Understanding the fiqh of menstrual blood is very important for women, but not many formal schools teach menstrual blood material in Islamic religious studies. Though it is not easy to understand it because the menstrual blood cycle of each woman is different. This study aims to analyze the explanation of fiqh of menstrual blood in Buya Yahya's method and the basic knowledge of fiqh of menstrual blood on the understanding of UMKT Faculty of Law students. Buya Yahya's method in explaining the fiqh of menstrual blood is considered as one of the methods that is easy to understand. This research uses quantitative methods with data collection techniques used are questionnaires, with primary data sources, namely data obtained directly from the source through the distribution of forms. The data analysis technique used is multiple linear regression. The results showed that students understand the basic knowledge of fiqh of menstrual blood and the explanation of fiqh of menstrual blood in Buya Yahya's method.

This study examines the legal protection against the prohibition of hijab for female workers in hotels located in Samarinda City. The research aims to analyze the legal protections available for women wearing hijabs and to determine whether such prohibitions constitute a violation of the right to worship. The research used in this research is empirical juridical with a statutory and case study approach. The findings reveal that the ban on hijabs in hotels results in violations of human rights and the religious rights of female workers. Although there are regulations in place to protect the right to worship, their implementation in practice remains weak, leaving female workers often in vulnerable positions. The study concludes that there is a need for strengthened regulations and legal awareness among employers to ensure that workers' rights are respected and protected, and to create an inclusive and equitable work environment

Implementasi terhadap penyelesaian sengketa perselisihan hubungan industrial di Kalimantan Timur melalui Pengadilan Hubungan Industrial pada Pengadilan Negeri Samarinda faktanya banyak menghadapi peluang dan tantangan. Apakah peluang dan tantang tersebut didasarkan atas hasil wawancara dengan Dinas Ketenagakerjaan Trans Kalimantan Timur, Pengadilan Hubungan Industrial pada Pengadilan Negeri Samarinda, praktisi hukum, mediator, perusahaan, karyawan, dan serikat buruh sebagai subyek hukum yang memegang peranan penting dalam penyelesaian sengketa perselisihan hubungan industrial. Penelitian ini menerapkan jenis penelitian yuridis-empiris atau penelitian lapangan yang dilakukan terhadap data primer dan dipadupadakan dengan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, dan Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja yang kemudian akan dianalisis secara kualitatif. Realita di lapangan mengindikasikan adanya peluang dan tantangan yang harus dihadapi oleh Pengadilan Hubungan Industrial pada Pengadilan Negeri Samarinda yang meliputi proses beracara dari sidang pertama hingga putusan mencakup administrasi hingga salinan perkara sampai kepada para pihak, kekeliruan wawasan hakim ad-hoc terhadap implementasi prosedural memeriksa dan memutus perkara perselisihan hubungan industrial, dan belum adanya sistem pengawasan terhadap implementasi putusan yang sudah bersifat tetap (inkracht) yang akan dijalankan oleh pengusaha atau pihak tergugat.

This study examines the legal implications of fixed-term employment contracts (PKWT) made without written agreements through a progressive law approach. The primary concern addressed is the legal vacuum and uncertainty caused by the absence of sanctions for unwritten PKWT, as stipulated in the amendments to Article 57 of Law Number 6 of 2023 concerning Job Creation. This study aims to analyze the legal implications of unwritten PKWT and seek progressive law-based solutions that prioritize workers justice. This research employs a normative juridical approach, utilizing a legislative approach and analysis of progressive law doctrine. The findings indicate that unwritten PKWT lead to legal uncertainty for workers, particularly in pursuing their rights and resolving industrial relations disputes. This is due to the lack of consequences for non-compliance with Article 57, resulting in a legal vacuum. From a progressive law perspective, an alternative solution emerges by prioritizing substantive justice over legal formalities, providing better protection for workers. This approach also highlights the need to strengthen regulations to ensure PKWT implementation aligns with the principles of justice.

The passage of the Presidential Regulation in Lieu of the Law on Job Creation as outlined in Law Number 6 of 2023, the Bipartite Cooperation Institution was formed. This paper examines the legal elements behind the establishment of the Bipartite Cooperation Institute. The Bipartite Cooperation Institute functions as a forum for communication between employers and workers in an organization with the aim of fostering positive working relationships, but there are obstacles in the implementation of Article 190 of the Manpower Law because there are no technical provisions regarding administrative sanctions for business actors who are not members of the Bipartite Cooperation Institution. Primary and secondary legal sources are analyzed using normative legal techniques. The results of the study show that changes in regulations in the Job Creation Law cause legal uncertainty related to the establishment and implementation of Bipartite Cooperation Institutions. Although the establishment of a Bipartite Cooperation Institute is mandatory for companies with more than 50 workers, the administrative sanctions regulated have not been effectively implemented. As a result, many companies do not comply with these obligations, thus hindering efforts to create productive and conducive industrial relations. This study recommends the need for clear technical arrangements regarding sanctions enforcement mechanisms, more massive socialization, and increased active participation of employers and workers, so that the Bipartite Cooperation Institution can function optimally in preventing industrial conflicts and supporting sustainable employment development.

The banking industry is one of the companies that has a big impact on the development and economic progress of a country. In carrying out the operational activities of the banking industry company, of course there are company obligations in running the company, one of which is that the company must report employment data to the East Kalimantan province's labor and transmigration office. However, in reality, in the field, many companies have not carried out mandatory employment reporting. The aim of the research is to determine the implementation, supervision, and investigation of mandatory company employment reporting in the banking industry in the city of Samarinda. The research method uses empirical, juridical, literature, and field approaches and is analyzed descriptively qualitatively. Results and discussion show that 16 out of 20 banking industry companies have implemented mandatory corporate employment reporting. The company's legal compliance and awareness of statutory regulations have been implemented quite well. Supervision and investigation were also carried out well. The limited number of supervisors is still weak; 1 out of 15 supervisors can only supervise 5 companies once a month. Banking industry companies must be aware of the regulations of Law Number 7 of 1981 concerning mandatory employment reporting so that employment reporting obligations can be carried out optimally.

The era of globalization and increasingly competitive developments require companies to maximize resources to create high-quality products. One of them is by having strong human resources (HR). Legal protection for the implementation of Occupational Safety and Health (K3) procedures is a crucial aspect in maintaining worker welfare and the sustainability of company operations as well as the supervisory function carried out by the government. This research was conducted empirically with primary and secondary data. The data was collected through literature studies and interviews with related parties through descriptive analysis and qualitative approaches. This study aims to determine the protection provided by the company for the implementation of K3 and the role of labor inspectors in the process. The results of this study indicate that the company has provided good protection to its workers including the provision of Personal Protective Equipment (PPE) in accordance with the Standard Operating Procedure (SOP). The role of the government in carrying out supervision and coaching is attempted to run optimally so that it can continue to be improved. This study emphasizes the importance of synergy between internal company protection and external supervision from the government to ensure the achievement of maximum occupational safety and health goals.

Penelitian ini bertujuan menganalisis pelindungan hukum bagi pekerja yang terikat dalam Perjanjian Kerja Waktu Tertentu (PKWT) yang dilakukan berulang secara terus-menerus. Fokus penelitian ini adalah untuk mengetahui konsekuensi hukum yang muncul ketika PKWT telah melebihi masa kerja lima tahun. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan penekanan pada analisis peraturan perundang-undangan, dokumen hukum, dan referensi literatur terkait. Data yang digunakan meliputi bahan hukum primer seperti Peraturan Pemerintah Nomor 35 Tahun 2021, Undang-Undang Nomor 13 Tahun 2003, bahan hukum sekunder seperti buku, jurnal, dan artikel ilmiah. Temuan menunjukkan bahwa PKWT yang dilakukan berulang secara terus-meenrus menyebabkan ketidakpastian hukum bagi pekerja, terutama dalam mendapatkan hak-haknya. Hal ini disebabkan oleh kurangnya konsekuensi atas ketidakpatuhan terhadap pasal 59, yang mengakibatkan kekosongan hukum. Dari perspektif pelindungan hukum preventif dan represif secara konsisten sangat penting untuk menjunjung tinggi keadilan dan memastikan kepastian hukum dalam hubungan kerja. Hal ini juga memastikan terciptanya hubungan kerja yang sehat dan menguntungkan bagi kedua belah pihak, yaitu pekerja dan pengusaha. Pendekatan ini juga menyoroti perlunya penguatan regulasi untuk memastikan implementasi PKWT seleras dengan prinsip-prinisp keadilan

Penelitian ini menganalisis aspek yuridis penggunaan Artificial Intelligence (AI) dalam transaksi bisnis online, khususnya terkait privasi data dan keamanan konsumen. AI telah meningkatkan efisiensi dan personalisasi layanan e-commerce, namun juga menimbulkan tantangan hukum, terutama dalam perlindungan data pribadi. Dengan metode yuridis-normatif, studi ini mengkaji regulasi seperti UU ITE, UU PDP, dan PP No. 80 Tahun 2019. Hasil penelitian menunjukkan bahwa meskipun regulasi sudah ada, masih terdapat kekosongan dan kelemahan hukum dalam penerapan serta pengawasan. Oleh karena itu, diperlukan penguatan regulasi dan kolaborasi antara pemerintah, pelaku usaha, dan masyarakat guna menciptakan ekosistem bisnis online yang aman dan bertanggung jawab. Studi ini diharapkan dapat berkontribusi dalam memperkuat kerangka hukum terkait AI serta mendukung perlindungan hak-hak konsumen di Indonesia.

Introduction: This research discusses legal protection aimed at child defendants, especially in cases of sexual violence committed against minors. This is based on a case study in Decision Number 13/Pid.Sus-Anak/2023/PNBPP and Decision Number 3/Pid.Sus-Anak/2023/PNBPP.Purposes of the Research: This research focuses on the stages or steps in the application of the law that protects the rights of child defendants with reference to Law Number 11 of 2012 concerning the Child Criminal Justice System.Methods of the Research: This research was conducted with a normative method in the form of a case study to evaluate the steps in the judiciary by starting with the arrest, investigation, prosecution, and conclusion with the welfare of children affected by the crime of sexual violence.Findings of the Research: The results of the study found that, although the criminal threat against perpetrators of sexual violence is quite severe, the implementation of punishment for children of sexual violence still prioritizes the principle of restorative justice, taking into account the psychological and social aspects of children. In both of the decisions analyzed, the child defendant received a prison sentence of different durations, and was required to undergo job training as part of the rehabilitation process. Legal protection for child defendants remains indispensable and plays an important role in guaranteeing the rights of every child as well as providing a deterrent effect in cases of sexual violence.
