Abstract

Hak atas kesehatan merupakan bagian dari hak asasi manusia yang wajib dipenuhi oleh negara tanpa terkecuali, termasuk bagi warga binaan pemasyarakatan. Penelitian ini bertujuan untuk menganalisis pemenuhan jaminan kesehatan dari BPJS bagi warga binaan Lembaga Pemasyarakatan Perempuan Kelas IIA Tenggarong dalam perspektif hak asasi manusia. Metode penelitian menggunakan pendekatan sosio-legal dengan teknik pengumpulan data melalui wawancara dan studi dokumen. Hasil penelitian menunjukkan bahwa pemenuhan jaminan kesehatan bagi warga binaan telah diupayakan melalui mekanisme preventif dan represif, namun masih terkendala identitas kependudukan, kurangnya pemahaman tentang BPJS, dan lemahnya koordinasi antar lembaga terkait. Kondisi ini menyebabkan sebagian warga binaan tetap tidak memiliki akses jaminan kesehatan meskipun telah ada regulasi yang mengaturnya, sehingga memperlihatkan kesenjangan antara norma hukum dan praktik di lapangan. Implikasi penelitian ini menegaskan pentingnya kebijakan yang lebih responsif dan sistem yang inklusif untuk menjamin kesetaraan hak kesehatan warga binaan

Abstract

This study explores the role of consumer trust in sustainability as a key factor influencing interest in purchasing environmentally friendly products. Despite increasing environmental awareness, many consumers remain hesitant to take action due to skepticism, perceived risk, and uncertainty about product authenticity. A systematic review of international literature (2020–2025) identifies five core trust dimensions: integrity, transparency, credibility, behavioral consistency, and long-term commitment. These dimensions shape consumers’ evaluations of green product claims and influence their willingness to engage in sustainable consumption. To explain the psychological mechanisms at work, the study integrates multiple theoretical perspectives: the Theory of Planned Behavior (TPB) emphasizes attitudes, subjective norms, and perceived control; Trust Theory explains how reliability and honesty reduce perceived risks; Signaling Theory clarifies how credible environmental communication influences consumer belief; and the Value-Belief-Norm (VBN) Theory connects personal values to pro-environmental actions. By synthesizing these frameworks, the analysis positions trust not merely as a mediating factor but as a foundational driver that enables the translation of positive environmental attitudes into actual green purchasing behavior. The findings underscore that businesses must move beyond superficial eco-friendly messaging to implement verifiable and consistent sustainability practices. This includes transparent reporting, third-party certification, and active stakeholder engagement. Policymakers also have a critical role in regulating misleading environmental claims and enforcing penalties for greenwashing, thereby protecting consumers and ensuring fair competition. Strengthening trust through these measures can help close the persistent gap between pro-environmental intentions and real-world purchasing actions. Overall, this study provides actionable insights for marketers, sustainability strategists, and regulators, highlighting that consumer trust is the cornerstone of sustainable market transformation. By cultivating trust, stakeholders can encourage environmentally responsible behavior at scale and contribute to long-term ecological well-being.

Abstract

This study aims to analyse the implementation of Total Quality Management (TQM) principles in enhancing student satisfaction at Madrasah Aliyah Negeri 2 Kudus. The main issues examined include: 1) how TQM is implemented at MAN 2 Kudus, 2) the factors that encourage and inhibit the implementation of TQM, and 3) the impact on student learning outcomes and the overall quality of education. This research employs a qualitative method with data collection techniques including observation, interviews, and documentation. The data obtained were analysed through the process of reduction, presentation, and conclusion drawing. The findings reveal that: 1) the implementation of TQM at MAN 2 Kudus involves all school elements--from leadership and teachers to students--with a focus on continuous improvement in educational services, learning processes, and resource management; 2) the main driving factors for successful TQM implementation are leadership commitment, active participation of all school members, and the emerging quality culture. However, challenges still exist, such as limited understanding of TQM principles among some teachers and staff, as well as inadequate supporting facilities. 3) The positive impact of TQM implementation is reflected in the increased student satisfaction with educational services, a more conducive learning atmosphere, and improvements in learning outcomes and graduate quality. The study recommends ongoing training on TQM for the entire academic personnel and strengthening of the internal quality assurance system. These findings are expected to serve as a reference for other educational institutions in optimizing TQM implementation to improve quality and student satisfaction.

Abstract

The rapid growth of Indonesia’s digital economy has created opportunities while simultaneously increasing the risk of monopolistic practices and unfair business competition. To address these issues, the Business Competition Supervisory Commission (KPPU) introduced behavioral remedies as an alternative dispute settlement mechanism. This study aims to analyze the effectiveness of behavioral remedies in cases of market control and abuse of dominant position. The research employs a doctrinal legal method. Effectiveness is assessed through two main indicators, namely the restoration of market conditions and the prevention of repeated violations. The findings show that this mechanism is generally effective in restoring competition and preventing recurrence, as demonstrated in several KPPU cases, including Case No. 04/KPPU-I/2024. However, its effectiveness remains conditional, as the mechanism is reactive, does not impose fines, and is monitored only for a relatively short period. Moreover, although KPPU Regulation No. 2 of 2023 regulates this mechanism, it does not provide sufficient legal explanation regarding the classification of articles that are permitted. Therefore, stronger monitoring and more detailed legal clarification are required to ensure the sustainable effectiveness of this mechanism in maintaining fair competition.

Abstract

Undang-undang Nomor 10 Tahun 1998 tentang Pemerintah Daerah mandates the establishment of a LPS (Deposit Insurance Agency) as the executor of the guarantee of public funds. one approach is needed separately to build a healthy banking system and strong is to give customers assurance that eksplisif for storage. LPS can function regulate safety and health of banks in general and conduct oversight by monitoring the balance, the practice of lending and investment strategies. In establishing a permanent guarantor institutions needed reform measures of the banking system as a prerequisite for effective system. Two basic reasons for the government to facilitate the establishment of LPS is the belief in the banking industry is very important for economic growth and the banking system is well controlled to minimize the occurrence of bank insolvency, and bankruptcy itself can be predicted and is an event that can be prevented. Also crucial is also a consideration equal protection of small customers from bankers who are not responsible is an approach that is fair and appropriate. In such conditions the bank can operate in a consistent and reliable to provide credit in the amount sufficient for the health of the economy.

Abstract

Latar Belakang: Putusan Pengadilan Agama yang final dan mengikat menyatakan bahwa hak asuh anak jatuh ke tangan isteri, akan tetapi putusannya tidak dilaksanakan dikarenakan mantan suami menahan kedua anaknya untuk bertemu ibunya. Sehingga, putusan tersebut dalam pelaksanaannya tidak memberikan kepastian hukum terhadap penerima putusan, secara putusan sudah terpenuhi hak asuhnya jatuh ke tanga ibu. Metode Penelitian: Jenis pendekatan yang digunakan yaitu penelitian doktrinal dengan pendekatan peraturan perundang-undangan untuk mengkaji kedudukan hak asuh anak berdasarkan regulasi di Indonesia serta apakah kepastian hukum terhadap hak asuh anak telah terpenuhi pada Putusan PA No. 1073/Pdt.G/2017/PA.Cbn. Hasil Penelitian: Dalam menentukan hak asuh anak, hakim pada awalnya mengevaluasi kerangka hukum yang berlaku untuk kasus tersebut, dengan bukti yang diberikan oleh kedua belah pihak. Akibatnya, kedua orang tua berkewajiban untuk mendukung dan mendidik anak-anak mereka sampai mereka mencapai usia dewasa, secara ekslusif demi kepentingan terbaik bagi anak. Berdasarkan Putusan PA No. 1073/Pdt.G/2017/PA.Cbn, ibu memiliki hak asuh yang sah, namun kepastian hukum masih belum terpenuhi karena Putusan Pengadilan belum dieksekusi oleh mantan suami, baik secara sukarela maupun melalui intervensi negara, khususnya terkait eksekusi hadhanah. Kesimpulan: Perlu dibentuk suatu peraturab yang secara tegas menjamin terlaksananya suatu Putusan Pengadilan dan apabila tidak dilaksanakan sebagaimana mestinya maka akan diberikan sanksi secara tegas maupun akibat hukum lainnya. Serta menerapkan teori kepastia hukum dari Jan M. Otto dan Sudikno Mertokusumo, yang secara garis besar bahwa kepastian hukum merupakan jaminan hukum tersebut harus dijalankan dengan baik dan dilaksanakan secara tegas demi menjamin terwujudnya kepastian hukum.

Abstract

Instagram saat ini tidak hanya menjadi media sosial, instagram juga telah menjadi tempat para pengiklan untuk memasarkan produknya kepada pengguna instagram. Namun, hadirnya tempat beriklan ini sering disalahgunakan oleh pihak-pihak yang tidak bertanggungjawab, salah satu bentuk penyalahgunaan ini dapat dilihat dengan hadirnya iklan judi online pada instagram. Hal ini juga diikuti dengan banyaknya wajah-wajah orang terkenal yang tanpa izin digunakan pada pemasaran iklan yang dimaksud. Pendekatan penelitian dilakukan dengan menggunakan pendekatan doktrinal yang mengandung karakter normatif yang bertujuan untuk mengkaji dua pokok pembahasan yaitu menganalisis pertanggungjawaban perantara (intermediary liability) instagram atas penggunaan foto tanpa izin pada iklan judi online dan upaya hukum yang dapat dilakukan pemilik foto atas penggunaan foto tanpa izin pada iklan judi online. Instagram selaku PSE memiliki tanggungjawab atas kegagalannya dalam melakukan penjaringan iklan pada platform Instagram sehingga mengakibatkan terjadinya pendistribusian dan pengumuman iklan illegal judi online yang menggunakan wajah seseorang tanpa izin. Pemilik foto secara perdata dapat meminta pertanggungjawaban dengan mengajukan gugatan perbuatan melawan hukum, dengan dasar hukum Pasal 27 ayat (2) Undang-Undang Republik Indonesia Nomor 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik yang menyatakan dan Pasal 12 Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta.
