Abstract

The government's efforts in collecting data and recording population documents have the aim of making the policy to ensure legal certainty for citizens and to make it easier for the public to fulfill their interests. Civil registration is part of the overall population administration system which consists of population registration and civil registration sub-systems. Documents issued by institutions/agencies that handle various public affairs and interests certainly cannot be separated from a series of administrative processes which will ultimately be stored/stored in an archive/data file. The issue raised in this research is how government policies regarding Population Data Collection and Recording can provide legal certainty for all Indonesian people. Based on the provisions for recording names as stipulated in Minister of Home Affairs Regulation Number 73 of 2022 concerning Recording Names in Population Documents, the name recording is carried out on the birth certificate in the event that the resident experiences an important event regarding the birth of a child, so the name recording is carried out on the child's birth certificate in the family. or residents concerned. The aim is to know and understand legal certainty regarding data collection and recording of population documents so that it will provide legal protection. To answer this problem, a normative research type research method was used, namely research using legal materials in the form of regulations, books, scientific articles related to data collection and recording of population documents. The results of this research provide confidence that the existence of data collection and recording of population documents has indeed provided legal certainty for the population of the Republic of Indonesia.

Abstract

This study conducts a normative juridical analysis of the TAPERA Programme, established by Government Regulation No. 21 of 2024, focusing on its efficacy in increasing the availability of housing for low-income communities in Indonesia. The TAPERA Programme aims to address housing affordability by encouraging savings among low-income individuals and providing financial assistance for housing needs. This research examines the legal framework, operational mechanisms, and regulatory environment of the programme, assessing its alignment with national housing policies and its potential impact. The findings indicate that while the TAPERA Programme holds significant promise due to its inclusive approach and emphasis on sustainability, challenges related to participation rates, implementation efficiency, and regulatory coherence need to be addressed. This analysis contributes to a deeper understanding of the legal and regulatory dimensions of housing policies in Indonesia, providing insights for policymakers and stakeholders involved in housing development for low-income communities.

Abstract

This study analyzes the impact of OJK Regulation Number 11/POJK.03/2016 on the implementation of sharia banking business activities and its role in ensuring the sustainability of the sharia financial industry in Indonesia. The regulation aims to strengthen governance, risk management, and transparency in sharia banking while promoting alignment with Islamic principles. Employing a qualitative juridical analysis, this research evaluates the regulation's effectiveness and identifies challenges faced by sharia banking institutions, including resource limitations, knowledge gaps, and regulatory ambiguities. The findings reveal that while the regulation has significantly improved compliance, risk management, and public trust, challenges persist in its practical implementation. Recommendations include capacity building, regulatory clarity, and technological adoption to optimize the regulation's impact. This study contributes to the understanding of regulatory frameworks in Islamic finance and offers insights for enhancing the resilience and sustainability of Indonesia's sharia financial industry.

Abstract

Masyarakat modern sering terjebak dalam ekonomi kapitalistik yang mengabaikan pelestarian lingkungan. Di Indonesia, sebagai negara berkembang dengan populasi padat, pertumbuhan penduduk menimbulkan berbagai masalah seperti meningkatnya kebutuhan ruang dan penurunan daya dukung lingkungan. Banyak lahan hijau kini berubah menjadi area komersial dan perkantoran. Permasalahan yang akan dibahas dalam penelitian ini adalah bagaimana kondisi dan pemanfaatan Taman Hutan Kota Taufan Gama Simatupang di Kisaran. Tujuan dari penelitian ini untuk mengetahui dan memahami sejauh mana taman kondisi dan pemanfaatan Taman Hutan Kota Taufan Gama Simatupang di Kisaran. Penelitian ini adalah penelitian hukum empiris ini menitikberatkan pada perilaku hukum masyarakat dalam konteks nyata, dan mengumpulkan data mengenai bagaimana masyarakat mematuhi dan berinteraksi dengan norma-norma hukum yang ada. Penataan ruang, yang diatur oleh UU Nomor 26 Tahun 2007, melibatkan perencanaan, pemanfaatan, dan pengendalian ruang untuk menjaga keseimbangan lingkungan. Di Kabupaten Asahan, Perda No. 12 Tahun 2013 mengatur Rencana Tata Ruang Wilayah (RTRW) yang mencakup RTH, namun hanya 8% dari target 30% RTH yang telah terpenuhi. RTH penting untuk menyeimbangkan ekosistem dan meningkatkan kualitas hidup. Di Kota Kisaran, RTH seperti Taman Hutan Kota Taufan Gama Simatupang menyediakan fasilitas rekreasi dan olahraga. Meski demikian, pengawasan RTH kurang efektif, terutama di wilayah terpencil. Menurut Peraturan Menteri Agraria No. 14 Tahun 2022, RTH memiliki enam fungsi utama: ekologis, resapan air, ekonomi, sosial budaya, estetika, dan penanggulangan bencana, yang dicapai melalui penanaman vegetasi, pengelolaan air hujan, dan penyediaan fasilitas olahraga dan rekreasi

Abstract

Penelitian ini mengkaji kesesuaian perubahan batas usia perkawinan dalam Undang-Undang Nomor 16 Tahun 2019 dengan konsep keadilan sosial dalam perspektif filsafat Pancasila. Metode yang digunakan adalah penelitian hukum normatif, dengan menganalisis bahan-bahan hukum seperti undang-undang, putusan pengadilan, dan pandangan para ahli. Hasil penelitian menunjukkan bahwa konsep keadilan sosial dalam filsafat Pancasila menekankan pada kesetaraan, perlindungan hak asasi manusia, dan adaptabilitas terhadap perubahan zaman. Perubahan batas usia perkawinan menjadi 19 tahun untuk laki-laki dan perempuan ditemukan sesuai dengan prinsip-prinsip keadilan sosial Pancasila, yang mencerminkan kesetaraan gender, perlindungan anak, dan responsivitas terhadap tuntutan masyarakat. Kesimpulannya, perubahan ini mewakili implementasi komprehensif dari prinsip keadilan sosial dalam filsafat Pancasila, mempromosikan kesetaraan, melindungi hak asasi manusia, serta menunjukkan fleksibilitas Pancasila dalam merespons perubahan sosial untuk membangun masyarakat Indonesia yang lebih adil dan sejahtera.

Abstract

This research delves into the multifaceted landscape of intellectual property protection within the Indonesian creative industries. Through qualitative analysis, interviews with 10 key informants elucidated the challenges faced by businesses, including rampant piracy, inadequacies in legal frameworks, and enforcement issues. Businesses responded with diverse legal strategies, encompassing copyright protection, trademark registration, industry collaboration, and technological solutions. Case studies provided tangible examples, showcasing the effectiveness and challenges of these strategies. Recommendations for legislative reforms, strengthened enforcement mechanisms, industry collaboration, and technological innovation are proposed. This research contributes valuable insights into the dynamic interplay between legal challenges and strategic responses in safeguarding intellectual property within the vibrant Indonesian creative industries.

Abstract

One of the primary difficulties in the development of the Indonesian National Capital (IKN) is the environment. According to predictions, the construction of IKN infrastructure could have an adverse effect on the environment, potentially affecting biodiversity, regional landscape quality, the amount of carbon stored in the forests, water availability, pollution, trash, noise, and drainage systems. In addition to having an influence on the environment, IKN development may also have an impact on social issues including land disputes brought on by property seeking and unauthorized land use. A conceptual and statutory approach is applied in the study method used to investigate current legal issues. The purpose of this research is to examine and assess how the government should manage and safeguard the environment in light of the move of the country's capital. The findings of this study suggest that shifting the country's capital will have an impact on the region around Kutai Kartanegara Regency. The management and conservation of the environment in the territory designated as the new nation's capital falls under the purview of the government, particularly regional governments. If someone violates or does not abide by the sustainability and welfare of the region, legal action can be taken, including administrative measures like filing objections, preventive and repressive protection, as well as providing sanctions in the form of fines and imprisonment.

Abstract

The Steering Element in the Regional Disaster Management Agency (BPBD) is an important organ that must exist, where one of its tasks is to provide input in the form of suggestions to the BPBD Leadership as a derivative of the National Disaster Management Agency (BNPB) in the regions. The absence of a Directing Element organ in BPBD will have no impact walking BPBD functions optimally and violates existing provisions. The existence of a Steering Element is very important, where the input provided is related to strategies, plans and evaluations at BPBD, where the Steering Element consists of employees from Government Agencies and those from Professional/Expert Societies. Empirical research is used due to the potential gap between Das Sollen and Sein , namely there is a gap between existing regulations and the existing situation. The type of field research referred to is obtaining data from research field directly which is the result become objective from research This that is Having a Steering Element in BPBD Asahan is an important and urgent matter. The result form found there are obstacles in implementation is one of them because mechanism the determination is assessed eat time so that needed seriousness as well as support budget from since start of the registration process until financing in implementation his job. The conclusion is that the existence of a Steering Element in the BPBD in Asahan is important and immediate actualization and existence This steering element must also be complemented by legal regulations at the level Regional District .

Abstract

Although the adoption of technologies such as blockchain, artificial intelligence, and mobile banking is progressing rapidly, significant challenges remain in ensuring that these innovations comply with Sharia principles while building customer trust. This study is driven by regulatory gaps in accommodating digital transactions, particularly electronic contracts, data protection, and cross-border services within the framework of Sharia compliance. This study examine the legal challenges and opportunities arising from digital transformation in Islamic banking, focusing on the extent to which existing laws, including Law No. 21/2008, DSN MUI fatwas, and OJK regulations, can support innovation. Using a normative juridical approach through literature review and legal analysis, this study hypothesizes that strengthening regulatory clarity and encouraging collaboration between regulators, financial institutions, and technology providers is crucial to maintaining Sharia-compliant digital finance. The findings show that although digital technology improves efficiency and inclusion, its effectiveness depends on the development of flexible regulations and customer trust in Sharia-compliant digital products. This provides practical recommendations for policymakers and Islamic financial institutions to balance innovation with Sharia compliance, thereby positioning Indonesia as a potential leader in global Islamic digital finance.
