Abstract

This article is intended to examine the control of child custody rights by fathers after divorce in Padang Lawas Regency. Field studies using juridical-empirical as the approach. The primary data source of this study is the results of interviews with husbands and wives who exercise child custody rights after divorce and traditional leaders of Padang Lawas Regency. Secondary data sources are in the form of the Compilation of Islamic Law, Law Number 1 of 1974 concerning Marriage, books, journals, and other materials relevant to this study. This study was analyzed using a descriptive approach. The results of the study show that child custody rights are fully the rights of fathers after divorce in Padang Lawas Regency. Child custody rights are the responsibility of the father towards all children including those under the age of twelve. The Padang Lawas community gives child custody rights to the father on the grounds that children are the successors of the lineage or the Patrilineal System. The wife is considered a newcomer after a divorce so she does not have child custody rights, but is still allowed to live with her mother but not forever just to relieve longing.  Keywords: Child Custody, Divorce, Padang Lawas, Patrilineal System

Abstract

This study examines the socio-religious context of the An-Nadzir community in Jembatan Miring, Palopo City, including the factors that influence it and the responses from government authorities and religious leaders. Through a phenomenological approach within the framework of religious sociology, the research reveals that the local population generally accepts the An-Nadzir community despite its distinct religious practices and interpretations. Its existence is grounded in the principle of enforcing the Prophet’s Sunnah in daily life, emphasizing values such as self-awareness, exemplary conduct, tolerance, and mutual assistance. The community has successfully adapted to the local socio-cultural environment through various elements, including kinship, education, regional policies, the economy, and the natural surroundings. Several factors contribute to its continued presence, including strong kinship ties, economic integration, a tolerant social atmosphere, and support from local authorities. Although differences remain in ritual practices, such as prayer methods, call to prayer, and dress, the government and religious leaders view the community positively and accept it as part of the Islamic landscape. The study contributes to a deeper understanding of how religious diversity can coexist harmoniously and serve as a foundation for building inclusive and tolerant communities.

Abstract

The advancement of modern reproductive technologies, such as in vitrofertilization (IVF) and surrogacy, has provided medical alternatives for couples facing infertility issues. Despite their benefits, these practices raise significant concerns from the perspective of Islamic law, particularly regarding lineage (nasab), the sanctity of the womb, and the protection of offspring. This study aimsto analyze the permissibility of IVF and surrogacy within Islamic jurisprudenceusing a normative approach, and to assess their compatibility through the lens ofmaqasid al-shari’ah (the higher objectives of Islamic law). This research employs a normative qualitative method, drawing upon classical and contemporary Islamic jurisprudential literature, fatwas from recognized Islamic legal institutions (such as the Indonesian Ulema Council and the International Islamic Fiqh Academy), and the theoretical framework of maqasid al-shari’ah. The study finds that IVF is permissible in Islamic law as long as it occurs within a lawfulmarital relationship and does not involve third-party donors. On the other hand, all forms of surrogacy—whether involving a genetic link to the surrogate or not—are prohibited (haram) due to their potential to compromise lineage, exploit women’s bodies, and violate the sanctity of the reproductive process. The findings reaffirm that Islamic law, through the objectives of maqasid al-shari’ah, places a strong emphasis on the preservation of lineage (hifz al-nasl) and the integrity ofthe family unit. Thus, modern reproductive technologies are only acceptable whenthey align with these fundamental ethical and legal principles. This study contributes to the development of contemporary Islamic jurisprudence and serves as a reference for formulating religiously appropriate policies in the face of evolving medical advancements. Abstract

This study aims to find out the analysis of Maqasyid Al-Syariah and its implications for family resilience in long-distance marriage in Bua District, Luwu Regency. The approach used is qualitative with three points of view, namely juridical, sociological, and regulatory approaches. Data was collected through observation, documentation, literature studies, and in-depth interviews with 16 resource persons consisting of married couples, community leaders, and religious leaders. The analysis process was carried out by data reduction, data presentation, and conclusion drawing systematically to gain a deep understanding of the social dynamics and Islamic family law in the research area. The results of the study show that couples who undergo long-distance marriages face a number of challenges such as suspicion, miscommunication, unmet spiritual needs, financial pressure, and the potential for infidelity that can lead to divorce. However, many couples are able to maintain domestic harmony by trusting each other, maintaining communication, fulfilling rights and obligations, and fostering patience and sincerity. The analysis of maqāṣid al-syarī'ah reveals that the principles of ḥifẓ al-nafs, ḥifẓ al-'aql, ḥifẓ al-nasl, and ḥifẓ al-māl can still be realized when the couple is able to maintain the spiritual, emotional, and economic balance of the family. Socially and scientifically, this research contributes to the strengthening of the study of Islamic law and family resilience by showing that the values of maqāṣid are adaptive and relevant in responding to contemporary social challenges, including the phenomenon of long-distance marriage.
