International Journal of Humanities, Law, and Politics is an official journal of the Communication in Research and Publications (CRP) and publishes original research papers that cover the theory, practice, history, or methodology of Humanities, Law, and Politics (HLP). IJHLP will act as a platform to encourage further research in Humanities, Law, and Politics theory and applications. The globalization in the humanities sector has had the impact of changing values and attitudes, development of science and technology, and a better standard of living. The globalization of law has caused the regulations of developing countries regarding investment, trade, services and other economic fields to approach those of developed countries. The globalization in the political field is marked by the inclusion of democratic values in many countries, which is accompanied by the growing political awareness of the people. To deal with the influence of globalization in the fields of humanities, law and politics, research must be carried out to filter out every influence of globalization, whether it is in accordance with customs or not. The mission of the International Journal of Humanities, Law, and Politics (IJHLP) is to enhance the dissemination of knowledge across all disciplines in theory, practice, history, or methodology of Humanities, Law, and Politics. The above discipline is not exhaustive, and papers representing any other social science field will be considered. The IJHLP particularly encourage manuscripts that discuss the latest research findings or contemporary research that can be used directly or indirectly in addressing critical issues and sharing of advanced knowledge and best practices in Humanities, Law, and Politics. The essential but not exclusive, audiences are academicians, graduate students, researchers, policy-makers, regulators, practitioners, and others interested in business, management, economics, and social development studies. Abstract

The development of information technology has facilitated digital communication, but has also opened up opportunities for privacy abuse, especially in the use of personal portraits without permission as WhatsApp stickers. This study analyzes the legal aspects, socio-psychological impacts, and prevention efforts related to the illegal use of personal portraits on digital platforms. Through a comprehensive review of Indonesian laws and regulations, the study reveals the complexity of personal data protection in the digital era. The results of the study show that despite the existence of a regulatory legal framework, there are still significant challenges in law enforcement, public awareness, and prevention technology. This study emphasizes the need for a multidimensional approach involving public education, strengthening regulations, and collaboration between the government, digital platforms, and law enforcement agencies to protect individual privacy rights.

Abstract

This study examines the legal, religious, and human rights views of the LGBT community in Indonesia. This study aims to provide a broader understanding of how society's views of LGBT are influenced by legal, religious, and human rights factors. The formulation of the problem in this study focuses on how the legal, Islamic religion, and human rights views of the LGBT community in Indonesia. This study uses a qualitative approach with literature study as the main method, focusing on the analysis of relevant written sources, such as books, articles, reports, laws, interpretations, hadiths, and human rights documents. Despite legal efforts through the Constitutional Court's decision rejecting the criminalization of same-sex activity, discrimination against LGBT individuals continues, both through regional regulations and conservative religious views. The Islamic perspective that views homosexuality as deviant behavior exacerbates social stigma and legal challenges for LGBT individuals.

Abstract

The implementation of taxes in Indonesia is often considered detrimental by the public, especially for microeconomic actors. Although the management of the State Revenue and Expenditure Budget (APBN) is more focused on macroeconomics to maintain long-term economic sustainability, its impact on the microeconomy is still not optimal. Taxes in Islamic governance not only function as a fiscal instrument but also as a mechanism for wealth distribution and addressing social inequality. The Islamic taxation system supports economic sustainability and social welfare in the Muslim community, which is the majority in Indonesia. Ideally, the implementation of taxes in Indonesia should be able to adopt the principles of Sharia economics to achieve the welfare of society. This paper discusses the application of taxes on micro and macroeconomics in Indonesia, using qualitative research methods through literature review. Secondary data comes from literature such as journals and related scientific works.

Abstract

Deepfake technology has developed rapidly and has had a significant impact in various fields, including politics and national security. This study analyzes the legal implications of the use of deepfakes in politics in Indonesia, highlighting regulatory challenges, the effectiveness of technology detection, and its impact on public opinion. This study uses a mixed methods approach, combining literature analysis, case studies, interviews with legal and technology experts, and social media data analysis. The results show that the spread of deepfakes has increased sharply ahead of the 2024 General Election, especially on Twitter, Facebook, and TikTok, contributing to disinformation and public polarization. Existing regulations, such as the Electronic Information and Transactions Law (UU ITE) and the Criminal Code (KUHP), do not specifically regulate deepfakes, thus creating difficulties in law enforcement. In addition, existing detection technologies still face challenges in identifying increasingly sophisticated deepfake content. As a mitigation measure, this study recommends the formation of special regulations regarding deepfakes, improving detection technology through collaboration with the technology sector, increasing the capacity of law enforcement in digital forensics, and public education to improve digital literacy. It is hoped that these steps can reduce the negative impact of deepfake on democracy and national security stability in Indonesia.

Abstract

Oral literature is an integral part of the culture of indigenous peoples, including the Moskona tribe in West Papua. This tradition plays a role in transmitting moral values, customary law, and the relationship between humans and nature. However, modernization brings changes in the pattern of delivery and sustainability of oral literature. This study aims to analyze the impact of modernization on the oral literature of the Moskona tribe and identify strategies for its preservation. Using a qualitative approach and ethnographic methods, data were collected through participatory observation, in-depth interviews, and documentation studies. The results of the study show that although the oral literature of the Moskona tribe still survives, the transmission pattern has changed from direct oral communication to written and digital documentation. The interest of the younger generation in oral delivery is starting to decline, with only 35% still actively listening to stories from traditional elders. In contrast, digital media such as videos, podcasts, and social media have become new means of spreading folklore. The preservation strategy involves various parties, including schools, local governments, cultural communities, and the younger generation, with efforts such as integration into the curriculum, cultural festivals, and digital documentation. This study confirms that modernization is not always a threat to oral literature, but can be an opportunity for its transformation and preservation. Further studies are needed to explore the effectiveness of digital strategies in maintaining the sustainability of oral traditions in indigenous communities.

Abstract

This study examines the socio-cultural impacts of the oil and gas industry on indigenous communities in Teluk Bintuni, West Papua, with particular focus on the Tangguh LNG Project. Through a qualitative case study approach utilizing in-depth interviews, participant observation, and document analysis, the research investigates how industrial development affects traditional practices, social structures, and economic patterns among the Sebyar, Sumuri, Irarutu, and Wamesa tribes. The study reveals significant transformations in community dynamics, including a shift from subsistence-based to cash-based economies, weakening of traditional leadership structures, and declining cultural practices. While the oil and gas industry has brought improved infrastructure, employment opportunities, and access to modern services through Corporate Social Responsibility (CSR) programs, it has simultaneously contributed to cultural erosion, social tensions, and land rights disputes. The research identifies a notable decrease in traditional ceremonies, communal gatherings, and indigenous language usage, particularly among younger generations increasingly drawn to modern lifestyles. Analysis of economic impacts shows a marked transition in livelihood patterns, with traditional hunting and farming activities being replaced by industrial employment and related service sectors. The study also highlights challenges in implementing effective CSR programs, noting limited community participation in planning and execution phases. These findings emphasize the need for more inclusive development approaches that balance economic growth with cultural preservation. The research contributes to the broader understanding of industrialization's impact on indigenous communities and provides recommendations for policy makers, corporate entities, and community leaders to foster more sustainable and culturally sensitive development practices. The study suggests that future success in similar contexts depends on strengthening legal frameworks for indigenous rights protection, improving community participation in decision-making processes, and developing more effective models for cultural preservation alongside industrial development.

Abstract

This study examines the legal aspects of the use of deepfake technology in political campaigns and its implications for the integrity of democracy. Through a qualitative approach with normative legal analysis methods, this study maps regulations related to deepfake in various countries, analyzes case studies of the use of deepfake in political campaigns, and evaluates the effectiveness of regulations in Indonesia. The results show that regulations on deepfake in political campaigns vary significantly between countries, with some countries such as the United States (at the state level) and the European Union having implemented specific regulations, while Indonesia still relies on the Electronic Information and Transactions Law (UU ITE) which does not specifically regulate deepfake. Case study analysis reveals the use of deepfake for positive purposes such as translating political speeches (India) and negative purposes such as spreading disinformation (United States, Russia, Philippines). The main challenges to regulation in Indonesia include the lack of public awareness, limited detection technology, the speed of information dissemination on social media, and the absence of specific sanctions for the misuse of deepfake in a political context. Based on these findings, this study recommends the establishment of specific regulations related to deepfake, strengthening multi-party collaboration in developing detection systems, increasing public education through digital literacy campaigns, and implementing strict law enforcement with specific sanctions. A synergy between comprehensive regulation, advanced detection technology, and high public awareness is needed to mitigate the negative impact of deepfakes on democratic integrity and ensure that this technology is used ethically in political communication.

Abstract

MSMEs (Micro, Small, and Medium Enterprises) play an important role in supporting the economy in Banten Province, with significant contributions to GRDP, job creation, and key sectors such as trade, manufacturing, and tourism. However, despite their great economic potential, MSMEs in Banten still face complex challenges, such as difficulties in accessing capital, low financial literacy, and dependence on local political policies. This study aims to analyze the role of MSMEs in political economic policies in Banten Province, identify the challenges faced by MSME actors, and provide policy recommendations that can improve the competitiveness of MSMEs in the region. The method used in this study is a qualitative approach with a case study method, which focuses on several cities and districts in Banten, such as Tangerang City, Serang City, and Pandeglang Regency. Data collection was carried out through in-depth interviews with MSME actors, local government officials, and related organizations, as well as direct observation at MSME business locations. The data obtained were then analyzed using a thematic analysis approach. The results of the study show that although government programs to support MSMEs have been launched, their distribution is not evenly distributed, especially in remote areas. The main challenges faced are limited access to capital, dependence on political decisions, and low financial literacy. In addition, digitalization is a great opportunity, but limited infrastructure is an obstacle. Based on these findings, the study provides policy recommendations, such as increasing access to financing, financial literacy training, equalizing assistance programs, and strengthening digital infrastructure to support the sustainability and growth of MSMEs in Banten.

Abstract

The development of artificial intelligence (AI) in the last two decades has significantly changed the face of democratic politics. AI is used in political campaigns, policy-making, and interactions between governments and citizens. For example, the launch of an AI tool called Nostrada in the UK that allows the public to interact with digital avatars of members of parliament, and the use of AI in the 2024 US election campaign to personalize messages and raise funds. However, the use of AI also poses major risks, such as the spread of disinformation through deepfakes and social media bots, and the amplification of algorithmic bias that can harm certain groups. AI systems that operate as “black boxes” pose challenges to transparency and accountability in political decision-making, thereby reducing public trust. Several countries, especially the European Union, have begun to implement regulations to prevent the misuse of AI, such as transparency obligations and deepfake detection. In addition to regulations, digital literacy is key to strengthening critical public participation in digital content. This study uses a qualitative-descriptive approach with a literature review to analyze the benefits and risks of AI in politics. The results emphasize the need for cross-sector collaboration to develop ethical and transparent policies so that AI strengthens digital democracy, not weakens it. This study highlights the importance of balancing technological innovation and protecting democratic values ​​in the face of an increasingly complex digital era.

Abstract

The Korean Wave or Hallyu phenomenon has had a significant influence on global popular culture, including in Indonesia. One form of this influence is seen in the production of fanfiction on digital platforms such as Wattpad. This study aims to analyze the influence of Korean culture on the narrative structure and intertextuality practices in Indonesian-language fanfiction with a Korean theme. The approach used is qualitative-descriptive analytical with Tzvetan Todorov's narrative theory and the concept of intertextuality as the basis for analysis. The objects of the study consisted of five popular fanfictions on Wattpad that carried the themes of K-pop and K-drama. The results of the analysis show that the narrative structure of the five fanfictions follows the classic pattern of Korean drama, which consists of the stages of equilibrium, disturbance, conflict, resolution, and achieving a new balance. Elements of intertextuality emerge through the use of character names, setting, emotional conflict, and language styles that resemble Korean drama dialogues. Indonesian fanfiction writers not only imitate, but also creatively adapt elements of Korean culture, combining them with local social and cultural contexts. From the readers' perspective, there is high enthusiasm for narratives that are full of Korean elements, indicating a horizon of hope formed from the consumption of global popular culture. In conclusion, Korean-themed fanfiction on Wattpad becomes a dialogical space between global culture and local expression, while also reflecting forms of creative literacy and cultural hybridization in the digital era.
