Abstract

Laku Pandai is a financial service created by the organizing bank to make it easier for people who use banks to reach banks to carry out other financial interests. This is based on the Financial Services Authority Regulation (POJK) Number 19 / POJK. 03 / 2014 concerning Office-less Financial Services in the Framework of Inclusive Finance. With this regulation, Bank BRI opened Laku Pandai services under the name BRILink, but as the implementation of Laku Pandai organized by BRILink progresses, many unscrupulous BRILink Agents take advantage of opportunities that ultimately harm customers in financial terms. This article explains the legal protection of losses suffered by Laku Pandai customers and the legal responsibility of BRILink Agents who commit criminal acts of embezzlement of BRILink customer money with normative juridical research methods. This article is made with the aim that the organizing Bank must provide special protection for Laku Pandai user customers and strive to supervise the activities of Laku Pandai Agents firmly so that criminal acts that harm customers do not occur.

Abstract

A halal certificate is a statement letter on the halalness of a product issued by an authorized institution whose legitimacy has been ascertained, the large number of frauds committed by business actors for counterfeiting the halalness of their products causes threats to the rights that consumers should receive. As a form of protection for consumer rights, the government has established provisions that are currently in effect, namely Law no. 08 of 1999 concerning Consumer Protection. With the existence of this consumer protection law, it will have an impact on the welfare and peace of Muslim communities wherever they are. The results of the research are expected to raise awareness among business actors how important halal certificates and halal labels are for Muslims and non-Muslims alike. Based on this research, it can be concluded how the law regarding consumer protection regulates and protects consumers who feel disadvantaged by the actions of irresponsible business actors who only think about big profits without thinking about what impact they will get. The approach method used in this study is a normative approach, a normative approach is an approach that is carried out by observing problems by analyzing norms, regulations that apply, and based on circulating news. Looking at the rules provided by law regarding consumer protection, how is the responsibility that should be given by someone as a business actor for losses received by consumers for the products they distribute and what actions consumers must take to be careful in reading and listening to information regarding the halalness of the product they will consume or use.

Abstract

Civil liability of specialist doctors for patient losses due to misdiagnosis. Background between specialist doctors and patients is based on therapeutic transactions (artsenovereenkomst), engagement (inspanningsverbintenis), engagement (resultaatverbintenis). Specialist doctors are required to have a higher level of skill and accuracy (standard of care) than general practitioners. Misdiagnosis that occurs due to negligence or carelessness of specialist doctors can trigger physical, material, and immaterial losses to patients, resulting in medical disputes. The first research objective is to analyze the legal qualifications of specialist doctors' misdiagnosis categorized as a violation of civil law. Second, to examine the form of civil liability. The research method in this study uses a normative juridical approach with descriptive-analytical research specifications. The data used are secondary data consisting of primary legal materials (Civil Code, Health Law), secondary legal materials. Data analysis was conducted qualitatively. The results of the study show that the legal qualifications of specialist doctors' misdiagnosis do not necessarily constitute legal responsibility if they comply with Standard Operating Procedures (SOP) and Medical Service Standards (SPM). Such errors arise from gross negligence or a violation of professional standards. They can be classified as breach of contract (Article 1243 of the Civil Code) if they violate the contractual clauses, or more commonly, as unlawful acts (Articles 1365 & 1366 of the Civil Code) if there is evidence of fault, loss, and a causal relationship (causaliteit). Furthermore, in terms of liability, specialist doctors are held personally liable or jointly liable with the hospital based on the doctrine of vicarious liability (Article 1367 of the Civil Code).

Abstract

This study aims to analyze the regulation of marriage dispensation in Indonesian positive law, examine the concept of marriage dispensation from the perspective of Islamic law, and provide a critical analysis of its judicial practices following the amendment of the Marriage Law. This research is a normative legal study employing statutory and conceptual approaches. Legal materials were collected through library research and analyzed qualitatively using a descriptive-analytical method. The findings indicate that, normatively, the regulation of marriage dispensation in Indonesia has been designed as an exceptional legal instrument aimed at protecting children. However, in practice, there remains a tendency for judges to grant dispensations flexibly, often based on sociological considerations rather than the principle of the best interests of the child. From the perspective of Islamic law, although the term “marriage dispensation” is not explicitly recognized, its conceptual basis can be understood through the principles of maqashid al-shariah, which emphasize public welfare (maslahah) and the prevention of harm (mafsadah). This study concludes that a reconstruction of the concept of marriage dispensation is necessary by integrating positive law and maqashid al-shariah to ensure stronger child protection and long-term welfare.

Abstract

Illegal gold mining in Beutong District, Nagan Raya Regency, constitutes not only a violation of law and a source of environmental degradation but also an organized socio-economic network sustained by power relations and community economic dependency. Previous studies have largely examined illegal mining from environmental, economic, or criminological perspectives separately, with limited integration of social network analysis, patron–client relations, and Islamic legal perspectives. This study analyzes the structure and persistence of illegal gold mining networks through the lenses of differential association theory, patron–client theory, and the Islamic legal concept of ḥifẓ al-bī’ah. Employing a qualitative socio-legal approach, the research draws on statutory analysis, literature review, media documentation, and semi-structured interviews with Yayasan Apel Green Aceh and communities surrounding the mining area. The findings demonstrate that illegal gold mining operates as an integrated network involving logistics suppliers, mining operators, collectors, and gold traders. The sustainability of this network is driven not only by economic incentives but also by patron–client relationships that reinforce dependency and by social learning processes that normalize illegal practices and weaken law enforcement. From the perspective of Islamic law, these activities violate the principles of ḥifẓ al-bī’ah, maṣlaḥah, and the prohibition of fasād fī al-arḍ due to their destructive environmental impacts and adverse consequences for public welfare. This study contributes an integrative framework that combines criminological theory, power relations, and Islamic legal principles to explain the persistence of illegal gold mining in Aceh.

Abstract

Fungsi sistem peradilan pidana untuk menanggulangi kejahatan sangat diperlukan dalam penegakan hukum. Akan tetapi sistem yang ada sekarang belum berfungsi secara optimal. Hal itu dikarenakan banyak hal-hal yang belum sesuai dengan kondisi masyarakat. Kondisi masyarakat terus berkembang, memaksa hukum untuk berkembang pula, menyesuaikan dengan keinginan masyarakat agar tetap menjaga rasa keadilan dan kepastian hukum yang selama ini diinginkan. Jenis penelitian ini  menggunakan metode penelitian kualitatif. Hasil penelitian ini menyarankan sesungguhnya sistem peradilan pidana yang ideal seharusnya mencakup tiga nilai pokok hukum: keadilan, kepastian hukum, dan kenyamanan. Baik secara teoritis ataupun praktis, tidak mudah untuk mengimplementasikan ketiga nilai dasar tersebut secara harmonis Agar hukum dapat berfungsi dengan optimal dan sesuai dengan keinginan masyarakat, maka tentu sistem yang ada sekarang harus diperbaharui dengan sistem yang sesuai dengan kondisi masyarakat. Sistem peradilan pidana merupakan salah satu sistem yang harus diperbaharui, mengingat fungsi dan kewenangannya yang sentral, yaitu memberikan kepastian hukum dan keadilan masyarakat. Sistem peradilan pidana adalah instrumen hukum pemberantasan kejahatan, ia harus menunjukkan keserasian dan keterkaitan antar subsistem, membentuk satu kesatuan keterkaitan yang menghadirkan rasa keadilan dan kepastian hukum bagi para pencari keadilan.

Abstract

Perkembangan tentang fenomena childfree cukup melebar luas diseluruh belahan dunia termasuk di negara Indonesia. Meskipun negara Indonesia itu sendiri merupakan negara yang minoritas. Tidak menutup kemungkinan childfree telah menjadi sorotan dari berbagai kalangan-kalangan tertentu. Timbulnya tren childfree ini ditimbulkan karna nilai sosial kebudayaan tentang pentingnya kehadiran seorang anak. Sebelumnya kehadirannya menjadi suatu yang sangat membanggakan dan dianugerahi akan tetapi sekarang menjadi suatu permasalahan. Penelitian ini merupakan penelitian normativ dan studi kepustakaan menganalisa terhadap teori-teori, konsep-konsep, dan juga secara langsung mengkaji berbagai aturan-aturan yang berhubungan dengan penelitian studi kepustakaan dengan malakukan penelitian terkait bahan pustaka atau data sekundernya. Hasil penelitian ini Abdul Majid An-Najar menekankan bahwa hukum Islam harus mempertimbangkan maslahat dan tidak boleh bertentangan dengan tujuan utama syariat. Childfree tanpa alasan syar’i tidak dianjurkan karena bertentangan dengan maqaṣid menjaga keturunan. Keputusan childfree harus diambil secara adil dan berdasarkan musyawarah antara suami dan istri, tanpa ada paksaan dari salah satu pihak.

Abstract

Films serve as educational media and convey moral messages, but they differ when they portray the true story of a victim of sexual violence by exposing their true identity without protection. The film "Vina Sebelum 7 Hari" depicts the real-life case of sexual violence experienced by Vina, with explicit scenes that depict the victim's traumatic experience and reveal her identity to the public. This potentially violates legal norms regarding the protection of the victim's identity, as stipulated in Article 69 (d) of Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence, the Pornography Law, the Broadcasting Law and the Protective data Personal law. The exposure of the victim's identity causes secondary psychological impacts, social stigma, and psychological distress for the victim and her family. Although the film is intended to have educational value and moral awareness, its presentation without adequate protection actually brings harm to the victim and society such as Article 69 letter (d) of Law No. 12 of 2022 concerning on the Crime of Sexual Violence, Article 10 of Law No. 44 of 2008 concerning on Pornography, Article 48 Paragraph 4 of Law No. 32 of 2002 concerning on Broadcasting and Law No. 27 of 2022 concerning on Personal Data Protection. This study uses a normative-juridical method and use analysis qualitative to discuss the legal protection of the identity of victims of sexual violence in the context of film screenings, examining aspects of TPKS, Pornography laws, Broadcasting law. Using secondary data source with primary, secondary and tertiary legal materials and using qualitative data analysis methods in order to produce more accurate reaserch.

Abstract

This study examines the shift in the legal paradigm regarding the legal status and criminal liability for the management of State-Owned Enterprises (SOEs) following the enactment of Law No. 1 of 2025 on SOEs, as well as its relevance to Supreme Court Circular Letter (SEMA) No. 4 of 2016 in Case No. 10/Pid.Sus -TPK/2025/Pn.Smr. The background of this study is the existence of overlapping regulations: new provisions assert that the directors, commissioners, and supervisory board members of SOEs are no longer considered state officials, while current practices still rely on old guidelines when assessing state losses. This study is a normative legal study employing a legislative and conceptual approach, utilizing descriptive-qualitative analysis of primary and secondary legal sources. The results of this study indicate that the 2025 SOE Law reinforces the separation of state assets—which have been distinct from the corporate assets of an SOE—thereby classifying risks that should be treated as business risks protected by the business judgment rule, provided they are undertaken in good faith, with due diligence, and without a conflict of interest. However, SEMA No. 4 of 2016 still allows judges the discretion to assess and determine the existence of state losses in specific cases, thereby creating the potential for overlap between the two existing regulations and the risk of over-criminalization of SOE business decisions.
