Abstract

The concept of plea bargaining in Indonesia's criminal justice system still lacks a clear and definitive standard. This study aims to examine the current application of plea bargaining in the Indonesian justice system and to explore an ideal framework for its implementation in the future. The research adopts a normative juridical approach. The findings reveal that plea bargaining remains a relatively new concept in Indonesian criminal law. The existing Criminal Procedure Code does not provide regulations for plea bargaining as an alternative method for resolving criminal cases outside of court. However, the Draft Criminal Procedure Code has introduced the concept under the term "special path" in Article 199, which allows for plea bargaining between judges, public prosecutors, and legal counsel. Plea bargaining has the potential to serve as a solution to challenges in sentencing and correctional systems, ensuring the principles of swift, simple, and cost-effective justice while safeguarding the rights of the accused and enhancing their role in legal proceedings.

Abstract

Big Data is the new oil. The real issue of the development of information technology is the existence of Big Data. Big Data is very important, talking about Big Data not only touches the issue of how big data you have, but what can be done with the data. The high cost of Big Data access is inversely proportional to the collection of data through surveys or censuses for free. analysis of the application of efficiency theory in an economic approach in imposing access costs to statistical activities, knowing the impact of imposing Big Data access fee tariffs, knowing the potential of Big Data as a supporter of official statistics in the future, what are the obstacles and solutions in implementing it. The preparation of this paper is juridical-empirical research with the nature of descriptive research with an economic law approach. Big Data is managed for different purposes using different systems and methods and not necessarily using statistical rules. The implementation of Big Data as a new data source is carried out through a combination of data sources. The imposition of Big Data access fees as a source of data supporting official statistics causes low utilization of Big Data as a new data source. The information technology revolution makes Big Data has the potential to complement, replace, improve, add, and improve the composition of existing statistical data sources, and produce more timely outputs. Difficult access and high costs for data collection are major obstacles. Therefore, it needs to be supported by legal instruments that facilitate its implementation in Indonesia. One is the reformulation of existing regulations that make it easier for basic statistical organizations to obtain such data sources for free and use only in the national interest

Abstract

Digital transformation in the public service sector requires readiness and capacity building of State Civil Apparatus (ASN) in managing technology-based services effectively. This study aims to develop a relevant and applicable ASN competency development model to support the implementation of the ePonti application at the Pontianak City Regional Revenue Agency (Bapenda). This application is a digital innovation designed to facilitate online regional tax services. This study uses a qualitative descriptive approach with data collection techniques through in-depth interviews, direct observation, and documentation. Informants consisted of Bapenda employees and community service users. The results of the study showed a gap in employee competency in three main dimensions: technical competency, digital communication skills, and training effectiveness. Around 70% of employees have mastered basic features such as tax data input and validation, but only 30% understand advanced features such as analytical dashboards and automatic reporting. As many as 50% of employees have not been able to deliver technical education effectively to the public. The training provided is still general in nature, not based on job needs analysis, and has not reached all employees evenly. This study presents a competency development model based on technical integration, digital public communication, and adaptive training. This model also recommends a peer-assisted learning approach to enhance collaboration between employees and support the ongoing digital transformation of public services.

Abstract

The pretrial system in Indonesia and in America clearly has differences based on the state legal system in each of these countries. In Indonesia, the implementation of pretrial is clearly regulated in the Criminal Procedure Code, while in America, which has a decentralized legal system, where the stages are regulated by federal and state laws which may differ in all jurisdictions in America. To find out comprehensively the comparison in the pretrial system that exists in Indonesia and America, so the research method used in this study is normative legal research with a comparative approach. From the research results, it was found that the outline of the comparison of the pretrial system between the two countries, such as the process of arrest and detention, as well as the concepts of bail and pretrial release, showed variations between the two countries. Indonesia uses the temporary release option, while the United States generally uses bail and conditional release mechanisms. Motions and pretrial hearings in Indonesia involve pretrial procedures, which focus on examining the legality of enforcement actions, while the United States allows pretrial motions and hearings on a variety of issues. Finally, the right to legal counsel is recognized in both countries, although provisions regarding public defenders may differ.

Abstract

Usaha mikro kecil dan menengah (UMKM) memiliki peran penting bagi suatu negara. Keberadaan UMKM akan memberiakan sumbangsi terhadap peningkatan pertumbuhan dan perkembangan ekonomi suatu negara. UMKM muncul dari orang-orang yang memiliki inisitif dan keberanian dalam mendirikan usaha atau bisnis. Jumlah UMKM di Indonesia terus mengalami peningkatan termasuk di provinsi gorontalao khususnya di desa Bilungo. Banyak potensi yang ada di desa Bilungo yang bisa dimanfaatkan untuk diolah menjadi kegiatan bisnis atau usaha. Untuk menciptakan peluang usaha baru maka diperlukan orang-orang kreatif dan inovatif dalam mengembangkan bisnisnya.Pengabdian ini bertujuan untuk memberiakan motivasi dan juga strategi yang komprehensif kepada masyarakat agar tertatik untuk mengembangkan potensi bisnis yang dimiliki agar dapat menciptakan dan mengembangkan kegiatan usaha atau bisnis baru.

Abstract

Pelaksanaan program wajib lapor di institusi penerima wajib lapor (IPWL) sendiri dilakukan sebagai upaya memberantas penyalahgunaan narkotika posisi yang strategis berada ditengah masyarakat menjadikan IPWL sebagai penjangkau dalam upaya mengentaskan masyarakat dari bahaya narkotika  Hambatan/kendala menurut Kamus Besar Bahasa Indonesia adalah halangan; rintangan, dalam hal ini halangan yang menghambat pelaksanaan rehabilitasi bagi pengguna narkotika. Hambatan pada umumnya dibedakan menjadi 2 (dua) yaitu hambatan internal dan hambatan eksternal. Hambatan internal mengacu pada kendala apa saja yang berasal dari lingkungan institusi tersebut seperti BNNK Serdang Bedagai, sedangkan hambatan eksternal mengacu pada kendala yang berasal dari luar institusi tersebut atau faktor sosial dimasyarakat biasanya terkait dengan kesadaran pecandu narkotika atau korban penyalahguna narkotika untuk melaporkan dirinya ke BNNK Serdang Bedagai atau Intitusi Penerima Wajib Lapor (IPWL). Hambatan internal dalam melaksanakan rehabilitasi, adalah kurangya sumber daya manusia dari Institusi Penerima Wajib Lapor (IPWL) di karenakan yang berhak menambah sumber daya manusia adalah institusi tersebut walaupun sudah diberikan berbagai pelatihan oleh BNNK Serdang Bedagai sedangkan Hambatan eksternal dalam pelaksanaan rehabilitasi adalah masih ada sebagian dari masyarakat kita masih berpedoman pada acuan yang lama yaitu pengguna narkotika di masukan kedalam Lembaga Permasyarakat tidak direhabilitasi, yang juga masih belum mengetahui adanya gerakan rehabilitasi bagi 100.000 pengguna narkotika yang jika melaporkan tidak akan dikenakan proses hukum dan juga tidak terlepas juga faktor korban itu sendiri untuk segera pulih dari dalam dirinya dan juga ingin segera terbebas dari segala macam obat-obatan yang dikonsumsinya.

Abstract

ABSTRAKPenelitian Ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi Anak Didik Pemasyaratan yang mengalami kekerasan di Lingkungan Lembaga Pembinaan Khusus Anak Kelas II di Kabupaten Maros dan untuk menganalisis faktor penghambat pemberian perlindungan hukum bagi anak didik pemasyarakatan di Lembaga Pembinaan Khusus Anak kelas II Kabupaten Maros. Penelitian ini merupakan penelitian yuridis empiris yang menggunakan metode penelitian wawancara dan kepustakaan sebagai teknik pengumpulan data yang kemudian dianalisis secara kualitatif dan disajikan secara deskriptif.  Adapun kesimpulan dari penelitian ini, yaitu (1) Bentuk perlindungan hukum bagi anak didik pemasyarakatan korban kekerasan yang diterapkan di Lingkungan Lembaga Pembinaan Khusus Anak Kelas II Maros adalah mengasingkan pelaku kekerasan terhadap anak ke dalam sel pengasingan (tutup sunyi) karena melakukan kekerasan terhadap anak didik pemasyarakatan merupakan pelanggaran disiplin berat (2) Faktor yang menghambat pemberian perlindungan hukum bagi anak didik pemasyarakatan adalah faktor sarana dan fasilitas umum di lingkungan lembaga pembinaan khusus anak yang digunakan masih secara bersama-sama oleh anak didik pemasyarakatan dan warga binaan yang lain (dewasa) dan faktor biaya yang menyebabkan hingga saat ini belum dapat dilaksanakan pemisahan lembaga pembinaan khusus anak dan dewasa.

Abstract

Program pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pemahaman dan penerapan manajemen kinerja yang efektif di kalangan UMKM di foodcourt pasar segar. Kota Makassar. Melalui serangkaian seminar, workshop, dan pendampingan intensif, para pelaku UMKM dibekali dengan pengetahuan tentang konsep dasar manajemen kinerja dan pentingnya Key Performance Indicators (KPI). Hasil pre-test dan post-test menunjukkan peningkatan pemahaman yang signifikan, dari rata-rata 40% sebelum pelatihan menjadi 85% setelah pelatihan. Selain itu, program ini berhasil meningkatkan kinerja bisnis UMKM, dengan 65% pelaku melaporkan peningkatan pemahaman sebesar 10-20%. Penggunaan teknologi dalam manajemen kinerja juga mengalami peningkatan signifikan, dari 20% sebelum program menjadi 75% setelah program. Teknologi yang diadopsi membantu UMKM dalam pemantauan dan evaluasi kinerja secara real-time, yang pada gilirannya meningkatkan efisiensi operasional dan kualitas layanan. Keberhasilan program ini menunjukkan pentingnya dukungan dan kolaborasi antara pemerintah, akademisi, dan pelaku UMKM untuk menciptakan lingkungan bisnis yang lebih produktif dan kompetitif. Dengan dukungan yang berkelanjutan, UMKM di Kota Makassar dapat terus berkembang dan berkontribusi pada pertumbuhan ekonomi lokal yang berkelanjutan.

Abstract

The purpose of this study was to determine the effectiveness of E-Planning in the preparation of the North Sulawesi Provincial RKPD in 2023 at the Regional Planning and Development Agency (BAPPEDA) of North Sulawesi Province, The method used is a qualitative research method, The research location is at the Regional Development Planning Agency (BAPPEDA) Office of North Sulawesi Province. The effectiveness of achieving the goals has been effective where the implementation of e-planning has been very helpful in providing convenience to Bappeda and regional apparatus in preparing the RKPD. For effectiveness, timeliness is not yet effective. Judging from the preparation of the RKPD which took 6 months it could not be completed on time in accordance with the provisions of the applicable regulations. For the effectiveness of human resources is already effective. Judging from the e-planning team that has been able to carry out e-planning well, both in the process of inputting, preparing plans and providing guidance to regional apparatus. For the effectiveness of facilities and infrastructure is already effective. Judging from the availability of supporting facilities and infrastructure such as computers, laptops, printers, wifi, ATK and special e-planning rooms.

Abstract

This research aims to examine the implementation of the Regional Government Information System (SIPD) and its urgency as an effort to eradicate criminal acts of corruption in the government in Makassar City. This research uses a qualitative descriptive method that examines the implementation of the Regional Development Information System through library research. Data was collected from documentation in the form of journals, research reports and government documents related to the implementation of the Regional Development Information System. The research results show that there are many things that still need to be improved in perfecting SIPD as a general application at the regional level, such as: 1) harmonization of regulations and policies, 2) synchronization of data and information content between levels of Regional Government (Regency/City/Province) and between Regional Governments with the Central Government; 3) business processes of planning, budgeting, implementation, monitoring, reporting and evaluation in regional government. regions, future improvements to SIPD must of course be in line with the National SPBE Architecture, so that the dream of implementing an Electronic-Based Government System as part of efforts to prevent corruption can be realized. Commitment to every element of the country is needed to improve the understanding that has been formed so far.
