Abstract

The   history   of  Islamization   in  the  archipelago,   especially   that happened since the 16th century has encouraged  a writing tradition of religious manuscripts in huge numbers. The manuscripts can definitely be regarded as primary sources for reconstruction a social- intellectual  history of Indonesian  Islam in the past. One of the most important topics discussed in such sources is that relates to the history of blaming and marginalization  of religious doctrine, especially that of Unity of Being (wahdat al-wujūd), or popularly known in Java as Manunggaling  Kawula Gusti. This article will examine some Islamic works covering  the discourse  of controversy  between  the orthodoxy and heterodoxy that emerged since the mid of 16th and 19th centuries in the Archipelago. The first work that will be consulted is a Sufi treatise entitled at-Tuhfah al-Mursalah ila an-Nabi (the Gift addressed to the spirit  of the Prophet)  written  by an Indian  scholar,  Fadl Alla>>>h al- Hindi al-Burhanpuri.  Furthermore,  this article will demonstrate  the emergence  of ‘derivative’ local works  of at-Tuhfah,  written  both in Arabic  and local languages.  The works contain  both opposing  and supporting thoughts of the theosophical doctrine discussed in the at- Tuhfah.

Abstract

Study on the Islamic studies tradition (orientalism) in Russia is quite rare, whereas compared to the Europeans or the West in general, the Russians actually have far reached into contact with Islam through a variety of traditions and cultures that developed the Arab-Muslim and Arab-Jewish.  This encounter  in the next stage turned into the birth of a tradition encouraging the study of Russian orientalism known as arabistika. This article attempts to trace the history of the growth of Islamic studies in Russia by looking at the factors driving its development and  the  official  policies  of  the  country’s  political  elite,  especially of Peters the Great. The author, in this context, tries to analyze the findings of I.Yu Krachkovsky  on spiritual tour performed by Russian intelligentsia to the Arab world, and the sources of Muh}ammad Na>z}im ad-Daira>wi revealing  the information  and documentation  of ancient Russian that are immortalized  by the some geographers,  historians, prominent Muslim adventurers such as at}-T}abari, al-Maqdisi, al-Idri>si>, al-Mas‘u>di>,  Ibn Khurdadbih, Ibn H}auqal,  Ibn Fad}la>n, Ibnu Bat{u>t}a and many others. This paper also reveal many of the central role of Peter the Great in the development of arabistika tradition in Russia.

Abstract

Lampung is the pepper-producing  areas that had been under seizing of kingdoms of the surrunding since long time. The arrival of Islam in Lampung, in a lot of analysis, is also closely related to its existence as the pepper-producing  area. When the Port of XVI-XVII centuries Banten grown into an international center for trade with commodities and spices,  especially  pepper,  then  for the supply  of the pepper,  it later expanded into a number of pepper-producing  regions, including Lampung. A number of policies applied to pepper-producing  regions, including  tying a number  of rules in the population  with a charter granted to the representative  retainer  of Banten in the area, one of them in the context of Lampung is the Charter Dalung Bojong which is the object study of this article. Using archeological history approach, the  present  author  attempted  to  uncover  the  elements  contained in  the  inscription  as  historical  sources  that  provide  information about  the  events  of  political,  bureaucratic,  religious,  and  the  life of the community  in the past. It is revealed  that the charter  issued in  1102  H/1691  M  by  Sultan  Abul  Mahasin  Muhammad   Zainul Abidin  (1690-1733  AD)  contains  regulations  of  forced  cultivation of  pepper,  the  pepper  trading  regulations,  and  also  contains  civil and criminal  laws. On the other hand, this inscription  also reveals a   pattern   of   Jakarta-Lampung    relationship   in   the   seventeenth century:  in terms of political,  economic,  social and cultural  rights.

Abstract

Abstract The  article  examines  the  traces  of ideology  and  practices  of Shia teachings that developed in Indonesia, particularly Aceh by analyzing two  popular  texts  in Acehnese  society,  especially  the  Pidie region, the story of Hasan and Husain and Nu r Muhammad. To this end, the author uses an interdisciplinary approaches; first it uses philology and codicology to assess the content and the physic of the manuscript. Then the inter-textual approach is used to compare the text of the manuscript with similar texts in order to obtain information related to the cultural practices of the Shia in Acehnese society. Then to analyze the context of the background  and the existence  of the manuscript  appeared in the local community even its popularity it uses the approach of social history. The authors found that the two texts being studied describe that people were really appreciated  and reflected history of the past, then they use it as a spirit in their lives. Persistent  struggle and relentless fight the people of Aceh against in disbelief and colonialism, perhaps, was part of a reflection of genuine appreciation  for the history of the struggle  of ‘Ali and his family that  they  were praised in the  saga.

Abstract

This  article  describes  scientific integration  of Abdul  Malik  Fajar’s insight. In essence, discussion surrounding the integration of scientific discourse,  between general/secular  sciences and religious ones, has long been the discussion of experts. The reason why Abdul Malik Fajar’s insight the topic of discussion in this article is because his thoughts on integration  of science not to be simply discourse.  What is more, he was able to pave the way to be an important and esteemed public figure that was pointed to hold the reins of the Minister of Religious Affairs, and followed then to be the Minister of National Education. Reconstruction of Islamic education from dichotomious character into non-dichotomous  one, the existence of the Islamic education  system that should be placed within the framework of sociological purposes, as well as school-based management education as a realization of the decentralization  of education  by offering  school-based  management (SBM) is the most original thought he was offering.

Abstract

The widespread of shari’a by-laws in some regencies and many cases of discrimination and persecution of certain religious sects empirically are the manifestation of hegemony of majority over those of minorities which has often been overlapped with agenda and interests of political elites and the ruling power. This paper describes a number of problem concerning the majority-minority relations in Indonesia, by tracing the historical roots of resolution on such cases in Medina Charter as the constitution of Islam and the 1945 Constitution as the Constitution of Indonesia. By using descriptive-analytic  approach, the author asserts that various forms of rejection and humiliation against religious minorities, both within the same religion as well as between different religions that takes places of the current is clearly in contrast to the spirit of Medina Charter and the 1945 Constitution. Facing such problem of religious majority-minority relations and their excesses and the reality of pluralism, state, in accord with the author’s conclusions, must take a dual role: The role of prevention in terms of keeping in harmony the relations between people of different religions/faiths, and of promotive one in implementing and advancing the noble universal values that favored by each religion.

Abstract

Indonesia  is  considered  the  most  populous  Muslim  country  in  the world that successfully develops democracy. In one hand or another, however,  a number  of ill treatments  of discrimination  over those of minorities in this country   continuously remains occurring. The minorities have not been fully acquired their rights mainly in relation to religious  freedom.  This  article  tries  to map  out the relationship between majority Muslims and non-Muslim  minorities  in Indonesia, which involves two important issues: Readiness of majority culture as the main subject and state constitution. Various human rights violations and  discrimination  experienced  by  minorities  was  not  solely  done by a mere majority, but also by state. It, has systematically  issued a potential number of legislation products which marginalizes minorities and favored majority.   To protect the rights of citizens from majority groups  and   state interference,  this article  puts forward  two steps; political advocacy of equality and capacity building for strengthening democratic  values. The first step is intended to encourage  the more serious attention  to and protect the existence  of minority  groups by issuing laws and regulations  that are fair and protected all citizens. While the second step is needed to strengthen democratic values such as liberty, equality and tolerance that has existed within the majority, those of Indonesian Muslims.

Abstract

Indonesia is a famously religious nation that has a high-level of plurality in many aspects of race/ethnicity, religion, belief, language, customs, political thoughts, economic, cultural and ideological. All these could potentially contribute conflict and tension between different groups if the attitude of extreme and formalistic  logic of fiqh flourished. This paper tryies to emphasize the importance of fiqh aqalliyah in the era of pluralism to organize the life among different religious believers in which religious conflict has often been the case due to double standards and the Islamic militant movement. By means of Kuhn’s shifting paradigm approach, this paper reveals that Muslims need to formulate a shifting paradigm of ijtihad, namely from fiqh aglabiyah   (majority fiqh) to fiqh aqalliyah (minority fiqh), where Muslims can protect non- Muslim minorities and also capable of providing the space for life of Muslims  in the non-Muslim  majority.  Thus, this paper develops  the nature of  paradigm of the fiqh aqalliyah of M. Amin Abdullah, who is only focused on the aspect of giving space to Muslims living in non- Muslim territory. In his presentation, the author emphasizes the need for re-reading  (re-interpret)   the old discourse  of fiqh and submit a new one drafted on the reading of religious texts based on universal religious values such as the conception of  qat}‘i>-z}anni> as proposed by Masdar F. Mas‘udi.

Abstract

This article focuses on answering questions on the application of the principles of enforcement of Shari’a Qanun in Aceh,  its position and its implications for non-Muslim minorities in the Shari’a Qanun. Based on indepth reviews of various laws and regulations, local regulations of Shari’a-Qanuns,  and other relevant  literatures,  the author found that the Shari’a Qanuns imposed Islamic law in Aceh adhere to the principles of quasi personality. On one side, the Qanun is only valid for every Muslim who is in Aceh (the principles of personality), but on the other hand this also applies to any person resides in the territory of Aceh (the principle of territoriality), including those of non-Muslim minorities; in particular if they do offenses not provided in the book  of penal law or in other regulations outside the book  of penal law, such as seclusion (khalwat) and ikhtilat. Implementation of such Qanun thus potentially gives raise intolerance to human rights violations (Human Rights), as opposed to the 1945 Constitution which guarantees every citizen to profess and practice their believe and religion. The solution might be that the formulation  of the Qanuns and its implementation in Aceh need to take several steps and considerations, including identification of a common platform that upholds the moral conception of  justice, humanity and welfare.
