Abstract

Crimes against children are increasingly occurring, especially sexual violence that does not only recognize place and time, but also does not recognize who will be the perpetrator and victim. For example, the child perpetrator in Decision Number 27/Pid.Sus-Anak/2023/PN Smr and Decision Number 12/Pid.Sus-Anak/2024/PN Smr. The difference in punishment (criminal disparity) seen in both decisions can create a bad stigma in the eyes of the victim and the community, especially since both perpetrators committed crimes with a similar level of seriousness. This study aims to analyze the disparity that occurs between the two verdicts and analyze the judge's consideration in sentencing child offenders. This research uses a normative juridical method with qualitative analysis, and relates the theory of justice and juvenile punishment. The results of this study indicate that the disparity in punishment given is due to differences in the legal basis used so that the final punishment given in the two decisions is also different. This can be influenced by the different views of judges who, in making their decisions, are not only derived from juridical considerations but also non-juridical considerations.

Abstract

This research discusses the legal protection for children involved in drug abuse as transaction intermediaries. The main focus of this research is the application of rehabilitation in the juvenile criminal justice system, emphasizing the importance of recovery rather than punishment. This research utilizes the normative literature method and approaches legislation, cases, and conceptual. The decision was analyzed to determine the form of legal protection that can be given to children with drug abuse cases. The findings indicate that Law No. 11/2012 on the Juvenile Criminal Justice System emphasizes that children must receive protection from the investigation stage until the legal process takes place. However, in practice, judges still often impose prison sentences without considering aspects of social and medical rehabilitation. This research recommends that the justice system prioritize rehabilitation to ensure optimal recovery and social reintegration of children, which is in line with child protection theory and restorative justice theory. Abstract

Penelitian ini menganalisis pertimbangan hukum hakim dalam Putusan Pengadilan Tinggi Bandung Nomor 86/Pid.Sus/2022/PT Bdg yang menjatuhkan hukuman mati terhadap pelaku kekerasan seksual terhadap anak. Penelitian ini bertujuan untuk menganalisis apakah putusan tersebut mencerminkan prinsip keadilan bagi korban, pelaku, dan masyarakat serta kesesuaiannya dengan prinsip hak asasi manusia. Metode yang digunakan adalah penelitian normatif dengan analisis deskriptif kualitatif terhadap peraturan perundang-undangan dan putusan pengadilan. Data diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa pertimbangan hakim mempertimbangkan aspek pembuktian, keadilan retributif, efek jera, serta dampak sosial. Namun, penerapan hukuman mati masih menuai perdebatan terkait efektivitasnya dalam pencegahan kejahatan seksual dan perlindungan hak asasi manusia. Kesimpulannya, meskipun putusan ini memberikan kepastian hukum dan keadilan bagi korban, diperlukan pendekatan lebih komprehensif dalam pemulihan korban dan pencegahan kekerasan seksual terhadap anak.

Abstract

Kegiatan pengabdian kepada masyarakat ini merupakan implementasi Tri Dharma Perguruan Tinggi yang bertujuan untuk meningkatkan pemahaman masyarakat dan mahasiswa mengenai sistem pembuktian tindak pidana siber di Indonesia. Permasalahan utama mitra adalah rendahnya pemahaman terkait validitas alat bukti elektronik dan disharmoni antara Kitab Undang-Undang Hukum Acara Pidana (KUHAP) dengan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), yang berakibat pada lemahnya tindak lanjut hukum terhadap laporan kejahatan siber. Untuk menjawab permasalahan tersebut, kegiatan sosialisasi dilaksanakan di Kelurahan Sidodadi, Samarinda, diikuti oleh 30 orang mahasiswa dan 20 orang dari mayarakat umum dengan metode ceramah normatif-yuridis, diskusi interaktif, dan studi kasus. Hasil kegiatan menunjukkan bahwa peserta memperoleh peningkatan pemahaman tentang validitas alat bukti digital dari sisi formil dan materiil, serta pentingnya dokumentasi forensik dalam proses penyidikan. Diskusi juga menyoroti perlunya harmonisasi regulasi dan pendampingan hukum bagi korban kejahatan siber agar proses pelaporan tidak terhambat karena kekurangan alat bukti. Kesimpulannya, kegiatan ini berkontribusi dalam memperkuat kesadaran hukum, meningkatkan kapasitas masyarakat dalam menghadapi cybercrime, dan mendorong reformasi hukum acara pidana yang responsif terhadap perkembangan teknologi informasi.

Abstract

The enforcement of criminal law in Indonesia plays a vital role in realizing a state based on law, as mandated by the 1945 Constitution. However, the criminal justice system, which should operate independently and with authority, still faces various serious challenges—ranging from political power intervention, unequal access to justice, to the weak integrity of law enforcement officials. This study aims to analyze the structure and dynamics of Indonesia’s criminal justice system within the framework of national legal politics, using a socio-legal approach that combines normative analysis and empirical field data. The main focus is directed at the integration of three aspects of the legal system: substance (legislation), structure (law enforcement institutions), and legal culture (awareness and behavior of both society and legal officials).The findings reveal that synchronization among the sub-systems of the criminal justice system—namely the police, prosecution, courts, and correctional institutions—is still suboptimal. This is exacerbated by low public trust in law enforcement, the criminalization of vulnerable groups, and the dominance of a formalistic approach that neglects substantive justice. In this context, progressive legal theory becomes highly relevant as a foundation for reforming the criminal justice system toward one that is more humane, just, and people-centered. Improving the quality of human resources in law enforcement is needed through legal education that is not only oriented toward legal certainty but also instills the values of justice and social utility. Therefore, an independent and dignified criminal justice system can only be realized if all legal elements work in an integrated manner and place substantive justice as the main orientation in every law enforcement process.

Abstract

Cases of child abuse are increasingly in the public spotlight. In some cases, children can also be perpetrators of violence against other individuals. This phenomenon raises various questions related to legal responsibility, justice approaches, and appropriate treatment of children as perpetrators of criminal acts. This study aims to analyze the criminal responsibility of children as perpetrators of violence and how the Judge's considerations in sentencing in Decision Number 5 / Pid.Sus-Anak / 2022 / PN.Smr and Decision 10 / Pid.Sus-Anak / 2023 / PN.Bpp. This study uses a normative legal research method, with three data sources, namely primary, secondary, and tertiary. Data were obtained through literature study collection techniques, and a legislative approach method with qualitative descriptive analysis, and drawing conclusions using inductive and deductive methods. The results of this study indicate that both Decisions have considered the legal, social, and psychological aspects of children as perpetrators of criminal acts. However, there are several things that are not in line with the principles of child protection and the restorative justice approach mandated by the Child Criminal Justice System Law.
