Abstract

This study explores the legislative frameworks governing drug rehabilitation and the reintegration of former drug addicts into society through a normative juridical analysis. The research examines how laws and policies influence the recovery journey, highlighting critical gaps in anti-discrimination measures, public health integration, and societal reintegration mechanisms. Comparative case studies from countries with progressive approaches, such as Portugal and Norway, illustrate effective models for aligning legal systems with public health strategies. The findings emphasize the need for legislative reforms that promote inclusivity, support long-term recovery, and foster societal acceptance. Recommendations include expanding anti-discrimination protections, incorporating restorative justice mechanisms, and enhancing interagency collaboration to ensure holistic rehabilitation programs. This research contributes to the discourse on aligning law and social policy to address the multifaceted challenges of drug addiction and reintegration.

Abstract

This study examines the legal mechanisms for the social reintegration of drug addicts, focusing on rehabilitation as a transformative approach to enabling individuals to re-enter society as productive citizens. Using a normative juridical analysis, the research explores the alignment of national legal frameworks with international human rights standards and evaluates the challenges in implementing rehabilitation-focused policies. Findings reveal that while laws and policies supporting rehabilitation exist, their effectiveness is hindered by societal stigma, inconsistent application, and resource limitations. The study emphasizes the need for policy alignment with international standards, expansion of community-based programs, public awareness campaigns, and strengthened monitoring systems. These measures are essential for creating a supportive legal and social environment conducive to the successful reintegration of drug addicts into society.

Abstract

The research investigates law's role in promoting transformative justice through social engineering, focusing on rehabilitation and reintegration processes of drug addicts into society. This study applies a normative-juridical approach to evaluate Indonesia's legal frameworks for their effectiveness in handling addiction as a public health issue. Comparative analyses with international models, such as the decriminalization in Portugal and harm reduction policies in the Netherlands, show what a change of heart in legal philosophy might achieve. The findings put forward the majors lacuna in the present legislation: undue punitive, lack of supportive infrastructure, and stigma among society. Recommendations offered by the study go on to include legislative reform for rehabilitation, supportive infrastructure development, public-private partnership for effective reintegration. This paper advocates for a compassionate justice system that embeds transformative justice principles into legal frameworks, promoting societal productivity and inclusivity.

Abstract

This paper provides a normative juridical analysis of Indonesia's carbon trading regulations, with a focus on environmental justice and fairness. It examines the legal framework established by Presidential Regulation No. 98 of 2021, which governs carbon pricing mechanisms, including carbon taxes and carbon credit trading. The analysis highlights key gaps in the regulation, particularly in terms of equitable benefit distribution and inclusion of vulnerable communities in decision-making processes. While Indonesia's carbon trading system aligns with global trends and its international obligations, significant improvements are needed to ensure that marginalized groups are not further disadvantaged. Recommendations include the redistribution of carbon trading revenues, enhanced public participation, stronger enforcement mechanisms, and alignment with international best practices.

Abstract

Corruption is recognized as an extraordinary crime that poses significant challenges to governance and justice systems. The remission policy for corruption perpetrators often raises concerns regarding its alignment with the principles of justice, as it can be perceived as undermining the severity of corruption offenses. This research addresses the critical question of how remission policies can coexist with the values of justice, particularly in the context of Indonesia's legal framework. The primary aim of this research is to explore the legal norms surrounding the remission policy for corruption perpetrators from a justice perspective. It seeks to analyze whether the existing policies uphold the principles of fairness and justice as articulated in the Indonesian Constitution and the state ideology of Pancasila. This research employs a normative legal research methodology, utilizing secondary data such as laws and legal theories. Two key approaches are applied: a statutory approach, which interprets legal norms within existing legislation, and a philosophical approach, which delves deeply into the theoretical underpinnings of justice. The findings indicate that while remission can be viewed as a human right and a potential reward for good behavior, its application must be strictly regulated to maintain public trust and uphold justice. The research emphasizes that remission policies should be grounded in solid legal foundations and should incorporate principles of community justice to ensure that they do not compromise the fight against corruption.

Abstract

Abstract: This article discusses the method of learning tafsir at Darul Maarif College (Petidam) Thailand. The main focus of this research is to understand the learning method of Al-Quran interpretation in Petidam and how respondents respond after using digital Tafsir Al-Mishbah (TAM). The method used in this research is a qualitative approach through observation, interviews and direct documentation in Petidam, July 15-19, 2024. The result of this research is that the learning method of Al-Quran interpretation is still using classical methods with reference to one book of interpretation, Shafwatutafasir written by Imam Ali Ash-Shabuny. From the results of interviews with 20 respondents after practicing learning the digital TAM application, it was recorded that respondents have got adventages from the digital TAM application. Because it is not only an interpretation but also contains asbabunnuzul, sirah of the prophet, worship, sharia and fiqh. However, some participants also felt two difficulties. First, it is difficult to download the digital TAM application via the Appstore. Second, they still find it difficult to understand the content of the digital TAM application due to language limitations. They suggested that the digital Al-Mishbah interpretation application could be equipped with various languages, especially Thai Malay so that it could be more easily understood.

Abstract

The Indonesian government has been actively facilitating business operations for both domestic and foreign entrepreneurs, as evidenced by the enactment of Law No. 6/2023, which amends the previous Job Creation Law (Law No. 2/2022) to enhance the business environment in Indonesia. Despite the positive intentions behind the Job Creation Law, there exists a vagueness in the norms regarding property rights for individual companies. This uncertainty has led to confusion among business actors and government officials, particularly concerning the issuance of land rights certificates. The primary aim of this research is to analyze and compare the impact of individual companies, as introduced by the Job Creation Law, on Indonesia's economy. The study seeks to clarify the legal position of property rights over individual company assets and their implications for the national economy. This research employs a normative juridical legal research methodology, utilizing a statutory approach and a conceptual approach. The authors examine relevant laws, regulations, literature, and articles to understand the legal framework surrounding property rights and their economic impact. The findings indicate that individual companies, as part of the Job Creation Law, have a positive influence on Indonesia's national economy. The contribution of micro and small enterprises (MSEs) to the Gross Domestic Product (GDP) has been significant, with their share increasing over the years, demonstrating their vital role in economic stability and growth.

Abstract

This study investigates grammatical omission errors in descriptive writing by second-semester EFL students at Madani Indonesia University. Using a descriptive qualitative approach, the research analyzed 45 student-written essays from a mid-term exam. Data were examined using Surface Strategy Taxonomy, focusing specifically on omission errors. The results revealed 239 total omission errors categorized into five types: articles (33.05%), pluralization (21.75%), punctuation (21.33%), verb phrases (12.97%), and conjunctions (10.87%). Article omission emerged as the most frequent. These errors often disrupted clarity, coherence, and grammatical accuracy. Findings highlight the influence of L1 interference and a limited grasp of basic grammar rules. The study underscores the need for focused instruction on articles, plurality, and structure to enhance students’ English writing accuracy and fluency.
