Abstract

The development of digital technology has brought significant changes to various aspects of life, including payment systems and immigration. Payment gateway, as a critical innovation in the digital financial sector, enables fast and cross-border transactions. However, this progress also presents new challenges for the legal system, particularly in monitoring cross-border transactions that may be subject to misuse. This research focuses on the integration of payment gateways with the immigration system in Indonesia and the legal challenges that arise from this process. Using a qualitative approach, this study analyzes existing regulations in Indonesia, comparing them with other countries such as the United States, the European Union, and Singapore, and identifies areas that need improvement. The findings indicate that while Indonesia has a solid legal foundation, there is a need to strengthen regulations related to Anti-Money Laundering (AML), Know Your Customer (KYC), and data protection. The research also provides policy recommendations to enhance cross-agency collaboration between immigration authorities and fintech service providers to create a safer and more effective system for monitoring cross-border digital transactions.

Abstract

Crimes against humanity in the world are still happening today, this has caused anxiety for the people of that country, as a result they are looking for a safe place to live and seeking protection in certain countries. Indonesia has become one of the destination countries for refugees and asylum seekers, especially for ethnic Myanmar Rohingya refugees, before they get a safe place based on UNHCR recommendations, therefore this study aims to analyze how the Indonesian government's policy towards international refugee migration in Indonesian territory and the process efforts made by Indonesia to tackle the migration of Rohingya refugees to Indonesian territory, especially in the province of Aceh. This study used a qualitative research method with a literature study approach and a case approach and obtained information from informants who were able to provide information related to the case, with the results of the research that the handling of Rohingya refugees in Aceh Province experienced positive progress shown by the Indonesian government. The existence of the Aceh Customary Sea Law or Panglima Laot obliges all fishermen in Aceh to help anyone whose life is threatened at sea. In addition, the people of Aceh have consistently accepted refugees while others have rejected their arrival. That there is solidarity between Muslims, with 98% of the people of Aceh identifying themselves as Muslims. The author also considers that the people of Aceh care more about human rights than the country of origin of the asylum seekers or refugees.

Abstract

Penegakan hukum keimigrasian di Indonesia dikategorikan menjadi Tindakan Administrasi Keimigrasian (TAK) dan penyidikan keimigrasian. TAK adalah sanksi administratif yang ditetapkan Pejabat Imigrasi terhadap Orang Asing di luar proses peradilan dan kemudian diatur lebih lanjut di dalam Undang- Undang No 6 tahun 2011 Tentang Keimigrasian, sedangkan Penyidikan keimigrasian merupakan tindakan yang dilakukan terhadap orang asing yang melakukan tindak pidana atau pelanggaran di bidang keimigrasian. Penyidikan dilaksanakan oleh Kepolisian Republik Indonesia (POLRI) & Penyidik Pegawai Negeri Sipil (PPNS). Dalam Implementasinya, PPNS menghadapi berbagai hambatan yang diakibatkan oleh faktor internal maupun eksternal, termasuk kemungkinan tidak adanya PPNS di beberapa kantor imigrasi. Penelitian ini mengkaji bagaimana peraturan yang berlaku dapat menjawab permasalahan tersebut, terutama dalam situasi ketiadaan PPNS di suatu kantor Imigrasi. Penelitian ini menggunakan Teori Hierarki Hukum dari Hans Kelsen untuk menganalisis kesesuaian antara peraturan-peraturan di tingkat yang lebih rendah dengan norma hukum yang berada pada tingkat yang lebih tinggi.

Abstract

Kebijakan bebas visa 30 hari yang diberikan oleh Pemerintah Turki kepada Warga Negara Indonesia (WNI) telah dimanfaatkan oleh sejumlah individu untuk bekerja secara ilegal sebagai Pekerja Migran Indonesia (PMI) non-prosedural. Dalam konteks ini, Konsulat Jenderal Republik Indonesia (KJRI) di Istanbul memiliki peran strategis dalam memberikan perlindungan hukum, termasuk melalui mekanisme pemulangan dan penerbitan Surat Perjalanan Laksana Paspor (SPLP). Penelitian ini bertujuan menganalisis bentuk perlindungan hukum tersebut dan menyoroti potensi pelanggaran keimigrasian yang berulang oleh eks PMI non-prosedural. Pendekatan yang digunakan adalah normatif-empiris dengan metode studi dokumen dan wawancara. Hasil penelitian menunjukkan bahwa meskipun tindakan KJRI selaras dengan prinsip perlindungan hukum nasional dan internasional, ketiadaan sistem sanksi administratif dan tidak adanya integrasi data lintas lembaga membuka peluang bagi pengulangan pelanggaran. Integrasi sistem antara Kementerian Luar Negeri, Direktorat Jenderal Imigrasi, dan BP2MI menjadi langkah strategis yang diperlukan dalam memperkuat pengawasan dan perlindungan terhadap PMI di luar negeri. Kata Kunci: Keimigrasian, KJRI, Perlindungan Hukum, PMI Non-Prosedural.

Abstract

Penegakan hukum keimigrasian di Indonesia menghadapi dilema antara penerapan sanksi administratif atau pidana terhadap pelanggaran oleh orang asing. Pasal 119 UU No. 6 Tahun 2011 memberikan ancaman pidana berat bagi siapa pun yang masuk atau tinggal tanpa dokumen sah, padahal asas ultimum remedium menghendaki pidana sebagai upaya terakhir. Penelitian ini bertujuan merekonstruksi Pasal 119 agar selaras dengan asas ultimum remedium, dengan mengutamakan tindakan administratif sebelum penindakan pidana. Metode penelitian bersifat kualitatif-deskriptif dengan pendekatan normatif-empiris; data primer diperoleh melalui wawancara dan studi kasus, sedangkan data sekunder melalui studi pustaka. Hasil menunjukkan tumpang-tindih sanksi administratif dan pidana menyebabkan disparitas penegakan. Prinsip ultimum remedium perlu dioptimalkan untuk mencegah overkriminalisasi dan meningkatkan efisiensi. Rekomendasi: Pasal 119 direvisi dengan kriteria jelas penggunaan pidana serta penguatan diskresi pejabat (Permenimipas No. 2/2025), agar penegakan lebih adil, efektif, dan humanis. Abstract

Ideally, foreign nationals who have entered and settled in Indonesia are required to provide information regarding their identity and family, as well as report any changes in marital status, nationality, employment, sponsorship, and address to the immigration office. This reporting obligation can be fulfilled by the sponsor; however, if the sponsor fails to do so, the foreign national bears the responsibility of reporting it. The failure of many foreign nationals to report these changes has led to various violations in Indonesia. As a country that adheres to Pancasila as the foundation of national life, Indonesia strives to maintain a balance between legal certainty, justice, and the welfare of its citizens. To achieve these three aspects, legal norms are required to regulate people's behavior, ensuring order and societal stability for the prosperity of the nation. However, in its enforcement, there is a disparity in authority among various immigration officials in Indonesia. Therefore, this study analyzes legal aspects of sanction imposition and explores possible solutions to this issue to create harmonization of immigration law in Indonesia. This research also refers to comparative studies with several other countries to provide a broader perspective on immigration law enforcement worldwide. This study employs a qualitative research approach, as described by Creswell. To address the research problems and propose appropriate solutions, the author applies the Dignified Justice Theory, which aligns with Indonesia’s national philosophy Pancasila.

Abstract

Background. The integration of Artificial Intelligence (AI) in immigration law enforcement has significantly improved efficiency in areas such as fraud detection, border security, and visa application assessments. However, the implementation of AI raises critical concerns related to transparency, fairness, and ethical accountability. The "black box" nature of AI systems often obscures the reasoning behind decisions, posing risks to the rights of migrants, especially refugees and asylum seekers. Furthermore, the increased use of biometric data for security purposes heightens privacy concerns and potential misuse. Purpose. This study aims to analyze the role of AI in immigration law enforcement, focusing on its benefits, limitations, and ethical challenges. It seeks to provide recommendations for regulatory frameworks that ensure a balance between operational efficiency and the protection of human rights. Method. The research adopts a qualitative approach, combining a review of scholarly articles and case studies from journals such as Comparative Migration Studies and AI & Society. Key themes include transparency, fairness, privacy, and accountability. Results. AI significantly enhances operational efficiency but remains vulnerable to biases and errors that can disproportionately affect vulnerable populations. Human oversight is critical to ensuring ethical decision-making and maintaining accountability. Conclusion. The integration of AI in immigration law must be guided by transparent, fair, and ethical regulatory frameworks. Emphasizing human oversight ensures that moral responsibility remains with human actors rather than AI systems.
