Abstract

The tradition of uang panai is one of the traditions that is still preserved by the Bugis-Makassar community in marriage. This tradition is in the form of a sum of money the groom gives the bride as a sign of appreciation and seriousness to marry her. However, the tradition of uang panai represented in the movie “Uang Panai Maha(r)l” shows a shift in value and is not based on Islamic values contained in the sources of Islamic law, namely the Al-Quran and Hadith. This study aims to analyze the content of hadith about the tradition of uang panai in Bugis-Makassar marriage customs represented in the film “Uang Panai Maha(r)l”. This research uses a descriptive qualitative method with a qualitative content analysis technique. The results showed that the hadiths related to marriage do not contradict the tradition of uang panai as long as they are by Islamic teachings. However, the concept of uang panai in the movie “Uang Panai Maha(r)l” is depicted excessively and contains elements of coercion. Thus, the concept of uang panai in the movie is not by the meaning of the hadith, which recommends making it easier for each other to carry out marriage and walimah. Based on the results of this study, it can be concluded that the tradition of uang panai in Bugis-Makassar wedding customs can be justified if it is carried out by Islamic teachings, namely the recommendation of marriage, the recommendation of facilitating marriage, and the recommendation of organizing walimah. This tradition must be carried out wisely and does not contain elements of coercion. Keywords: Uang Panai, Hadith, Bugis-Makassar Wedding, Film

Abstract

This research discusses the rambu solo' tradition in Toraja, the value of pluralism in the tradition, and urf analysis related to the rambu solo' procession. This research uses a qualitative method with a legal sociological approach, empirical, and urf analysis. The rambu solo' ceremony is divided into several levels: 1) disili', for lower castes and infants; 2) di pasangbongi, for free people with a short procession; 3) dibatang/didoya tedong, for the middle and upper classes; and 4) rapasan, specifically for nobles. This tradition reflects the value of pluralism through togetherness in the 3S (Sikamali, Siangga', Siangkaran). Urf in rambu solo' includes shahih urf, except for some additional customs that do not conflict with Islamic law. Keywords: Pluralism Values, Rambu Solo Toraja, Urf Analysis

Abstract

The Mamasa community has the Merenden Tedong tradition which is rooted in customary law as an effective conflict resolution model in resolving social problems. This tradition is deeply rooted and has become a unique cultural icon in overcoming social challenges and conflicts in society. The integration of this traditional approach with a formal approach from the government has strengthened the mechanism for mitigating socio-religious conflict in social life. This article aims to describe the integration between two conflict resolution models, namely the cultural approach through customary law and the structural approach through government policy, as an effort to mitigate socio-religious conflict in Mamasa. This research used a phenomenological analysis approach involving in-depth interviews. Informants consisted of traditional leaders, community leaders, government officials and community members to gain a comprehensive understanding of the Merenden Tedong tradition as a model for conflict resolution. This research found that the integration of cultural and structural approaches in the Merenden Tedong tradition contributed significantly to mitigating social and religious conflict. Collaboration between traditional institutions and the government strengthened the role of customary law in conflict prevention, proving that an integrative approach is more effective than a unilateral model. Further research is recommended to explore the role of the younger generation in maintaining the identity of Pitu Ulunna Salu as a conflict mitigation strategy. Abstract

First-time voters are a fairly large segment of voters. This shows that First-Time voters are a large resource in politics in Indonesia. Indonesia as a democratic country certainly expects every element of society to be actively involved in every democratic process, including the first-time voter segment. First-time voters as an important segment then have quite good political awareness. Through this political awareness, a pattern of political preference formation will then be formed. First-time voters as a large political resource are of course highly expected to be able to participate, at least voting in elections. So far, existing research regarding First-time voters only places as mere objects. However, this research then examines in more depth the patterns of political preference formation that will influence the political behavior of first-time voters. This research is qualitative research with primary data obtained through in-depth interviews with high school students as research informants. Based on the research conducted, it appears that First-time voters in Makassar City have quite good political awareness, which is an implication of their better political knowledge. So, when making choices in an election, First-time voters have a tendency to make their own choices based on their political preferences. The pattern of forming political preferences of first-time voters is sociology, rationality and psychology. Keywords: Firs-time voters, Political Preferences, Political Awareness

Abstract

This research explores the communication of traditional sexual customs in Mandar society, focusing on practices related to sexual relations. Although these practices are an integral part of Mandar cultural identity, social change and modernization have affected their understanding and application. Using phenomenological analysis, this study identifies the symbolic meanings, values and changes that occur in these customs and seeks to understand the role of verbal and non-verbal communication in their preservation or transformation. The findings reveal that symbols in traditional sexual rituals still have important meanings, reflecting values such as respect, family honor and social harmony. However, there have been noticeable changes in the way these symbols are understood and practiced, especially among the younger generation, who tend to interpret the customs from a modern perspective. These findings contribute to understanding how cultural symbols adapt in a changing social landscape, with broader implications for cultural preservation and communication studies in evolving societies.

Abstract

The research explains the internalization of Maqasid Al-syari’ah in the Bugis traditional marriage process, because of various oblique views of Bugis marriage customs, it should be addressed wisely and wisely. This research is qualitative research using an Islamic legal juridical approach with qualitative descriptive analysis.  Data sources are primary data conducted through interviews with traditional leaders, religious leaders, community leaders, and secondary data taken from documents that have relevance to the research. Data collection techniques are observation, interviews, and documentation. The results showed that the meaning of the panai money marriage tradition, although not found in Islamic law, is not contrary to sharia and does not damage the faith. Because in it there is benefit, both for the wife and the husband. This kind of custom is called al-adah aṣ-ṣaḥiḥ or al-urf aṣ-ṣaḥiḥ, which is a good custom that can be used as a legal consideration. Islam as a merciful religion accepts customs and culture as long as they do not contradict Islamic shari'a and the custom has become a provision that must be implemented and is considered a rule that must be obeyed, then the custom can be used as a foothold as Islamic law recognizes the validity of customs in the interpretation of law, as the fiqhiyyah rule: al-adah muhakkamah which means that custom can be used as a legal footing.
