Abstract

In Kota Bagansiapiapi, it is common to find the Chinese community performing marriages based on their beliefs without registering them with the Civil Registry office. Divorce due to the death of the husband/father in such cases results in the marriage and child remaining unregistered. The unregistered child faces difficulties in inheriting paternal rights due to the lack of legal ties. This study aims to explore the mechanism of acknowledging children born from unregistered marriages within the Chinese community, the legal position of inheritance rights for children born from unregistered marriages, and the legal protection of a child's inheritance rights. The empirical research was conducted at the Vihara, the Civil Registration and Population Office, and Notaries in Kota Bagansiapiapi. The findings reveal the mechanism for acknowledging children and the implications of unregistered marriages on a child's inheritance rights. Legal protection for a child's inheritance rights remains fragmented and lacks harmonization with administrative regulations on population and marriage.

Abstract

The Toba Batak ethnic group living in the Samosir area is essentially a collection of traditional communities and generally are farmers who work on agricultural land and conceptualize land as not only an economic resource but also as a clan identity. The important role of land in human life, is that land is an object that is prone to disputes or disputes between humans. This type of research is empirical juridical research where the approach to the problem is carried out by examining the provisions of customary law in the Toba Samosir Regency. This research is normative and descriptive analysis, where this research attempts to describe, explain, and analyze the problems that arise, and then look for the correct answers as solutions to these problems. The results of the discussion of the problems that arise in this research are that legal efforts to resolve disputes over customary land tenure in Toba Samosir Regency can be carried out through non-litigation channels with consensus deliberation through traditional leaders and if a resolution cannot be obtained, then it will be taken through litigation. Legal efforts to resolve customary land tenure disputes in Toba Samosir Regency through litigation have provided legal certainty and legal protection.

Abstract

This article analyzes the regulation of online game access in Indonesia, the validity of purchasing game vouchers by minors, both conventionally and electronically, and the urgency of legal protection in the acquisition of such vouchers by underage individuals. The research method employed is juridical normative, utilizing secondary data, focused on written regulations, legal principles, legal systematics, legal comparisons, and legal history. The findings reveal that Minister of Communication and Information Regulation No. 11 of 2016 governs online game access through the Indonesian Game Rating System (IGRS), categorizing users into four age groups. Purchasing game vouchers by minors is legally permissible but becomes invalid when breaching age or moral requirements and relevant laws. Legal protection necessitates regulations concerning age limits and transactional competency, especially within retail establishments offering game vouchers, to prevent adverse implications of online game usage among children.

Abstract

Forest areas are certain areas designated by the government to be maintained as permanent forests. If an area can be said to be a forest area, it must go through four stages, namely designation of the forest area, arrangement of forest area boundaries, mapping of the forest area, and determination of the forest area. Regarding forest areas, it is regulated in Law No. 41 of 1999 concerning Forestry, Law No. 11 of 2020 concerning Forestry Cluster Job Creation, and Ministerial Decree No. 579/Menhut-II/2014, dated June 24, 2014, concerning Forest Areas of North Sumatra Province. This research was carried out through a descriptive type of normative research. Source of library research data, primary data. then analyzed using qualitative analysis. The research results show that the regulations regarding forest areas in North Sumatra province issued by the Ministry of Environment and Forestry have a lot of land that overlaps with land that has land rights such as cultivation rights. As happened in Tanjung Balai District Court Decision No. 04/Pdt.G/2020/Pn.Tjb, in its considerations, the panel of judges took into account the history of the issuance of the cultivation rights because the cultivation rights

Abstract

This research aims to determine and analyze the legal protection of the personal property of underage influencers The type of research used is normative legal research, specifically by examining or dissecting optional information as legal material, especially important legal material, and additional legal material, by understanding regulation as a set of guidelines or positive standards in a common set of laws. The exploratory idea used in this exam is analytical descriptive research on the legal relationship of underage influencers with their service providers. Underage influencers have a different legal status compared to adult influencers. Legal protection of the personal property of underage influencers. The law provides special protections for minors, including protection of their personal property as influencers. This protection includes a guardian to protect property.

Abstract

Pemerintah memberikan fasilitas terkait dengan pemanfaatan sisa lebih pajak penghasilan yayasan dari laba kegiatan usaha yang dijalankannya. Penelitian ini bertujuan untuk mengetahui Bagaimanakah penerapan pengenaan pajak penghasilan Pada Yayasan Islamic Centre Sumatera Utara yang bergerak di bidang pendidikan, faktor-faktor apakah yang menghambat penerapan pengenaan pajak penghasilan Pada Yayasan Islamic Centre Sumatera Utara yang bergerak di bidang pendidikan, dan bagaimanakah pelaksanaan pengelolaan sisa lebih yang diterima oleh yayasan berdasarkan Peraturan Menteri Keuangan Nomor 68 Tahun 2020 sebagai fasilitas perpajakan Oleh Yayasan Islamic Centre Sumatera Utara yang bergerak di bidang pendidikan. Metode penelitian yang digunakan dalam penelitian ini adalah jenis penelitian hukum normatif, yang didukung dengan sumber data primer dan data sekunder, serta dilakukan analisis secara kualitatif. Hasil penelitian dan pembahasan yaitu, melalui kegiatan usaha yang dijalankannya, yayasan dapat memperoleh laba, yang merupakan objek PPh. Kendala terkait dengan pembayaran Uang SPP dari para siswa dan santri sering kali mengalami kendala waktu pembayaran yang disetorkan kepada pihak yayasan yang menyebabkan hambatan pada proses pembukuan terkait penghasilan yang akan disetorkan. Yayasan Islamic Centre Sumatera Utara telah melakukan pembangunan atas sarana dan prasarana berupa, pembangunan 2 gedung ruang kelas, juga dipergunakan untuk perenovasian terhadap kamar mandi hingga perbaikan pagar yayasan, atas sisa lebih juga dipergunakan untuk pemasangan penyejuk udara, pada seluruh ruangan kelas, serta penambahan unit televisi sirkuit tertutup hingga kini total yang terpasang berjumlah 100 unit.

Abstract

One of the main problems experienced by information technology-based co-funding services is the high amount of loan interest from the organizer. This resulted in a pile of interest that never finished and eventually became a default and was determined to be in default. The beneficiary fails to pay the funds along with interest. This is considered burdensome and it is necessary to find alternative funding services that do not charge high interest to users. This article aims to solve the problem of minimizing default through Islamic financial technology to provide access for business actors. The concept of financing through syariah fintech companies is a solution and answer for business actors, especially MSMEs, regarding the complexity of capital and without determining interest from the lender. All will be determined through an agreement that has been agreed between the funder and the recipient of funds. The agreed agreement is also not the same from one another, which is based on the allocation of funds from the loan applicant. The difference between Islamic and conventional fintech in reducing risk can be clearly seen. That is, if in conventional fintech is to raise interest as a form of prudence. So that the absence of interest will be the main attraction for syariah fintech. The method used in this paper is literature research. The result is the minimization of defaults by fund recipients through Islamic financial technology to provide financial access for business actors.

Abstract

Activities on social media have become a habit that isdifficult for users to leave behind, making theseactivities take place continuously in order to continueto exist on social media. But not all of these activitiesare beneficial, they can also be disastrous for users andeven other people. The urgency of this study is to focuson the limits of the use of social media in health careactivities, which will see and know the rules governingthe limits of the use of social media during health careactivities. Reviewing whether the activity of recordinghealth service activities is justified by law so that itwill not interfere with health service activities. Thisstudy uses normative law which is descriptiveanalytical, using a comparative law and case approach.The data source uses secondary data sources, consistingof primary legal materials, secondary legal materials,and tertiary legal materials. Data collection usesliterature collection techniques with data collectiontools in the form of document studies and legislation,with data analysis using qualitative research. Thisstudy concludes that in Indonesia, activities on socialmedia have not yet been regulated, making it difficultfor justice seekers to gain access if there is abuse ofactivities on social media, especially when providinghealth services

Abstract

This article or writing aims to analyze the legal protection of personal data for banking customer services and analyze the resolution of the problem of leakage and protection of customer data after the enactment of financial services authority regulation (POJK) Number 6/Pojk.O7/2022. The problem focuses on the Financial Services Authority (OJK) regulations and the Personal Data Protection Law (UU PDP). Data was collected using a normative approach, using primary (laws, regulations), secondary (legal literature), and tertiary (legal encyclopedia) legal materials, and analyzed qualitatively. The research results show that the protection of banking customers' personal data in Indonesia has increased with the existence of POJK Number 6/POJK.07/2022 and Law Number 27 of 2022, which emphasize transparency, transparency and data security. Banking institutions must comply with the provisions and sanctions if they violate them, with the OJK playing an important role in supervision. In addition, resolving data leaks involves assessing losses and can be done through mediation, arbitration or litigation. Compliance with regulations and principles of legal justice is expected to minimize negative impacts and maintain public trust.

Abstract

This article on legal studies aims to analyze the concept of bad faith and the passing off doctrine in the context of infringement of well-known brands, with a focus on the Supreme Court decision Number 345 K/Pdt.Sus-Hki/2021. This research uses a normative juridical approach through literature study and analysis of court decisions. This decision is interesting because it explains in depth how the court assesses the element of bad faith and the application of the passing-off doctrine in trademark disputes. The results of the study show that the Supreme Court applies international and national principles regarding the protection of well-known brands, and considers evidence of intent to imitate or mislead consumers. This research provides insight into the development of jurisprudence in Indonesia regarding legal protection of well-known brands and offers recommendations for legal practitioners in handling similar cases in the future.
