Abstract

Freedom of the press in Indonesia is constitutionally guaranteed under Article 28F of the 1945 Constitution as a vital pillar of democracy and freedom of expression. However, this freedom is often misused by individuals posing as journalists to commit extortion, thereby undermining the integrity of the press. This study aims to analyze the form of criminal liability imposed on individuals who abuse the journalist profession to conduct extortion accompanied by threats, as regulated in Article 368 of the Indonesian Criminal Code. Using a normative legal research method with a literature-based approach, this study examines legal doctrines, scholarly works, and relevant legislation, including the Press Law and the Criminal Code. The findings indicate that the principle of lex specialis derogat legi generali cannot be applied to such cases because extortion is a general crime, not a press dispute. Therefore, criminal liability falls entirely under the jurisdiction of general criminal law, not the Press Law. The study concludes that the misuse of journalistic attributes as tools for extortion eliminates press privilege and must be prosecuted as an ordinary criminal offense to safeguard press integrity and uphold legal certainty.

Abstract

This study examines the legal status of recordings obtained without consent as evidence in adultery cases, particularly in relation to the tension between legal certainty and the right to privacy. The main problem lies in the absence of clear legal standards governing the admissibility of such evidence, which creates uncertainty in judicial practice. This research aims to analyze the validity of unauthorized recordings as evidence and to assess their implications for privacy protection within the Indonesian legal framework. The study employs a normative juridical method using statutory and conceptual approaches, focusing on relevant regulations such as the Criminal Procedure Code, the Electronic Information and Transactions Law, and the Personal Data Protection Law, as well as constitutional court decisions. The findings indicate that although such recordings may be considered as supporting evidence under certain conditions, their use raises serious concerns regarding violations of privacy rights. The lack of consistent legal interpretation further complicates their admissibility in court. Therefore, clearer legal guidelines are necessary to balance evidentiary needs with the protection of fundamental rights.

Abstract

Bantuan hukum struktural mengasumsikan bahwa kemiskinan masyarakat lebih dikarenakan kondisi struktural yang timpang. Apabila paradigma lama bantuan hukum hanya bertumpu pada bantuan hukum melalui jalur hukum saja, tanpa didukung oleh pendekatan yang bercorak struktural, maka gerakan bantuan hukum tidak akan efektif, maka strategi bantuan melalui jalur hukum wajib didukung oleh suatu gerakan yang meruntuhkan ketimpangan tersebut. Kajian ini membahas problematika pemberian bantuan hukum bagi masyarakat dan bagaimana refleksi asas equality before the law melalui pemberian bantuan hukum struktural dan non struktural. Metode penelitian yang digunakan adalah pendekatan kualitatif, metode pengumpulan data melalui studi kepustakaan, dan teknis analisis data bersifat kualitatif. Hasil kajian menunjukkan bahwa problematik pemberian bantuan hukum struktural dan non struktural dipengaruhi oleh kerangka hukum normative pemberian bantuan hukum yang tidak bekerja, dll, sedangkan refleksi asas equality before the law berkaitan dengan pemberian bantuan hukum struktural dan non struktural ini sudah dimuat dalam pasal 28D ayat (1) Undang-Undang Dasar 1945, yaitu bahwa setiap orang berhak atas pengakuan, jaminan, perlindungan, dan kepastian hukum yang adil serta perlakuan yang sama di hadapan hukum. Asas ini sebagai prinsip yang sangat vital dalam pemberian bantuan hukum struktural dan non struktural, hal Ini juga merupakan konsekuensi Negara Indonesia sebagai negara hukum (pasal 1 ayat (3) UUD 1945 hasil perubahan ketiga). Ada tiga prinsip negara hukum (rechstaat), yaitu supremasi hukum (supremacy of law), kesetaraan di hadapan hukum (equality before the law), dan penegakan hukum dengan cara-cara yang tidak bertentangan dengan hukum (due process of law).

Abstract

The rapid advancement of Artificial Intelligence (AI) has given rise to new forms of cybercrime, one of which is deepfake technology. Deepfakes involve the manipulation of videos, audio, or images to create fabricated content that may harm the dignity, reputation, and privacy of individuals. This study addresses two research questions: (1) What is the legal responsibility of perpetrators who misuse deepfake technology in ways that violate an individual's right to privacy under the Indonesian legal system? and (2) How are the human rights of victims of deepfake misuse that infringes upon the right to privacy protected? The objectives of this study are, first, to examine the enforcement of laws against perpetrators of deepfake pornography in Indonesia and, second, to analyze the legal protection available to victims of deepfake misuse from a human rights perspective. This research employs a normative legal research method based on library research, utilizing statutory regulations, books, scholarly journals, and other relevant legal sources. The findings indicate that individuals who create and disseminate deepfake content that violates another person's right to privacy must be held legally accountable for their actions. Furthermore, victims of deepfake misuse are entitled to legal protection grounded in the principles of human rights.
