KARSA is a peer-reviewed national journal published by Institut Agama Islam Negeri Madura. It has been nationally accredited SINTA 2 since 2017 by Ministry of Research Technology and Higher Education of Republic Indonesia. It is published twice a year (June and December). It publishes articles of research results, applied theory studies, social issues, cultural studies, and Islamic culture issues. The aim of KARSA is to disseminate cutting-edge research that explores the interrelationship between social studies and (including) culture. The journal has scope and seeks to provide a forum for researchers interested in the interaction between social and cultural aspects across several disciplines. The journal publishes quality, original and state-of-the-art articles that may be theoretical or empirical in orientation and that advance our understanding of the intricate relationship between social science and culture. KARSA accepts manuscript with a different kind of languages are Indonesian, English, Arabic, or French.

Abstract

This study aims to determine the socio-cultural and religious resilience index in Sumbawa Regency through social, cultural, and religious life indicators, as well as to determine the role of key stakeholders in facilitating the realization of this resilience. The design is a mixture of quantitative and qualitative research. Quantitative research includes data collection through a public perception questionnaire about the resilience indicators. Qualitative research includes the use of documentation, informal interviews and observations to explore the roles of key stakeholders in facilitating the realization of resilience in the regency. The study results show that the social, cultural, and religious resilience index in Sumbawa Regency recorded a score of 80.1 (high), indicating good and controlled conditions. The two dimensions with a very high category are religious tolerance (84.1) and equality in religion (83.1), while the others are in the high category, namely the social dimension (76.1), culture (78.5), and cooperation between religious communities (78.6). They indicate that all dimensions of resilience have room to improve to achieve optimal scores. The key stakeholders are vital in realizing socio-cultural and religious resilience in Sumbawa Regency. The collaboration and involvement of various group representatives in implementing activities contribute to realizing resilience in a pluralistic society in Sumbawa Regency.

Abstract

Facts show memorizing the Qur’an is difficult, especially considering contemporary man’s busyness. The memorizers of the Qur’an admit that they have difficulty finding time to repeat (murâja’ah) the memorizations they have consistently. This study tries to reveal the contribution of the T.E.S. method, a method of memorizing the Qur’an discovered by Ustadz Jemmi Gumilar ST., in improving the memorization of the Qur’an. Using a qualitative approach and descriptive method, this study shows that the T.E.S. method has positively contributed to improving the quality and quantity of memorization of the Qur’an of the tahfîzh participants. Many beneficiaries and recognition of the training participants for the effectiveness of the T.E.S. method prove this. Theoretically, the success of the T.E.S. method lies in time management and discipline or consistency in reading the Qur’an, memorizing, and repeating memorization.

Abstract

This study aims to describe and analyze religious values ​​and spiritual responsibility in Hijaz Yamani poems and their relevance to character education in learning. The study used a descriptive qualitative method with a content analysis approach. Data were sourced from the poetry anthology “Malam Hujan” with data collection techniques through literature study, observation, and notes. The results of the study indicate that: (1) Religious values ​​in Hijaz Yamani poems are integrated with spiritual responsibility values ​​reflected through the use of diction, symbols, and figures of speech that represent the vertical relationship between humans and God; (2) The poem “Kalau Kau Datang” contains spiritual responsibility values ​​shown through awareness of the presence of angels as a symbol of the end of life and readiness to face the Creator; (3) Religious values ​​and spiritual responsibility in Hijaz Yamani poems have significant relevance to character education, especially in the development of students’ spiritual, moral, and social dimensions. The implication of this study is the importance of integrating religious values ​​and spiritual responsibility through literary works in learning to strengthen students' character education.

Abstract

This study investigates Islamic jurisprudence principles concerning workers’ protection regarding wage determination and payment in Indonesia. Employing a juridical-normative approach, the research analyzes labor regulations, Islamic jurisprudential rules, and the concept of labor law. Data were collected through legal document analysis, Islamic literature review, and comparative studies and were analyzed qualitatively using descriptive-analytical methods. The findings indicate that Islamic jurisprudence principles, prioritizing justice, equality, and workers’ welfare, have been incorporated into Indonesian labor law through Law Number 13 of 2003 on Manpower and Government Regulation Number 51 of 2023 on Wages. Islam regards workers as equals to employers and prohibits the imposition of excessive workloads, delays in wage payments, and unjust treatment of workers. Similarly, Indonesian legislation prohibits employers from delaying wages and ensures workers receive fair compensation. The study underscores the significance of integrating Islamic principles with positive law to establish a more humane and equitable wage system that safeguards workers’ rights and promotes their welfare in Indonesia, particularly within the context of Subang Regency as an industrial area. This research contributes to a comprehensive understanding of legal protection for workers within the wage system by synthesizing the principles of Indonesian positive law and Islamic jurisprudence.

Abstract

This research examines the complexity of the relationship between spiritual and economic aspects in the context of the pilgrimage of saints in Indonesia. Using qualitative and anthropological approaches, this research relies on secondary sources of relevant literature. The ’ziarah wali’ (saint pilgrimage), which has strong roots in traditional Muslim cultures, has undergone significant transformations along with economic and political developments in the modern era. This study analyzes how the veneration of holy men in many parts of Javanese culture transformed from religious ritual into social and economic activity manifested in popular tourism. The literature review includes various sources of literature data related to the study of the history of the pilgrimage of saints, socio-cultural changes, government policies related to religious tourism, and the economic impact on the community around the pilgrimage site. The main findings indicate an ongoing negotiation between spiritual values and economic interests in shaping the contemporary pilgrimage landscape in Indonesia. The analysis shows the complex dynamics between pilgrims’ spiritual motivations, local communities' economic interests, and government policies in developing the religious tourism sector. This research contributes to a more nuanced understanding of socioeconomic dynamics in spiritual practices and the implications for policies on cultural heritage preservation and religious tourism development in Indonesia.

Abstract

The rapid development of Artificial Intelligence (AI) has brought significant transformation across various sectors but also presents complex and urgent ethical challenges. Key issues include algorithmic bias that may reinforce social discrimination, privacy violations due to massive data collection without adequate control, and unclear accountability in autonomous AI systems. These challenges threaten social justice, individual rights, and public trust in technology. This study aims to develop an AI ethics framework grounded in Maqāṣid al-Sharīʿa, the Islamic legal philosophy emphasizing the protection of five fundamental values: religion (ḥifẓ al-dīn), life (ḥifẓ al-nafs), intellect (ḥifẓ al-ʿaql), lineage (ḥifẓ al-nasl), and property (ḥifẓ al-māl). A qualitative literature review method employing content analysis and thematic synthesis was applied to examine relevant literature on AI ethics and Maqāṣid al-Sharīʿa, identifying gaps and opportunities for normative integration. The findings demonstrate that Maqāṣid al-Sharīʿa offers a holistic perspective complementing Western AI ethics frameworks by incorporating spiritual, moral, and social justice dimensions. The principle of ḥifẓ al-ʿaql underpins efforts to combat misinformation, while ḥifẓ al-māl guides the equitable development of Sharia-compliant fintech. This study recommends inclusive algorithm design, Sharia-based regulation, and multidisciplinary collaboration among religious scholars, technology developers, and regulators to ensure ethical, responsible, and sustainable AI development.

Abstract

This study investigates the dynamics of interactions among stakeholders in shaping MSME actors' business orientation in Gili Trawangan regarding acceptance and rejection of halal certification on food and beverage products. Using a qualitative approach and case study method, data were collected through participant observation over two months and in-depth interviews with 18 key informants, including MSME actors, government representatives, and tourists. The study explores how MSME actors' attitudes amid contestation between the government as an institutional stakeholder and tourists as primary stakeholders influence decisions to accept or reject halal certification. Findings show that the dominance of primary stakeholders, namely tourists, is the main factor shaping MSME business orientation, which tends to follow tourists' preferences in offering food and beverage products. Conversely, the government's function as an institutional stakeholder in promoting halal certification is less effective, leading MSMEs to resist certification and rely on traditional halal-based offerings and product diversification into non-halal items to attract various tourist segments. This research contributes significantly to understanding power relations and interests among stakeholders in MSME management within tourism and policy implications related to halal certification. Limitations include geographic scope, focus on certain MSME groups in Gili Trawangan, and reliance on data subjectively reported by informants. Future research should broaden the context and include diverse MSME groups in different regions to obtain a more comprehensive picture of stakeholder influence on business orientation.

Abstract

Community policing, a proactive crime prevention strategy, faces unique challenges in apartment-based urban environments like South Jakarta's Kalibata City Apartment complex. These communities are characterized by higher levels of individualism and lower social cohesion, making it difficult to establish effective community-police partnerships. The study, involving 360 randomly selected residents, found that the social fabric of apartment communities lacks the integration necessary for successful community-policing partnerships. The study also highlighted the socio-spatial characteristics of apartment complexes, such as high population density and vertical living arrangements, which significantly shape the feasibility and outcomes of community policing initiatives. This research contributes to the broader discourse on urban policing by identifying key gaps in existing practices and emphasizing the need for context-sensitive approaches.

Abstract

This research examines the alignment between Restorative Justice concepts and constitutional principles embedded in Indonesia’s 1945 Constitution, analyzing its effectiveness in achieving substantive justice and social restoration. Employing normative legal research methodology with statute, conceptual, comparative, and case approaches, this study investigates how Restorative Justice can serve as an instrument for actualizing constitutional values within Indonesia's constitutional system. The research reveals profound philosophical harmonization between Restorative Justice principles and constitutional values, particularly regarding human rights protection (Article 28I), substantive justice (Article 28D), and the rule of law principle (Article 1(3)). The analysis demonstrates that Restorative Justice effectively achieves substantive justice through participatory processes that prioritize dialogue, accountability, and community involvement over punitive measures. Evidence from juvenile criminal justice implementation and comparative analysis with international practices indicates significant effectiveness in reducing recidivism rates and strengthening social cohesion. The study concludes that Restorative Justice constitutes a constitutional imperative rather than merely an alternative judicial mechanism, representing the actualization of substantive constitutionalism that aligns with Indonesia’s foundational Pancasila values. This research contributes to constitutional law scholarship by establishing a theoretical framework that integrates alternative justice mechanisms within constitutional governance, providing empirical evidence for constitutional-based Restorative Justice effectiveness, and offering methodological foundations for future research examining the intersection between constitutional values and innovative justice practices.

Abstract

Indonesia faces significant challenges in ensuring equitable health rights fulfillment despite having comprehensive health legislation, with persistent disparities in healthcare access across geographical and socioeconomic dimensions raising questions about the effectiveness of health rights implementation within the international human rights law framework. This research aims to analyze the implementation of health rights in Indonesia within the framework of international human rights law, evaluate the conformity of Indonesian health policies with international human rights standards, identify legal and policy factors contributing to healthcare access disparities, and assess the effectiveness of health regulation implementation in ensuring citizens’ health rights fulfillment. The study employs normative-empirical methods with a policy analysis approach. Research findings demonstrate that despite Indonesia’s comprehensive legal foundation from constitutional to technical, operational regulations, healthcare access disparities remain a complex structural challenge. The evaluation of AAAQ principles (Availability, Accessibility, Acceptability, and Quality) reveals significant geographical and socioeconomic inequality, particularly between urban-rural areas and western-eastern Indonesian regions. The effectiveness of health regulation implementation shows a paradox between firm normative commitments and diverse practical realities, with challenges including coordination complexity across government levels, limited healthcare human resources, and unequal health facility distribution. This research recommends human rights-based health policy reforms that integrate Pancasila values to create a more inclusive, equitable, and sustainable healthcare system that achieves health justice in Indonesia.
