Abstract

The growth of Over The Top (OTT) services has made it more difficult to protect press companies' economic rights over their news content. OTT News Aggregators often distribute news without proper permission or fair compensation, leading to financial harm for news publishers. This situation raises legal concerns about the protection mechanisms and liability of OTT News Aggregators in Indonesia. This study uses a normative juridical approach, analyzing laws, legal doctrines, and scholarly opinions related to violations of economic rights by OTT platforms. According to this study, online news content is safeguarded by the Press Law, the Copyright Law, and the Electronic Information and Transactions Law (ITE Law). Presidential Regulation No. 32 of 2024 on Publisher Rights, specifically Articles 5(f) and 7, which mandate that digital platforms collaborate with press institutions, strengthens these safeguards. However, only the non-binding Circular Letter of the Minister of Communication and Informatics No. 3 of 2016 addresses the legal obligation of OTT News Aggregators, so leaving it weak. Therefore, there is a need to update the ITE Law, PP PSTE, and Ministerial Regulation No. 5 of 2020, and to introduce strict liability to ensure better accountability and protection of economic rights.

Abstract

One of the crucial problems in the scope of intellectual property today is the phenomenon of overlap between copyright and industrial design rights. One of the important things to study is the existence of legal regulations that have been harmonized and effective to overcome these problems. In this research, the method used is a statutory and comparative approach with analytical descriptive specifications. This study found that the overlap of copyright and industrial design rights law has not been regulated and harmonized properly in Indonesian positive law. The results of this study indicate that by not harmonizing the protection of copyright with industrial design rights in Indonesia, Indonesia does not have legal certainty and has a legal gap in the enforcement of rights and settlement of disputes when compared to Australia. Therefore, harmonization between copyright and industrial design rights law is needed, including the necessary reforms to provide legal certainty for creators and industry players in the future.

Abstract

In copyright, there are two exclusive rights, namely economic and moral rights, and these two rights are not owned by the creator or copyright holder because there is a principle called the Fair Use Principle. Video copyright is one of the objects of copyright protection in digital media whose existence is in great demand by various circles of society because it is easy to access gadgets and internet networks. One of the platforms that are often used to upload, watch, and share videos is Youtube. The specification of this research is Legal Research using a normative juridical approach and data collection techniques utilizing a literature study, then analyzed in a qualitative normative manner. The results of this study are on the Youtube Platform. Several channels re-upload video copyrighted works that do not belong to them without permission, even if those channels do not include the source, and monetization is carried out so that it is for commercial purposes. It is not following Fair Use principles and the Youtube platform as an organizer. The electronic system, of course, also has responsibility for violations that occur on its Platform, which in this case is the occurrence of copyright infringement

Abstract

Tak dapat disangkal, pesatnya perubahan dunia pada era globalisasi berpangkal dari teknologi informasi yang kian berkembang. Berbaurnya teknologi dengan telekomunikasi menimbulkan revolusi pada sistem informasi. Dahulu, untuk mengakses atau mengolah data dan informasi, manusia membutuhkan proses yang panjang. Kini, dunia seolah diberikan kemudahan dalam mengakses dan terhubung dengan beragam informasi dan data yang tersaji. Lain halnya dengan Rahasia Dagang sebagai bagian dari kekayaan intelektual yang bernilai ekonomi tinggi dalam kegiatan usaha di Indonesia. Nilai ekonomi dari Rahasia Dagang melekat karena adanya informasi yang sengaja untuk tidak diketahui oleh umum. Hal tersebut menjadikan elemen ini termasuk salah satu bagian yang cukup menarik atensi. Mengingat pada era ini, industri jasa telekomunikasi seolah menopang tanggung jawab besar untuk melindungi setiap data yang masuk ke dalam dunia digital. Terdapatnya resiko berupa kebocoran data yang bersifat rahasia menjadi problematika terhadap pelindungan data dalam industri jasa telekomunikasi. Dengan ini, digunakan metode penelitian yuridis normatif melalui pengumpulan data yang dilakukan secara daring. Penelitian ini menghasilkan sebuah rujukan perihal pengaturan yang tepat sesuai kebutuhan Indonesia dalam merespon pelindungan data sebagai rahasia dagang pada jasa telekomunikasi yang belum terakomodir dengan baik saat ini. Melalui optimalisasi keberadaan umbrella regulation dan penyusunan kebijakan khusus dalam sektor telekomunikasi berupa co-regulation atau self-regulation.

Abstract

Terbitnya PP Nomor 24 Tahun 2022 membuka ruang akan adanya skema pembiayaan berbasis Kekayaan Intelektual. Namun, terbitnya PP tersebut masih menimbulkan kesenjangan antara hukum yang dicita-citakan dengan keadaan hukum dalam kenyataannya, yang lazim disebut dengan kesenjangan antara das sollen dan das sein. Peraturan Pemerintah Nomor 24 tahun 2022 yang membuka ruang fasilitasi pembiayaan berbasis Kekayaan Intelektual pada kenyataannya belum dapat sampai pada titik yang ideal, karena terdapat hal-hal yang bersifat yuridis dan teknis belum mendapat pengaturan yang komprehensif, termasuk kesiapan lembaga/institusi yang mengelilingi pembiayaan berbasis Kekayaan Intelektual. Dari hasil penelitian diperoleh bahwa pelaksanaan jaminan Kekayaan Intelektual atas penjaminan Hak Cipta pasca berlakunya PP Nomor 24 Tahun 2022 mengenai nilai penjaminan belum dapat diimplementasikan karena lembaga Penilai KI belum berdiri dan kepastian hukum atas penjaminan Hak Cipta menimbulkan ketidakpastian hukum karena tidak adanya ketentuan tentang tata cara eksekusi Hak Cipta yang menjadi agunan, PP Nomor 24 tahun 2022 belum selaras dengan Undang-Undang Hak Cipta dan belum adanya Peraturan OJK yang mengakomodir Hak Cipta atau KI secara umum sebagai agunan pada sektor jasa keuangan. Penelitian ini merekomendasikan kepada Pemerintah untuk menginisiasi pendirian dan penerbitan regulasi lembaga Penilai KI, membentuk hukum positif pada level undang-undang ataupun berupa revisi terhadap Undang-Undang Hak Cipta yang berlaku saat ini dengan yang di dalamnya memuat ketentuan khusus mengenai penjaminan Hak Cipta terutama perihal teknis tata cara eksekusi Hak Ekonomi pada Hak Cipta dan menerbitkan Peraturan OJK yang menambahkan Hak Cipta atau KI secara umum sebagai aset yang dapat menjadi agunan pada sektor jasa keuangan.

Abstract

The development of social commerce in Indonesia faces legal challenges due to the transaction ban stipulated in Permendag 31/2023. This regulation prohibits social commerce platforms from facilitating direct transactions within their systems, leading to the closure of TikTok Shop in October 2023. However, TikTok Shop resumed operations after acquiring Tokopedia, sparking debates over regulatory compliance and legal certainty for business actors. This study employs a normative juridical method to analyze the legal protection for social commerce providers regarding the transaction ban. The findings indicate that this policy impacts micro, small, and medium enterprises (MSMEs) and creates legal uncertainty. Moreover, the ban contradicts the partnership principle in trade law and Mochtar Kusumaatmadja's legal development theory, which emphasizes that law should drive economic growth. This study recommends regulatory adjustments to align with technological advancements while ensuring protection for business actors and consumers in the digital ecosystem

Abstract

Kemajuan teknologi yang terjadi menghasilkan banyak penemuan baru, salah satunya emoji dalam komunikasi. Masyarakat mulai beralih dari komunikasi secara konvensional menuju komunikasi melalui sistem elektronik. Walaupun esensi dari komunikasi tidak berubah signifikan, nyatanya terjadi konflik terkait penggunaan emoji itu sendiri, dalam hal ini terkait emoji thumbs up. Oleh karena itu, diperlukan suatu penelitian komprehensif mengenai relevansi kedudukan emoji thumbs up di Indonesia. Penelitian ini menerapkan metode yuridis normatif yaitu meneliti sumber kepustakaan atau bahan sekunder. Penelitian ini membahas mengenai kedudukan emoji thumbs up itu sendiri serta sejauh mana praktik di Indonesia dapat mengakomodir penggunaan emoji thumbs up di Indonesia. Hasil penelitian menunjukkan bahwa Indonesia belum mengatur mengenai kedudukan emoji thumbs up. Namun, berdasarkan regulasi lainnya yang berkaitan dengan sistem elektronik, kedudukan emoji thumbs up sendiri belum dapat disamakan dengan bentuk-bentuk persetujuan elektronik lainnya.

Abstract

One of intellectual property that has legal protection in Indonesia is industrial design. In Indonesia, industrial design is closely related to the handicraft industry. In Indonesia there is already a registration of industrial designs that use handicraft designs such as traditional batik motif designs which are protected by copyright as an expression of traditional culture. This phenomenon is an overlapping and intersecting issue between the fields of copyright and industrial design. For this reason, legal studies are urgently needed to determine whether a traditional cultural expression can have industrial design novelty or not. This article uses a normative juridical approach, in the form of an analysis of legal principles of Indonesia’s law which is related to research problems. Based on the research results, traditional batik motifs fulfill the elements of an industrial design that can be registered and protected by the industrial design legal framework in Indonesia. The principle of novelty of industrial design can be implemented to filter the novelty of industrial design in selecting registration of traditional batik motifs as industrial designs. The legal protection of traditional batik motifs based on the Industrial Design Law has not been regulated comprehensively and clearly, the legal protection is only regulated as a disclosure of pre-existing industrial designs. A theoretical approach is needed in applying the articles regarding provisions for checking the novelty and registration of industrial designs related to communal intellectual property using the legal principles and theories that underlie the formation of the Industrial Design Law in Indonesia.
