Abstract

Protecting the nesting habitat of the Moluccan Scrubfowl (Eulipoa wallacei) is important to conserve the population of this endemic species in North Maluku. The success rate of semi-natural hatching nests of Moluccan Scrubfowl varies in each hatchery conservation location. This study aims to determine the nest success of semi-natural hatching program of Moluccan Scrubfowl in Mamuya Village, North Halmahera Regency. A field experiment approach was used to estimate nest success in semi-natural (in-situ) incubation treatments. Eggs used for the semi-natural hatching treatment were collected from landowner egg collecting activities at four Moluccan Scrubfowl nesting sites. In semi-natural hatching, each bird egg was placed in 60 cm of sand with a minimum distance of 10 cm between eggs (egg density adjusted to the number of eggs planted). A total of 116 Moluccan Scrubfowl eggs were planted over four planting periods and during the natural incubation period the eggs hatched producing 96 chicks. The nest success of the semi-natural hatching program for Moluccan Scrubfowl in Mamuya Village has a high success value of 0,835 (83,52%). This optimal success indicates that incubation in the chick embryo formation process is stable on the sand substrate. The mean incubation time interval for hatching eggs lasted 74 days (interval 72 - 76 days)

Abstract

Introduction: The criminal policy of natural resource corruption in the fisheries sector can be carried out using two approaches, namely the penal approach and the non-penal approach.Purposes of the Research: .Methods of the Research: This research method is normative juridical while still involving the role of other social sciences in legal social studies. The approach used in this research is a statutory approach and a conceptual approach. Data collection was carried out by literature study and then analyzed qualitatively.Results of the Research: IUU Fishing practices such as transshipment, fraudulent acts of marking down ship sizes, using unreported foreign crew members or using falsified documents, bribing bribes in permit processing and various actions that lead to corrupt practices in the fisheries sector cause the country to suffer huge losses and have a bad impact on the country. people's welfare and exploitation of natural resources that can damage the ecosystem. For this reason, there is a need for criminal policy or efforts to overcome corruption by using two approaches, namely a repressive penal approach and a preventive non-penal approach.

Abstract

Introduction: Indonesia's financial income and expenditure called Fiscal are obtained from three components, namely: Tax, Non-Tax State Revenue, and Grants. However, at the time of fiscal distribution as part of state expenditure in this case aid funds experienced problems that gave rise to criminal acts of Corruption.Purposes of the Research: :  Aims to analyze criminal law policies regarding misused funds and analyze criminal law policies in corruption crimes related to misused aid funds.Methods of the Research: This study uses normative juridical with legal materials used in the study are primary, secondary, and tertiary. The collection technique is carried out through literature studies in the form of books, scientific works, and other literature.Findings of the Research: The results of the study show that the criminal law policy implemented by the Indonesian government is regulated in Law Number 31 of 1999 jo. Law Number 20 of 2001 concerning the Eradication of Corruption. Not only in this law, when Covid-19 hit Indonesia, the Indonesian government issued Government Regulation in Lieu of Law Number 1 of 2020 concerning State Financial Policy and Financial System Stability for the handling of the Covid-19 Pandemic. However, in practice, corruption still occurs in the field, and at the time of the judge's decision does not receive a punishment commensurate according to the deed and is not fully in line with the criminal law policy in Indonesia to eradicate corruption.

Abstract

This study aims to determine the application of agroforestry patterns and their contribution to the income of farmers in the village of Samuda, North Halmahera Regency. The research method used was a purposive sampling method, with 30 respondent farmers who had coconut-based agroforestry land. Data collection and analysis are done descriptively and quantitatively. The results showed that two patterns of agroforestry application, the Agrisilvikultur Tress Along with Borders pattern and the Agrisilvikultur Random Mixture pattern, we're able to make many ecological and economic contributions. From the ecological point of view, mixed agroforestry patterns can increase resistance to plant diseases, and economically, agroforestry patterns can increase farmers' average income. Completion of coconut-based agroforestry in the form of copra increased the average annual income of IDR 35,633,333.3/year and the average income from secondary crops by IDR. 1,249,637,500/year. While the average income from non-agroforestry products is IDR 34,550,000/year. Comparison of income and expenditure shows that the average income of farmers is greater than the expenditure, so the application of agroforestry patterns has a significant influence on the level of welfare of farmers in the study area.

Abstract

Hakim tidak boleh menjatuhkan pidana tersebut kecuali apabila dengan sekurang-kurangnya dua alat bukti yang sah, sehingga hakim memperoleh keyakinan bahwa suatu tindak pidana benar-benar terjadi dan terdakwalah yang bersalah melakukannya (Pasal 183 KUHAP). Tujuan artikel ini adalah untuk mengkaji dan menganalisis pertimbangan hukum hakim dalam memutus perkara tindak pidana penganiayaan memenuhi keadilan. Metode Penulisan/Penelitian: Penelitian ini merupakan penelitian yuridis normatif. Tipe penelitian bersifat deskriptif analisis. Data dan informasi penunjang kemudian diidentifikasi selanjutnya disistematisasi untuk dilakukan penafsiran dan diberikan argumentasi untuk mendapatkan kesimpulan atas permasalahan. Pertimbangan hukum Hakim dalam memutus perkara tindak pidana penganiayaan dapat memenuhi keadilan didasarkan pada fakta-fakta di persidangan dan pertimbangan hukum Hakim secara yuridis dan non yuridis. Pertimbangan hukum hakim secara yuridis yaitu dakwaan yang telah dibacakan di depan sidang pengadilan, surat tuntutan, alat bukti (berupa keterangan saksi, surat, keterangan ahli, petunjuk, dan keterangan terdakwa), barang bukti dan pertimbangan secara non yuridis yaitu latar belakang perbuatan terdakwa, akibat perbuatan terdakwa, kondisi diri terdakwa, keadaan sosial ekonomi terdakwa.

Abstract

Introduction: The waters of Maluku are often the main target of Illegal Fishing crimes. The problem in this writing is what factors cause the development of illegal fishing crimes in Maluku waters and how to enforce the law against illegal fishing crimes that occur in Maluku waters.Purposes of the Research: The purpose of this writing is to study and analyze the factors that cause and enforce the law against illegal fishing crimes in Maluku waters.Methods of the Research: The research method used is empirical juridical, the data sources used are primary data and secondary data. Data collection techniques through observation, interviews and literature studies. Qualitative data analysis techniques.Findings of the Research: The results of the study show that the Factors Influencing the Development of Illegal Fishing Crimes in Maluku Waters are upwelling conditions around the Banda Sea and the sea; the geographical location of the Maluku Islands which has an impact on the vulnerability of control and connectivity; coral reef ecosystems, mangroves and seagrass beds that are still good in Maluku waters; lack of human resources for law enforcement officers and fishermen; lack of supporting facilities/facilities; lack of budget; lack of supervision; weak regulations; and lack of community participation. Law Enforcement against Illegal Fishing Crimes in Maluku Waters is influenced by legal factors/statutes; law enforcement officers; supporting facilities/facilities; society and culture.
