently, internet access has become easier, and the Directorate General of State Wealth (DJKN) utilizes this convenience for the public interest with the launch of an internet auction application (e-Auction). The research method used is normative juridical, namely research that prioritizes how to research library materials and laws and regulations. The results of this study show that online auctions of collateral are seen as more effective and efficient than conventional auctions. Secondly, often bidders who do not make repayments on the grounds that their auction accounts are hacked make auction decisions inappropriately. Thirdly, online auctions make auction activities independent of threats or terror between bidders when competing in auction price negotiations.   Tujuan penelitian ini untuk menganalisis dan menguraikan permasalahan yang sering muncul dalam lelang barang jaminan secara online serta hambatan yang dialami oleh penyelenggara lelang maupun peserta lelang dan untuk mengetahui apakah lelang online ini lebih efektif dan efisien daripada lelang konvensional. Urgensi penelitian ini sebagai referensi bagi peneliti pada khususnya dan masyarakat pada umumnya yang tertarik pada masalah lelang barang jaminan secara online, selain itu internet merupakan suatu layanan komunikasi elektronik yang menghubungkan jaringan komputer dan fasilitas komputer yang terorganisasi di seluruh dunia melalui telepon atau satelit dengan mengkoneksikan perangkatnya pada jaringan internet. Saat ini akses internet sudah semakin terasa mudah. Direktorat Jenderal Kekayaan Negara (DJKN) memanfaatkan kemudahan ini untuk kepentingan publik dengan peluncuran aplikasi lelang internet (e-Auction). Metode penelitian yang digunakan adalah yuridis normatif, yaitu penelitian yang mengutamakan cara meneliti bahan pustaka dan peraturan perundang-undangan. Hasil penelitian ini menunjukkan lelang barang jaminan secara online dipandang lebih efektif dan efisien daripada lelang secara konvensional; kedua, seringnya peserta lelang yang tidak melakukan pelunasan dengan alasan akun lelangnya terkena hack menjadikan keputusan lelang tidak patut; ketiga, lelang online menjadikan kegiatan lelang terlepas dari ancaman maupun teror antar peserta lelang saat bersaing dalam negosiasi harga lelang.

Abstract

The purpose of this research is to analyze the effectiveness of combating online gambling crimes in the jurisdiction of the Central Java Regional Police (Polda Jawa Tengah). This research is important because of the increasing prevalence of online gambling, or what is more commonly known as illegal lottery gambling (togel), which has become a significant issue across all layers of Indonesian society. The research methodology used is socio-legal. The novelty of this research lies in examining the effectiveness of combating online gambling within the jurisdiction of the Central Java Regional Police. The findings of this study explain that the factors influencing individuals getting involved in online gambling can be divided into two categories: internal and external factors. The application of Article 303 paragraph (1) of the Indonesian Criminal Code (KUHP) for conventional gambling and Article 45 jo. Article 27 paragraph (2) of Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE) is discussed. Various methods can be employed for the prevention of online gambling, including pre-emptive, preventive, and repressive methods. The prevention of online gambling is an effective means of combating online gambling crimes. Tujuan penelitian ini untuk menganalisis efektivitas pemberantasan tindak pidana judi online di wilayah hukum Polda Jawa Tengah. Penelitian ini penting karena semakin maraknya judi online atau yang lebih dikenal perjudian togel gelap (togel) yang saat ini marak menjadi salah satu permasalahan yang cukup signifikan disoroti di semua lapisan masyarakat Indonesia. Metode penlitian menggunakan yuridis sosiologis. Kebaruan penelitian ini adalah mengkaji efektifitas pemberantasan judi online di wilayah hukum Polda Jawa Tengah. Hasil penelitian ini menjelaskan bahwa faktor yang mempengaruhi masyarakat terjerat judi online antara lain terbagi menjadi dua faktor, yaitu faktor internal dan faktor eksternal. Penerapan Pasal 303 ayat (1) KUHP untuk judi konvensional maupun Pasal 45 jo. Pasal 27 ayat (2) Undang-undang Nomor 11 Tahun 2008 tentang ITE. Upaya pencegahan judi online dapat dilakukan berbagai cara antara lain dengan metode pre-emptive, metode preventif dan metode represif. Metode pencegahan perjudian online merupakan sarana yang efektif dalam pemberantasan tindak pidana judi online.

Abstract

The purpose of this research is to analyze the investigation of juvenile criminal cases through restorative justice in the Central Java Regional Police (Polda Jawa Tengah). The importance of a friendly and fair resolution for children facing the law. The diversion of cases from the criminal justice process to non-criminal justice processes. Diversion can be carried out when the criminal threat is below 7 (seven) years and is not a repeat offense. This type of research uses a socio-legal approach. The research findings indicate that the juvenile diversion process in Central Java Regional Police involves transferring cases from the criminal court to a deliberation process to achieve balance and restoration. Mediators in the deliberation can be trusted community figures, school principals, or teachers. Standard rules are needed for non-formal treatment of cases involving children in conflict with the law to limit negative practices in the justice system. Diversion is carried out to promote the well-being of children, especially in cases of juvenile delinquency, and to prevent recidivism. Tujuan penelitian ini untuk menganalisis penyidikan terhadap perkara tindak pidana anak melalui restorative justice di Polda Jawa Tengah. Pentingnya penyelesaian perkara yang ramah dan adil bagi anak yang berhadapan dengan hukum. Pengalihan perkara dari proses peradilan pidana ke proses di luar peradilan pidana. Diversi dapat dilaksanakan apabila ancaman pidananya di bawah 7 (tujuh) tahun; dan bukan merupakan pengulangan tindak pidana. Jenis penelitian ini menggunakan yuridis sosiologis. Hasil penelitian proses diversi anak pada Polda Jawa Tengah melibatkan pengalihan perkara dari pengadilan pidana ke proses musyawarah untuk mencapai keseimbangan dan memulihkan keadaan. Mediator dalam musyawarah dapat berupa tokoh masyarakat yang dipercaya atau kepala sekolah atau guru. Aturan standar diperlukan untuk perlakuan non-formal terhadap kasus anak yang berkonflik dengan hukum untuk membatasi praktik negatif dalam sistem peradilan. Diversi dilakukan untuk mencapai kesejahteraan bagi anak, khususnya terhadap kejahatan anak, dan untuk mencegah terjadinya residivis.
