Abstract

Even though many legal instruments have been created to ensure that the rights of women and children are fulfilled, in the field there is still a lot of neglect of the rights of women and children. The Religious Courts through the formulation of the Supreme Court of Religion chamber of the Republic of Indonesia have created many guidelines for Judges in examining cases and ensuring that the rights of wives and children are fulfilled.based on SEMA No. 1 of 2017, SEMA No. 3 of 2018, SEMA No. 2 of 2019, as well as SEMA No. 5 of 2021 which extends further to the husband's belongings which can be submitted for marital confiscation to ensure that the wife and children are provided for. The type of research that the author uses is norative empirical through library research and experience in trials, with a research approach used as a judicial case study. The conclusion of this article is that the fulfillment of women's rights during a divorce has been carried out in the court process, there is a need for socialization and legal assistance to women so that the fulfillment of their rights after a divorce can be carried out well.

Abstract

Law enforcement of child support obligations of fathers as Civil Servants (PNS) after divorce often encounters obstacles, such as non-compliance in implementing Religious Court rulings. This study focuses on the Bengkulu High Religious Court (Pengadilan Tinggi Agama, PTA), which has implemented an execution system to ensure the financial rights of women and children after divorce.The primary objective of this research is to analyze the factors contributing to non-compliance among fathers with civil servant status, assess the implementation process of court decisions, evaluate the execution model employed by the PTA of Bengkulu, and explore avenues for its improvement. The study is grounded in the theories of the supremacy of law, law enforcement, and legal execution, employing a normative-empirical approach with descriptive methods. Data collection techniques included observation, interviews, and document analysis. The findings reveal that several factors, including economic constraints and limited legal awareness, contribute to the non-compliance of civil servant fathers in fulfilling child support obligations. The execution process is largely similar to the procedures for enforcing monetary payments. The PTA of Bengkulu has innovatively introduced the E-Mosi Caper application to monitor compliance and track the implementation of child support orders. To enhance the effectiveness of this execution model, the study proposes regulatory harmonization, the establishment of a dedicated implementation team, and heightened public awareness campaigns. These measures aim to support the development of a more robust and efficient system for ensuring compliance with child support obligations, ultimately advancing the protection of women’s and children’s financial rights after divorce. Penegakan hukum terhadap kewajiban nafkah anak oleh ayah berstatus Pegawai Negeri Sipil (PNS) pasca perceraian sering kali menghadapi kendala, seperti ketidakpatuhan dalam melaksanakan putusan Pengadilan Agama. Penelitian ini berfokus pada Pengadilan Tinggi Agama (PTA) Bengkulu, yang telah menerapkan sistem eksekusi untuk menjamin hak-hak finansial perempuan dan anak setelah perceraian. Tujuan utama dari penelitian ini adalah menganalisis faktor-faktor yang menyebabkan ketidakpatuhan ayah berstatus PNS, menilai proses pelaksanaan putusan pengadilan, mengevaluasi model eksekusi yang diterapkan oleh PTA Bengkulu, serta mengeksplorasi cara-cara untuk meningkatkan efektivitas sistem tersebut. Penelitian ini didasarkan pada teori supremasi hukum, penegakan hukum, dan eksekusi hukum, dengan pendekatan normatif-empiris menggunakan metode deskriptif. Teknik pengumpulan data meliputi observasi, wawancara, dan analisis dokumen. Hasil penelitian menunjukkan bahwa beberapa faktor, seperti keterbatasan ekonomi dan rendahnya kesadaran hukum, berkontribusi pada ketidakpatuhan ayah PNS dalam memenuhi kewajiban nafkah anak. Proses eksekusi menyerupai pelaksanaan pembayaran uang. PTA Bengkulu memanfaatkan aplikasi E-Mosi Caper untuk memantau kepatuhan dan melacak pelaksanaan perintah nafkah anak. Untuk meningkatkan efektivitas model eksekusi ini, penelitian ini mengusulkan harmonisasi regulasi, pembentukan tim pelaksana khusus, dan kampanye peningkatan kesadaran publik. Langkah-langkah ini bertujuan untuk mendukung pengembangan sistem yang lebih kuat dan efisien dalam menjamin kepatuhan terhadap kewajiban nafkah anak, sehingga pada akhirnya memperkuat perlindungan hak-hak finansial perempuan dan anak setelah perceraian.

Abstract

The purpose of this study is to find out reform of the law on the division of joint property divorce. 50-fifty provisions regarding the sharing of joint assets are often applied rigidly in accordance with the provisions of Article 97 of the KHI. The resulting output does not provide a sense of justice to the parties. This research is normative law with a substantive analysis approach to the provisions of Article 97 of the KHI. The results showed that the sharing of joint assets was regulating (regelen) not coercive (dwingon). In certain cases, this provision can be deviated by contextualizing it through the maqashid sharia approach to the substance of the case. The amount of the contribution of either party to the acquisition of joint assets and commitment to the sacred promise of marriage is a modifying element ('illat) in the case of sharing of joint assets. Maqashid shari'ah as an instrument in law making (istinbath) plays a very large role in this case, especially if the case presented is closely related to distributive justice where the elements of benefit and the purpose of the law are the main benchmark in seeking justice. Contextual reasoning and a substantive approach to the purpose of article 97 KHI by prioritizing psychological and contributive aspects to the case of division of joint property will make the article flexible. In the event that the role of one party is greater in the acquisition of joint property and there is an attitude of inconsistency of one party towards marital commitment, it becomes a ratio legis of reduced share of joint property of the former husband and wife.

Abstract

This study aims to analyze the mechanism for disbanding community organizations based on Law Number 16 of 2017. The dissolution regulated in the mass organization law also contradicts the theory of the rule of law and justice in the civil service. The implementation of just law is fundamental to creating a peaceful cycle of society and maintaining the rights of freedom of the community, especially in association and assembly. This study uses a normative legal method. The results of this study indicate that the government should continue to pay attention to the rights of the community in freedom of assembly and association and continue to implement due process of law as a representation of efforts to create a just government to present a more peaceful democratic climate in addition to the state's anticipation of organizations that conflict with Pancasila and the 1945 Constitution.

Abstract

Public financial policy broadly regulates the income, management, and expenditures of state finances while considering the welfare of society. One source of funding in Sharia is zakat. In its implementation, the state plays a role in optimally managing zakat funds, in Indonesia, the provisions concerning zakat are regulated under Law No. 23 of 2011 on the Management of Zakat, where BAZNAS becomes a semi-autonomous body directly responsible to the president. The presence of BAZNAS serves as both a regulator and an operator that collects zakat funds, which has led to various viewpoints in Indonesia. Ultimately, the Zakat Management Institutions (LAZ) that are part of the Zakat Forum (FOZ) conducted a judicial review at the Constitutional Court to obtain legal certainty.

Abstract

Mahkamah Konstitusi memiliki peran sebagai Negative legislature yang artinya memiliki kewenangan sebagai pembatal Undang-Undang bila dalam pengujianya terbukti melanggar Konstitusi, namun dewasa ini banyak ditemui putusan Mahkamah Konstitusi yang memuat norma baru atau berperan sebagai Positive Legislature. Penelitian ini bertujuan untuk mengkaji dan mengkritisi peran Positive Legislature oleh Mahkamah Konstitusi yang notabenenya sebagai Lembaga Yudikatif. Jenis penelitian ini adalah yuridis normatif yaitu penelitian dengan mengkaji sumber-sumber kepustakaan baik sumber data primer,sekunder dan juga tersier. Dalam penelitian ini ditemui bahwa peran Positive Legislature oleh Mahkamah Konstitusi yang merupakan Lembaga yudikatif tidak sesuai dengan prinsip negara hukum yang menganut system pemisahaan kekuasaan juga tidak sesuai dengan doktrin Judicial restraint yang membatasi pengadilan untuk tidak membuat norma baru dalam putusanya. Disamping itu juga hingga saat ini tidak adanya pengaturan yang secara implisif mengatur syarat dan Batasan perumusan norma baru oleh Mahkamah Konstitusi, pada akhirnya penelitian ini mendorong agar segera dibuatnya pengaturan mengenai syarat dan Batasan Mahkamah Konstitusi dalam merumuskan Norma Baru.

Abstract

The obligatory will regulated in Article 209 of the Compilation of Islamic Law is only for adoptive parents and adopted children, there is no obligatory will for heirs of different religions. On the other hand, there is a need for legal provisions that present a solution to provide part of the inheritance to heirs who do not receive inheritance due to religious differences. The purpose of this research is to analyze the important obligatory will in terms of its necessity, as well as a study of the obligatory will in terms of the procedure or implementation of the obligatory will itself in resolving disputes in court with legal considerations that are certain, fair and beneficial. The research method uses a qualitative method with a normative juridical approach. Primary data was obtained from regulations, laws, verdict numbers: 368 K/AG/1995, 51 K/AG/1999, 16 K/AG/2010, 721 K/AG/2015, 218 K/AG/2016 and 331 K/AG/2018. Supreme Court Decision No. 331 K/AG/2018 as well as the Compilation of Islamic Law (KHI) article 209 and regulations governing mandatory wills, secondary, tertiary data obtained from library studies, books, documents, journals and so on that have the same relevance to this research. The analysis process uses a legal logic approach, which analyzes the norms and laws or regulations that apply in depth, radically, systematically, and logically. The results of this study concluded that the dynamics of religious court decisions regarding compulsory bequests for heirs of different religions vary greatly, some are granted and some are rejected, the consideration depends on the sitting of the case that is disputed in the religious court, while the granting of compulsory bequests for heirs of different religions refers to the opinion who allows it as long as it is a will and the different religion in question is not kafir dzimmi. The effect of this decision becomes jurisprudence as part of the source of law for judges at levels below the Supreme Court. The contribution of the religious court's decision on this matter is that it can become a permanent jurisprudence so that it is proposed as a new article in KHI to fill in the missing article regarding mandatory wills for heirs of different religions.

Abstract

This research aims to explore the influence of community participation on the creation of local legal products in Indonesia, focusing on regions with special autonomy status like Banda Aceh, Aceh Besar Regency, Yogyakarta City, and Surakarta City, and comparing them with regions with ordinary autonomy status like Bandung Regency and Bandung City. Using a combined normative and empirical legal research approach, including public consultations and field surveys, the study delves into the origin of regional legal products, highlighting community participation, people's sovereignty, the rule of law, and public policy. It examines various factors affecting community involvement, such as social, political, cultural, and educational factors. The research findings underscore the importance of community participation in shaping the quality and compliance of local legal products. However, conventional patterns in facilitating community involvement often result in suboptimal participation, except for unique cases like Aceh, which demonstrates innovative approaches and impactful outcomes. The study concludes that enhancing community participation is crucial for improving the quality and effectiveness of local legal products, ensuring better compliance and implementation at the grassroots level.

Abstract

The reform of Islamic family law is not only related to legal matters but also to the social and cultural values surrounding it. In Indonesia, the development of Islamic family law has relied on the government and the legislature, as reflected in the enactment of the Marriage Law and the Compilation of Islamic Law. However, the lengthy legislative process, which is often laden with political interests, makes it difficult to accelerate legal reform. This study aims to analyze the role of the Supreme Court, particularly the Religious Chamber, as an institution with the potential to expedite the reform of Islamic family law through its judicial authority. applying a qualitative method and descriptive analysis, this research finds that the Supreme Court contributes significantly to Islamic family law reform through progressive decisions and the Plenary Meetings of the Religious Chamber producing  legal formulations. The main findings show that the reform agenda promoted by the Supreme Court focuses on strengthening the protection of women’s and children’s rights. The study also identifies two major challenges in implementation: variations in judges’ adherence to the plenary formulations and limited public access to information regarding the plenary outcomes. These findings underscore the importance of optimizing the role of the Supreme Court as a strategic driver in accelerating the reform of Islamic family law in Indonesia.
