Abstract

International Criminal Court merupakan sebuah peradilan internasional permanen yang dibentuk berdasarkan perjanjian internasional didalam Statuta Roma 1998. Selama dua dekade terbentuknya peradilan ini telah terjadi penarikan diri beberapa negara dari keanggotaan peradilan internasional tersebut, seperti Burundi dan Filipina. Selama proses meratifikasi Statuta Roma 1998 tersebut, kedua negara telah membentuk implementasi hukum Statuta Roma 1998 kedalam hukum nasional masing-masing negara. Adanya penarikan diri ini berdampak bagaimana status implementasi hukum tersebut di hukum nasional.  Metode pendekatan yang digunakan yaitu dengan ditinjau berdasarkan pendekatan kasus serta pendekatan perundang-undangan dengan tujuan penelitian untuk menganalisis Implementation Legislation terhadap negara-negara yang telah menarik diri dari Statuta Roma 1998.Hasil penelitian ini adalah bagaimana implementasi hukum negara setelah berlaku efektifnya penarikan diri, hal tersebut terkait apakah implementasi hukum Statuta Roma 1998 dinegara tersebut apakah disabut atau masih berlaku. Kesimpulan dari proses penganalisisan penelitian ini juga mempertimbangkan kasus yang terjadi serta bagaimana proses ratifikasi kedua negara tersebut berlangsung hingga penarikan dirinya. Analisis implementasi hukum setelah efektifnya penarikan diri ini dikaji dengan menggunakan Teori Dualisme dan Monisme, serta dengan memperhatikan asas Pacta Sunt Servanda didalam hukum perjanjian internasional.

Abstract

Street children represent a consequence of the urban divide, reflecting a disparity within urban areas. These children live in precarious conditions with limited opportunities for a respectable life. This study aims to explore the Government's involvement, particularly in terms of policy preparedness and infrastructure, aimed at improving the quality of life for street children and ensuring their fair access to justice. This research endeavor intends to analyze procedural policies and governmental initiatives directed at realizing sustainable development goals pertaining to the rights of street children. The findings of this investigation reveal that the government is actively engaged in endeavors to grant street children their rights and to actualize sustainable development objectives. Notably, various existing measures encompass the establishment of interim shelters, serving as educational facilities and platforms for the fulfillment of other rights for these children. However, there remains room for enhancement in these efforts, necessitating a broader reach to encompass regions with substantial populations of street children. This expansion is imperative to effectively achieve sustainable development goals through the comprehensive fulfillment of the rights of street children.

Abstract

The International Criminal Court is an international criminal justice institution established in the context of struggle against impunity. Eighteen years of operation of the ICC since 2002, ICC experienced a case where the state it one by one withdraw from membership, such as South Africa, Burundi, Gambia and the Philippines, which is due to the inclusion of ICC investigations related to these state as well as several reasons related to the existence of discriminatory ICC judicial operations patterns. What is the implementation of ICC legal norms by state parties, and how the impact on the existence of ICC is what will be discussed in this study. The research method used is Socio-Legal Research, which examines the relationship between juridical and political aspects. The results of this study conclude some evidence related to the implementation of ICC legal norms by withdrawing party states, such as the background to ratifying the Rome Statute 1998, the implementation of the law, and the reasons for withdrawing the country, as well as some juridical and political impacts affecting the existence of the ICC.

Abstract

AbstractThe presence of the Kijing International Port in Mempawah Regency is a maritime transportation infrastructure that has an important and strategic role for the growth of industry and trade. In fact, the construction of this international port not only has an impact on investors and activities at the port, but also on the local community who live around the port. The community is always the one affected by any development, so there is a need for protection and preventive efforts to protect their rights as well as other things such as the potential for crime to occur in the Kijing international port area. This research was studied using socio-legal research methods which analyze legal studies normatively and the implications of impacts on society empirically, so that the approach taken is based on a statutory approach, a case approach and a social approach. The results of this research analyze studies of cases that often occur in international port areas in Indonesia, such as violent crimes resulting from social conflict, criminal acts of narcotics abuse, and criminal acts of prostitution. Of the several forms of crime, not all crimes have occurred in the Kijing international port area, so it is important to prepare preventive measures for these crimes to occur. So that the construction of this port can have a positive impact on the surrounding community socially, economically and legally.  AbstrakHadirnya Pelabuhan Internasional Kijing di Kabupaten Mempawah menjadi suatu infrastruktur transportasi laut yang mempunyai peran penting dan   strategis untuk pertumbuhan industri dan perdagangan. Pembangunan pelabuhan internasional ini nyatanya tidak hanya berdampak pada investor maupun kegiatan aktivitas di pelabuhan tersebut, melainkan masyarakat setempat yang   tinggal di sekitar pelabuhan. Masyarakat selalu menjadi yang terdampak pada setiap pembangunan, sehingga perlu adanya perlindungan dan upaya preventif melindungi hak-hak mereka serta hal-hal lain seperti potensi terjadinya kejahatan yang terdapat di kawasan pelabuhan internasional kijing. Penelitian ini dikaji menggunakan metode penelitian sosio-legal yang menganalisis kajian hukum secara normatif dan implikasi dampak yang terjadi pada masyarakat secara empiris, sehingga pendekatan yang dilakukan berdasarkan pendekatan undang-undang, pendekatan kasus, serta pendekatan sosial. Hasil penelitian ini menganalisis kajian kasus-kasus yang sering terjadi di kawasan pelabuhan internasional di Indonesia, seperti tindak pidana kekerasan akibat konflik sosial, tindak pidana penyalahgunaan narkotika, serta tindak pidana kasus prostitusi. Dari beberapa bentuk kejahatan tersebut, tidak semua kejahatan pernah terjadi di kawasan pelabuhan internasional kijing, sehingga penting untuk mempersiapkan upaya preventif terjadinya kejahatan tersebut. Sehingga pembangunan pelabuhan ini dapat berdampak baik kepada masyarakat sekitar secara sosial, ekonomi, maupun hukum.

Abstract

Sustainable Development Goals are an agenda to increase inclusive economic growth in a region. As the capital of West Kalimantan Province, Pontianak City has a vital role in increasing the realization of this development by implementing policies oriented towards sustainable development, specifically in fulfilling access to decent work in Pontianak City. One of the employment sectors that is of concern is providing parking attendants with decent work access. This research examines whether the fulfillment of access to decent work for parking attendants has been fully fulfilled by looking at access to the fulfillment of human rights and compliance with the laws regulated in existing regulatory policies in the City of Pontianak. This research was carried out using socio-legal research methods, as it will examine social rules that are confirmed based on existing laws in legislation. This research shows that several indicators still need to be met to fulfill access to decent work within the standards set in the Sustainable Development Goals. One aspect of access to decent work for parking attendants that needs to be met is that social security still needs to be a priority, as well as the lack of availability of laws governing parking management in Pontianak City. So, there needs to be consideration and strengthening in fulfilling the law so that parking attendants get clear legal status and legal availability to realize decent work and economic growth according to the 8 Sustainable Development Goals.

Abstract

Cryptocurrency in Indonesia presents both advantages and challenges. The Indonesian government has not yet given legality to cryptocurrency as legal tender. However, even though it does not have specific regulations, this matter regarding crypto is described as a crypto asset in several legal regulations in Indonesia. This study aims to examine the potential for implementing cryptocurrency as legal tender in Indonesia and whether it can be regulated within the country's legal framework. It also compares Indonesia's situation with the legal systems of El Salvador and the Central African Republic, where cryptocurrency has been adopted as legal tender. This study was studied in a socio-legal research method review, which used several approaches from a legislative perspective, case studies, and a comparison of state laws.  The findings reveal that while there is no specific law in Indonesia that regulates cryptocurrency as legal tender, there are existing regulations governing crypto assets, overseen by the country's futures supervisory agency. Crypto in Indonesia does not yet meet the standard requirements as legal tender, such as tability of value, divisibility, and uniformity. Based on a comparison of laws in El Salvador and the Central African Republic that have established crypto as legal tender, several comparisons can be seen starting from the structure, substance, and legal culture, where support for regulations and institutions as well as community support can maximize the legalization of crypto in Indonesia, but this requires several special considerations related to the impact and influence that will be faced if the legality of crypto is implemented. Therefore, based on the comparison of the law, it will be seen whether Indonesia.

Abstract

Indonesia mengalami darurat femisida. Dari data komnas perempuan telah terjadi 237 kasus di tahun 2021, 307 kasus di tahun 2022, dan 159 kasus di tahun 2023 hingga april 2024. Penelitian bertujuan mengetahui mengapa perempuan dapat menjadi korban femisida dan apa saja jenis korban femisida tersebut. Menggunakan penelitian hukum empiris dengan pedekatan kasus, undang-undang dan teori. Femisida dianalisis dari kacamata viktimologi. Adapun hasil penelitian yaitu terdapat dua jenis korban femisida dalam perspektif viktimologi. Pertama, biologically weak victim. Perempuan menjadi korban femisida disebabkan bentuk fisik dan mentalnya. Perempuan secara individu sebenarnya tidak melakukan hal apapun yang memancing laki-laki untuk membunuh dirinya, akan tetapi sisi visual-sentris dan emosional pada laki-lakilah yang membuatnya melakukan pembunuhan pada perempuan. Kedua, precipitative victims. Perempuan sebagai korban berada dalam keadaan yang memudahkannya untuk menjadi korban pembunuhan oleh laki-laki, seperti berada ditempat yang sepi dan gelap. Perempuan menjadi korban femisida disebabkan dua faktor. Pertama, faktor personal. Dikarenakan jenis kelamin perempuan yang secara konstruk sosial dianggap masih belum setara dengan laki-laki. Kedua, faktor situsional. Konflik berujung ketegangan antara laki-laki dan perempuan mengundang amarah emosional dari laki-laki, pada akhirnya membuat perempuan menjadi korban femisida. Pemerintah harus mengeluarkan kebijakan bersifat preventif atau tindakan darurat dan insidentil jika diperlukan untuk merespon femisida ini

Abstract

This article examines Denpasar District Court Decision No. 80/Pdt.G/2018/PN Dps relating to nominee agreements in collaboration at Bali Restaurants involving foreigners and Indonesian citizens which focuses on problems arising from the existence of a Nominee Agreement in terms of Foreign Investment in Indonesia as well as the application of law in Investment Foreigners comply with the legal certainty of investing, therefore the aim of this article is to provide an overview and analysis of these two aspects. This article uses a normative approach by analyzing secondary data qualitatively. The result of the article is that Decision No. 80/Pdt.G/2018/PN Dps has prohibited the use of Nominee Agreements in Foreign Investment in order to maintain transparency and a fair investment climate. The ruling confirms the Nominee Agreement prohibition for the sake of legal certainty in foreign investment, and the government is committed to regulatory compliance to support sustainable economic development. Therefore, as a legal product, foreign investment is required to comply with Indonesian investment law in accordance with Denpasar District Court Decision No. 80/Pdt.G/2018/PN.DPS, and the judge emphasized the obligation of Foreign Investment to comply with investment law provisions, reflecting the application of legal certainty in investing in Indonesia

Abstract

The problem regarding the interpretation of the meaning of imprisonment and corporal punishment as stated in Article 73 paragraph (3) of UNCLOS 1982 has caused differences in judges' decisions against perpetrators of IUU Fishing in the Indonesian Exclusive Economic Zone (ZEEI). On the one hand, there are courts that explain that confinement in lieu of a fine is contrary to UNCLOS 1982, while on the other hand it is said that it does not violate UNCLOS 1982. This study was conducted to provide a legal study of whether the imposition of confinement in lieu of a fine on perpetrators of IUU Fishing in ZEEI. The results of this study, namely according to the interpretation of grammatical and the meaning of words/terms (taalkundige interpretation) and the explanation of legal experts, can be concluded that imprisonment and confinement (including confinement in lieu of a fine) are included in the scope of the prohibition of Article 73 paragraph (3) of UNCLOS 1982, because this punishment eliminates a person's freedom. Courts in Indonesia should be consistent not implementing imprisonment and corporal punishment considering that Indonesia has ratified UNCLOS 1982 and is bound by the principle of pacta sunt servanda. This paper provides proposals to amend the Fisheries Law and Judges are also encouraged to make independent legal discoveries to create substitute criminal sanctions for fines that do not conflict with UNCLOS 1982.
