Abstract

State financial losses are those caused by unlawful acts or acts that abuse the authority, opportunity or means available to someone due to their position or position and this is done in conjunction with acts of enriching oneself or another person or a corporation. Conflict of authority related to the assessment of state financial losses in handling corruption cases, answered by the issuance of the Constitutional Court Decision Number 31 / PUU-X / 2012 dated October 23, 2012. Polemics related to the authority to calculate state losses in handling corruption cases are answered with the issuance of Decision of the Constitutional Court (MK) Number 31 / PUU-X / 2012 dated October 23, 2012. For this reason the authors are interested in examining how the role of BPKP in auditing state finances after the MK decision. This study uses normative juridical writing methods. After the writer conducted the research, the writer concluded that: 1) BPKP's position after the Constitutional Court's decision, acknowledged the authority of BPKP in conducting an investigative audit; 2) The impact of BPKP's audit results as a basis for calculating the losses of state finances can be seen from the BPKP's repressive strategy. The repressive strategy carried out by BPKP had an impact in terms of conducting investigative audits carried out on the handling of cases that were strategic, significant, material and received public scrutiny. In repressive efforts, the role of BPKP is not limited to conducting audits; 3) To optimize BPKP audit results as a basis for calculating state financial losses in preventing money laundering, BPKP in accordance with Government Regulation No. 60/2008 concerning Government Internal Control Systems and Presidential Regulation No. 192/2014 can conduct internal supervision through audits including audits investigative.

Abstract

A hallmark of constitutional democracy is the idea that a democratic government is a government that has limited powers and is not justified in acting arbitrarily against its citizens. State power is divided in such a way that opportunities for abuse are reduced. By way of handing it over to several people or bodies and not centralizing the power of government in one hand or one body. Juridical formulation of these principles is famous for Rechstaat (rule of law) and Rule of Law. In the view of democratic groups that base themselves on communist ideology, they always act ambivalent towards the state. The state is seen as a coercive tool that will eventually disappear by itself, after the emergence of communist society. Karl Marx and Engels, the State is nothing but a machine used by one class to act against another class and the state is only a transitional institution used in the struggle to oppress opponents with violence. The state will eventually disappear when communism is reached because no one is oppressed.

Abstract

The construction of border regions and disadvantaged areas is one of President Jokowi's and Vice President Jusuf Kalla's Nawacita program. Each region does not have to be exactly the same in carrying out development, differences in development need to be done in order to accommodate the characteristics and capabilities of each region. The term is asymmetric decentralization. This research itself is to support the Draft Law on the Acceleration of the Development of Disadvantaged Regions which is being drafted by the DPD RI. Although the government has issued various policies to catch up, but to realize the acceleration of underdeveloped regional development a strategic legal umbrella is needed. The formulation of the problems raised in this study are: 1) how to realize the acceleration of border area development and lag behind through meeting basic needs such as education, health, food, infrastructure? 2) how to synergize the implementation of these programs to reduce inequality between regions? This research will use normative juridical research and supported by empirical juridical research so that it will be able to see the realization of the acceleration of border area development and lagging through meeting basic needs such as education, health, food, and infrastructure are important in building regional development equality in Indonesia. To realize this, food needs to synergize the implementation of these programs to reduce inequality between regions in Indonesia.

Abstract

Social harmony relies heavily on effective protection for children and women. In this context, transformative approaches are increasingly crucial for fostering sustainable change. This journal explores various multidisciplinary approaches in safeguarding children and women. Utilizing a broad conceptual framework, this article delves into novel strategies that promote positive shifts in understanding, protection, and empowerment of children and women. Through literature synthesis and empirical research, this journal aims to provide deep insights into how transformative approaches can be applied within the context of child and women protection. Practical implications of these findings are also discussed to contribute sustainably to policies and practices in this field.

Abstract

Pencurian adalah salah satu tindak pidana, bila dilakukan oleh orang dewasa maka hal tersebut sudah umum dan biasanya bila tertangkap akan menjalani proses hukum yang sudah umum. Namun berbeda jika tindak pidana pencurian dilakukan oleh anak dibawah umur dan tentu proses hukum yang diberlakukan juga berbeda. Kejaksaan Republik Indonesia adalah lembaga pemerintah yang menjalankan kekuasaan negara di bidang penuntutan dan kewenangan lain berdasarkan undang-undang. Metode pendekatan yang dilakukan oleh penulis yaitu menggunakan Yuridis-Empiris, yaitu dengan langsung turun kelapangan melakukan Observasi, Wawancara dan Mengkaji bahan pustaka. Sumber data pada penelitian ini adalah data yang didapat melalui responden yaitu jaksa penuntut umum berupa hasil wawancara dan bahan pustaka lainnya. Penelitian ini dilaksanakan di Kejaksaan Negeri Bukittinggi. Hasil dari penelitian ini dapat disimpulkan : pertama, Peran Jaksa di kejaksaan negeri bukittinggi dalam memberikan penegakan hukum dan penuntutan terhadap anak yang melakukan tindak pidana pencurian sudah sesuai dengan regulasi yang telah ditetapkan oleh Undang-Undang. Kedua, kendala atau hambatan yang dihadapi seperti singkatnya masa penuntutan anak, dan factor lain seperti factor internal dan factor eksternal.

Abstract

Keadilan Restorative yang diterapkan di Indonesia merupakan salah satu mekanisme penyelesaian perkara untuk mengubah formalitas pemidanaan yang awalnya fokus pada pemberian sanksi dan nestapa kepada si pelaku menjadi mediasi yang melibatkan pelaku, korban, keluarga pelaku/korban, tokoh masyarakat, dan pihak lain yang terkait dengan kasus untuk sama-sama menciptakan kesepakatan penyelesaian perkara yang adil dan seimbang bagi kedua belah pihak yang tujuannya adalah untuk memberikan kesempatan kepada kedua belah pihak untuk mengembalikan pola hubungan baik dalam masyarakat. Penelitian ini dilaksanakan di Kejaksaan Negeri Padang. Hasil penelitian diperoleh pertama, pelaksanaan Restorative Justice oleh jaksa penuntut umum dalam tindak pidana percobaan pencurian memenuhi syarat sesuai ketentuan dengan perdamaian yang disepakati tanpa syarat dari pihak korban kepada tersangka. Kedua, kendala yang dihadapi jaksa adalah sulit untuk berkomunikasi dengan pelaku, mencapai kesepakatan kedua belah pihak, menghadirkan pihak-pihak korban/pelaku, saksi korban/pelaku, tokoh masyarakat, dan lainnya. Perlu adanya substansi yang menyesuaikan pelaksanaan Restorative Justice secara baik dan lengkap, sehingga proses penyelesaian kasus-kasus hukum tertentu dapat dilakukan melalui restoratif, dengan lebih cepat, adil, sederhana dan tidak memakan waktu serta biaya yang mahal.

Abstract

Anak yang menjadi korban dari kejahatan kekerasan seksual memiliki dampak yang sangat besar, untuk itu anak yang menjadi korban kekerasan sekual wajib mendapatkan perlindungan dan  haknya sebagai korban. Salah satu hak anak yang menjadi korban tindak pidana adalah mendapatkan restitusi. Restitusi adalah pembayaran ganti kerugian yang dibebankan kepada pelaku. Penelitian ini bertujuan untuk mengetahui Pelaksanaan Permohonan Penuntut umum dalam Pemenuhan Hak Restitusi bagi Anak korban Tindak Pidana Pencabulan dan untuk Mengetahui Kendala yang dihadapi Penuntut umum dalam Pemenuhan Hak Restitusi bagi Anak korban tindak pidana Pencabulan serta Upaya penyelesaiannya.berdasarkan putusan pengadilan yang berkekuatan hukum tetap atas kerugian materill dan immaterill yang diderita oleh korban. Jenis Penelitian ini  adalah Penelitian Empiris, yang bersifat Deskriptif. Data primer diperoleh dengan cara  Wawancara bersama Penuntut umum di Kejaksaan Negeri Bukittinggi. Data sekunder berupa bahan hukum primer yang berasal dari peraturan perundang-undangan dan bahan hukum sekunder berasal dari memperoleh data atau informasi yang berhubungan dengan masalah yang akan diteliti.Hasil dari Penelitian ini yaitu : Pertama, Pelaksanaan Penuntut umum dalam pemenuhan hak restitusi korban tindak pidana pencabulan ini adalah Melakukan tuntutan dan Melaksanakan Penetapan hakim. Kedua, Kendala yang dihadapi Penuntut Umum dalam Pemenuhan hak restitusi ini adalah Kondisi ekonomi pelaku; tidak ada pengaturan mengenai sanksi apabila tidak membayar restitusi; Tidak ada upaya paksa; dan Sulit menghadirkan pihak ketiga.

Abstract

Recess is a period when DPRD members conduct activities outside the session, especially in their constituencies, to accommodate the aspirations of the community. Recess is conducted in order to carry out legislative and supervisory duties. However, if it is used for campaigning, it violates election rules that can harm democracy and tarnish the image of legislative members. Without a clear regulation, the practice of campaigning during recess can be a challenge for election supervisory institutions such as Panwaslu. This research uses an empirical legal approach method and was conducted in Agam Regency, West Sumatra Province, by collecting primary data through interviews with Panwaslu and secondary data from literature and legal documents. The analysis was conducted qualitatively to understand the impact and implications of campaign practices during the recess period on democracy and the integrity of legislative institutions.

Abstract

This study aims to examine children's rights in carrying out the reconstruction of cases of abuse carried out by investigators, the obstacles that are often faced by investigators in carrying out reconstruction, and the efforts of investigators to deal with obstacles when carrying out reconstruction, this study uses empirical juridical research, namely examining applicable legal provisions and what actually happens in society. As for the results of the first study, Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection regulates the protection of the rights of children who become suspects in criminal acts because criminal justice for children is not merely a punishment but for improvement. conditions, maintenance and protection of children and preventing repetition of acts by using constructive courts. Second, the obstacle in the process of reconstructing the crime itself is that ideally in carrying out the reconstruction of the crime it must be carried out at the scene of the incident. Because by carrying out the reconstruction of the crime at the scene of the case, it will make it easier for the suspect to carry out his actions thereby facilitating the examination. However, it is not uncommon for the reconstruction of a crime to be carried out at the scene of the actual incident. This is because there are obstacles from the community, whose emotions usually have not subsided due to cases that have happened to their families and their environment. Usually, in big cases and this worries the community, reconstruction of the crime is not carried out at the place where the case occurred. So that in cases like this the reconstruction of the crime is carried out at the scene determined by the investigator, and the third is that obstacles arising from the investigation process in overcoming obstacles that arise due to the loss of evidence can be prevented by providing information to the public. through legal counseling as well as to law enforcement agencies themselves and related agencies. In this way, it is hoped that the public will know more about the importance of evidence in the context of the case settlement process. Meanwhile, other obstacles can be overcome by increasing public legal awareness through legal counseling. This counseling does not have to be carried out in a formal setting but can be carried out informally by each member of the Police in their daily interactions in the community. So that this will bring citizens and the police closer together in a friendly and open relationship.

Abstract

Abstrak Penelitian ini membahas mengenai implementasi Peraturan Nagari Nomor 4 Tahun 2022 Tentang Gotong Royong Dan Swadaya Masyarakat Di Nagari Tanjung Haro Sikabu-Kabu Padang Panjang. Peraturan ini telah diundangkan sejak oktober tahun 2022. Diundangkan sebagai upaya mewujudkan lingkungan yang asri, bersih, dan sehat, serta meningkatkan jiwa sosial masyarakat guna mempererat hubungan silaturahmi. Penelitian ini bertujuan untuk mengkaji implementasi peraturan tersebut dan mengidentifikasi kendala serta upaya yang dapat dilakukan dalam pelaksanaannya. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif. Pengumpulan data dilakukan melalui studi kepustakaan dan penelitian lapangan dengan teknik wawancara dan studi dokumen. Hasil penelitian menunjukkan bahwa implementasi peraturan ini belum berjalan secara maksimal. Kendala utama yang dihadapi adalah kurangnya partisipasi dan kesadaran masyarakat dalam melaksanakan aturan yang telah disepakati bersama serta kurang tegasnya pihak-pihak terkait dalam menjalankan aturan yang telah disepakati. Upaya yang dapat dilakukan antara lain adalah meningkatkan sosialisasi, memberikan pembinaan, dan pendampingan kepada masyarakat serta menegakkan sanksi secara tegas bagi pelanggar aturan. Diperlukan kerjasama yang baik antara pemerintah nagari dan masyarakat agar tujuan dari peraturan nagari ini dapat tercapai secara optimal. Kata kunci: Implementasi, Peraturan Nagri, Gotong Royong, Swadaya Masyarakat Abstract This research discusses the implementation of nagari regulation number 4 of 2022 conceming mutual cooperation and community self-help in nagari tanjung haro sikabu-kabu padang panjang. This regulation has been promulgated since october 2022. It was promulgatedas anffort to create a beautful, clean andhealthy environment, as well as improve the social spirit of the community in order to strengthen friendly relations. This research with a qualitative approach. Data collection was cammed out through literature study and field researhusing interview techniques and document study. The research results show thow that the implementation of this regulation has notrun optimally. The main obstacle faced is the lack of community participation and awareness in implementing the mutually agreed rules and the lack of firmness of the relevant parties in implementing the agreed rules. Efforts that can be made include increasing socialization, providing guiddance and assistance to the community and strictiy enforcing sanctions for rule violators. Good cooperation is needed between the nagari government and the community so that the objective of this nagari regulation can be achieved optimally.
