Abstract

Education has a vital role in shaping the character and quality of human resources, with student discipline as one of the key elements in creating a conducive learning environment. This study aims to analyze the law related to the granting of disciplinary sanctions by teachers to students in schools, focusing on the legal challenges faced by teachers in enforcing discipline. Through a normative juridical approach, this study examines the Supreme Court Decision Number 1554 K/Pid/2013 which affirms that teachers cannot be punished when carrying out their professional duties, including in the provision of disciplinary sanctions. In addition, regulations such as Articles 39 and 40 of Government Regulation No. 19 of 2017 provide a legal basis for teachers to enforce discipline without fear of legal consequences. As such, the study highlights the importance of legal protection and the development of clear policies to support effective and safe education efforts.

Abstract

The Job Loss Insurance Program is a social protection program aimed at workers who lose their jobs due to termination of employment (PHK). The benefits of this program include cash assistance, job training, and job market information, and are regulated by Law No. 6 of 2023 and Government Regulation No. 37 of 2021, which was amended to Government Regulation No. 6 of 2025. This study aims to analyze the existence of the right to Job Loss Insurance for workers who experience termination of employment due to violations of collective labor agreements, which, in practice, lack clear legal certainty. The method used in this study is a normative legal approach based on legislation and conceptual analysis. The findings reveal disparities in legal protection and normative uncertainty, which may impact workers' access to unemployment insurance benefits. Therefore, harmonization of policies and regulations is necessary to provide legal certainty and inclusive, fair protection for all workers

Abstract

Penyalahgunaan data pribadi merupakan salah satu tantangan utama di era digital. Meskipun berbagai regulasi telah diterbitkan, rendahnya tingkat literasi masyarakat terkait perlindungan data menyebabkan celah keamanan yang mudah dimanfaatkan pihak tidak bertanggung jawab. Artikel ini bertujuan untuk menganalisis urgensi edukasi publik dalam meningkatkan kesadaran dan pemahaman masyarakat terhadap perlindungan data pribadi. Metode yang digunakan adalah studi pustaka yang merujuk pada regulasi, literatur akademik, dan laporan kasus penyalahgunaan data. Hasil kajian menunjukkan bahwa edukasi publik yang berkelanjutan dan terstruktur sangat dibutuhkan guna membentuk perilaku masyarakat yang bijak dalam membagikan data pribadi di ruang digital.

Abstract

Abstract

The intensity of criminal acts committed across countries, with crimes and modus operandi that are difficult to identify. This raises problems that require juridical countermeasures by engaging in intense cooperation between countries. The study has the goal of (1) to find out and explain the legal basis behind the reciprocated legal aid in criminal problems between Indonesia - Swiss, and (2) to study about a form of mutual legal assistance between Republic of Indonesia with Confederacy of Swiss. The method of research used was normative juridical research, known in law science as normative law research. The legal material in this study is primary material and secondary material. The analysis technique used is a descriptive method of describing an event that was thoroughly studied and providing legal arguments on the subject. Under law about International treaties, it is a regulation that provides a legal basis for Indonesian governments in requesting or providing mutual legal assistance in criminal matters (under article 2 of act about mutual legal assistance) the agreement between Indonesia with Swiss is explained in article 2 of treaty on mutual legal assistance in criminal matters between the republic of Indonesia and the Swiss Confederation.

Abstract

Legal protection of wages for workers with certain employment contracts is a crucial topic in the field of employment in Indonesia. Law = Law Number 13 of 2003 concerning Manpower, Law Number 6 of 2023 concerning Job Creation and Government Regulation Number 51 of 2023 concerning Wages serve as a legal basis for regulating workers' salaries with certain employment contracts. Despite the regulations that have been set, there are still challenges in their implementation, especially in terms of providing adequate salaries. This study applies a normative juridical method with a prescriptive approach to analyze legal protection in the payment system for workers with certain employment contracts. The findings of the study indicate that weak supervision and low awareness from employers cause many workers to receive salaries that do not meet standards. Effective legal protection is needed to ensure fairness in employment relations and ensure welfare for workers. It is hoped that increased supervision and enforcement of sanctions for those who violate the provisions can improve this situation, increase productivity, and create a harmonious working atmosphere.

Abstract

Peningkatan kesadaran hukum pada masyarakat terhadap hak dan kewajiban dalam penanganan penyakit tuberkulosis (TB) merupakan isu penting dalam konteks kesehatan masyarakat. Tuberkulosis, sebagai salah satu penyakit menular yang mempengaruhi kesehatan global, memerlukan perhatian khusus dalam hal kepatuhan terhadap pengobatan dan pencegahan. Dalam penelitian ini, tujuan utama adalah untuk menganalisis faktor-faktor yang mempengaruhi kesadaran hukum masyarakat mengenai hak dan kewajiban mereka dalam konteks penanganan TB. Penelitian ini menggunakan pendekatan kualitatif dan kuantitatif untuk menggali pemahaman masyarakat tentang hukum terkait kesehatan, serta peran mereka dalam pencegahan dan pengobatan TB. Hasil menunjukkan bahwa kesadaran hukum yang rendah berkontribusi pada ketidakpatuhan terhadap pengobatan, yang berdampak pada peningkatan angka penularan TB. Oleh karena itu, diperlukan strategi edukasi yang efektif untuk meningkatkan pemahaman masyarakat tentang hak mereka sebagai pasien dan kewajiban mereka dalam menjaga kesehatan komunitas. Melalui sosialisasi, pendidikan, dan keteladanan dari pemimpin masyarakat, diharapkan kesadaran hukum dapat ditingkatkan. Dengan demikian, masyarakat tidak hanya memahami pentingnya kepatuhan terhadap hukum tetapi juga merasakan manfaat langsung dari penerapan hukum tersebut dalam kehidupan sehari-hari. Penelitian ini diharapkan dapat memberikan kontribusi signifikan dalam upaya penanggulangan TB di Indonesia melalui peningkatan kesadaran hukum masyarakat.

Abstract

The foundation is a legal entity that is private and run without profit (profit oriented). There are three organs that run a Foundation, namely Builders, Managers and Supervisors. The organ that is responsible for running the Foundation so that the purpose and purpose of the foundation of the Foundation which is social, religious, and humanitarian can be realized. Establishment of Law Foundation Number 16 of 2001 on the Foundation. The regulation contains the norm vacancy (rechtsvacuum) in the regulation of Foundation Builders. The problematic form of authority possessed by the Founders of the Foundation, seems to be infinite (absolute) and there is no arrangement for the termination of the Builder. The purpose of this writing is to analyze the form of vacancy norms of Law No. 16 of 2001 on the Foundation regarding the authority held by the Founders of the Foundation. Based on the description, then the problem is what are the consequences of juridis rechtsvacuum on Law Number 16 of 2001 on the Foundation on the form of responsibility of the Builder ?. This writing uses the writing method used is the normative juridical writing that is all the activities of a person to answer legal issues that are academic and practical, using a legal approach (Statute Approach), and a conceptual approach (Conceptual Approach) with prescriptive writing that gives a description or formulate problems in accordance with existing circumstances / facts. The author uses this method to provide an argument for the results of the writing done by the author. The results of the writing on the legal consequences of the form of problem solving on the form of arbitrariness of the Founders of the Foundation due to the vacancy of rules (rechtsvacuum) on Law No. 16 of 2001 on the Foundation.

Abstract

Subsidized housing programs are designed to ensure access to adequate housing for low-income communities. However, delays in the delivery of houses by developers frequently occur despite buyers having fulfilled their contractual obligations. Such disputes are not merely cases of breach of contract but also involve the principle of good faith in contract performance. This study analyzes the meaning and function of good faith in disputes concerning delayed delivery of subsidized housing and examines the implications of normative ambiguity on consumer legal protection. Using a normative juridical method with statutory, conceptual, and case approaches, the study finds that the absence of operational standards of good faith in the Civil Code and housing regulations leads to legal uncertainty and inconsistent judicial reasoning. Delays by developers are not consistently considered violations of good faith, thereby weakening consumer protection. The study concludes that explicit normative indicators of developers’ good faith and regulatory harmonization are essential to ensure legal certainty and substantive justice.
