Abstract

Research problems: What is the maqashid al-syariah perspective regarding someone who gives divorce outside the court? Research purposes: knowing the losses (mafsadat) due to divorce outside of court from the perspective of maqashid al-syariah. Research methods; using normative legal research (library research). Research results show that Divorce outside a court session is not permitted from a maqashid al-syariah perspective, even though it is permitted according to the Qur'an and hadith. Still, both imply indirectly that Islam allows divorce but, on the other hand, hopes that divorce will not occur. Divorce outside of court can disturb children's mental health. Children who were originally in a harmonious and loving family are suddenly in a family environment that is the opposite; their children are also feared to be vulnerable to falling into the company of alcohol and illegal drugs; the status of children is unclear according to the lawn causing the court to have no legal power to force the ex-husband to provide maintenance to the ex-wife during the iddah period; shelter, clothing, food and to their children too.

Abstract

Correctional institutions have complicated problems; the number of inmates is already over-capacity, prisons are places for courses on crime and terrorism, budget requirements are swelling, and the number of prison riots is increasing. Health problems exacerbate this during the covid 19 pandemic. The research method in this article uses qualitative research methods with a library approach. This paper contributes to the improvement of the system, especially in fostering Islam in correctional institutions through the pesantren program. The results state that it is necessary to strengthen the role of pesantren in correctional institutions to shape prisoners' morals for the better.

Abstract

ABSTRACT This study attempts to answer the above problems by examining the conceptual implementation of the hubb slogan al-wathan min al-iman KH. Hasyim Asy'ari in the education of the character of love for the homeland. Hubb al-wathan's slogan min al-iman echoed by KH. Hasyim Asyari as a lighter of the fighting spirit of the santri to maintain the independence of the nation, instill nationalism and patriotism which evoke the courage to make sacrifices of soul, body and property as well as scientific credibility and character of KH. Hasyim Asy'ari is a combination of his strong religious character, national commitment, leadership, and broad insight into his state. Abstract

Tujuan penelitian untuk menganalisis sejauh mana transformasi digital di pengadilan agama dalam mengevaluasi efektivitas e-Court di Jawa Tengah selama dan setelah Covid-19. Metode penelitian yang digunakan adalah normatif. Hasil Penelitian menunjukkan bahwa jumlah perkara yang didaftarkan melalui e-Court di Pengadilan Agama Wilayah Hukum Pengadilan Tinggi Agama Semarang Jawa Tengah pada masa pandemi Covid-19 dan pasca pandemi Covid-19 belum optimal. Semakin tahun mengalami naik turun bahkan tidak menunjukkan kenaikan yang signifikan. Ada beberapa hambatan yang ditemui dalam pelaksanaan e-Court, yaitu rendahnya kemampuan pencari keadilan dalam menggunakan fitur e-Court, pencari keadilan tidak mengetahui nilai utility dari e-Court serta fasilitas internet yang tidak memadai. Kendala lainnya karena banyak masyarakat di Jawa Tengah khususnya yang barasal dari pedesaan tidak familiar dengan penggunaan e-mail. Maka daripada bingung, mereka memilih pendaftaran perkara melaui secara manual, padahal pendaftaran perkara melaui e-Court lebih parktis dan biayanya murah. Oleh karena itu, Pengadilan Agama Wilayah Hukum Pengadilan Tinggi Agama Semarang Jawa Tengah perlu melakukan edukasi dan sosialisasi e-Court kepada masyarakat untuk mewujudkan cita-cita Mahkamah Agung dalam memodernisasi lembaga peradilan tanpa menyimpang dari prinsip hukum acara perdata. Kenaikan signifikan penggunaan fitur e-Court hanya terjadi di Pengadilan Agama Kelas II Magelang, dikarenakan adanya kebijakan agar sebisa mungkin seluruh masyarakat pencari keadilan mendaftarkan perkaranya secara elektronik. Meskipun terdapat kenaikan penggunaan fitur e-Court yang signifikan tetapi masih ada saja yang mengalami kesulitan, kecuali bagi masyarakat yang sudah melek Teknologi Informasi. The purpose of this study is to analyze the extent of digital transformation in religious courts in evaluating the effectiveness of e-Court in Central Java during and after Covid-19. The research method used is normative. The results of the study show that the number of cases registered through e-Court in the Religious Court of the High Religious Court of Semarang, Central Java during the Covid-19 pandemic and after the Covid-19 pandemic has not been optimal. Every year it experiences ups and downs and does not even show a significant increase. There are several obstacles encountered in the implementation of e-Court, namely the low ability of justice seekers to use the e-Court feature, justice seekers do not know the utility value of e-Court and inadequate internet facilities. Another obstacle is because many people in Central Java, especially those from rural areas, are not familiar with the use of e-mail. So rather than being confused, they choose to register cases manually, even though registering cases through e-Court is more practical and cheaper. Therefore, the Religious Court of the High Religious Court of Semarang, Central Java needs to educate and socialize e-Court to the public to realize the ideals of the Supreme Court in modernizing the judicial institution without deviating from the principles of civil procedural law. A significant increase in the use of the e-Court feature only occurred in the Class II Religious Court of Magelang, due to the policy that as much as possible all justice seekers register their cases electronically. Although there has been a significant increase in the use of the e-Court feature, there are still some who experience difficulties, except for people who are already literate in Information Technology.
