Abstract

This study aims to determine how the application of the Imlā’ Manẓūr method improves the writing skills (maḥārah al-kitābah) of students in class X-A at MA DDI Ogoamas. Using a qualitative descriptive approach, data was collected through observation, interviews, and documentation and analyzed using data reduction, presentation, and verification techniques, accompanied by triangulation techniques for validity. The results indicate that the implementation of the Imlā’ Manẓūr method is effective in improving Arabic writing skills, as evidenced by improved understanding of the Arabic alphabet and the ability to connect letters. Educators also applied the al-ḥiwār technique through paired learning, supported by tools such as lesson plans, textbooks, laptops, and Android devices.

Abstract

Arbitration is a mechanism for resolving civil disputes outside traditional courts, governed by a written arbitration agreement between the disputing parties. Limited to commercial and specific disputes like banking, an arbitration tribunal, consisting of arbitrators, hears and decides these matters. In Indonesia, Law Number 30 of 1999 states that the appointment of two arbitrators grants them authority to select a third. Meanwhile, Russian laws, such as Federal Law No. 382-FZ and Law No. 5338-1, empower the Nomination Committee of Permanent Arbitration to appoint a third arbitrator from an approved list. This article employs a normative juridical method with a comparative law approach to scrutinize the selection and appointment of a third arbitrator according to Indonesian and Russian law. Qualitative analysis reveals that, under certain circumstances, all three arbitrators may be appointed by the Nomination Committee or even the general jurisdiction court, as outlined in the Russian International Commercial Arbitration Court's regulations. The article underscores the importance of providing legal certainty to disputing parties, empowering arbitrators, and avoiding conflicts that could impede dispute resolution. By shedding light on the appointment process, this research aims to contribute to the efficacy of arbitration as a judicious alternative for resolving disputes.

Abstract

Badan Arbitrase Nasional Indonesia so called BANI Arbitration Center (“BAC”) is an independent institution that provides services in settling disputes outside the state court. BANI is domiciled in Jakarta and there are BANI Region located in various big cities in Indonesia: Bandung, Surabaya, Medan, Denpasar, Palembang, Pontianak, and Jambi, acting autonomously and independently in upholding law and justice. The parties still have disagreements on where to take themselves if there is a dispute between them. Dispute settlement through BANI has become the choice of business actors to resolve their trade disputes. In addition to the characteristics of being fast, efficient, and thorough, arbitration adheres to the principle of a win-win solution and is straight forward because there are no appeals and cassation institutions. The arbitration fee is also more measurable because the process is faster. Another advantage of arbitration is that its decisions are immediately (final) and binding, apart from its confidential nature, in which the trial process and arbitration award are not published. The object of the study is the settlement of business dispute through BANI Region. The purpose of this writing is to analyze and describe (a) how does the implementation of parties authonomy in arbitration; (b) can the parties choose the forum of arbitration through BANI Region? (c) Has BANI Region have the authority or competency to examine and decide business disputes? (d) to what extent is the role of BANI Region in law enforcement in Indonesia? This paper uses a normative juridical approach with a qualitative analysis method on RI Law No. 30 Year 1999 concerning Arbitration and Alternative Dispute Resolution and the 2022 BANI Rules and Procedures. The conclusion are that the disputing parties (a) They implemented parties authonomy in arbitration; namely befor, during and after dispute arises till the implement of arbitral award; (b) They can choose forum for dispute settlement through BANI Region; (c) BANI Region have the authority to examine and decide trade disputes; (d) BANI Region have a strategic role in law enforcement in Indonesia.

Abstract

Seperempat abad lebih usia Undang-Undang tentang Arbitrase Indonesia, yaitu Undang-Undang Nomor 30 Tahun 1999 tentang “Arbitrase dan Alternatif Penyelesaian Sengketa”, namun undang-undang tersebut masih belum dipahami dengan baik bahwa terdapat amanah atau pesan penting dari uundang-undang tersebut sebagaimana disebutkan dalam Pasal 9 ayat (2) bagi Pejabat Umum Notaris. Notaris adalah pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang No.2 Tahun 2014 tentang Jabatan Notaris, antara lain dalam Pasal 15 ayat (2) huruf (e) untuk memberikan penyuluhan hukum sehubungan dengan pembuatan akta. Artikel ini akan membahas seputar amanah atau pesan UU tersebut. Artikel ini akan menggunakan pendekatan yuridis normatif dan deskriptif analitis serta studi kepustakaan (library research).

Abstract

Tidak dapat dipungkiri bahwa dalam kehidupan bermasyarakat sering terjadi permasalahan atau sengketa. Permasalahan dalam kehidupan masyarakat banyak terjadi pada berbagai lini di kehidupan masyarakat yaitu kegiatan ekonomi dan bisnis. Yang umumnya menjadi akar dari munculnya permasalahan atau sengketa adalah perbedaan terhadap pendapat, benturan dari kepentingan, hingga rasa takut dirugikan. Penyelesaian sengketa pada dunia bisnis umumnya dilaksanakan dengan menggunakan cara litigasi atau penyelesaian sengketa melalui pengadilan. Namun disamping penyelesaian sengketa melalui proses pengadilan, terdapat pula penyelesaian sengketa melalui non litigasi atau di luar pengadilan. Penyelesaian melalui non litigasi atau di luar pengadilan ialah penyelesaian sengketa yang dilakukan menggunakan cara-cara yang ada di luar pengadilan atau menggunakan lembaga alternatif penyelesaian sengketa. Pasal 1 Undang-Undang Nomor 30 Tahun 1999 Tentang Arbitrase dan Alternatif Penyelesaian Sengketa menyebutkan bahwa Arbitrase adalah cara untuk menyelesaikan suatu permasalahan perdata diluar peradilan umum yang didasarkan oleh perjanjian arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa.

Abstract

The implementation of IT-based learning media has recently had a positive impact on the learning process of students, particularly in Arabic language lessons, so that IT-based learning media can now be found in almost all educational institutions, including Islamic boarding schools. This study examines the implementation of IT-based audio-visual learning media in enhancing Mahārah al-Istimā’ among students at PMDG Campus 11 Ittihadul Ummah Poso. With theacher from the Language Advisory Council (LAC) as the primary data source and PMDG students at Campus 11 Ittihadul Ummah Poso as the secondary data source, this study employs a qualitative descriptive field research methodology. Data collection was conducted through documentation, interviews, and observations. The results of the study indicate that the implementation of IT-based audio-visual learning media in improving Mahārah al-Istimā’ among PMDG students at Campus 11 Ittihadul Ummah Poso. The implementation was carried out during weekly activities every Friday morning, consisting of three stages: the introductory stage, the core stage, and the evaluation stage. Regarding the impact of the implementation of audio-visual media, the students were able to understand vocabulary, comprehend sentences, understand a text, and provide responses to the text.
