Abstract

Background: The juvenile criminal justice system has evolved to incorporate restorative justice (RJ) practices, which emphasize repairing harm and rehabilitating offenders through dialogue and reconciliation. The implementation of RJ in juvenile justice systems aims to provide an alternative to punitive measures and encourage offenders to take responsibility for their actions while addressing the needs of victims and communities. Despite its promise, the effectiveness of RJ in reducing recidivism and promoting positive outcomes for juvenile offenders remains underexplored. Objective: This study aims to evaluate the effectiveness of restorative justice practices in the juvenile criminal justice system, focusing on recidivism rates, victim satisfaction, and the rehabilitation of juvenile offenders. The research seeks to assess whether RJ methods contribute to better long-term outcomes compared to traditional punitive approaches. Method: A mixed-methods approach was employed, combining quantitative analysis of recidivism rates and qualitative interviews with juvenile offenders, victims, and justice system professionals involved in RJ programs. Results: The findings show that restorative justice significantly reduces recidivism rates and improves victim satisfaction. Juvenile offenders reported feeling more accountable for their actions, and communities experienced a greater sense of justice and restoration. Conclusion: Restorative justice practices prove to be effective in the juvenile criminal justice system, offering promising alternatives to traditional punitive methods. Policymakers should consider expanding RJ programs to further enhance rehabilitation and community healing.

Abstract

Background: Climate change is one of the most pressing global challenges, with significant consequences for ecosystems, economies, and human societies. International environmental law plays a critical role in shaping global efforts to mitigate climate change by establishing legal frameworks for cooperation and action. However, the effectiveness of international environmental law in addressing climate change remains a subject of debate, particularly concerning the implementation of mitigation strategies at the national and global levels. Objective: This study aims to analyze the role of international environmental law in climate change mitigation efforts, with a focus on the key legal instruments and agreements that shape global climate governance. The research seeks to evaluate the effectiveness of these legal frameworks in reducing greenhouse gas emissions and promoting sustainable environmental practices. Method: A qualitative research design was employed, using case studies, legal analysis, and interviews with environmental law experts, policymakers, and practitioners. The study examined major international agreements such as the Paris Agreement and the Kyoto Protocol to assess their impact on climate change mitigation efforts. Results: The findings indicate that while international environmental law has contributed to raising awareness and setting targets for climate change mitigation, the implementation of these efforts remains uneven, with many countries struggling to meet their commitments due to domestic challenges. Conclusion: The study concludes that international environmental law has been instrumental in global climate change efforts, but enhanced implementation mechanisms and greater international cooperation are necessary to achieve meaningful progress.

Abstract

This study evaluates the effectiveness of arbitration in resolving business disputes compared to formal judicial channels, and analyzes the legal force of arbitral awards. In the competitive business world, conflicts often occur, and resolution through the courts is considered less efficient because it is time-consuming, high cost, and open to the public. Arbitration as a form of Alternative Dispute Resolution (ADR) offers a fast, flexible, closed process, and a binding award. In Indonesia, this mechanism is regulated in Law No. 30 of 1999 and is implemented by institutions such as BANI and Basyarnas. A normative juridical research method was used. Challenges still exist, such as lack of understanding and execution of court-dependent decisions.

Abstract

This study investigates the legal complexities in determining the status of children born out of wedlock within the framework of Islamic family law, focusing on cases adjudicated by the Temanggung Religious Court. The research is driven by the increasing number of disputes related to birth records, the evidentiary role of DNA testing, and the legal implications for children's civil status and inheritance rights. Employing a normative legal research method, this study analyzes statutory regulations, authoritative legal literature, and selected court decisions to evaluate how legal norms are applied in actual case resolutions. The study aims to explore several critical issues: the implications of different birth records, the role of DNA testing in establishing paternity, and the legal recognition of children born out of wedlock in Islamic family law. Findings indicate that DNA testing has emerged as a pivotal tool in confirming biological paternity, thereby providing legal certainty and safeguarding children's inheritance rights. However, inconsistencies in birth record documentation often result in ambiguity and pose challenges in determining legal parentage. The jurisprudence of the Temanggung Religious Court demonstrates varied approaches, reflecting both the rigidity and adaptability of current legal interpretations in reconciling religious doctrine with scientific evidence. The study concludes that despite the availability of scientific methods, the absence of uniform legal standards contributes to inconsistencies in the protection of children's rights. Legal reform is therefore necessary to harmonize Islamic legal principles with modern evidentiary practices. Strengthening procedural clarity and integrating scientific proof within religious adjudication frameworks will promote a more equitable and rights-based approach in family law, particularly in matters of parentage and inheritance.

Abstract

Abstract: Background. This article explains the city's Regional People's Representative Council (DPRD), which has a strategic role in realizing policies based on community aspirations, as a representation of the people. Aims. The DPRD is in charge of legislation, budgeting, and supervision of local governments. This research aims to describe the extent of the city DPRD's role in absorbing, processing, and implementing the community's aspirations into public policies that have a real impact. Methods. This study used a qualitative descriptive approach, with data collection techniques involving literature studies, interviews, and observations. Result. The study's results show that the city DPRD has formal mechanisms, such as recess, hearings, and deliberative forums, to absorb the community's aspirations. However, the challenges faced include uncertainty of public participation, the dominance of political pressure, and budget and resource constraints. Conclusion. To increase the effectiveness of the DPRD's role in realizing policies based on people's aspirations, transparency, accountability, and stronger communication between the legislature and the public are necessary. Implementation. Thus, the resulting policies can be more relevant and in the public interest.

Abstract

This systematic literature review explores the convergence of digital transformation and innovative business models in achieving a sustainable competitive advantage. As organizations increasingly adopt digital technologies such as artificial intelligence (AI), cloud computing, and the Internet of Things (IoT), they are transforming their operations and enhancing customer experiences. Simultaneously, there is a growing emphasis on integrating sustainability into business strategies, with a focus on economic, environmental, and social sustainability. This review highlights the critical role of business model innovation in leveraging digital tools to create value while addressing the environmental and social impacts of business activities. The findings underscore the importance of combining digital transformation with sustainable practices to drive long-term growth, improve operational efficiency, and meet evolving regulatory and consumer expectations. Ultimately, businesses that successfully integrate these two forces are better positioned to thrive in an increasingly competitive and eco-conscious market.

Abstract

Penelitian ini bertujuan untuk mengkaji secara normatif peran serta masyarakat dalam proses legislasi nasional, dengan studi fokus pada Undang-Undang Sistem Pendidikan Nasional (UU SISDIKNAS) dan Undang-Undang Keterbukaan Informasi Publik (UU KIP). Kedua regulasi ini merupakan instrumen hukum strategis dalam menjamin akses masyarakat terhadap layanan pendidikan dan informasi yang terbuka dan akuntabel. Penelitian ini dilatarbelakangi oleh masih terbatasnya efektivitas implementasi kedua undang-undang tersebut dalam menjangkau seluruh lapisan masyarakat secara adil, khususnya kelompok yang rentan terhadap eksklusi sosial dan geografis. Pendekatan yang digunakan adalah kualitatif deskriptif dengan metode studi dokumen, yang mencakup analisis terhadap substansi hukum, proses legislasi, serta pelaksanaan kebijakan di tingkat pusat dan daerah. Hasil penelitian menunjukkan bahwa secara normatif, UU SISDIKNAS dan UU KIP telah memuat prinsip-prinsip partisipasi publik dan akses yang inklusif. Namun, dalam praktiknya terdapat kesenjangan antara ketentuan hukum dan implementasi faktual di lapangan. Kendala utama yang diidentifikasi meliputi minimnya ruang partisipasi publik yang bermakna dalam proses pembentukan undang-undang, dominasi elit dalam agenda legislasi, lemahnya pengawasan pelaksanaan kebijakan, serta hambatan birokrasi dan koordinasi antar lembaga. Selain itu, inkonsistensi kebijakan antara tingkat pusat dan daerah turut memperlemah efektivitas regulasi tersebut. Penelitian ini menegaskan bahwa reformasi sistem legislasi harus diarahkan pada penguatan mekanisme partisipasi publik yang substansial, peningkatan kapasitas institusi pengawas, serta penyelarasan kebijakan lintas sektor dan tingkat pemerintahan. Dengan tata kelola legislasi yang lebih inklusif dan akuntabel, regulasi di bidang pendidikan dan informasi dapat berfungsi secara optimal dalam mendorong pemerataan akses dan kualitas layanan publik yang berkeadilan.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) play a vital role in economic growth, particularly in developing countries, contributing significantly to GDP and employment. In a competitive market, marketing strategies such as promotion, brand image, competitive pricing, and product innovation are crucial factors influencing consumer purchasing decisions. Signal Coffee Depok can enhance its market competitiveness by leveraging digital marketing, word-of-mouth, and attractive promotional strategies to boost consumer purchase interest. This study employs a quantitative research method with an associative approach to examine the causal relationships between promotion, purchase interest, and purchasing decisions using path analysis with SmartPLS. Data were collected through validated and reliable questionnaires, and the Sobel test was conducted to assess the mediating effect of purchase interest. The results indicate strong correlations between promotion (X) and purchase interest (Y) (r = 0.777), as well as between promotion (X) and purchasing decisions (Z) (r = 0.745), while the relationship between purchase interest (Y) and purchasing decisions (Z) is very strong (r = 0.825). Path analysis reveals that promotion directly influences purchase interest (77.7%) and purchasing decisions (26.3%), while purchase interest affects purchasing decisions by 62.1%. The indirect effect of promotion on purchasing decisions through purchase interest is 16.3%, bringing the total effect to 42.6%. The T-test and F-test confirm the significance of the relationships between variables, but the mediating effect of purchase interest in the relationship between promotion and purchasing decisions is not statistically significant. Abstract

Aims. This study analyzes the construction of marketplace liability in protecting consumers of halal products in Indonesia's digital economy. Methods. The research employs a normative legal method with statutory, conceptual, comparative, and case approaches. Data were obtained from primary legal materials such as laws, government regulations, and ministerial regulations, as well as secondary sources, including academic journals and reports from halal certification authorities. Result. The findings reveal that marketplaces cannot be considered neutral intermediaries, but rather business actors under the Consumer Protection Law, with obligations to ensure the accuracy and truthfulness of halal claims. The absence of explicit technical regulations on halal verification in electronic commerce has created a legal vacuum that weakens consumer protection. Comparative analysis of Malaysia, the United Arab Emirates, and the European Union shows that due diligence obligations for platforms have proven effective in minimizing false halal claims. Conclusion. This study concludes that Indonesia requires conditional safe harbor mechanisms, layered accountability, and mandatory integration with BPJPH's halal database to strengthen legal certainty and consumer trust in the halal digital ecosystem.

Abstract

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency has created a national priority program called the Accelerated Complete Systematic Land Registration (PTSL) as regulated in Ministerial Regulation ATR/BPN No. 6 of 2018. The PTSL program will be implemented throughout the Republic of Indonesia with the aim of accelerating the provision of legal certainty to all land rights holders, thereby helping to prevent land disputes in the community. The research contribution is the identification and analysis of the reasons why some members of the Mundu Pesisir Village community reject the PTFL-PM program. The study found that the response of the community to the program was very positive. However, there are internal family barriers to its implementation. Strategies of the Cirebon Regency Land Office and the Land Data Collector at the Land Office to Ensure the Proper Implementation of the Program are discussed.
